>> i did, gasia. the court reporter gave it to me own this dvd, 12 volumes, one for each day of these grand jury preegsd that went on behind closed doors. it was a very, very extensive file, and we, as you said, have been pouring over it. again, it gives a lot of details about this case and the disappearance of sierra lamar. let's show you pictures, again, of him. he was arrested for the morgan hill girl's disappearance. she vanished in march, 2012, and her body has never been found. for the first time, we are seeing these documents. they go into great detail about this -- the case against torres. let me show you one key element that we have found, which is very interesting. take a look at this quote that we have excerpted from the file. it says as part of the testimony by authorities, it was sierra's hair on a rope inside garcia-torre s' trunk when it was seized on april 7th of 2012.

now, this was the first time that they had received any piece -- the only time they had found any piece of sierra's body other than where you might expect to find it, in her home, her own clothing, things of that nature. the transcript also talks in detail about the discovery of his vehicle, the discovery of sierra's phone, and also, interestingly, some fibers that were found on her sweatshirt from floor mats in torres's car. it also shows investigators presenting evidence that torres had attempted carjacking and attempted kidnapping to three women back in march of 2009. they do use those women as witnesses in this, and they talk extensively about dna analysis of evidence down to fibers, as we mentioned, in this case. so a lot of information that we're pulling out of this. i did want to tell you that back here live, i did speak to sierra lamar's father earlier this afternoon before we received the

documents. he said he has been made aware these were going to be released. he said he was going to be talking about this with his family, and that we would be talking a little bit later on tonight. he wasn't sure if he would be having any comments, but he did talk to me about his feelings on this day, kind of reliving all of the pain that that family has gone through. so, again, we have a team going through this. 12 volumes of documents with this transcript of the grand jury proceedings, so for the first time, we will see that, and we will bring that information to you coming up on the 10:00 news tonight. for now, reporting live in san jose, jana katsuyama, ktvu channel 2 news. a federal judge in oakland today restarted proceedings in a civil wrongful death lawsuit. he was the 13-year-old boy fatally shot last october. on monday, the sonoma county district attorney announced that criminal charges would not be filed against deputy eric gelhaus. he's the one who spotted lopez

walking along the street. deputy gelhaus said he thought that rifle was real. breaking news just into the news room, santa clara police say a person was killed in an accident with an amtrak train. it happened at lafayette and agnew just before 5:30 tonight. santa clara police and amtrak police are responding to the scene and will bring you any new information as we get it. and we have new information tonight about the deadly crash that shut down highway 17 in the santa cruz mountains all day yesterday. ktvu's ann ruben is live in san jose where she's learned about the man who was killed in the crash, and unfortunately, it's not his family's first brush with tragedy. ann. >> well, originally from santa cruz, dan mcguire was a san jose state graduate and was currently working for triple crown consulting. loved ones described him as both a great leader and a free spirit. >> loved ones are in shock, not

just that dan mcguire's life was cut short, but also that his family was struck by tragedy again. his brother, andrew, was also killed in a car accident. these are photos from a memorial they held from him on the beach. >> he was telling me how close to his brother he was and how, you know, how traujic that was in his life. >> and now this. colleagues saw the accident and feared the worse. dan mcguire's car was one of ten struck by an out of control tractor-trailer on highway 17. he was killed instantly. >> we've lost a genuine soul. >> we respected him for the man that he was and just -- i'm just shocked that he's not going to be there anymore. >> now, chp investigators are trying to determine what happened. they're diagramming the roadway, following up with the company sbt trucking, and inspecting the truck. >> first of aushlgs we're going to do a great investigation, and then we're going to try to be able to come up with the finding as to exactly what led up to this tragic event. >> the driver told us yesterday he jammed on the brakes, but they did nothing to slow him

down. he want ld to apologize to his family and the seven others injured in the crash. >> i'm sorry to the person who lost his life. i'm sorry to all the persons injured during this. >> six of the people injured in the crash were released from the hospital yesterday. the seventh was expected to be released from the hospital today. live in san jose, ann ruben, ktvu channel 2 news. the san mateo county coroner's office identified a man who was hit and killed last night by a caltrain on the peninsula. 33-year-old jordan brinkman of walnut creek was on the southbound train tracks just before 10:00 p.m. at watkins avenue in atherton. according to caltrain and police preliminary investigation indicate that is he intentionally stepped right on to the tracks as the train was approaching. a man suspected of robbing a jewelry store in santa rosa yesterday remains at large tonight. police released new surveillance

pictures showing the suspect inside bennett valley jewelers. he's described as a tall, black man with a heavy build. investigators believe he may have been shot in the leg or lower abdomen during the robbery. now, another suspect, who was taken into custody yesterday, has been identified as 43-year-old jimmy l. carry of oakland. the owner of the jewelry store was injured during the robbery, but is expected to be okay. santa cruz county sheriff's deputies arrested the man accused in an elaborate scam to get underage girls to send him provocative pictures through text messages. 29-year-old scott angelo was taken into custody for allegedly sending the text. investigators say angelo texted one teen posing as her father. the text said his coworker's father had a swim suit line. he then asked for pictures of the girl in a swim suit. investigators say they've tied angelo to dozens of similar texts. angelo lives in sunny vail. we have a crew there looking into the case, and we'll have

more for you coming up tonight at 10:00. an oakland woman is recovering tonight from a brutal punch that left her unconscious outside at&t park. tonight police are turning to the public for help in tracking the man who attacked her. ktvu live outside at&t here with more witness reaction. christina. >> well, witnesses say people did record that fight on their cell phones, but thif no idea who those people are. police are just hoping they come forward with the footage. authorities already made one arrest, and they're hoping to make another one very soon. >> punches were flying in a brawl between fans cheering for the same team near the corner of 2nd and king streets thursday night outside at&t park. >> these people all had a's gear on so it's just silly. it was obviously not a giants versus a's thing. >> cory white works near the stadium. >> they were punching each other in the head and rolling around on the ground and stuff. >> until he says an intoxicated woman was knocked unconscious by a man almost twice her size.

>> i don't know if he was aiming for her or what, but she was right there, and it was just a really solid hit. >> san francisco police say the woman was trying to stop the fight between her 28-year-old friend from san jose and two other men when she got punched. they arrested 31-year-old francisco lopez of sack sashgs but they're looking for the man who hit the woman. he's described as african-american, weighing 240 pounds, act 5 foot 10 and possibly in his 30s. >> this attack is not related to any rivalry. >> white said sporting events don't bring out the best in people, especially when a man is seen hitting a woman. >> i think it's horrible. i think it's cowardly. >> the sacramento man is now in a san francisco county jail facing four felony charges and one misdemeanor charge, but police are now worried about finding his friend and video of that fight. live in san francisco, christina rendon, ktvu channel 2 news. an elderly man accused of trying to kill his former doctor

is going to be evaluated for his mental competency. 84-year-old raymond is facing an attempted murder charge for the shooting at the doctor in april. his attorney is questioning owasa's competency to stand trial, and the court ordered & valuation. prosecutors say he was angry about pain treatment he received years earlier and that he went to the doctor's office in daly city and started shooting. the doctor was not hurt. the state's whooping cough epidemic is expanding, and there's still no end in sight. state health officials said there were 835 more whooping cough cases reported in just the last few weeks. that brings the total to nearly 5,400 since the beginning of the year and double all cases since last year. sonoma, santa clara and continue cost counties have the highest number of whooping cough cases in the state. to lift a ban that prevents gay men from donating blood.

san francisco is one of the 61 cities where the national gay blood drive took to the streets today. gay men gathered downtown with family and friends who donated blood in their place. organizers say it's all an effort to raise attention to the ban, which many say is discriminatory and also outdated. >> we need to move away from reactionary discriminatory policies and -- and make policy based on actual public health. >> protesters also wrote letters to the fda to show how many gay men are willing to donate blood if allowed. the fda ban preventing gay men from donating blood has been in effect since 1983. the agency says the ban is in place because of an increased risk for exposure to certain infectious diseases like hiv. the fda also bans intravenous drug abusers from donating blood because of the same risk. in addition, people who have

tested positive for hep tie tis b are also not allowed to serve as donors. crews will be replacing the sewage pipeline at the south end of willow pass road between galinda and mira vista streets. the work starts monday and should be done by august 29th. she was making dinner when she heard the cries of a child. >> i heard "help" like it got stronger and stronger. >> the quick action that she took that saved a father from drowning. the lone golf course in one of the city's underserved neighborhoods is about to close, but should it? and the one bill that could sink the world famous glenn eagle's golf course. after the break weir talking about a heat up. fire danger coming up, as well. i'll have the specifics. see you back here.

frj breaking news just into our news room regarding a fatal incident involving a train and one person today in the south bay. news chopper 2 here still over the scene in santa clara. santa clara police tell us a person was killed in an accident with an amtrak train at lafayette and ago agnew just before 5:30 this evening. we see santa clara police as well as amtrak police responding to the scene. new information, we understand it was a san jose to sacramento train that struck a trespasser on the track. amtrak is selling us a couple of trains are stopped on the track behind this accident. at this point, vta and bart are nonnorring amtrak customers. if you're driving in the area, there is an active investigation going on tonight in santa clara at lafayette and agnew after one person was hit and killed by an amtrak train. san francisco transit officials are considering a plan to increase a fee for corporate shuttles that use muni bus

stops. the buses used by tech companies have been targets of protesters. the demonstrators say tech workers are buying up properties and displacing families from neighborhoods. in response, the city of san francisco has approved a pilot program to charge a $1 fee each time the buses use a muni stop. now, officials are considering raising that fee to $3.55 per stop. officials say it turns out the buses make significantly fewer stops than anticipated, and the fee was revised to cover costs to implement the program. a world renowned golf course could become a victim of the drought. ktvu's tom vacar went to the glenn eagle's golf course in san francisco today to show us why rising water costs could sink the business. >> for many reasons, the rough doesn't get any rougher than right here at glenn eagle golf course at san francisco's

troubled sun anydale district. by the end of the month, the half-century-old course, lee trevino once called the hardest course in america, could be gone. >> what we're seeing here is a generational shift in the game. >> san francisco native tom shea took over the course a decade ago with a lease that makes him responsible for everything, making the rapidly-delap dated course a money-losing enterprise. and, now, the city is demanding 40% more for water, which could sink glenn eagle, unless the new lease shea is negotiating, gives him better terms like other city courses managed by private firms. >> when other golf courses in other neighborhoods are receiving city support such as utilities, water and labor, to deny this golf course the same is -- is really quite an injustice. >> how do you do, coach? >> not ready for 18 holes. hero for saving the life of a neighbor who almost drowned. rochelle works as a medical assistant in san ramon and says a couple weeks ago she was home cooking dinner when she heard a woman outside screaming that a man was drowning. she says the man had jumped into the pool to save his own daughter. the daughter was safe, but the father was at the bottom of the pool. she says she instinctively jumped right into the water to save the man. >> i got him out of the pool. i saw he had no heart rate, and i just started cpr on him. so i did compression and gave him mouth to mouth. after about two or three compressions, he started to cough up the water. >> tonight an alameda county fire captain told us that you can't train people to do what she did, and he called her a hero. children and adults learn life-saving water safety skills today at an east bay pool.

the contra costa county fire department joined the life guards to show how to save someone in distress in the water. life guards say it's really important for participants to designate an adult to watch the children in the water. >> there's multiple adults around, you know, might think that someone else is responsible. you want to make things clear and who has supervision over the children in the water. >> life guards also say the fences around home pools are important, along with flotation devices for children still learning how to swim. a nice day. temperatures are going to increase as we head towards the bay area weekend. not that warm this week. we didn't have a lot of fires either. we didn't have a lot of poor air quality. we had nice winds, cool temperatures, but that changed as we head forward towards the weekend. the temperatureses will make it into the 90s in some spots, maybe mid 90s in the warmest spots. the fog is cleared from the coast for the time being, but it'll be back tonight as the fog reforms. you isle see it push well inland tonight. the computer model will show that it's going to make a push

back into livermore valley tonight, but i suspect it'll burn off more rapidly tomorrow. i think the inversion, which is what keeps the fog at the coast, is going to shallow out a bit, and it's going to do just that, keep the fg at the coast by afternoon. san jose right now and then san francisco right now. you see the fog trying to reform out there, some showing up on the head lands there. as we head into the bay area weekend,itis going to be beautiful for the most part. with that, air quality is not as great, and fire danger comes up. so tomorrow morning about 4:00 a.m., look at that fog footprint. pretty aggressive. not as aggressive as this morning. this morning was basically everywhere. burns off quickly, and 90s start to show up. so warmer day tomorrow. when i say 90s, they start creeping into our area in eastern valleys of santa rosa and out towards concord. sunday, these reds will be more other napa and concord. but along the coast, it's going to remain cool and mild with a fog of low clouds. 87 in vacaville tomorrow. these numbers on sunday will be

in the 90s. so nice-looking weekend with cool coast, warm bay, hot inland by sunday. and then monday and tuesday, still going to stay pretty warm to hot, and we'll be looking at increased fire danger. that -- point that out, but when you have days like this, the fires aren't as rampant, but when we get a couple hot days in a row, you watch, we'll get brush fires going on sunday and monday and tuesday, as well. it'll be part of the news cast. unfortunately this time of year, driest year on record in the state of california, and weir noticing it because as soon as it gets warm, fire danger goes way up. red flag warning has been dropped in northern california. as we head into the weekend, sunday o your warmest day. coming up on hot bay area monday and tuesday. coast stays cool right through the period. a lot of people live out there. they like the 58, 59-degree temperature, pacifica and san francisco. >> my family was going to stinson this weekend. i think i heard you say earlier -- >> on saturday or sunday? >> they're going tomorrow. >> it'll be foggy. there will be breaks in the afternoon, but it'll be foggy
