traffic. i looked outside the door. it's kind of gray outside our doors steve, thousand we look? >> -- how do we look? >> we look great. yesterday temperatures warmed up. mid-80s for some inland areas. 70s around the bay. the breeze is picking up. coast fog is not going anywhere. inland temps will be sunny but cooler. water temps are upper 40s, low 50s. it doesn't take much to get this cooler pattern in place. a low dropped down for the pacific northwest. 5 to 15 degrees cooler today after yesterday's readings. it looks like it's really beginning to thicken up there. very very cool for some. 40s not only in the north bay but parts of the peninsula or very low 50s. you combine that with gusts of 31 at travel. they're done. i'm telling you, i know this pattern. i've seen it before. when you get 31 that tells us the breeze is going out to sacramento.

we have the low clouds. that means it's a cooler pattern. with that in mind, look for coast fog, 50s, 60s by the coast. 60s mainly around the bay. 70s or low 80s inland. >> we're looking at a commute that has some problems now. i want to mention the traffic on the east shore freeway has been very steady, and the drive time has stated about 20 minutes. that's not much more than it normally is. just a few minutes more and i think everyone will say i'll take it, no problems there. when you get to the bay bridge there's slow traffic to be had at the bay bridge toll plaza. a 25 minute drive time into san francisco. i do want to mention southbound 880 and fremont at stevenson, there is a crash, and it's backing traffic up into union city. normally on this friday, on these fridays we don't have a lot of slow traffic in the area. we just got report of a new accident in the south bay. i'm going to just kind of manually go there. it's reported southbound 680 at

mckey. just kind of zooming in here. traffic doesn't seem like there's slow traffic in this area. the crash is reported southbound 680 around here when i put the icon. we're going to look for that and see if that's going to affect traffic anytime soon. 7:03. let's go back to the desk. thank you, sal. new this morning, a kidnapping investigation in oakland. police tell us a woman was abducted at gunpoint and then held at a home overnight. ktvu's alex savidge is live at the house where officers have been standing by waiting for a search warrant. good morning alex. >> reporter: good morning to you. oakland police right now are trying to figure out why this woman was abducted at gunpoint not far away from where we are this morning and then held for some time inside this home that's across the street from us here. we're on 75th avenue just off bancroft. you can see oakland police officers are out here right now. this is where that kidnapping victim was found safe early this morning. the home is blocked off with crime scene tape, and that's because police are waiting for

a search warrant to be able to gather evidence inside. >> all right and that was the scene early this morning as police surrounded this home and ordered everyone outside. officers took at least three people into custody to question them about this kidnapping. the victim was rescued. the sergeant told me that woman in her 50s is doing fine. police say everything started around 10:00 last night when this woman was kidnapped at gunpoint from a car she was riding in. that happened about a mile away on 67th avenue. the woman driving that car called 9-1-1 and reported what happened. officers then checked several different houses before they wound up at this place on 75th 75th avenue. at this point, police can't say why this woman was taken. that's what investigators are now trying to figure out. again, they're waiting for a search warrant to go inside this home and gather evidence. we're live this morning in oakland, alex savidge ktvu

channel 2 news. thank you alex. 7:05, happening today in just 30 minutes, some parents at oakland's high school are planning a rally on this last day of classes. this follows a meeting earlier this week on the morality clause controversy at bishop o'doud and other catholic schools in the diocese of oakland. oakland's bishop met with teachers and students and promise today clarify the language in the new contract. at least three teacher haves refused to sign the contract which asks them to conform to the teachings of the catholic church on the job and in their private lives. we'll have live coverage in the second hour of mornings on 2. time is 7:06. new reports at about 400 pleasanton high school students will have to retake the advanced placement tests for college. the california college board found problems with the way students at omidor valley high school were seated.

apparently they were not seated the required 5 feet apart. students have been told they have to retake the tests sometime next week. parents with concerns are invited to go to a meeting at the school this morning at 8:30 and at 1:30 this afternoon. students from seven low performing california schools including three schools right here in the bay area they are suing the state claiming schools have failed them. the lawsuit was filed yesterday. it claims students at schools in low income areas get for a less learning time than students in affluent schools. it cited problems like a shortage of teachers and the failure to have class schedules ready at the beginning of the year. this lawsuit is representing 8,000 students including several from fremont and castlemont high school in oakland and knee symptom elementary in richmond. the founder of facebook is showing his support for local schools. mark zuckerberg and his wife

priscilla khan are promising $120 million to public schools in low income communities. he says everyone though "the bay area is one of the most prosperous places in the world, there are many schools that don't have the resources they need. first $5 million will go to schools in redwood city, ravenswood and san francisco and will focus on principal training, classroom technology and helping students transition in middle school to high school. the state gambling commission is expected to set a hearing date today on the license renewal of san jose's casino matrix. the commission has put off making a decision on the casino's license as it investigates recent accusations. earlier this month, california's attorney general filed papers accusing the casino of hiding millions of dollars in profits and trying to avoid paying taxes. casino matrix could lose its license. time is 7:08. some medical marijuana dispensaries in san jose are

offering what they call weed for votes. in an effort to increase the turnout at tuesday's primary election. cannabis collectors are offering everything from discounts to free pot, but it's only for members who bring in an i voted sticker or ballot stub on tuesday june 3rd. after they vote, supporters are asked to go to the san jose city council meeting where medical marijuana regulations will be debated. the city is considering a new ordinance to move many pot clubs and also reduce their hours. a warning from san jose police about a new scam that targets undocumented immigrants. ktvu's janine de la vega joining us live now to tell us how con artists are taking advantage of a new law. good morning janine. >> reporter: good morning, dave. this new law allows undocumented people to get a driver's license, and it's a relief for those people who don't have papers, who have been driving illegally to try to get to work or take their kids to school, and now there

are some scammers who are taking advantage of this vulnerable population. and that is why the san jose police department is telling people to be careful. they say people are actually posing as lawyers and staff of the dmv promising them a driver's license. some criminals are asking up to $1000 a person to obtain illegal license. officers say always be aware of agents claiming to be able to help you by paying a fee. there are also false dmv websites popping up. under the new state law undocumented people who can prove their identity and residency in california as well as pass the written and the behind the wheel driving test will be able to get a license. right now, though, the dmv is in the process of reviewing the categories of documents needed to verify identity and residents. the public's going to get a chance to comment on those proposed regulations this summer, so driver's licenses for undocumented people won't be issued until january 1st of 2015, and anyone who's trying

to tell you different is just not telling the truth. reporting live from san jose, janine de la vega ktvu channel 2 news. time now 7:10. now this morning, president obama says he will meet with the head of the veteran's affairs department in just about 15 minutes from now to have what he calls a serious conversation. that announcement comes after veterans affairs secretary eric shinseki spoke just about an hour and a half ago and said that his agency takes caring for veterans seriously. >> this situation can be fixed with v. a., congress, and all of us like many of you working together with the best interests of veterans at heart. >> now shinseki also announced he is removing the top leaders of a v. a. hospital in phoenix arizona. congress is investigating whether that hospital and v. a. facilities around the country falsified their records to cover up long wait times for

it's been one week since the deadly rampage in isla vista. hundreds of people gathered at a san jose high school to honor one of the young victims. >> ♪ i will remember you. ♪ >> mourners filled he land high school to help comfort george chen's visibly heartbroken parents. 19-year-old chen graduated from leland high two years ago. he was one of elliot rodger's first victims. >> i don't want to stand here. if my son can come back, i don't need to stand here, and i hope i'm the last one to stand here. >> chen's devastated parents say this time of grief is also a time to forgive. they say they are praying for

the family of their son's killer. time is 7:15. at an event in san francisco, snoop dog called for an end to gun violence in the wake of that deadly shooting in isla vista. >> shouldn't be until it hits somebody in your family or someone so direct to you that you do something about it, because we're all family and those kids that are being affected by these school shootings and the shooting that we had the other day in southern california, this is outrageous. we need to do something about it. >> the hall of famer joe montana, swimmer diana nyad, m. c. hammer and former san francisco willie brown joined snoop dog at this fundraiser for the no guns allowed campaign. snoop dog has a personal history of gun violence but says he wants others to learn from his mistakes. he was acquitted of murder in 1996, and he was arrested in 2006 for having a gun at an airport. now today he says he does not own a gun. it's a new effort in washington d. c. but a local

lawmaker to pass gun control legislation. coming up for you at 7:45, ktvu's kyla campbell will have a live report on a bill being introduced this morning that's a response to that deadly attack near u. c. santa barbara. 7:16. a stockton man had the scare of his life while visiting one of the tallest buildings in the world. alejandro garabay and his cousins went to willis tower in chicago and took pictures of themselves sitting on the floor of the glass ledge that's 1350 feet above the street. as they started to stand up, they heard a noise and felt the glass cracking under his hand. >> i couldn't actually say much. you would expect like holy -- you know, nothing like that. it was just like i just jumped off. i was like wow, i literally just jumped off. >> an engineer from the company that installed the sky deck says there was never any real danger. >> that's hard for me to even look at it. >> i know. >> he explained the cracking was not the actual glass but a

she goes monday, tuesday. it is 7:20. it's an honor once dominated by harvard, but a new study says stanford has apparently grabbed the top spot for america's it school. according to the princeton review survey, stanford tops the list of when high school seniors are asked to name their dream college. the princeton review -- the university is now considered the place to study computer science, engineering and technology. time now 7:21. an entire high school senior class at one bay area school could do a lot of celebrating this morning, all 56 graduates are going to college. >> please move your tassels from right to left to symbolize that your high school diploma has been awarded to you. >> now, see, we can applaud them because all of them are the first in their families to

time now just about 7:25. midnight tonight, that's the deadline to put in an application if you want to become an oakland police officer. the city's trying to fix the police staffing shortage. four years ago there were 801 police officers. the city now is budgeted for just over 700, but the number of officers out on the street, it's a lot lower than that because of officers retiring or leaving the police department. the starting salary for an oakland police officer is about $70,000 a year. meantime, there's one neighborhood in oakland proudly showing its support to the police department. yesterday people living near bella vista park held this cookout to thank police officers.

it gave them a chance to interact with the community under positive circumstances. >> my brother is a victim, and i'm a victim because it happened, and he does have family, and if you're willing to speak to the police and let them know what they need to know, then they're willing to help you. >> police say they've been able to solve four homicides in that area this year including a shooting in march. police say a lot of crimes are solved through the help of very brave people who come forward with what they know. this morning we're hearing from the sacramento woman who survived a bear attack in alaska by playing dead. >> i truly learned growing up, you don't do nothing. you don't fight back. >> it happened earlier this month in anchorage after jessica gamboa surprised a mother bear with her cubs. the bear knocked her to the ground and clawed at her several times. she laid still and did not speak and believes that saved

morning where the stage is set for the return of the bottlerock music festival one year after the first festival prompted dozens of neighborhood complaints and ended as a financial failure. ktvu's tara moriarty is there and coming up she'll tell us what's going done to make good on the promises that this year will be different. >> you think tara could go up there. >> yeah. good morning i'm tori campbell. >> i'm dave clark. lets talk about your weather and traffic. >> different than yesterday, that's for sure. yesterday we were fog free. ed to there's a lot of fog there and it's making a good surge coast and bay. low clouds, cool and breezy. really chilly this morning for this time of year end of may. we're getting a lot of 40s, even some low 40s. fog on the coast isn't going anywhere. i think it will be back big time tonight into tomorrow. if you're heading into the city or anywhere around the bay, i would take a jacket tonight because there's going to be a pretty good west wind behind that. 40s on the temps, 46 novato, 46 santa rosa, low 50s for many, and you combine that with a

westerly breeze, even if it's sunny. you'll probably notice how cool it is. you get a decent breeze from concord out to fairfield. travis gusting to 31 out of the west southwest. that says the cool air will make it all the way out to sacramento. lots of low clouds and fog. they continue to fill in on the coast. so fog, sun, cooler, breezy to windy at times, temperatures inland upper 70s compared to the mid you are orr up -- or upper 80s. steve, good morning. we're getting a little bit more slow traffic in lafayette and orinda on westbound 24 as you drive to the caldecott tunnel. the drive time is 10 minutes. usually it's about 8. we're not seeing a lot of slow traffic. most of it is right here. you see it on your screen in lafayette near the lafayette exit, pleasant hill road. it does get better as you make your way toward oakland. bay bridge toll plaza. that is backed up for a 30 or 35 minute drive time into san francisco. we're hoping for a little better on a friday. it still has a chance to

improve after 8:00 as it did yesterday. we're hoping for that. traffic is okay on 580 and 880. as we look at concord traffic slows just after 242 heading south. now at 7:32 let's go back to the desk. it is an incident that has both shocked and angered people and now ktvu news has obtained the video of an oakland school security guard beating a special needs student in a wheelchair at oakland high school. ktvu's pam cook is in the newsroom with that video and, pam, the controversy that surrounds it. >> 17-year-old francisco martinez left the hospital yesterday after the latest checkup on his injuries. he's a high school sophomore, and he tells us here at ktvu news that he protested when a security guard tried to clear the hall and wheel him to class. now this is a look at the video. it shows the guard in the white shirt as they were making their way down the school hallway pushing martinez. you can also see the guard's

right hand then smack the teenager. seconds later the guard hits him again, and martinez who has cerebral palsy is then thrown out of his wheelchair and on to the floor. he says what the tape does not show is that the guard beat him in the elevator ride just minutes before that cursing at him when martinez told the guard that he's in pain. >> he tells me like that, i don't give a -- i hope you don't walk for another two or three weeks. >> he said that? >> yes, he said that. >> martinez admits spitting at the guard in protest just before the beating shown on tape. the school district says it fired security guard marcell mitchell immediately after the incident. he's seen here in this grainy photo. now a spokesperson says that mitchell had been hired as a substitute security officer in november and had passed a background check. the guard is due in court next month to face felony criminal charges. now we're going to have more of

that teenager's interview in our next hour. >> several members of the oakland community showed their anger about this beating incident during wednesday night's school board meeting. >> those students much less a student in a wheelchair could be assaulted or treated wait that francisco was. >> there is no way that a white student in his wheelchair would have been thrown out of his chair on to the ground. >> the oakland school district says it's taking this beating incident very seriously. the spokesman says this could lead to major changes in the way the school district chains school security guards. our coverage continues on our channel 2 website ktvu.com. we've posted that surveillance video in its entirety as well as the letter that was sent home to parents by the school district. 7:35, today bryan stow's attorneys plan to show the night he was attacked there was a lot of violence throughout

dodger stadium. stow suffered severe brain damage when two dodgers fans beat him in the parking lot three years ago. his lawyers will call people to the stand today who were in the ballpark that night, and they will testify they were threatened at the game and witnessed several fights that night. >> raises havoc starting in the 2nd inning. so this wasn't some little thing that happened in the parking lot, oh, my gosh. this was something that went on for three hours. >> in opening statements, stow's attorney blasted the dodgers and their former owner for failing to provide adequate security. but the dodgers blame the attack on the two fans who admitted to beating stow. the team lawyer also told jurors there is evidence stow was drunk and that the fight started over something he had said. happening today, a pleasanton teenager scheduled to be sentenced for his role in a car crash that killed a bicyclist.

isis the -- 19-year-old cody hall is expected to be sentenced to nine years in state prison as part of plea deal. the sentencing comes after hall pled no contest to charges of vehicular manslaughter in last year's crash that killed a dublin woman and injured her husband. the case drew national attention due to hall's social media posts where he bragged about speeding and going on a death ride. new technology is speeding up the commute for thousands of bus riders in san francisco. many muni buses now are equipped with a high-tech device that can change the timing of traffic lights at some of the busiest intersections in the city. the lights stay green if a commuter bus is approaching. muni says this new technology has reduced commute times by 10% since it was first introduced in march. >> what we're seeing and we've been doing it now for about five or six weeks on the mission, we're seeing significant savings meaning, you know, on average 5 to 7 minutes on a trip that could

be, you know, 50 to 55 minutes. >> i take it downtown every day for work, and it's really stop and go until it gets to the tunnel, so i think just any additional time saving would be really nice. >> now there's an antenna on the bus. it sends a signal to an antenna near the traffic light, which in turn signals san francisco's main traffic computer. muni is now making plans to expand this new system across the city. happening today in just about four hours from now, napa's bottlerock music festival will begin. one year ago the first festival ended with neighborhood complaints and a lot of money problems, but the new organizers are hoping that outcast, the cure and heart can bring new life to that festival. tara moriarty is out there right now. you're at fairgrounds, and the stage is set. >> reporter: that's right, and you can add blue travelers as well as the bare naked ladies to that list of performers.

it's going to be quite the lineup. behind me you can see the folks here, the tech crews have been putting the finishing touches on the sound stage. we know that a new sound barrier wall was put in to try to keep neighbors happy. if we pan over to the right, there are these signs and they say no event parking. they are everywhere. last year the event drew scores of complaints about noise, traffic, and parking, and this year there will be more traffic controls and there are new event owners as well. last year's promoters went bankrupt after making only $11 million on the $20 million festival. the city and vendors went unpaid until dave graham's company bought the rights. we asked one neighbor this morning if she was dreading this event or looking forward to it. >> i've been a resident all my life, and this is one of the most exciting things that i've seen happen in the valley, so whatever. if people complain, they're going to complain. you can't make everyone happy.

president janet napolitano about new research on mental illness. she says a team of scientists at u. c. san francisco has received a $26 million grant to develop a device to retrain the brains of the mentally ill. they will collaborate with researchers from several other schools including u. c. berkeley. the announcement comes days after six u. c. santa barbara students were killed in an attack at isla vista. the gunman in that attack reportedly suffered from mental illness since he was a child. time now 6:46. you got to see this story. a bus driver in oregon called a hero because he rescued a 2- year-old boy who was wandering in a busy street. take a look, this happened last week in gresham oregon. it was captured on surveillance video. you can see the little boy right there and then the driver stop his bus in the middle of the street, run over to the little boy. he stayed right with this 2- year-old until the police got there. >> to be honest with you, from the time i saw the child i'm not sure i looked out to see if there were any other cars.

7:55. oakland police are searching for man they say sexually assaulted a woman in broad daylight. it happened about 12:30 wednesday afternoon on east 31 31st street near highland hospital. investigators say the suspect approached a woman in is a secluded area, groped her and tried to assault her. the suspect is described as an african-american man between 25 and 35 years old. 5 feet 10 inches tall and weighing 140 pounds. 7:55. tomorrow the navy gives an update about possible radiation contamination on treasure

island. earlier this year the u.s. navy said it would test all the homes on treasure island for higher levels of radiation. that followed the discovery of radioactive items buried near the homes where about 2,000 people now live. the navy once used this same area to dump toxic materials. that update on the testing is tomorrow, 10 a.m., at the casa day la vista building. a woman considered a public health nuisance is still breeding rats in san francisco. ktvu obtained this video you're looking at from animal care and control. this was shot in 2011. you can see rats burring through the woman's apartment. the public health department ended up exterminating 1,000 rats in and around the building. animal care officials also say the 43-year-old woman is known as erica j. she's mentally ill. in recent years she's been

gunpoint and held for hours at a home in east oakland. officers blared a warning out on horns after surrounding a home on 75th avenue early this morning. shortly after that they detained at least three people for questioning. a sergeant tells us that the woman was riding in a car last night when she was forced out by a man with a gun. another woman who was also in the victim's car then called police for help. the kidnapped woman who's in her 50s is doing well. investigators are now looking for a motive to the abduction. there are new reports that about 400 pleasanton high school students will have to retake the advanced placement tests for college. the oakland tribune reports that california college board found problems with the way students at amador valley high school were seated during a recent test. apparently they were not seated the required 5 feet apart.

students have been told they'll have to retake the tests sometime next week. parents with concerns are invited to attend the meeting at the school this morning in about 25 minutes at 8:30, and then there's another meeting at 1:30 this afternoon. a group of students from seven low performing california schools including three here in the bay area are suing the state because they say it has failed them. the lawsuit filed yesterday claims students at schools in high poverty areas received for a less learning time than students in affluent schools. it cites problems such as a shortage of teachers and the failure to have class schedules ready at the beginning of the year. the lawsuit represents 8,000 students including several from fremont and castlemont high schools in oakland and nystrom elementary in richmond. a group of oakland parents are staging a rally against a code of conduct at an east bay high school. the parents along with teachers are pretty upset about a

morality clause. ktvu's alex savidge joining us live. you're at bishop o'dowd high school in oakland. the rally just got started out there. i can hear what's going on alex. >> reporter: this demonstration organized by bishop o'dowd parents who say they want to show their support for teachers here at this school who they feel have been put in a very tough spot being asked to sign that morality clause that we've been talking about for the past week or so. this is the scene here. you can see close to 100 people, this is parents, some teachers, and some students are lining the entrance here to the school. this is the last day of class, by the way, here at bishop o'dowd, and you can see they're holding signs. cars are honking as they pass by. the folks involved in this demonstration are calling on the diocese to back away from controversial language that was inserted into teacher contracts. the diocese wants to require teachers to adhere to catholic church teachings in their private lives as well as their professional lives. several teachers have refused

to sign that clause. others have simply quit. some parents meantime are pulling financial support for the school over this issue, and they say teachers have the right to keep their private lives private. >> it's a non-issue. the ultimate point is to educate our students and to delve into the personal lives of our teachers takes away. that energy could be far better spent educating our students than the energy put forth to say what are you doing in your personal life. >> reporter: now the bishop of the oakland diocese michael barber says he is reconsidering that controversial morality clause that had been inserted into the teacher contracts, although it is unclear how the language in that contract will change. it comes after a meeting with parents, teachers and administrators earlier on this week. parents out here say this issue is far from over. this particular demonstration on the last day of class will be going on until about 8:30

this morning. we're live this morning in oakland, alex savidge ktvu channel 2 news. the founder of facebook showing his support for local schools. mark zuckerberg and his wife priscilla khan are promising $120 million to public schools in low income bay area communities. zuckerberg says even though the bay area is one of the most prosperous places in the world, there are a lot of schools that don't have the resources they need. now the first $5 million will go to schools on the peninsula including the ravenswood school district. it is 8:06, a new lawsuit claims a lack of security at san francisco's pride festival led to a shooting that injured two vendors. attorney generals for trevor gardner filed the lawsuit after he was shot in the leg while working at the festival last year. according to the san francisco examiner, the lawsuit claims a lack of security allowed the shooter to entered festival with a gun and escape after

firing into the crowd. police do not believe either man who was shot was the intended target. time is 8:06. a san jose police department has lost even more police officers making it harder to fight crime. more police officers turned in resignations this week because of changes to a disability policy. under the new policy, injured police officers who can't go back to their regular police duties will be asked to work another city job. and it's not clear if they'll be protected from layoffs. >> there's no safety net if i was to be injured on the job i would not be guaranteed a disability retirement where i would be able to support my family. >> now san jose mayor chuck reed says injured officers working a new job would get settlement the same pay. a warning from san jose police about a new scam

targeting undocumented immigrants. ktvu channel 2 reporter janine de la vega is live now to let us know how con artists are basically taking advantage of this new law. good morning janine. >> reporter: good morning, we're here in east san jose where there's a large mexican population and i've been speaking to people who say they are not surprised a new scam has surf surfaced. people are posing as dmv employees and offering people without papers driver's driver's licenses, but california isn't actually issuing those legal driver's licenses until next year. that's why the san jose police is putting out a warning that some criminals are asking up to $1000 a person to obtain a legal license. officers say always be awe are of agents claiming to help by giving them money. under the new state law undocumented people who could prove their identity and residency in california as well as pass the written and behind the wheel driving test will be able to get a license. right now the dmv is in the

they deserve. this morning i think some of you also heard rick take a truly remarkable action in public remarks he took responsibility for the conduct of those facilities and apologized to his fellow veterans and to the american people. and a few minutes ago secretary shinseki offered me his own resignation. with considerable regret i accept it. mr. shinseki has served his country with honor for nearly 50 years. he did two tours of combat in vietnam. he's a veteran who left a part of himself on the battlefield. he rose to command the first cavalry division, served as army chief of staff, and has never been afraid to speak truth. as secretary of the v. a., he presided over record

investments in our veterans, enrolling 2 million new veterans in health care and delivering disability pay to vietnam veterans exposed to agent orange, making it ease year easier for veterans with post traumatic stress, mental health issues to get treatment. improving care for our women veterans. at the same time he helped reduce veteran homelessness and helped more than 1 million veterans serve as members of their families pursue their education under post 9/11 g. i. bill. so rick's commitment to our veterans is unquestioned. his service to our country is exemplary. i am grateful for his service as are many veterans across the country. he has worked hard to investigate and identify the problems on access to care. as he told me this morning, the v. a. needs new leadership to

address it. he does not want to be a distraction because his priority is to fix the problem and make sure our vets are getting the care they need. that was rick's judgment on behalf of his fellow veterans. and i agree. we don't have time for distractions. we need to fix the problem. for now, the leader that will help move us forward is sloan gibson who will take on the reigns as acting secretary. sloan became deputy secretary at the v. a. just three months ago, but he too has devoted his life to serving our country and our veterans. his grandfather fought on the front lines of world war i. his father was a tail gunner in world war ii. son graduated from west point -- sloan graduated from west points and served in the infantry and most recently he was president and ceo of the uso which does a remarkable job supporting our men and women at war, their families, our wounded warriors and families

of the fallen. sloan has 20 years of private sector and nonprofit experience that he brecks to bear on our -- brings to bear on our ongoing work and i'm grateful he's willing to take on this task. i met with sloan after i met with rick this morning, and made it clear that reforms should not wait. they need to precede immediately. i've also asked neighbors to stay at the v. a. to help sloan and the department through this transition and to complete his own review of the vha. in the meantime we're going to look diligently for a new permanent v. a. secretary and we hope to confirm that successor and fill that post as soon as possible. we're going to do right by our veterans across the board as long as it takes. we're not going to stop working to make sure that they get the care, the benefits the opportunities that they've earned and they deserve. i said we wouldn't tolerate misconduct, and we will not. i said that we have to do better and we will. there are too many veterans receiving care right now who

it won't disappear. maybe sunday it might burn off sooner. we'll have warmer temps with the fog in place. westerly breeze and much cooler lows this morning. a lot of 40s and low 50s. we're running about 5, 7 degrees cooler. there's a no doubt about it westerly breeze in place, some gusts over 25 miles per hour towards the delta. look for the fog to win out giving us a cooler pattern today and saturday. a west wind, cool overall, even up to clear lake and out to vacaville. that tells us temperatures today, 70s for many, 50s 60s close to the water. we are still looking at traffic that's a little slow. so commutes had improved only to have a couple of incidents kind of mess them up again. let's go out and take a look at the east shore freeway. still holding steady at 23 minutes here from the carquinez bridge to the macarthur maze. when you get to the bay bridge it had been clearing out. then we had a stalled big rig. it's a 30 minute drive time, although still things are looking better than they have earlier this week. it's going to take a little time to get through this commute.

give yourself a little extra time there. also want to mention that southbound 880 is slow at fremont as you drive south and head down towards the south bay because of the some earlier issues that are nor clear. santa clara valley traffic is going to be slow but not as bad as other days. let's go back to the desk. thank you. time is 8:33. a shocking story of a teenage boy hit and knocked out of his wheelchair, and it was all caught on camera. ktvu's pam cook's in our newsroom to show us that video. the actions being taken at that school. >> francisco martinez is a sophomore at oakland high school, and he tells ktvu that when he argued with a school security guard, the conversation turned violent. now this is a look at the video. it shows the school security guard there in the white shirt pushing martinez down the hallway. martinez has cerebral palsy and is in a wheelchair. then you see the guard smacking martinez. seconds later he hits him again. >> he slapped me so hard that

he threw me out of my chair. i hit the floor with my chin first. i had a scar right here. >> martinez says what the tape does not show is the guard beating him in the elevator just minutes before that scene that was captured on video. the school district says it has fired guard marcell mitchell immediately after the incident. the district says it hired mitchell as a substitute security officer in november and says he did pass a background check. he was arrested by oakland police. he now faces felony charges. reporting live in the newsroom pam cook ktvu channel 2 news. several members of the oakland community showed their anger during wednesday night's school board meeting. >> most students much less -- no students much less a student in a wheelchair should be assaulted or treated the way he was. >> there's no way a white student in his wheelchair would have been thrown out of his chair on to the ground.

>> the oakland school district says it's taking this beating incident very seriously. a spokesman says this could lead to major changes in the way the school district trains school security guards. our coverage on this continues at ktvu.com. we've posted the entire surveillance video in its entirety. you can see it as well as the letter that was sent home to parents by the school district. 8:35, midnight tonight is the application deadline for anyone who wants to become an oakland police officer. the city is trying to resolve its staffing shortage. four years ago there were 801 officers. the city now is budgeted for just over 700, but the number of officers on the street is much lower than that because of people retiring or leaving the department. starting salary for an oakland police officer is about $70,000 a year. all right. time is 8:36. legislation to limit evictions under the ellis act in san francisco has passed the state

senate. the bill sponsored by state senator mark leno requires a landlord to own a building for at least five years before tenants can be evicted under the ellis act. the measure had failed to pass the senate on wednesday, but then leno agreed to make changes to the bill for example, to exempt mom and pop landlords. the measure then passed last night. now it goes on to the state assembly. both the state senate and the assembly passed resolutions urging an accreditation committee to give city college of san francisco more time to fix its problems. the commission has set a deadline of july 31st. these resolutions say city college has met almost 95% of the 350 octoberives laid out by -- objectives laid out by the commission but need more time. the commission has repeatedly refused other requests to extend their deadline. if city college loses its accreditation it would close. 8:37. happening today, the stage now set for a major music festival

in the wine country. the bottlerock festival is back one year after the first festival ended as a financial failure. ktvu's tara moriarty joins us live from napa where the first act will take the stage in just a few hours. good morning tara. >> good>> reporter: good morning, the fray, as well as ll cool j will be performing. the big name is heart that's going to be here over the weekend. things are really buzzing. we had a chance to walk on the grounds a while ago and the lights are strung from the trees. the white tents are up and the sound crews putting on the finishing touches. last year the event drew scores of complaints about noise, traffic, and parking, but this year there's going to be more traffic controls. and there are new event owners, too. last year's promoter went bankrupt after making only $11 million on the $20 million festival. the city and vendors went unpaid until david graham's

time is 8:43. oakland police say they're still investigating reports of an overnight abduction of a woman. witnesses say investigators say a woman in her 50s was forced out of a car by a man with a gun late last night. police eventually found her this morning at a home on 75th 75th avenue. reportedly she's in good condition. police have detained at least

three people for questioning. so far there's no word of a motive. san jose police say scammers are taking advantage of a new law that allows undocumented immigrants to get driver's licenses. police say con artists posing as dmv employees are asking for as much as a thousand dollars for fake driver's licenses. the dmv won't start issuing licenses to undocumented immigrants until january. just 20 minutes ago, and you saw it live right here on mornings on 2, president obama announced that eric shinseki has resigned as veterans affairs secretary. the announcement comes after an inspector general report revealed that some v. a. hospitals covered up how long wounded vets had to wait to get medical care. ktvu's kyla campbell live in washington now to break down these latest developments. kyla. >> reporter: dave, after a private meeting, president obama said he and shinseki agreed that we don't have time for distractions. we have to fix the problem.

will release the nationwide audit in the coming days. meanwhile president obama said the v. a.'s deputy secretary sloan gibson will temporarily fill the role as secretary. live in washington kyla campbell ktvu channel 2 news. thank you kyla. 8:45, a bay area congressman has introduced a bill that would provide more resources for mental health care. the bill comes in the wake of the deadly attack near u. c. santa barbara. it would let states place temporary restrictions on people who have been involuntarily hospitalized with serious mental illness. the bill would also prohibit people convicted of misdemeanor stalking from having a gun, and it would also allocate almost $20 million to help states add information to the national background check system. happening now on the last day of classes, some parents are rallying at oakland's bishop o'dowd high school. they are criticizing a

controversial morality clause that's in teacher's contracts. alex savidge is live at the school where the rally started just about an hour ago. good morning alex. >> reporter: well, tori good morning to you. that rally did just wrap up here on the last day of classes at bishop o'dowd high school. this demonstration was organized by parents who say they want to show their support for teachers here who have been forced to sign a strict morality clause or risk losing their jobs. some of the parents who were out here this morning say they believe the teachers have the right to keep their private lives private. >> we're going to keep sort of the bureaucracy of the church away from the good solid teaching principles that are going on at this school. >> reporter: this is the demonstration that got started about 7:30 this morning. dozens of parents, some students and some teachers all were out in front of the school holding up signs calling on the oakland diocese to back away

from controversial language that was inserted into teacher contracts. the diocese wants to require teachers who adhere to catholic church teachings in their private lives as well as their professional lives. several teachers have refused to sign that clause. some of them have simply quit. after a meeting earlier this week with administrators and teachers, bishop michael barber says he is reconsidering that controversial morality clause. one of the teachers told me that makes him somewhat optimistic. >> people are hopeful that okay, at least maybe there might be some sort of clarity. that's really what's part of the problem, there hasn't been any clarity. >> reporter: it is unclear at this point how the language in that contract might change. one parent told me this issue is far from over. along with support from parents, students are also backing faculty. they started a petition at change.org and some of the

then it's sup sunny. a lot of 40s this morning. pretty impressive for the end of may here. as we go into the next couple of days, it will be a fog forecast, that's for sure because there's a lot o'go around. water temps very cold. upper 40s, low 50s. you go right outside the golden gate it's in the low 50s from bodega bay to half moon bay. 49 to 53. a west wind and a ramp up of a fog bank. it's going to get higher tonight and tomorrow. took a while to get on the marin and sonoma coasts, but it filled in there. a lot of 50s. i don't think it's 61 yet, something wrong with that. a lot of 50s. you combine that with a west wind of 24. to gusts of 30 out of travis. that is a sure sign that the delta breeze is in full force and going to continue. a series of lows are going to continue to rotate through over the next five, seven days. 53 in ukiah.

some people in brentwood say a man living in a house on their street illegally is creating a neighborhood nightmare. the neighbors who wanted their identities hidden out of concern for their safety, say the man who lives at a home on heartland circle is a bully. and it's a home that was foreclosed on so no one is supposed to be living there. two of the neighbors filed police reports about incidents where they say the man approached them in a threatening manner. >> avoid the house. >> and tell me you have a kid.
