against a second guard after ktvu obtained the video. >> reporter: we received the video this afternoon and the school district is filing a report with child protective services. the video starts with francisco smiling. francisco and the officer start fighting over control of the wheelchair. the sec guard steps in and francisco goes down to the floor. mitchell appears to kick him in the head. at one point you see both guards on top of francisco. >> he throws me to the corner

of the elevator and grabs my chest. >> reporter: the video was released. mitchell appears to pull san francisco to the ground and beat him. the second guard has been identified as sholandra cotton. she's been placed on administrative lead. >> the video is agredious to begin with. there's no reason for an adult to react thislike this, in a violent manner. >> reporter: the attack on francisco martinez is appalling, says the francisco's attorney. they are conducting an independent investigation and they're asking a civil lawsuit. meantime we did try and contact that second guard, but we have not been able to get her

response so far. jana katsuyama, ktvu channel 2 news. in oakland, a woman accused of attacking a 9-year-old girl at a school with a hammer has now been charged with sexual assault. court documents say 48-year-old hasima diame forced the girl into a school bathroom at lafayette el elementary school in west oakland then repeatedly hit her with a hammer. a district spokesperson says last friday's attack may have stemmed from a dispute between diame and the girl's family. now to election 2014 and ballots being counted right now to decide key local and statewide racing from this primary. we already have early results on many of the big races. >> we have live team koár -- coverage. let's get right to the numbers for both of those races.

in the race for governor, governor brown is taking the lead. but his race to the challenger has been close all evening. right now republican neil kashkari has 21,000 votes. and dave cortezi took an early lead but the second spot on the november ballot has pretty much been up for grabs much of the night. right now sam loyardo and nguyen are separated by only one now votes. azmith is live after catching up with all three candidates. >> reporter: talk about a birthday present, today is

cortezi's birthday. and he received most of the votes. he is not on the city council like all the other candidates. he ran in 2006 for mayor and lost. he says he's not surprised that he's going on to the next round. and says that voters want a new direction. >> i think what has happened is people have gotten so tired of calling 911 and not getting a response. they made a 911 call today with their ballot. they want change. >> the overwhelming amount of voters are voting for a chance. they stood with major reed. they stood for sustainable services and safety. >> reporter: that is councilman sam liccardo he is coming in second in this race. he is also in good spirits

tonight. we caught up with him at an election party in downtown. liccardo has a big downtown following. he is the governor's supporter. we want to mention madison nguyen. she is also still in the running. she told us tonight she's optimistic. she was waiting until the very last votes were counted. if elected she would be san jose's first vietnamese mayor. again this is a very close race. we will of course keep you posted on who takes that second spot with dave cortese in november. i'm azmith smith, ktvu news. now to governor, incumbent

jerry brown is leading. here's a look at the latest number,kashkari and donnelly are leading. >> reporter: we're at the contra costa party. that challenger could have a significant part in the other elections. we spoke to kankhari. he took to the stage and spoke about optimism. >> i'm not going to give a long speech tonight. i will just say, we feel great.

the e hecks. it's going to be a close race as well. >> reporter: we heard briefly from kashkari and we're waiting to hear from donelly. donelly has led and those numbers flippedded in the last few days leading up to this primary. ken pritchett, ktvu news. just about 90 minutes ago, governor brown spoke to supporters. he said he is not surprised by tonight's results. >> i want to thank the people of california for giving me a fourth chance to serve them in the governorship. >> reporter: the governor went on to say he understands this is a primary victory and he will campaign hard to win an historic fourth term asgovernor. brown said california has come a long way in the last four years by closing a massive budget shortfall. he also took time to plug his rainy day fund initiative which will appear on the november ballot. moving now to the race for

lieutenant governor. the incumbent gavin newsom has a demanding lead with 50% of the vote and will advance to november. he will likely face republican ron nearing who right now has 8% of the vote. the name of now suspended state senator leland yee is still on the ballot even though he dropped out too late to get it removed. the latest report show democrat alex padilla and haavard vad -- and padilla as the leaders in the race so far. and you can also get up to the minute returns on our website ktvu.com. you will find links with information about county by county results. there are new developments tonight following the arrest of a man at the center of a

nationwide man hunt. today one day following his arrest at crissy field explosive suspect chamberlain made his first appearance in a bay area courtroom. that's where we learned the exact nature of the case federal agents are building against him. as ktvu's allie rasmus reports, family and friends are standing behind him. >> reporter: authorities described mr. chamberlain. >> mr. chamberlain was a desperate and dangerous person. >> reporter: and the way his friends see him. >> he is not a person that would hurt anyone. >> it's hard to make sense if you know him and it's hard to make sense if you do know him. i think he was just lost. >> reporter: a new report gives us details on what officials found in his home. they found a screw top glass jar with a powdery green

another rough ride today from nummi passengers among a driver protest that that's had them calling in sick by the hundreds. tonight munni tells us it expects to have more drivers tomorrow but still won't operate on a full schedule. amber lee is in the city now with a growing frustration among passengers and also how a voter approved measure is playing into this dispute. amber-- >> frank, we're at west portal a major hub for san francisco commuters. passengers tell me service was better today but that is still caused them headaches. >> on this second day of drivers calling in sick to protest the proposed contracts, sfm pa says it is running half the number of buses and training. >> monday on the way to work and home i had to catch a cab so i've had to spend $40 to get to and from work on one day. today i had to catch another

cab downtown. >> reporter: the annoyance among riders is growing. even though the wait time for many has gone down compared to yesterday. passengers say munni is a lifeline often the only way to get to their destination. >> i depend on it to go to work. i do. >> reporter: many passengers say on time service was lacking even before the sick out. in an effort to improve service, voters approved prop g in 2010. requires munni operators be at least the second highest paid transit operators in the country. ktvu checked records to see where munni operates wages stand. for b.a.r.t. it's $34.37. in new york it's $31.87 and in chicago it's $30.77. and all operators except for nummi pay into their pension.

for the very latest on if munni situation and how the commute is going. our coverage begins at 3:30 in the morning. >> the santa clara district's attorney is teaming up with the police department to solve two cold case killings. the two agencies are pulling their funds to offer $20,000 reward for information leading to an arrest and conviction in either of the two homicides last year. the first is the deadly stabbing of 17-year-old anthony daniel santa cruz near san jose high school in february of 2013. the second case is the fatal shooting of 20-year-old justin watkins in may of last year. police say the two cases are not related. new at 10 10:00, the oakland city council approved damages to the parents of a teenager shot and killed. daniel bluford died after an officer shot and killed him in

may of 2012. police say bluford pointed a gun at the officer during a chase but never fired a shot. a lawsuit said that bluford, tripped and fell and that the officer shot him three times as he tried to get out. if search for a sailor who's boat sank was discovered today. the search began after a sailboat sank. late this afternoon the marine county sheriff's office confirmed the body is that of henry ewing. he was headed to the philippines. a distress signal was sent from the boat early yesterday morning. a nice little warm up today as high pressure started building. the fog is getting thinner. dense fog right now along the coastal sections out in the richmond district out in the sunset district. fog will be at the coast if

next few days but it's going to be warmer inland then hot in the inland bay valleys over the next couple of days. we have fog across the coast. you can pick it up here sitting here a hole at stinson beach. we have very dense fog in the golden gate park. coming up over noe valley. we had fog everywhere this morning extending up into the delta. tomorrow because the fog is getting pinched back here to the coast extent of the fog push will be just past the oakland hills. tomorrow morning it's 6:00 a.m. right. and here's if fog going to the gate. i think we will see more going through the san bruno gap. it'll be kind of limited right around the bay. it's not going to push into napa. shouldn't push into livermore. means a warmer day tomorrow. as we head into tomorrow afternoon the fog burns right back do if coast. daytime highs warm up.

the white house is apologizing for not notifying key members of congress about a taliban prisoner swap to free bergdahl. president obama said there was little time to notify congress when the swap was happening. dianne feinstein suggested that not notifying congress 30 days in advance is illegal. >> it comes by surprise that the deal came into effect. >> reporter: several members are upset with the release of the five former guantanamo

prisoners saying they're still a threat. people gathered to remember the bloody crack down of the democracy movement in tiananmen square. protesters gathered. but then on the night of june 5, 1989 the chinese army moved in and cleared out the square. exactly how many people died is not known. it could be hundreds if not possible thousands. in beijing, chinese authorities did not allow any remembrance. the only sign of something difference was the increased presence of police and soldiers. many young chinese people don't even know about the massacre. police in san leandro say two teenagers are under arrest. the teens attacked two middle school students yesterday on corn wall way. one of the teens pistol whipped

pretty much the honor system when it comes to paying fees but let's be honest how many times have you put money on n -- money in one of these envelopes. turns out millions are not paying up. >> reporter: it has been a bumpy road to recovery for california state parks. the once pristine natural habitats have fallen victim to chronic under funding. and visitors have noticed a change. more like dollars. >> i am shocked at the steep prices. this is the bible of camping. >> reporter: the price to stay overnight was significantly less than the $35 it is now. >> $12. i feel like it could discourage some people who have never been to the parks to explore the nature from coming and trying it out. >> reporter: a just released report showing that 93 million are enjoying if outdoors. >> the water is really calming for me. and it's beautiful. >> reporter: but not paying the

park fees. the california research bureau points out that if those nonpaying visitors each paid just $1, the state parks department could increase revenue by 40%. >> if i have it i'm happy to pay and support it. but i don't always have $5. >> reporter: that's what the current parking fee is. we found several people today that had not paid. kioskses have been added that make payment easier. the hopes is that removing soft of the hassle -- removing some of the hassle will make for a brighter future. it not only recommends that the department come up with a strategy for collecting that revenue but also a strategy for increasing revenue. i'm heather holmes, ktvu channel 2 news. the fbi is cracking down on laser attacks aimed at aircraft. the security agency announced today it is expanding a program that offers a $10,000 reward

for information leading to arrests in connection with a laser flash. illegal laser flashing incidents have spiked nation nationwide over the last seven years. to nearly 4,000 in 2013. you tube is back online in turkey tonight by an order of the country's highest court. the constitutional court said the two month ban of you tube in turkey was a breach of human rights. turkey's government had breached you tube after recordings surfaced saying it was necessary. hayward kaiser permanente has closed tonight.

today was moving day, the hospital is closed. >> reporter: ambulances lined up to take them to the new hospital in san leandro. the nurses that worked in hayward are following those patients here to the new kaiser hospital. among them is norris narmth but says he's not ready to hit the ground running. >> there's a lot of clangs logistics wise. i don't think we've had enough time to work those out to be able to safeguard the patients. >> reporter: the new hospital has new equipment but nurses received just three days of training and some of that was online. >> there could be some delays in patient care. from it. in could be confusion. >> reporter: this icu nurse says one of her training days did not go well. >> half of the time the equipment were not working. so we didn't have a full day training. >> reporter: a vice president with kaiser says the incoming staff has been properly trained. >> we have gone through surveys

prosecutors charged a former oober driver in connection with a confrontation with a customer. davie whitmer is accused of purging a passenger in the chest. james alva told ktvu that whitner called him homophobic slurs. whitmer appeared in court on another case. >> at the time the incident took place the police decided

they didn't even want to fight him for this. >> reporter: court records show whitmer has a criminal records. another oober driver is behind bars being held on $1 million bail. he's accused of kidnapping a woman in southern california. officers arrested fredrick denser on suspicion that he kidnapped a woman and took her to a motel room in panarama city. the woman called 911 early sunday morning after waking up in bed next to demster. police say it does not appear that the woman used the oober app to arrange her fare. google gave other e-mail providers a nudge in order to give e-mails private with inscriptions. if those e-mails are sent to and from a provider that

back now to our election results in the race for district five council member in san somewhere -- jose, school board trustee carrasco is leading xavier campos. you may remember she accused him of hiring a private investigator to follow her and her children. here is another look at the race for mayor. new numbers show nguyen and laccardo are still very close. an increased fire danger after voters rejected a parcel tax two years ago. emergency funds kept fire stations open but now that money is about to run out. john fowler reports it's facing

some firefighters to make choices that could put their own communities at risk. >> reporter: at his daughter's end of school party this afternoon at discovery bay, coloni dillan struggled with the decision he says he was forced to make. >> i have to look out for my future and my future for my family. >> reporter: after seven years, dillan is leaving east contra costa fire going to another department. >> i just worry about my community and my fellow firemen that i'm leaving behind. >> reporter: firefighter dike is also leaving. eight firefighters may leave this summer. by november 18 of 45 or 40% of the department could be gone. >> it's an unconfidentable feeling everyone for the 27 left knowing that you know they can't do what they want to do. to help the community out.

in the driest earlier fire season in memory two of five east county college stations may close. remaining firefighters stretched so thin a small blaze could turn catastrophic. it's a lack of resource that is has firefighters families nervous. >> it's scary for anyone we know in the area here. you know, there could be one incident at one place and all five engines get dispatched to that and then there's nothing. >> reporter: the fire district says with property taxes low, contributions to firefighter pensions forced to go out and expenses cut to if bone there's no good solution. and voters have not been willing to tax themselves even for fire safety. in brentwood, john fowler. 14 california indian tribes have reach an agreement on legislation that would make internet poker legal in california. for years some of the state's major tribes have been in disagreement with other casinos. now they have agreed to support

a bill that would allow current tribal casino owners to have internet poker. the latest effort to regulate water -- cannabis dispensaries today. city leaders say regulation is needed. >> right now all of the dispensaries in san jose are illegal. but we're proposing to allow them in certain zones as long as we control the bad behavior. >> dispensary owners say the restrictions are too restrictive. the council plans to take up the issue next tuesday when he returns so he can break the dead lock. a little bit warmer out there today. temperatures increased over yesterday's numbers. we have less fog this morning.

we started out with a lot but it burned off very quickly. that's the way it goes tomorrow. less fog and a quicker burn off. these inland areas are coming up five or 6 degrees. still cool on the coast but inland temperatures are going to really start to warm. the story really is the fog along the coast which has been limited to the coast this evening which means the high pressure is building in. when i say limited at the coast. it's not really getting up over the hills. we showed you that earlier. it was trapped along the coast. with the inland valleys not getting that marine push of air that cool air. temperatures inland are going to begin to warm. so we'll see low 90s as we head toward the weekend. the winds are blowing all over the place. san francisco airport gusting to -- sustained at 14 gusting to 25. and then hayward we have 6-mile an hour winds. so the wind are relatively light out there today. santa rosa 49 degrees. that's pretty chilly. some of the overnight spots are
