the former b.a.r.t. police officer responsible for killing oscar grant will appear in san francisco federal court this morning. we'll tell you who is suing him and why this case is so unique.

an 89-year-old grandmother punched, then carjacked in broad daylight. the surveillance video police in the east bay hope will lead to an arrest. temperatures on monday soared inland but yesterday they started to come down. they will continue to come down today. we'll show you how much. >> reporter: we'll tell you about tough new restrictions on medical marijuana dispensaries here in san jose and what advocates for medical marijuana dispensaries say they are gonna do about it. "mornings on 2" starts right now. it's the case that gripped the bay area. more than five years ago. we're live in san francisco where in an hour and a half, a new trial will get underway in the controversial shooting death of b.a.r.t. passenger, oscar grant. ktvu's tara moriarty is there in front of the courthouse and coming up in two minutes, she'll tell us about the key players involved in the suit as former b.a.r.t., johannes

mehserle, prepares to go back on the stand. good morning. welcome to "mornings on 2." i'm tori campbell. >> good morning. >> good morning. >> i'm dave clark. let's talk about your weather and traffic. how does it look? >> pretty foggy for some. breezy and wind y for others. by this afternoon, the fog may start to move back locally inland. it will be one of those days. it's getting helped along by a system in the north. 65 in oakland. they may start to hit that for a half-hour and then cool down. a lot of clouds starting to merge together. they are coming together. 50s on the temperatures. they low 60s. we're way done a good 21 degrees in some of the higher elevations. the sea breeze is in place. that system is gonna enhance the fog tonight. i think it's going to come flying in tonight and give us additional cooler conditions. can't get much cooler by the

coast. 70s for many. inland in the 100s. there will be a few 80s. 50s, 60s for others. here's sal. right now we're hooking at a commute at its peak. we'll show you the eastbound freeway westbound 80. i want to show you the traffic between the carquinez bridge and the macarthur maze is 20- minute drive time. i can do this and show you what it looks like on the maps here. and you can see there is not a lot going on, especially in hercules and richmond. the road sensors still showing a lot of green in this area heading down. so we're going to see traffic that is moving along not too bad. i would say this is pretty good for this time of the morning. bay bridge toll plaza is backed up for a 25, 30-minute delay at the bay bridge. so if you are going there, you can give yourself just a look at a normal commute there this morning with no major problems. contra costa county, 680 is backed up from 242. 242 slows as you drive into pleasant hill and walnut creek.

24 is not bad. but 580 up to its old tricks. we have a lot of slow traffic on westbound 580. this is a 56-minute drive time from grant line road to 680. back to the desk. >> all right. thank you, sal. happening today -- another trial tied to the controversial police shooting of oscar grant gets underway in about 90 minutes. grant's father is suing the former b.a.r.t. officer responsible for his death. tara moriarty is live from outside of the federal courthouse in san francisco with more on this civil rights lawsuit. garming, tara. >> -- good morning, tara. >> reporter: good morning. one of the things that has to be proven is that johannes mehserle intentionally killed oscar grant and oscar grant was robbed of his relationship with his son because he was killed. now, mehserle's attorney, michael reign, has said that grant himself stole the relationship when he -- when he committed murder and was sent

to prison. grant's mother has been serving a life sentence for a 1985 murder. he has been in prison since before he was born. he talked to him by phone on a monthly basis as an adult. >> it's really heartbreaking for me to see that reigns is out telling folks there was no bond or relationship between the two of them. that's not true. just because somebody is incarcerated doesn't mean they don't love their relative. >> reporter: now, last month, b.a.r.t. agreed to pay $175,000 to settle a lawsuit filed by five men who were detained with oscar grant on the platform new year's eve. in 2011, b.a.r.t. paid nearly $3 million to grant's mother and daughter. mehserle was convicted of involuntary manslaughter after shooting grant on the platform. the former officer said he meant to use his taser but

instead pulled his gun b.a.r.t. is not being sued but rather mehserle as an individual. testimony is set for 8:30. i'm tara moriarty, ktvu channel 2 news. 7:05. san francisco police investigating an early-morning homicide in the tenderloin district. an emergency call came in around midnight on turk street. when police arrived, they found a person had been shot to death. investigators are handling the case now with the homicide group. they have not told us the name of the victim as yet. we're also finding out more about the richmond mother facing murder charges tied to an amber alert face. 35-year-old alicia ortez is accused of killing her estranged husband then abducting their three children. ktvu news learned she got a restraining order against her husband last year claiming domestic abuse. a judge lifted the order last

month. now, ortez and a male companion are facing murder charges. >> there will probably be oobl charges but at this point we're mainly focusing on the homicide itself and bringing the children to a safe place. >> police say those children were in the custody of their father at the time of that deadly shooting. the abdukd prompted a statewide -- abduction prompted a statewide amber alert. the children are safe. searchers continue to look for a missing uc berkeley student. searchers from contra costa student have joined the search for 23-year-old cody mathews. he had been staying at the family's cabin in the icehouse area of el tora doe county -- el dorado county. his family said they talked to him last friday before he went on the hike. >> i've had a strong connection with him on the feeling level and i can't read him this time.

that's you have unsettling for me. that's not normal. >> mathews is said to be experienced in hiking. searchers found a footprint distive to the -- distinctive to the shoes he wears. an earthquake hit around 2:30 this morning centered near barstow, 115 miles northeast of downtown los angeles. many people call local police and news media outlets say the jake jolted them out of bed. but there are no reports of injuries or major damage. medical marijuana users in san jose are pretty angry about tough new rules on where medical marijuana dispensaries can do bis. christien kafton is -- can do business. christien kafton is live with

more. >> reporter: dispensaries will be facing some of the tightest restrictions in the state following last night's city council vote. >> 7-3, the motion is approved. >> reporter: the council voted last night to crack down on pot dispensaries. the new ordinance allows current and future dispensaries only to order in select neighborhood. because of those new rules, 70 of the pot dlubs would -- clubs would have to close or move. it's illegal to be in front of schools and daycare within 1,000 feet, hours of the clubs would be curtailed and they would have to grow their marijuana in or adjacent to santa clara county and the marijuana would have to be processed within the city limits of san jose. some support this but say this ordinance goes too far and could lead to voters overturning it at the ballot box. >> i think we need to regulate everything.

first obama administration official to testify publicly about the controversial swap. we're taking a live look right now at the house armed services committee. the committee members are giving their opening statements. right now, hagel has yet to speak. committee members want hagel to explain why officials did not give congress the mandatory 30- day headsup, whether his health was deteriorating and if the u.s. gave up too much for a man who might have deserted his platoon. the u.s. afreed to transfer five detainees from guantanamo bay. >> experts and statements were false. >> reporter: i contacted jackie spear. her staff said they are ready to question hagel.

kyla campbell, ktvu channel 2 news. california's budget deadline is four days away. governor brown and state lawmakers have reached an agreement on all of the major spending issues without the nasty bickering in past years. experts credit california's robust economy and the recent voter approved measure that docks state lawmakers pay if they don't meet the june 15th deadline. they are expected to iron out several other deals this year. the thornniest issue could be overtime pay for those who work for the state services program. the u.s. supreme court has declined to hear a controversial case involving california's prison population. the high court refused to hear an appeal of a court order involving the house of disabled inmates. this week supreme court decision highlights the growing tensions between california and the federal courts about crowding and conditions in california's troubled prison system. 7:16. it's an enormous piece of

saw the wind gusting at travis. have a good delta breeze. some of the higher elevations have come down, 20, 25 degrees. for monday, that equals a cooler forecast for everybody. it will dig into pacific northwest. we'll get the southern edge of it. that's all it takes. that will lift the fog tonight. i think tonight it comes roaring back in. temperatures won't stay there very long even if you have the 80s. this is the fog forecast for tonight. look what happens by tonight. by 9:00, it's already moving inland. i think overnight it goes all the way out maybe to areas that don't get fog. cooler, windy, low clouds. you can call it fog but it's low clouds. 70s for many inland. there will be a few 80s. afternoon temperatures will drop. clearlake, 87. 71 novato. 67 kentfield. vallejo at 68 degrees. 62 sausalito, 75 in walnut creek to brentwood and oakley's

east bay board's approved a 9.5% rate hike effective july 1st. the average monthly bill will go from $46 to about $52. east bay m.u.d. board members said the rate hike is needed to help refinance and pay off the district's $2 billion debt. a big chunk of that debt came from a project to bring water from the sacramento river to the east bay. east bay m.u.d. serves about 1.3 million people in alameda and contra costa counties. 7:24. change your name. that's the very clear message a native-american tribe from northern california is sending to the washington redskins. >> take a look at this. to underscore their commitment to a demand for change, the yocha tribe spent a lot of money on this 60-second tv ad. it aired during the nba final

game last night. they say the redskins name is insulting. >> in my opinion, the r word is derogatory like the n word. >> that tv ad ran in seven markets including here in the bay area, and washington, d.c. despite the growing push, the team still does not want to change its name. they say they've always shown respect to the legacy and traditions of native-americans. the battle over selling the l.a. clippers goes to court today. donald sterling's wife intends to ask a probate court to verify her standing as the head of the family trust and ruled that she had the right to sell the team for $2 billion. two doctors have declared donald sterling mentally incapacitated which shelley's lawyers say gives her full

control of the trust. sterling agreed to sell the team but has pulled that support. he called the nba a band of hypocrites and bullies. a short thyme -- time eeg, nasa postponed to send a flying saucer to test technology that could be tuesdayed to land on mars. a spokesperson said the weather caused the launch to be -- to be scrubbed. the next scheduled launch saturday. nasa has depended on the same parachute design to slow the spacecraft after they enter the martian atmosphere but it needs a new plan if it wants to land heavier objects and even astronauts on the planet. how a decision made by the city weeks ago is adding fuel

when it gets hot. >> right. >> cooler today. things have changed. the cooling continues tonight into tomorrow. i think tomorrow will be the coolest day. thursday into friday, there's a lot of fog out there. it's getting helped along by a system digging in the north. low moving into the northwest has ramped up the sea breeze. temperatures are in the 50s. everything came tumbling down. 24 gusts to 35 at travis. it's a southwest or southwesterly breeze. the low is right there. that's not bad. we could have used that in december, january, february. it's here now. the end result is an increase in the nothing and much, much cooler temperatures -- fog and much, much cooler temperatures. low clouds, plenty to go around. a couple of areas will get the sun. 70s for many inland. a lot of 60s and 70s today compared to the last couple of days. here's sal. >> we have a lot of slow traffic on highway 4 and i just

want to show it to you. the stretch between lone tree and loveridge is five minutes. i want to give you the drive from antioch to concord, it's more like 25 minutes. usually it doesn't take that long. there's a lot of low traffic in your way. unfortunately -- well, fortunately, i should say, i don't see any reason for it. i don't see any a crash -- i'm just looking to make sure i didn't miss anything. now, there is a crash in martinez but that's not related to this. this is just good old-fashioned stop-and-go commute traffic. let's take a look at the bay bridge toll plaza, same thing goes. 30-minute plus delay getting into san francisco. we are not getting that june, you know, little bump in the drive times. the drive times seem to be going up. westbound 580 livermore valley, a couple of earlier crashes. your drive time is also very large. 43 minutes. although, it's improved. it's still 43 minutes from

grant line road to the 680 interchange. let's go back to the desk. police in el cerrito still searching for a man who brutally beat an 89-year-old grandmother in a parking lot, then stole her car. the elderly woman weighs less than 100 pounds and uses a walker to get around. ktvu's alex savidge live in el cerrito now with more about the search for that parolee suspected in the suspect. good morning, alex. >> reporter: good morning. the elderly woman in this case is expected to survive, she remains in the hospital this morning with several broken bones. this assault happened here in the parking lot of this cvs store and as we push in here, you can see at the front of the store, there are surveillance cameras and there's surveillance video that's helping investigators this morning. police say they have identified the attacker but he does remain on the loose right now. this is the man police are searching for, 28-year-old terrance hardy from toekd. police say -- from oakland.

police say he punched the woman in the face and stole her car. it all happened sunday afternoon just outside the store on san pablo avenue. the victim had just gone inside to pick up some medication. she came outside and was getting in her car. that's plen he attacked her, took her purse and -- thes -- that's when he attacked her, took her purse and took her car. friends describe her as frail, she weighs less than00 pound. she uses a -- than 100 pounds. she uses a walker and can't understand this crime. >> why would somebody do this? you don't want me to think what i think they are. they are punks. >> reporter: this morning, police are searching for the stolen car, it's a white 1992 toyota camry with 2 znr 291

california license plate. police want you to be on the lookout for the man, terrance hardy. he was a skin graft on the left side of his head. he faces charms of carjacking and elder abuse. alex savidge, ktvu channel 2 news. another court hearing scheduled today for the man suspected of killing sierra lamar. antolin garcia-torres last went before a judge in may. he's accused of killing 15-year- old sierra lamar who vanished more than two years ago on her way to school. last month, the district attorney announced he will seek the death penalty against garcia-torres even though lamar's body has not been found. he's pled not guilty to the charges. >> in a couple of hours from now, raymond chow is due back in a federal courthouse in san

francisco. the former chinatown gang leader who is in county jail now, he's scheduled to ask a federal jung to release him on bail. now, chow is accused of money laundering and also plotting to sell stolen goods. he's one of 29 defendants tied to the leland yee corruption case. city leaders in oakland are pretty angry after two children were shot in a matter of hours. police say a 2-year-old boy was hit by a bullet monday night at a home on 83rd avenue around 10:00. a couple of hours earlier, a 3- year-old was grazed by a bullet at a bus stop on 66th and international. the police chief of oakland says this kind of violence can't be tolerated. >> we've implemented a lot of strategies to reduce the crimes. >> now, both children are expected to recover. so far, police have made four

arrests in these shootings. they are still looking for possibly more suspects. 7:36. san jose's dome theater on olson drive now has historic status on the city level. supporters of the idea say the dome is one of the few remaining examples of mid century futuristic architecture. but they argue there's nothing historic about the building and the land would be better used for development. the dome is under consideration now to be named a national historic landmark. however, even if it gets, that does not guarantee it will be preserved but it will make it harder for potential developers to tear it down. a pile of trash has led to a big political stink for oakland mayoral candidate rebecca kaplan. the controversy is over a media event last week held in an area that was littered with trash. kaplan used the garbage to highlight mayor jean quan's failure to keep the city clean.

at least one city contractor is criticizing kaplan because she didn't do anything herself to pick up the trash. ken houston says he's so mad he's considering for running for mayor himself. kaplan responded to the claims with this tweet that reads "like so many, i'm concerned about illegal dumping. that's why i co-authored a budget to increase funding for removal." she also claims she did report the illegal dumping online. there is a new twist in the car crash last weekend involving jean quan. an investigation into that crash has uncovered another controversy. this one it affects all of the red light cameras in the city of oakland. brian flores joining us live now. you are in west koekd. there is a strange connection, brian. >> reporter: hi, dave. good morning. we're talking about the red light cameras like the one behind me, right before the entrance on 58 o these cameras are physically here. but something that was recently

uncovered, they are not operational. they haven't been online for about a month. this information was uncoved by the chronic -- uncovered by the chronicle. now, whether or not quan ran a red light, there were questions raised about whether the camera kos have caught what happened. this -- whether the camera could have caught what happened. what was uncovered by the chronicle, none of the lights have been operational. while there were some in the city council who weren't big fans of the cameras, what angered some is this was never brought up for public debate. the city launched a red light camera program in 2008 where they were placed at 11 high traffic intersections, the city cites that the traffic cameras

reduce the number of accidents. it remains unclear how much money the red light cameras brought in in the first place. we have reached out to city councilmembers as well as the mayor for a response. back to you. chancellors from community colleges all over the state, they are showing a support for city college of san francisco. city college in danger of losing it's crede dation at the end of -- accreditation at the end of next month. 50 those signing letters have encouraged them to extend the deadline. they said they would revoke the ccsf accreditation on july 31st. that would force the college to close. the archbishop of san francisco's under fire for planning to go to a rally in washington, d.c. last week. he plans to join the march for marriage. it's an event to publicize the

campaign against gay marriage. critics say it is organized by groups that promote hatred towards gay people. san francisco mayor ed lee and lieutenant-governor gavin newsom are among those urging him not to go. the archbishop has become a national leader in opposing same-sex marriage. 7:41. a serious fireworks accident in san jose is another reminder about the danger of fireworks as the 4th of july approaches. it's a story we first told you about yesterday during "mornings on 2." a 10-year-old boy suffered a major hand injury after getting ahold of a stash of illegal fireworks at his family's home on friday. the boy who neighbors say is mentally disabled apparently lit the fireworks in the bedroom. a neighbor said he heard an explosion and came running to help. >> at first, i thought he cut himself with a knife. no, there are no -- there's no

hand. the hand's blown off. >> the officer found more than 14 pound of illegal fireworks inside the family's home. police arrested the boy's father who now faces charges of felony child endangerment and possessing illegal fireworks. meanwhile, santa clara county is funding a public awareness campaign about the dangers of fireworks. it coincides with the return of san jose's downtown 4th of july fireworks show. there's mott been a show there since -- not been a show since 2008. the rotary club secured the fund to bring the display back this year. california is fighting, trying to stay in the running for that new tesla battery factory. democrats and republicans in the state legislature, they are working together on a bill to offer tesla tax incentives to build what tesla calls the factory in california. the governor of texas met with california republican lawmakers in sacramento. he drove to the meeting in a

7:46. a landmark and very controversial ruling that could have a big impact on california schools and your kid. pam cook is in the studio now with this week's ruling and the angry response from teachers. such a big issue. >> it really is. california's teachers unions are upset about the ruling made by its superior court judge that throws out the long- standing teacher tenure policy. the ruling says several provisions of the california education code are unconstitutional. the judge's decision says tenure cheats the students and that it can protect ineffective

teachers by making it difficult to fire them. nine california students in a group called students matter filed the lawsuit. they claim giving teachers tenure after two years on the job pro-- >> i believe our education system is failing system. it's not putting the children's need as a priority and the management of our education system. >> the child impoverty is going to not have the resources at home or in the community to help them succeed. we need to be working on poverty not bashing teachers. >> reporter: now, the superior dowrt court -- the california teachers association plans to appeal the ruling. in our next hour of "mornings on 2," how california compares

to other states in terms of teacher tenure and how this case could have a ripple effect across the country. 7:47. this morning, we're finding out the fremont union high school district in cupertino is not a stranger to year book problems. we told you yesterday morning about a recent discovery, a student deliberately altered the text in this year's monte vista year book to mock a jewish classmate. according to the mercury news, a similar incident happened at homestead high school. two students hacked into a computer, changed a quote under a senior's quote to a phrase with homophobic overturns. a school district spokesperson says as a result tougher year book review policies were put into place at homestead high school but those policies will not apply to monta vista high. the district is asking students bring back 1600 year books that were passed out so that a corrective label can be placed over the offending caption.

just moments ago. good morning, tara. >> reporter: good morning. we have not seen johannes mehserle come in but we did see rains come in, his attorney. agrant must prove that he had a relationship with his son and number two, that johannes mehserle can intentionally killed oscar grant. grant's father has been serving a prison sentence for a 1985 murder. he's been in prison since before his son was born. but they say they loved each other and his son visited him in prison on a monthly basis as an adult. now, mehserle's lawyer says his client did not intend to kill grant, he pulled his gun instead of his taser. but mccoy says there was intent. >> he didn't want to give a

statement to the b.a.r.t. investigators that morning. he asked for his attorney to be present so they can look at the amateur video which suggests to me that he wanted to put his story together. and in fact, seven days later, he resigned. >> reporter: last month, b.a.r.t. agreed to pay $175,000 to settle a lawsuit filed by five men who were detained with oscar grant on the platform new year's eve 2009. in 2011, b.a.r.t. paid nearly $3 million to grant's mother and daughter. mehserle was convicted of involuntary manslaughter. today, b.a.r.t. is not being sued but rather johannes mehserle as an individual and again all of this testimony, everything should get underway in about a half-hour. tara moriarty, ktvu channel 2 news. >> all right. 8:04. new this morning, san francisco police investigating an early- morning homicide in the

tenderloin district. an emergency call came in around midnight on turk street. when the police got there, they found a person had been shot to death. homicide investigators have not released the name of the victim. we're finding out more this morning about the richmond mother facing murder charges tie to an amber alert as i ka -- case. alicia ortez is accused of killing her estranged husband and then abducting their three children. we've learned she got a restraining order against him claiming domestic violence. that order was lifted last month. ortez and a male compapian are facing -- companion are facing homicide charges. >> there will probably be additional charges but we're mainly focusing on the homicide itself and obviously the bringing the children to a safe place. >> police say the children were in the custody of their father

coming out of livermore, still slow. back to the desk. >> thank you. police in el cerrito searching for a man suspected of punching an 89-year-old woman and stealing her car in broad daylight. alex savidge joining us live. you are outside of the cvs pharmacy where the attack occurred. you just talked to a witness who helped that woman moments after she was attacked. >> reporter: well, dave, good morning to you. i did speak to the woman who happened to be driving true the parking lot of the cvs store and saw this elderly woman being asaulted and carjacked -- assaulted a carjacked. she was one of several who helped to comfort the victim bleeding quite a bit. she remains in the hospital with several broken bones. the police identified the attacker. they are searching for 28-year- old terrance hardy from oakland. police say he's the man who bunched this -- punched this 89- year-old woman in the face and stole her car. it all happened sunday afternoon just outside of the store on pan sab blow avenue --

san pablo avenue. the victim was coming out of the pharmacy and getting in her car. surveillance video shows the victim's white toyota camry being driven from the parking lot after this carjacking. >> he pulled her out, through her -- tossed her on the ground. got into the car, the door was open. he pulled out. she was still halfway out. >> i hope he's off the streets. that was vicious. it was really wrong what he did. it was horrible. >> reporter: friends of the victim describe her as frail. they say she ewhats less than 100 pound and uses a walker. she's still in the hospital. but her condition is said to be improving. police are searching for the woman's stolen car, a white 1992 toyota camry.

to release him on bail. he's in jail accused of money laundering and plotting to sell stolen goods. he's one of 29 defendants tied to the leland yee krupp thun case -- corruption case. a new twiss in the jean quan auto accident case. an investigation has uncovered another controversy, this one affecting all of the red light cameras in the city of oakland. brian flores is live in west oakland with this rather strange connection. good morning, brian. >> reporter: good morning. we're talking with those red light cameras just like the one you see behind me on 27th and north gate. they are physically here but something that was recently uncovered, as you mentioned, haven't been operational. haven't been online for about a month. the information was not covered by the chronicle in an article this morning. police continue to investigate whether mayor jean quan ran a red light on 26th and market late sunday afternoon, not too

far from where we were standing. some are wondering whether a camera caught what happens. this morning we went by the intersection. didn't see a red light camera there. what was uncovered is none of the cameras have been operational since last night. it's caught some by surprise. the paper reports that the city let the contract expire with phoenix arizona based light camera red flicks. while some weren't big fans of the cameras in the first place, it was not brought up for public debate. they launched this campaign in 2008 where 11 lights were placed. it cites that the cameras did not generate enough money to keep it operational. the paper cites the report that says traffic cameras reduce the number of accidents. as we take it back out here live, what isn't clear is exactly how much the cameras

brought in. we heard anywhere between $250,000, over a million dollars. we have tried to reach out to city officials including the mayor also red flags traffic systems. we've not heard back this morning. we're live here in oakland. brian flores, ktvu channel 2 news. 8:37. more than a million people in the east bay, you are gonna pay more for your water service. east bay m.u.d.'s board of directors unanimously approved a 9.5% rate hike. it's effective july 1st. the average bill will go from $46 to about $52. east bay board members say they need the rate hike to refinance and pay off the $2 billion debt. a big chunk of the debt came from a project to bring water to the sacramento river to the east bay. east bay m.u.d. serves 1.3 million people in alameda and contra costa counties. chancellors from community colleges around the state are showing their support for city college of san francisco.

city college is in danger of losing its accreditation at the end of mo next month. now -- at the end of next month. now 50 junior chancellors have signed a letter urging the commission to extend city college's toom line. the commission said it would revoke ccsf's accreditation on july 31st. that would force the college to close. well, san jose's dome theater on olson drive, it now has historic status. supporters say it's one of the few remaining examples of mid century futuristic architecture. however, four city council members argue there's nothing historic about the building. they say the land would be better used for development. the dome is under consideration to be named a national historic landmark. that decision may come before the end of summer. it is 8:39. a 10-year-old boy in san jose falls victim to a fireworks explosion. >> i heard a big old boom.

as he entered the courthouse. grant's attorney must prove that his client indeed had a relationship with his son and that mehserle intentionally killed oscar grant. grant's father has been serving a life prison sentence for a 1985 murder. he's been in cars rarted -- incarcerated before his son was born. his attorney says he visited his father as a child and talked to him on a monthly basis as an adult. >> just because someone is incarcerated does not mean they don't loved ones. i think the jury will get his incarceration has nothing to do with the shooting death. >> reporter: now, last month, b.a.r.t. agreed to pay $175,000 to settle a lawsuit filed by five men detained with oscar grant on the platform in 2009. in 2011, b.a.r.t. paid nearly $3 million to grant's mother and daughter. mehserle was convicted, of

course, of involuntary manslaughter after shooting grant. rain said he pulled his gun instead of his taser by mistake. much more coming up on our noon news. live from san francisco, tara moriarty, ktvu channel 2 news. a landmark case that pits students against teachers and schools against the state. pam cook is in the studio with more. >> came teacher unions are very upset about the ruling made by a judge that throws out the teacher-tenure policy. the ruling says several provisions of the california education code are unconstitutional. the judge's decision says teacher tenure cheats the students and it can protect ineffective teachers by making it difficult to fire them. nine california students, including three from the bay area filed the lawsuit. they claim giving teachers

tenure after two years on the job protects ineffective teachers and often send them into the poorest neighborhoods. a student from skyline high school in oakland is one of the student plaintiffs in the case. >> he didn't teach us anything. just assigned work and he didn't explain the work. >> the lawsuit has nothing to to with what's best for kid. but was manufactured by a silicon valley millionaire and pr firm to undermine the teaching profession and push their agenda on our schools. now, the california teacher association plans to appeal the ruling. i was just looking at all of the big newspapers across the country. the new york times, the washington post, twitter, facebook, everyone is talking about this and how it could have an impact on other states. dave and tori? >> thank you. let's bring sal back, get you to where you need to go.

everybody behaving? >> there's some improvement. there is an issue in fremont. i want to start with the bay bridge. we've seen improvement just as i suspected. you can go back on your dvr and say sal predicted it because he did. that's because the 880 ramp started to clear up. that's the first sign of the clearup, 15-minute drive time which has dramatically improved getting in san francisco. let's go to 880 which is slower than normal. it's very slow. this is the normal crowd getting into san francisco as you close in on 9:00. fremont police just tweeted that there is a problem with a disabled train at hansen. the rail line runs there. you can see it. right where the icon is, that train is distabled. fremont police would like you to avoid the area. it's near a school, there is a little bit of a traffic jam there. let's go to steve. >> thank you, sal. we do have some breaks in the fog. there's a lot of fog working its way up the coast and down

the coast. i think tomorrow it will make a big push inland. maybe all the way to sacramento tomorrow. >> a couple of things going on. it's listed, cooler air spilling in. and a strong low. that will enhance the fog. i think tomorrow is a drizzle day as well. coast and bay. i would not be surprised. 60s on the temperatures. mainly low. these are 10 degrees cooler. you ramp up a breeze, 36, 40 miles an hour. that will do it. mainly a south wind for some in advance of the low moving into the north. there were breaks in the fog. there's a couple. you can see they are joining together as the low inches closer. cooler, breezy to windy a lot of low clouds. it looks like the north bay taking the brunt. it will be cooler with 60s or very low 70s. some pockets of sun on the coast. even well inland temperatures. ukiah, clearlake coming down and even out to vacaville. we'll see these come down more

welcome back. 8:52. the family of jahi mcmath asking her school in oakland to give her an honorary tip ploe ma. she's the 13-year-old girl medically declared brain dead after complications during tonsil surgery at oakland children's hospital last december. she was an 8th grader. her family tells the bay area news group the school will consider that proposal today. the graduation ceremony is friday. city officials in oakland very angry about the shootings of two children just hours apart. now, police say a 2-year-old boy was hit by a bullet at a home on 83rd avenue about 10:00 monday night. and then a couple of hours earlier a 3-year-old was grazed by a bullet at a bus stop at 66th and international. the police chief of oakland says this kind of violence
