a wildfire burning out of control. we're following developing news as firefighters scramble in a remote area. i'm frank somerville. >> and i'm julie haener. a wildfire broke out not far from napa valley. it's burning in the pope valley area above lake barriesa. we have the developing news from ken pritchett. he's been talking with firefighters trying to protect

farmers farmers -- farm and ranch property. ken pritchett has the story. >> reporter: it is always a sign of a big and threatening wildfire. a tanker was called in to make the stop. from noon to 6:00 p.m. this fire grew to 4 acres. this farmer got a call from his son. >> he called me and said you better get home. there's 200 homes all up in the brush. >> reporter: brush that could not be drier. the fire moved unpredictable. >> the wind not having a direction the whole time has

made runs in different directions. the focus for calfire is saving lives in the path of a fire. dennis pratt and patricia holcumb could not get home. >> i've lost a home before, i don't want to go through it again. >> reporter: firefighters were in place defending their homes and pets left alone. >> i want to get to my animals. i want to get to my babies. >> reporter: calfire says this fire has not burned for some time. and several buildings were burned down, firefighters

believe those buildings were outbuildings. the winds today were not very strong. calfire says this was a drought driven fire. because of the dry conditions out here. in fact, they say it's as dry out here now as it should be in september or october. in napa county, ken pritchett. >> ken, thank you. now to rosemary orozco on the conditions that might help firefighters to get over the fire conditions. >> yes, well at night the winds usually calm down. right now looks like they're coming in primarily from the southwest. i wanted to point to the shade of yellow. you see that that's at the hills up above. right at 10,000 feet i'm tracking temperatures in the

70s with relative humidity at 46%. so in the hills up above some of this could be due to the rising smoke and the fire creating that warmer air up above. for tomorrow morning for those firefighters, tomorrow afternoon will be warm and dry once again. more details now the red cross has a shelter set up for those evacuated by the fire. it's being manned by volunteers of middle town high school. in big canyon. ktvu has new information about a violent home invasion. neighbors of the victim are outraged after learning an elderly woman was the victim of a sexual assault. earlier today one teenager was

take into custody but another suspect is still at large. >> reporter: a 16-year-old suspect was being held here at juvenile hall while the search comets -- continues for a second attacker. the young suspects were armed with a gun when they broke into the home and tied upd the -- tied up the couple. this morning, neighbors cannot believe something so horrible could happen to the elderly couple. >> i cannot believe something like that would happen to someone so sweet. >> reporter: at some point the 85 female was sexually assaulted. >> reporter: the suspect stole the couple's chevy suv and

violent. >> no not that violent. >> reporter: the elderly woman was taken to the hospital and treated for her injuries. police are still looking to see if they can gather enough information to create a sketch of the second suspect. maureen naylor, ktvu news. a jury in san francisco has cleared former b.a.r.t. police officer mehserle of civil rights violations for the killing of oscar grant. the jury rejected a claim by oscar grant's father seeking financial damages for his son's death. jurors concluded the father did not have a close relationship with his son. grant's father has been in prison for murder for his son's entire life. but family members say the jury did not understand how a father could be involved in his

children's lives. the attorney for the elder grant says he's considering an appeal. mehserle reportedly started crying when the verdict was read. the family of bryan stow says they're tired but optimistic as they wait for a jury to decide his case. jurors must decide if the dodgers former owner was negligent and if a lack of adequate security contributed to the attack. the stow family is asking for $37 million to cover a lifetime of medical bills. stow's mother talked about their options if they don't receive damages. >> we're going to have to look at me cuts out bryan's nighttime care and taking care of bryan myself and leaving him

for two hours. barry bonds is getting another day in court and an opportunity to fight his conviction. the ninth circuit court of appeals. it will now be heard by an 11 judge panel instead of a three judge panel. bonds served 30 days of house arrests for giving rambling evasive testimony over the use of muscle enhancement drugs. concerns about crime at an amtrak parking lot near the oakland coliseum. a commuter contacted us saying his vehicle had been broken into twice. it turns out he is not alone. he told his story to amber lee, she's at that lot and the commuter says he's gotten the run around from authorities. >> reporter: now we're at the

commuter parking lot for amtrak. usually it's filled with cars now it's filled with broken glass. a pile of shattered glass here, there and just about everywhere you look in this parking lot. we counted eight spaces where there was evidence of a vehicle break-in. >> it's bad just about every week there's a new pile of glass. four or five cars at a time. >> reporter: nick parks his truck here when he takes amtrak daily from oakland to santa clara. on friday he found a passenger window of his --over his red pickup truck. >> they didn't even steal anything, just straight up vandalism. >> reporter: it's the second time his vehicle has been broken into here. the first time it happened nick says he didn't do anything about it. this time. >> this gentleman here was also hit. >> reporter: he shot cell phone video of the four other cars in the lot that were also

vandalized on the same day. in this case says -- nick says he called oakland police and amtrak but got the run around. >> i got to a call center, the beat cop. and after 45 minutes i got to tell my story. >> reporter: he says they told him to park his car near a surveillance camera. but that was no deterrent. he says he was told to park at a different station. >> what does that mean? you just don't care about this lot? that's what it basically said to me. what i'm hoping is nobody else parks here or amtrak hires a security guard. >> reporter: i've contacted amtrak and police about the break-ins. oakland police says it patrols the surrounding area because amtrak does their own patrols.

bills. federal investigators are accusing team mobile of bilking its customers out of hundreds of millions of the dollars. heather holmes in berkeley now with the allegations of cramming and what customers need to know. heather-- >> reporter: frank, cramming is when businesses stuff unauthorized charges on to consumers bills. and now the federal trade commission is taking team mobile here to task over that practice. team mobile targeted by u.s. regulators. >> i think team mobile is a pretty good company. >> reporter: the fcc claims that the thing that the company is good at charging bogus charges. this charge was found on page 123 of a customer's bill. >> it looked to us like team mobile was trying to get away with a fast one to rip off its

customers and that's just not right. >> reporter: mark tony of san francisco based the utility reform network tells me he's not surprised by the allegations. >> unfortunately it happens all the time which is why customers need to read their bills every month. >> reporter: but who really reads their bill? >> not closely enough apparently. >> reporter: customers did complain about the phony fees. but team mobile failed to act collecting as much as 40% of the charges. the fdc chairwoman saying it's wrong for a company like team mobile to profit from their customers. >> i think the issue of requiring consumers to surveil their printed billing is a difficult thing. so i'm all for simpler billing railroad now team mobile says

they that had already stopped their practice of charging their customers. and they're reaching out to crammed billing victims. it will impose a 1 cent per ounce tax on heavy presweetened teas. the measure needs a simple vote to pass. san francisco is set to vote on a similar measure. squirrels were also on tonight's agenda. berkeley wants to reduce its squirrel population but a suggestion to gas them has been suggested. instead the city council is expected to make it a crime to feed squirrels and other critters punishable by a $1,000 fine, six months in jail or both. squirrels and gophers are releasing a gas that chases

vacation? >> reporter: the school board president tells me it appears the vote could go either way. reporting live in el cerrito, jana katsuyama, ktvu channel 2 news. we had a dramatic drop in temperatures today. at this hour the on shore breeze continues to blow and those low clouds spilling back into the bay. as we get into tomorrow morning i expect they're going to be widespread. well into the east bay, the north bay, down into portions of the south bay. they're going to peel away a lot like today by mid-morning. i think we will see that sunshine. they will hold tough along coastline, and will be mostly gray. as we get into tomorrow morning, temperatures like yesterday morning. in addition to the low clouds i think we will have patchy drizzle out there perhaps along the coast. maybe in areas just inside the bay. that will be for tomorrow morning. may also see a return of it

come thursday morning. we're going to be sort of in this pattern for the next several days before we see a warming trend toward the holiday weekend. 53 tomorrow in pacifica. low 70s for oakland. low 70s expected in fremont and san jose you will check in at 79. these numbers a lot like what we had today. upper 80s in livermore. upper 70s for areas like napa and santa rosa and some of the areas in the south bay. these temperatures again going to hold steady as we get into wednesday and thursday. i'll show you that extended forecast with your fourth of july holiday coming up. >> we'll see you then, thank you. another marmoth appears to be on the lose. one was spotted today on potrero hill near 23rd and rhode island street. officers are asking neighbors to look on the look out for the animal so it can be taken back

today marks the first day on the job for a superintendent of the oakland public schools. he's taking over a district which is struggling in a number of levels. gasia mikaelian sat down with him for a one on one interview and learned why he said there are tough choices ahead.

>> reporter: antwon wilson says he knows the days of being applauded won't last. >> i guarantee you i will never be as popular as i am right now. the new head of the oakland unified school district says he will do whatever it takes to support his two major goals improving graduation rates and getting more students into college two clear cut goals for a district that's clearly struggling. ousd serves some 40,000 students has about 100 school sites and is coping with a $64 million budget shortfall. wilson told us he is starting with the basics. >> if kids do not have access to quality teachers, they do not have access to rigorous curriculum, they do not have a safe environment, everything we look to build on top of that foundation that weak foundation will crumble. >> reporter: before coming to oak oakland was assistant

superintendent of portland schools. >> what we have to make sure is be about graduation and postsecondary success both college and career and being productive adults. productive world citizens. that's at the center of what we do. >> reporter: the new superintendent says he will make the most out of the school resources. >> are you looking into closing more schools after a research found that osd had too many schools for the people they serve. >> we will look at solutions that may lead to the closing of schools and if that's where it leads, that's where we'll go. >> reporter: school board voted to close five elementary

schools in oakland in 2011, the community outcry was great. but wilson says he's asking the community to put emotion aside adding that every decision he makes will be based on community. >> reporter: wilson also says he wants to turn the trend of leaving oakland once their children become school aged. a new add campaign that challenges stereo types about girls is going viral online. >> show me what it looks like to run like a girl. >> the ad is from the feminine hygiene company always.

than 2,000 acres and prompted evacuations in a rural part of napa county. ken pritchett live for us once again tonight with late details from a calfire information officer, ken. >> reporter: right now we're on buck's canyon road at the command center for this fire. joining us now is officer burnett. can you tell us the latest on what's happening. >> reporter: this evening the fire continues to burn. we are making progress this evening though the fire continues to grow. 30% of it is contained now throughout the evening we have bulldozers and crews building a containment line around this fire. >> what about structures. earlier we were talking about five structures and you're still looking into what that is now. >> it does look like most of those were outbuildings, sheds stuff like that. we were talking earlier

about the wind out here. they were shifting making it unpredictable where the fire was going to go with these canyons and hills. but the wind were not that strong. explain to me why that factors into a fire that grew so quickly. >> normally when we would have a fire like this at such an explosive rate this fire grew because of the dry conditions. we're expecting conditions right now that we would typically see in late summer, even early fall. and that's what allowed this fire to grow so quickly and was allowing it to continue to grow this evening. >> daniel, thank you very much. obviously calfire will be out here all night. tomorrow this may go on for several days here as they keep an eye on this fire here in napa county. we'll send it back to you. >> ken, thank you very much. investigators are still trying to determine what sparked two separate fires in san jose. those two fires started miles

apart. one woman told ktvu she saw a young man running from the scene of one fire just after it started. but so far fire investigators haven't said if they believe either fire was intentionally set. the ventura county coroner says a missing firefighter found dead in the los padres national forest had fallen off a cliff. the coroner determined mike herdman died of blunt force trauma. he reportedly was camping three weeks ago when he ran off in the middle of the night chasing his dog. his body was found last friday less than a mile from his camp site. the dog was found a week into the search. there's a story we told you about last night it involves an abandoned building. and for the second night in a row police were out there removing squatters. our crews found officers ordering people out of the former navy building about 8:30 this morning. two of them were later

arrested. earlier a man leaving the building told us that as many as 30 people live inside. he said some had no other place to go. but he says others are criminals. >> it'sed bad. definitely bad. it's evil. there's every drug addict, alcoholic, criminal. the worse are coming just to stay there. because they know they can. >> police say the inside of the building is filled with trash, dirty needles, fee sees and other hazards and that it's been like that for years. neighbors say they want the building torn down. officials are looking into that option. rob roth reports, police are looking into this case as a possible hate crime. >> these two women, jackie and jennifer are bruised, battered and more.

>> i hate that i was going to die. >> my heart is so sad. >> reporter: the couple has been together for about a year. they asked that we not reveal their last name. the couple decided to leave a gay pride parade in san francisco. they said they were walking down ninth street near market. >> this group of guys were in front of us. they said an anti gay slur. >> reporter: then jennifer says she was attacked by five then six men. >> i got kicked 10 times that i could count. before i held my head and i curled up into a little ball. >> i seen a guy left back his leg and kick her so hard in the head it reminded me of a football player kicking off a ball. >> i felt really close to being gone. >> reporter: jackie says she then threw herself on jennifer to protect her and took a

beating herself. she says she asked why is this happening. >> they said we did it because you're gay. >> reporter: jackie suffered a fractured wrist. police are investigating the crime as a hate crime. there were 27 hate crimes reported in san francisco last year. of that 13 almost half were anti gay. police say they are following several leads and are asking any if witnesses to come forward. >> this is the worse event i've ever experienced. >> reporter: the two women say they'll be working with a police sketch artist in the hopes of identifying their attackers. rob roth, ktvu news. noisy groups were able to stop two buses that were

broken up an illegal fireworks operation. officers say he was using a 15- year-old boy as a runner who would retrieve the fireworks from the storage space. police say they confiscated about 100 illegal fireworks that were being sold for about $10 a piece. >> we're talking about a destructive device which it's called an m1000 or m80 it's a small destructive device. you can lose a hand, you can lose an arm. it's very dangerous. >> reporter: prosecutors are charging the 18-year-old with felony possession of explosives and child endangerment. san francisco 49ers linebacker alden smith will not face charges for allegedly making a bomb threat at los angeles international airport. this is cell phone video of the incident. the los angeles city attorney decided not to file charges against smith. police say they thought he may have been intoxicated at the time. this comes as smith is scheduled to be sentenced later

this month on three felony gun charges. he's pleaded noen contest. the nfl is expected to decide if smith should be suspended for the start of upcoming season after that case is done. police in palo alto are looking for a stolen bentley convertible worth an estimated $177,000. the car is similar to this one it's blue and a 2013 model. it was parked on stanford avenue. the owner reported it stolen on friday. the license plate number 6zvp247. if you have seen it you're asked to call palo alto police. a number of new state laws are going into effect today and we want to walk you through some of them. starting today the state minimum wage is going up to $9 an hour. as of today workers can now take paid time off to care for a wider number of family members. the family leave law allows employees to care for a grand

the city council approved a city wide project to park for parking at levi stadium in near by santa clara. mountain view held a rehearsal on how to deal with 49er fans transferring from caltrans to light rail on game days or other events. thousands of fans are expected to take massen transit into hold up -- into mountain view for games. and that's something business owners are looking forward to. >> i'm sure businesses are going to like it the only issue is the parking issue. imagine going home to a space that's no bigger than a shipping containers. that's actually the idea that's taking shape now in san francisco. >> ktvu's john fowler fowler

came within two points of the 17,000 mark today. nasdaq rose 50. today's gain came on positive manufacturers results in u.s. and china. wealth in california and the lack of it 58% of californians say the gap between the wealthy and everyone else is higher than in the past. 25% said it was smaller and a majority are dissatisfies satisfies -- dissatisfied with the way wealth is distributed. 28% wanted an increase in the state's minimum wage. 37% say the current schedule of hikes is adequate. it's due to go up to $12 in 2016. 10% think the minimum wage has been raised too much already. google announced today it has acquired a digital music app called songza. the act competes with pandora. the price wasn't disclosed but
