morning commute. a driver stopped his truck and intentionally set it on fire. >> very bizarre. >> reporter: he took this photo as he drove by. >> he looked like he was trying to threaten the firefighters that were spraying him, he had a smile on his face. looked out of his mind. >> a officer with department of homeland security stopped and detained the man. chp arrested arrested the man. he learned a bridge security system alerted caltrans and chp. censors and cameras above and below the bridge provide what officers describe as security awareness superior to any other bridge or highway. >> part of that is a surveillance system that was involved this morning, it is monitored 24 hours, 7 days a

likely related to homeless encampments in the area. the fire started before 2:30 p.m. this afternoon, no one was injured. another fire about 3:30 p.m. this afternoon. news chopper 2 was over head there as well and took this picture of cal fire helicopters making water drops. cal fire also had ground crews working to keep the fire from burning. it was burning near adopey road -- adobe road amid dry brush and trees. three acres ended up burning. san francisco mother arrested accused of driving drunk and crashing her car into marsh with her child inside. the mother is facing a number of charges after the crash. tuesday afternoon she drove off the road and into a tidal pool. ktvu's christien kafton is live at the scene of the crash. this happened in the middle of the afternoon. >> reporter: that's right. you can see the car has been

towed. you can see the tire tracks in the muddy area where the car wound up. when police officers responded she was in her car with her son and hadn't made a call for help possibly because she was driving while intoxicated. the crash happened tuesday afternoon. the woman was speeding -- was speeding and went off the road. neither her or her son were injured but chp found she was driving on a suspended license and officers suspected she was intoxicated and she was arrested and booked. >> she lost control. she placed that child in to a situation that could have resulted in serious injury. in california, if you place a

willie torrence and lawrence denard are on trial for murder. woman pleaded not guilty to stabbing her son to death. police found the 23-year-old ashley newton holding a baby in her arms in april. records obtained by ktvu show she told detectives i am sorry i killed my baby. she will return to court july 17. there was another delay today in a decision on whether to charge mother who is accused of assaulting a boy who was bullying her daughter at school. delia garcia-bratcher appeared in court today. they asked the case be delayed saying investigators are still interviewing witnesses. the judge granted the request. outside the courtroom delia garcia-bratcher spoke with the media and denied the accusations against her. >> reporter: [ inaudible question ] >> yes. i was hoping but i am just going to have to fight for my

afternoon. the 70-year-old female driver was conscious but disorientated. the car went over the sidewalk and crashed into the wall of the san francisco firefighters credit union. it set off the air bags. police are investigating whether she had a medical issue at the time. a strange problem on a muni bus this afternoon. a nearly nude passenger caused a hour long delay about 2:00 p.m. police say the driver stopped the bus and evacuated riders, including children after a 19- year-old passenger stripped down to his shoes and one sock covering his gentles. he said it was legal because he was covered front and back. the san francisco catholic archbishop headlined a match for marriage in washington today. on capitol hill as he told thousands of people to stand by their beliefs in marriage between a man and a woman. >> s of here on capitol hill as people -- i was here on capitol hill as people celebrated. one of the main speakers today san francisco catholic archbishop, he says every child deserves mother and a father. >> there are people who are of good will and are trying to promote what they think is right and fair. it is misdirected. >> the archbishop's message will upset some bay area people who signed a petition calling for him not to attend this rally. the catholic leader said it is easy to become resentful.

that is burning on clayton road, in san jose. we have been watching this for 15 to 20 minutes. there is a house that is on fire there in the 1300 block of clayton. also grass in the area may have caught fire. we are working to send a fire to the area, amber lee hopefully will be arriving soon. the conditions not particularly favorable for firefighters. mid-80s. windy. breezy there. it does look like they are getting at least a good handle on this fire. we will keep you posted. now to the school district, they voted to change the mascot at the school because over the controversy of native americans schools. now they will be called the titans. they approved the change yesterday. it was entired by a decision to remove the name apaches from a

high school. they argued the name was offensive to native americans. a man seeking treatment for burns in santa rosa is now accused of arson and setting himself on fire. witnesses told police the man was setting a car on fire at a mall tuesday night when he started rolling on the ground because his clothes were on fire. he then turned up at the hospital. the man spilled accelerant on his clothes. he is being treated for burns and hasn't been arrested yet. the crookedest street in the world will shut down to all vehicle traffic this weekend in response to complaints from residents. they approved a pilot project to temporarily clazolambert street for four weekends this summer. this weekend visitors will only be allowed to walk on the

a 24-year-old marine veteran who showed courage and sacrifice during a fire fight with the taliban in afghanistan 4 years ago received the nation's highest military award today from president obama. retired corporal william carpenter was deck decorated for w the highest honor for protecting a fellow marine.

nothing short of a miracle. he skis, snowboards and has done sky diving and he is a marathon runner and a student at the university of south carolina and thinking of a major in psychology because he wants to help others. the driver blameled in the crash -- blamed in the crash involving tracy morgan was speeding. the national transportation safety board released a report on the crash that injured tracy morgan and killed his friend. the truck driver was going 65 miles per hour when heplode into the limo. the speed limit was 45 miles per hour. he is charged with voluntary manslaughter. tracy morgan is now in fair condition. a new plan to keep officers on the streets in san jose but not everyone is happy about it. the controversial move with officer over time. >> some students fear their college could be closing with

ktvu channel 2 news starts right now, with breaking news. >> and that breaking news comes to us from san jose. the house fire that is also turned into a brush fire. we have been following this for the 30 minutes. we have updated information. as you can see they haven't controlled the fire yet. it expended to this field and burning that dry brush, temperatures are in the county it is breezy -- 80s and it is breezy. the bad news here is this started, we believe, in two houses. both of those houses have been burned to the ground. it is tough to see in this picture, perhaps as the camera zooms out we will see the homes but they are completely burned to the ground. don't know what caused this fire as yet but the first call came in from the airport for a

structure fire. it went to two alarms. we want to bring in the san jose fire department. are you there? >> i am. i can tell you there are a few firefighters working to fully contain this fire. just putting out hot spots. we were on a different story headed in a different area and we saw smoke and that is why we headed this way. i heard you say there were two homes that were completely destroyed but it is unclear if anybody was living in the homes. 1300 block of clayton road. there were no injuries. the first call came in from the airport for a structure fire, two alarm grass fire. firefighters received aid from cal fire. they are saying it is a total loss but it is unclear whether or not there was anybody living

in the homes. i talked to a couple people that live nearby that come to see the fire, they believe these were abandon homes, maybe there were squatters living here but we haven't been able to confirm that. but they are not looking for anyone and there were no injuries. >> my apologies. you work here for ktvu channel 2 news, not for the fire department. how concerned are they about the fire spreading? >> reporter: i get the sense here that is not a massive concern right now. i asked whether or not the fire was considered to be under control and he couldn't answer that just yet. half a dozen firefighters that are still very actively working to put out hot spots. a complete loss. you can see the remains of what may have been in the homes. it looks like there was

been burned. if we get more information we will pass it along to you. a city having a hard time keeping police police officers. san jose's struggles to keep officers patrolling the streets. a new plan isn't going over well with everybody. ktvu's john sasaki shows us how they are resorting to extreme measures to keep the city safe. >> san jose has hundreds fewer police officers than it should. >> our levels are critical stages. we want to ensure our officers are safe. >> the police department must have a certain number of people patrolling the streets so it is implementing an over time policy. >> they will be asked to hold over for 3 hours. midnights, two hours. we will take volunteers. >> reporter: on top of the 10 hour shifts the officers already work. >> making it more dangerous for

them. >> reporter: lay offs and cuts in pay and benefits. a few years ago there were 1400 officers, now less than 900. >> we have a crop of new recruits. as the department continues to add officers the over time will reduce. >> reporter: leaders are optimistic but it might not be enough. officials expect 300 total officers to resign or retire in the next two years and over time will not likely help retain officers. >> our officers have been identified as being over worked and fatigued. additional burden is dangerous and unsafe. >> the police officers association is saying -- putting the blame on the city. i wish they would put the residents at the forefront and help us to make sure that officers stay with the city of san jose. >> officials say they continue to search for new ways to

recruit more officers. john sasaki, ktvu channel 2 news. >> we wanted to know if other police departments require their officers to work over time. police officers in oakland are required. in san francisco they are not routinely required to except in special cases. new at 5:00 p.m. supporters of medical marijuana gearing up to push back in the south bay after the city counsel adopted new regulation. ktvu's ann rubin is in san jose where she learned about their new petition effort. >> reporter: they say let the campaigning and the fundraising begin. >> reporter: in the war over

cannabis clubs in san jose the next battle is already brewing. days after the city counsel adopted new regulation on medical marijuana, the clubs vowed to fight them. >> we are trying to remove the bad ports of the ordinances. >> reporter: to do that they need a referendum. to get it they need 100,000 signatures in the next 30 days. >> we need to spend a million dollars in the next 30 days. we have to raise it. >> reporter: they raised a quarter of that already and plan to hire between 2 and 300 people to gather signatures. but they are not the only ones gearing up for a fight. >> i am not worried about a referendum. we will win. >> san jose mayor says he will personally mount the campaign against it. >> i will take the lead. we will raise money, organize a committee and do a campaign. >> reporter: he says the regulations are fair, designed

more now on the breaking news. the fire that is burning in san jose at the foot of mount hamilton. we have new information on what may have caused the fire. the fire department says it believes propane tanks may have exploded setting off the fire. what you are looking at is the after math. looks like firefighter have this fire under control. unfortunately two homes have been burned to the ground. the fire burned neighboring grass but looks like the fire is under control. these are pictures taken earlier. there is nothing left of the two momes. we have a -- homes.

we have melanie woodrow on the scene. the type of phone you carry can make you more likely to be attacked. a new report has the numbers on how kill switches on smart phones are detouring thieves in san francisco. similar technology will be used in other phones as well. ktvu's janine de la vega shows us security efforts are still falling short. >> reporter: a worry that many smart phone users have. >> like, um, yeah, you know, you never know. >> reporter: san francisco district attorney and new york attorney general announced what they are calling a major milestone in preventing smart phone theft. google and microsoft will incorporate a kill switch into the next version of their operating system. it allows a user to render it useless if it is stolen. >> technology has to be

food recall we reported on several weeks ago. a colorado woman filed a lawsuit against them. she alleges she contracted salmonella. earlier they recalled chia powder linked to salmonella after the cdc said 21 people were sickened. two were in california. new at 5:00 p.m. students many who are single mothers are concerned that their school could close within the week. talking about briman college. we told you a month ago their campus in san jose shut down for a few days because it owed tens of thousands of dollars in rent. ktvu's noelle walker went to try to get answers about what is going on. >> reporter: it is open today but students tell ktvu their education plan hit a speed bump. >> we have less than 7 or 8 days to pack up and leave and

ktvu channel 2 news starts right now with breaking news. >> we are following breaking news in san jose. two homes have been destroyed in a fire. crews are also battling a brush fire that is slowly creeping towards another home. you can see it on the hill. firefighters are stationed around the building right now trying to protect it. we have been following this breaking news for an hour now. hello. i am frank somerville. >> and i am julie haener. >> news chopper 2 is over head as firefighters are trying to get the upper hand. the flames continue to burn through brush. the fire is burning that foot of mount hamilton. it broke out about 5:00 p.m. we have been watching as the fire burned two homes, leveled the homes, nothing left. we talked to melanie and she was telling us how the wind didn't seem to be a panther but the temperatures -- factor but the temperatures were warm.
