street, not far from downtown san leandro. people who live in -- who live in the area are told to shelter in place. i am ken wayne. frank somerville is off. >> i am julie haener. developing news, amtrak is reporting delays because of a deadly accident in richmond. fire officials say a person was hit and killed by a southbound train coming into the amtrak station. this is video from news chopper 2. you can see investigators there at the scene. the train was close enough to the station to off load all passengers who were not hurt. the north bound track is operating. fire crews on the scene of a grass fire on olhone college in fremont. news chopper 2 is live over head. you can see flames are burning right now. the fire burned 5 acres of that very dry grass land. we just saw crews citing back

fires. that is what -- setting back fires. that is what that may be. olhone college is on mission boulevard and it is next to open space in the foothills off 680. crews are in the mop up stain right now. our chief meteorologist bill martin -- stage right now. our chief meteorologist bill martin is tracking the conditions right now. >> very dry conditions. over the last 24 hours, 36 hours, temperatures cooled off. setting the back fires here, it will burn up hill and burn all the potential fuel. the situation at the fire zone, you have winds at 22. that is the story today. a wind advisory is in effect in the fairfield area. san francisco international airport 45 miles per hour. look at the humidity. right? 55%. look at the temperature.

64. look at the wind direction. a moist direction. that is helpful for firefighters. here is the wind advisory till 8:00 a.m. a fire in vacaville, marine, but conditions because of the cooler temperatures can, the higher humidity not as severe as they could be. when i come back we will talk about the warm up, heating up, and i will let you know how that effects fire danger. >> more on the other fires you mentioned. 12 hours after it started crews have a wildfire in marin 80% contained. it started at 5:00 a.m. it burned 35 acres on the north side. cal fire brought in ground crews and a aircraft. hikers were kept away from the fire area. a grass fire is threatening homes north of vacaville. it started around 2:30 p.m.

this afternoon. it burned 70 acres. they sent several aircraft to drop water on the flames. you can see the charred ground is next to homes in the area and homes are still threatened but no homes have burned. it is windy, 22 miles per hour but fire crews stopped the forward progress of the flames. the fire is 30% contained. police are warning the public after a 13-year-old girl was grabbed by three men and raped. ktvu's jana katsuyama is live where she spoke with investigators about the case. we will get more on the story coming up in a couple minutes. a bill that could speed up the process of firing teachers charged with misconduct is headed to governor jerry brown. ktvu's eric rasmussen has been following the push for changes and joins us live in the news room to explain why there is

optimism it will become law. >> reporter: governor jerry brown vetoed a similar effort last year but those behind the new bill are working the governor and they are very hopeful. they passed a b-2 15, it aims to speed up the dismissal process for teachers accused of sex abuse by creating a separate appeals process. hearings begin within six months. even non-egregious cases would be stream lined. the teachers association opposed a ruling declaring tenure rules unconstitutional, the union actually supported a b-2 15. . >> we are hopeful we had a break through. when we can all agree there is certain types of conduct that have absolutely no business

happening at any school. >> reporter: she auththered bill. she said the dismissals process takes too long and cost too muchs money. last month we -- too much money. last month we found it took years before teacher's credentials were suspected or revoked for misconduct. i received an e-mail saying the administration supports this new bill but it gave no time line for how soon governor jerry brown will sign -- governor jerry brown will sign it. eric rasmussen, ktvu channel 2 news. tenure laws are conconstitutional. that ruling -- unconstitutional. teachers unions have promised to appeal. as we mentioned oakland police are issuing a warning after a 13-year-old girl was

gang raped. now to ktvu's jana katsuyama. she is live at oakland police headquarters with the latest on this case. >> reporter: i spoke to oakland police this past hour about the investigation. they are issuing a public safety advisory. the victim is a 13-year-old girl. i will show you a map of where they say this happened. the victim reported she had been on the 9200 block of coral road about 11:00 p.m. on friday morning. she -- 11:00 a.m. friday morning. she said a car pulled up, there were three men in the car. they forced her at gun point into the vehicle and sexually assaulted her. [ audio difficulties ] >> we will look at video, going back and canvassing the area. talking to witnesses and with the family. we will talk with the victim.

>> that was jana katsuyama reporting from oakland. we will have more on this stories tonight on the 10:00 p.m. news. stanford students protested on how they are handling a sexual assault case involving two students and the punishment for the rapist. . >> the student who says she was sexually assaulted helped lead a protest today. the students are upset over the decision yesterday not to expel the student accused of rape. officials say it happened off campus and the suspect is not considered a threat to others. >> expulsion has to be the deful -- default. >> the student will be allowed to finish school though they will with hold his degree for

two years. seats on these buses are being locked up because of a safety issue. finding a seat is getting even tougher. ktvu's christien kafton is in san francisco. they said they are taking hundreds of seats out of use to make the buses safer? >> reporter: regular muni riders say getting a seat could be tough. >> it is horrible. you can't get any seats. people are just standing. >> reporter: regular muni riders noticed there are now even fewer seats. in april they are locking seats up so they can't be used. >> i saw the stickers last week and i was like -- wondering about it. >> the stickers follows a

warning from the bus manufacturer saying there have been three hard breaking incidents where passengers were ejected from the seats and sustained injuries. none of the incidents happened in san francisco but muni took the warning seriously. >> we decided to fold the seats up and keep the passengers from sitting in the seats. >> reporter: he knows the dangers first hand after a bus she was on was cut off by a passing car. >> so suddenly we flew forward. >> the problem is limited to the older buses. newer buses feature barriers like this aimed to prevent passengers from flying forward in a sudden stop. passengers say they understand the need for safety but also say muni needs to find a way to replace those seats. >> they have to do something

about it. >> reporter: right now 80% of muni's fleet is effected. they say the mta is phasing in the new buses with the safer seats. the older buses will be gone in 5 years. right now -- moving on. b.a.r.t.'s board of directors selected two options for its new fleet of cars. one has support pole near the doors and a bike rack in the middle. the second design has poles at the end of the cars and no bike rack. they are ordering 10 cars to be tested. the board made a decision on the fares for the oakland people mover. six dollars a person. the rail extension runs 3-miles and will open up this fall. a simple school prank spark

i don't. i am not a doctor. >> it does not work and it is damaging to people who are subjected to it and undermines people's mental health. >> reporter: his remarks drew angry responses on twitter. he called on him to apologize. they did not respond to our request for comment this afternoon. in san francisco, david stevenson, ktvu channel 2 news. criminal charges will not be filed against colin kaepernick stemming from a suspicious incident involving a woman in his miami hotel room. prosecutors said there is insufficient evidence that any crime was committed and tests indicated the woman was not sexually assaulted. she reported she may have been assaulted after drinking and smoking with colin kaepernick and two other football players. colin kaepernick tweeted said saying as i said from day one i would never do nings that --
