with how the school district is responding. >> i've been putting in multip requests for the second surveillance video and the spokesman told me they located this extra footage this afternoon, we were able to get a copy, look at the video. they say that this shows more of this incident. this video came from a lower floor camera at oakland high school and shows the incident involving marshal mitchel who's been fired getting involved with a student, francisco martinez, you see martinez get into a scuffle with the guard, at one point mitchel appears to kick martinez in the head and drags him into the elevator with the help of a second officer. is second officer is being

placed on administrative leave. and the spokesman says they are going to look into this if she should be fired. >> she will be put on leave effective tomorrow, we only came into this information discovering the footage this afternoon, we didn't have time to serve the papers and notify the supervisor and all the things we're required to do. but effectively this person is on leave now and that will be formalized tomorrow. >> last week i spoke with martinez as he came out of children's hospital in oakland. he said he's had pain since that incident. i reached his attorney and they are considering a civil lawsuit. they have not filed anything at this time. look, we have some of that original video that we obtained last week, showing up on the

third floor, the incident between mitchel and martinez. martinez admissions he was upset and spit at the guard. he was handcuffed. the guard in the 2nd video it shows that guard at one point knocking him to the floor, and then pulling him back on the wheel choir and wheeling him away from the camera. there's both videos turned over to oakland police, we understand they will be pursuing an desirable investigation in light of this new footage. we're continuing to reach out and we're expecting a comment back from them. we'll have that on our 10:00 news. city leaders are trying to force muni drivers back on the job. it appears they will call in sick tomorrow. the commute is filled with long lines of people waiting for

buses. they are running at half fleet. because of the strikeout. scott wiener planned to present a emergency resolution but it may be symbolic. >> you can't force them to come back to work. the mta may be able to do that. it's important for us to stand up for the rideers. >> the mta in a strongly worded statement said the sick out is a direct violation of the contract with the union. drivers who engage in further sick days may be subject to termination. claudine wang is live to tell us what's at stake. some worry they are not on the same page. that's right. inside city hall, we got a lesson on pension from the city's hr correcter. why this is -- director. the agreement was voted down

the numbers were 1198 to 47. the muni workers didn't like it. there's concerns at city hall this may be a miss underring. >> continuing to pay the employers section. >> the chief said this afternoon's meeting wasn't part about clearing the air and doing the math. the fight over the new agreement comes down to pensions. >> seems to be coming down to a key issue the concern to the operators that has not been communicated well to them. >> right now the city pays its contribution and the employee contribution. but it's a new day and the city doesn't want to pay for that any more. instead the officials would rather give raises. they want to give employees a 5 .05 raise for a 7 1/2%

contribution. but those numbers don't match up or do this. >> slightly lower number because for every dollar that we give in wages we must payroll up costs. workers comp, unemployment, social security, in fact, pensions. >> i talked to the union today and they don't agree with the math, they think the members will lose money. that being said, when it comes to the next official step it is clear this goes to arbitration on-saturday. we know drivers have called in sick tomorrow, we don't know how many. this leaves commuters in limbo again. continuing coverage now of the arrest of the san francisco man accused of having bomb making materials in his apartment.

we're getting a clearer picture of what ryan chamberlin was capable of. he made his first appearance in court today. alley rasmus with the new information revealed in the criminal complaint. >> the criminal complaint is six pages long but it alleged he had two sets of bomb making materials in his russian hill apartment. his friends say when they look at the complaint and compare it to the manthey know it doesn't make -- man they know it doesn't make sense. >> he was struggling with personal problems. >> somebody that was growing more desperate. >> it affected him deeper than i thought. when we saw him, he was a very social energetic excited guy. the fbi said exam bear lain -- chamberlin was a public threat.

he had bomb making materials. a bag contained the four components necessary to comprise an ied. power source, wires, switching device and explosive. investigators found a toolbox that had additional ied components including wires and a clothes pin switch. >> i don't believe he ever was a threat to anybody. >> amanda fine has known him for six years, he was a warm and supportive friend. the last person she would think would hurt others. she and friends are contributing to a online legal defense fund. i hope we can support him no matter what. i can't make sense of it but i want him to know we love him. the fbi conducted another search of another residence listed in his name. it's not clear if they found

anything of significance there. the fbi says their investigation into chamberlin continues. new at 6:00 the doors just opened for business and we're learning of safety concerns as ambulances move patients to kaisers new hospital in san leandro, nurses say they didn't get the training they needed to work in the new hospital. rob is live in hayward, he spoke with the nurses about the tough track us. >> -- transition. some nurses are uneasy they are about to move to a new hospital with new equipment and they are not sure how to use some of it. for the last few dozen remaining patients in hayward, today was moving day. the hospital is closed. ambulances lined up to take them to the new hospital in san

leandro. the 450 nurses that worked in hayward are following the patients to the new hospital, among them is robert, he's been a registered nurse at kaiser for 32 years but he's not ready to hit the ground learning. >> there's a lot of procedure changes and i don't think we've had enough time to work those out to be able to safe guard the patients. >> the new hospital has new equipment, but noshes received three days of -- nurses received three days of training and some of that was online. >> this icu nurse said one of her training days didn't go well. half of the time the equipment was not working. >> a vice president with kaiser said the staff has been trained. >> we have gone through surveys and license with the state and we have all the appropriate training to provide safe and

effective care. >> we have numerous resources on-site after we open to provide ongoing training to staff if they feel they need it. >> it's a learning curve, that learning curve needs to be done before you hit the facility. >> the nurses don't feel patient care will be seriously jeopardized, they feel the transition could have been made easier. it's election day and the first california primary where the two highest vote-getters will be to november ballot regardless of political party. election officials are expecting a low turn out today. >> that's right. i'm at the santa clara register of voter office. it's been a slow day all day. they are expecting a last minute surge of voters as people get off of work and a

couple cars coming through. many other polling places with less activity. the projects turnout is less than 35%. that's the lowest in 20 years for a primary election. it's a similar story across the bay area. in alameda voter turnout is expected to be 20 to 30%. the registers office said turnout is higher based more on population and demographics, not the ballot measures or the high profile races. >> we've lived here 50 years, and we've voted every time. so we're surprised when people plain about this or that that they didn't vote for anything. it's important to do it. >> and when we talk to voters some say the may ors -- mayors race brought them to the polls.

polo shirt and dark khaki pants. this comes as police are looking for a teenager who groped a woman on a neighborhood trail. he's latino or asian, 5'6". there were three incidents. police say none of the victims suffered physical injuries. visa is announcing a new tool to help consumer navigate fees on prepaid cards. visa will flag cards with a special logo when they meet standards. like flat monthly fees. prepaid card always designed for people who don't of checking accounts. there's no requirement to disclose fees and terms in a uniformed way. qualifying cards continue of -- won't have over charge factors.

see the fog pushes through the san bruno gap, it is pushing in, by tomorrow i expect fog in hayward, here's what the computer model things, tomorrow at 6:00 a.m., shoots the gap, here's san bruno gap, you see fog showing up in the corridor through oakland and hayward, then it goes back to the coast, i'm not sure it's going happen, it will be foggy at the beach. the heat starts to come this way. you know that pattern, so tomorrow, warmer than today, 92 in clearlake, 90 in vacaville. with this pattern you have good air quality. breezy conditions at the airport and the golden gate brick. the atmosphere will get turned up. you won't see a red-flag warning. it's what you expect for this time of the year.
