dna evidence, emotional interviews and a criminal past. tonight a grand jury transcript is unsealed revealing new details in a case against sierra lamar's killer. >> i think this is one step in the process that will lead to getting justice for sierra and the family. good evening i'm gasia mikaelian in for julie haener. >> and i'm frank somerville. her body has never been found but tonight we're learning how prosecutors are building a case against the man accused of killing sierra lamar.

it's through details in a 2,000 page transcript. we begin tonight with jana katsuyama. she has been going over those documents and spoke to sierra's father. >> reporter: this transcript is really revealing how prosecutors are making the connection. on the tiniest of dna evidence, hairs, fibers and even prior alleged attempted kidnappings. massive search parties and police investigators have been unable to find sierra lamar since she disappeared. today transcripts finally reveal how prosecutors are making the case against the suspect. tonight we spoke to sierra's father. >> the transcript coming out i

think is good in that the public deserves to know as we the family deserves to know some of these details. details such as evidence seized. it was sierra's hair they found in the trunk of the car. >> i was not aware that there was dna found. >> reporter: the case against torrez stands by a tiny thread. skin fibers and hair fibers. the transcript also shows emotional testimony from three women who torrez allegedly attempted to kidnap in march 2009. one victim described the assault. quote he continued to tase me the more i would struggle the tighter his how old would get. and later she said, i started

screaming and yelling and he started punching me in the face. >> i think this is one step in the process that will lead to getting justice for sierra and the family. >> reporter: garcia torrez pled not guilty in january and remains in jail. prosecutors say they're going after the death penalty. court records show that the next court date is september 10th. in san jose, jana katsuyama, ktvu. we spoke to a defense attorney about the case. >> sierra lamar's hair was found in a rope. there doesn't seem to be any explanation for that fact. >> torrez says he never met

lamar. he worked with a landscaper who says he gave him the rope so he could practice tieing knots. new information tonight on an investigation into a car accident involving oakland mayor gene quan. we have video of the mayor driving her suv moments before she collided with the sedan on 26th and market street one month ago. police say all they can determine is that one of the two vehicles ran a red light. we can't say which one. the investigation also ruled out the use of a cell phone with either driver. the time of the investigation isn't known. mayor quan usedded her city issued phone at 5:16 then 5:31, 5:36 and 5:37. we also know she accessed the internet at 5:22. giants and a's faced off yesterday at at&t park one night after the park outside that hospitalized an oakland

woman. ken pritchett is in san francisco with new information on the incident and how police are turning to the public for help in finding the one outstanding suspect. ken. >> the witness says that it was a 200-pound plus man who attacked a defenseless woman. the game last night was between the giants and a's. police say that had nothing to do with it. >> reporter: as katy crosser and her husband were walking to the ball ballpark they were not talking about tonight's game yet what happened at yesterday's game. >> i'm really saddened by what happened because that's not what baseball is all about. >> reporter: it happened across from the ballpark, a woman trying to stop a fight between two men was attacked. >> she was really harmless. >> reporter: a man was helping the woman who appeared drunk. the men started fighting. >> the intoxicated girl stood up and the bigger guy just

turned around and punched her right in the face. she fell right on the sidewalk. obviously knock out cold. >> reporter: the woman taken to the hospital with head injuries. >> we're glad to say that she is responding to her treatment. and looks like she'll be fine. >> reporter: by tracing a license plate, police were able to arrest francisco lopez in sacramento last night. >> at this point we're still looking for a secondary suspect. and we're working with the victims in obtaining information on her whereabouts now. >> reporter: police say the fight was not fan rivalry violence which is clear to cory white. >> these people all had a's gear on. it was not a giants versus a's thing. i don't know what they were all thinking. >> reporter: we talked to a san francisco police officer out here tonight who says he wasn't aware of anything different in terms of staffing. there were a large number of officers outside today as presumably there were yesterday and for most games.

it's important to remember this attack happened two hours after yesterday's game ended. in san francisco, ken pritchett, ktvu channel 2 news. police say they believe that the suspect they have in custody was the one who struck the woman. he's now in san francisco jail facing assault with a deadly weapon and conspiracy charges. a man who robbed a jewelry store in santa rosa yesterday is still on the lose tonight. police released these new surveillance photos showing the robber inside bennett valley jewelers. he's described as a tall black man with a heavy build. investigators believe he may have been shot in the lower leg. another man has been identified as 43-year-old jimmy alteri of oakland. an employee at the jewelry store was injured but is expected to be okay. police are investigating a collision involving an amtrak train and pedestrian. it happened just south of the santa clara station near lafayette and agnus. a train going from san jose to

sacramento hit and killed a man who was trespassing on the track. riders who were delayed were taken to the station. police headquarters in oakland was evacuated this morning because of what they thought might be a gas leak. crews isolated the smell to the heating and air-conditioning system in a police administration building on seventh and broadway. after a full scan of the area, fire officials determined the odor was not gas. by late this afternoon employees were temporarily allowed back inside. the delay did cause an inconvenience to the people who were evacuated. we all have served the public. we know it comes far. >> things happen. you know, okay. come back on monday. >> reporter: no word yet on when the building will reopen for its normal hours. the centers for disease control is taking action after

potentially dangerous lab accident involving deadly diseases. the cdc is shutting down two research labs and stopping transfers of samples to other labs. it says it found five incidents in the past decade where disease samples were mishandled including one that came to light wednesday. the review was prompted by last month's accidental exposure by dozens of workers at amtrak. and california is having an outbreak of whooping cough. a teenager was diagnosed today and shares what to look for. >> reporter: gasia, 5,400 cases statewide and the north bay rate is about seven times higher than average. much of that is opposition to vaccines higher here. but protussis hits those who have had their vaccines especially teenagers. matt blackman makes beautiful

breaking news right now of an apartment complex in pleasanton. it's in the 1300 block of -- road. the alameda county department says they got the call around 9:30. the fire is reported to be burning in the second floor. a second alarm was called immediately. residents started evacuating the complex on their own. we will keep an eye on this situation and bring you more information as soon as it becomes available. a scam tricking teens of texting pictures of themselves. cara liu has the story. and how the man gained the teenagers' trust. >> reporter: it was over a

series of text messages that scott angelo was able to trick teenage girls to send pictures of themselves. it was through tricking them into thinking they were a family member. >> it's not something that a normal person would do. >> reporter: deputies shared some of the texts. one said hey it's dad. this is my new number i had to change it for work. it was followed by another that said, a coworker's daughter has her own swim ware line she wanted me to ask her if you would be interested in helping her promote her stuff. angelo then pretended to be a second person asking the girls to send provocative photos for a potential modeling gig. at least five teen girls from santa cruz county fell victim. so did a girl from indiana and another from maryland. deputies say they confiscated more than 50 photos when they arrested angelo on thursday. >> it definitely transfers to the mind of criminallalty. >> reporter: there was no answer when we went by angelo's

sunny vale home this evening. >> supersurprised. >> reporter: neighbors say angelo lived here with his parents and never seemed to be a problem. >> they're really always nice people. when we see them in the evening they casually talk. they're very friendly and willing to help. >> reporter: angelo posted bail yesterday. as for how he contacted the girls, they don't know but they believe social media played a role. they're asking any other victims to please come forward. yahoo and one of its top female executives are being sued for sexual harassment. maria yang is identified as a

senior -- a woman says that yang forced her to have sex several times and feared her after she refused. initially the municipal transportation agency wanted to charge them $1 per stop but now they're upping that to $3.55 per stop. officials say it turns out the buses make significantly fewer stops than anticipated and the fee was revised to cover the cost to implement this 18 month pilot program. new rules are going into effect to require drivers to get fast track if they want to use toll lanes. the goal here is to cut down on drivers who cheat by using diamond lanes when they shouldn't. starting january 1st. fast track transponders will be required to use the car pool lane and the new toll lanes on 580. similar requirements are expected in santa clara and contra costa counties in the

exhibits this year's fair includes plenty of rides for children. this year's fair runs through frill july 27th. tickets are $12 for adults, $8 for children. pretty significant rain layer out there and tonight. we're getting a big push of cool moist air inland just like we did yesterday morning. we will see a lot of fog tomorrow among but it'll warm quickly. temperatures are going to warm. daytime highs are going to make it to the upper 80s. so the satellite imagine shows fog along the coast. showing up mainly right now along point rays. showing up at the san francisco air. it's blowing pretty hard there. a lot of fog for you tomorrow morning. the winds are issuing that warm air. strong 30-mile an hour gusts.

you see strong on shore cool night breezes. they're going to get cut off tomorrow. that's why we warm up. that's why fire danger is going to go up a little bit. fire danger will become more of an issue. definitely compared to what we've seen. the fire danger is going to ratchet up. computer models show the morning fog footprint. that's a lot like tomorrow but it should get sunny really quick. i think the fog burns off any where even in san francisco by lunchtime. look for the reds they're 90. that's for saturday. look how much further west they come. still going to be cool along the coast. there's going to be more 70s than 80s. warmer still on sunday and into next week. that's a broad brush. when i come back at 10:45. specific temperatures for your neighborhood and then we'll take a look at the increasing temperatures next week.

leaders in israel say they won't stop firing missells into gaza unless hamas militants stop attacking israel first. israeli military officials say they've taken out the hamas command centers and a great deal of their ability to strike israel. the death toll tops 100. the united nation says more than half are civilian. and palestinian officials say 23 are children.

>> we are doing everything we can to minimize civilian casualties on the other side. where hamas is deliberately targeting our civilians. killing as many israeli civilians as possible. >> reporter: hamas struck a gas station. that was one one of more than 600 hamas bombings to date. anne rubin has details on the investigation and tells us why the loss is especially difficult for the victim's family. >> reporter: loved ones are in shock not just that dan mcguire's life was cut short but that the family was struck

again. colleagues saw the accident and feared the worse. dan mcguire's car was one of 10 struck by an out of control tractor trailer on highway 15. he was killed instantly. >> we've lost a genuine soul. >> totally respected him for the man that he was and just, just shocked that he's not going to be there anymore. >> reporter: now chp investigators are trying to determine what happened. they're diagramming the highway, following up with the company and inspecting the truck. >> first of all we're going to do a great investigation and we're going to try to come up with the finding of exactly what led up to this event. >> reporter: the driver told us yesterday he jammed on the brake but they did nothing to slow him down. he wanted to apologize to mcguire's family and the seven others who lost their lives.

six of the other injured were released from the hospital yesterday. the seventh was expected to be released today. and we're learning more about the lawsuit filed by andy lopez' parents. he was the 17-year-old shot and killed by a deputy. last week we found out that the deputy was not going to face any charges. deputy galehouse said he thought the rifle was real. a woman jumps into action to save the man in the bottom of the pool. >> his daughter was right there screaming. >> she tells us about the moments leading up to the rescue. >> city leaders say they detected radiation right here on treasure island. why they say there's nothing to worry about. a reminder you can get ktvu news to go. download the ktvu app, click the i con and then watch all of

radiation has been detected on treasure island. paul chambers live on treasure island where the testing is being done. paul you learned that city leaders learned that there's no need for people to worry. >> reporter: that's right gasia. city leaders say of the units tested so far only one had a higher than normal level of radiation. one reason why they say there's nothing to worry about that unit is unoccupied. since june, 355 occupy and vacant units were surveyed for radiation on treasure island. of those tested, radiation is detected in one unit. >> i don't want to get sick. >> reporter: she's not the only one. this woman who asked we call her julie has lived on treasure island for several years. they're afraid if we speak out

about the contamination they'll be harassed by city workers. still, fearing the results of the test they want the city to take action. >> fleeing the radiation and all the contaminations of. >> the readings are such that it does not represent a health concern but it's something that we want to investigate further. >> reporter: he's not allowed to say which kwraoupt is -- unit is the one that tested positive. but the levels are so low and the effects are localized that there's no threat to others. >> it is a vacant unit. so it certainly does not expose any of the adjoining units or neighboring residents to any sort of radiation at all. >> reporter: you hear radiation and then they panic and they don't necessarily reach out to find the information. >> reporter: some of the units were built where some of the solid waste was dispose. and that's where the high

levels are being found. >> being buried by the soil. being shielded by the unit. the radiation that they emit is not of health risk. >> reporter: there's still 149 other units to to be tested that should be wrapped up sometime in mid-september. i'm paul chambers, ktvu channel 2 news. another costly repair is happening on the new eastern span of the bay bridge. this time it has nothing to do with safety. workers are removing thousands of tiny steel particles from the tower on the bridge. the problem is they're rusting and turning orange. bridge officials say it will cost $1 million to remove the particles and repaint over the rust spots. as predicted california had very low voter turn out. it was the lowest first date. debra bowen says over 25% of registered voters participated. many of the people who voted

didn't cast their ballots at the poll. clerks in two counties started recounting ballots. just 481 votes separate perez and yee. perez called for a recount last week. and since he requested it he'll have to pay for it. the winner will face seringer in the fall election. former calpers chief executive ronosco pled guilty to bribery and fraud charges. he said he took $200,000 in cash and other bribes from a businessman in lake tahoe. that busy man is now accused of trying -- businessman is now accused of trying to influence

watch this, it's a crash course on how not to park a lamborghini. this is security video from a five star hotel in new dehli. the valet crashes into one car, keeps going and finally stopping when he hits a concrete barrier. that lamborghini is worth $300,000. and the owner is asking for compensation but the hotel refuses to pay. a friend of the owner was using the car at the time. the group eviction free sf stages a protest earlier this week. but in a statement issued today the company said tenant mary phillips will be allowed to remain in her home for the rest of her life rent free.

a nationwide blood drive is demanding that a ban be lifted that does not allow gays and lesbians to donate. but officials say the ban is discriminatory and outdated. >> we need to move away from reactionary discriminatory policies and make policy base on actual public health. >> protesters also wrote letters to the fda to show how many gay men are willing to donate blood if allowed. opponents launched a white house petition crawling for a removal. it has more than 7,000 signatures. wall street posed a gain. but investors are wondering if the markets have gone too high too fast this year. amazon is formally asking

the federal aviation administration for permission to start testing drones. amazon wants to use drones to deliver small packages to customers of amazon prime within 30 minutes of ordering. the faa currently has a ban on the commercial use of drones without its permission so obviously amazon would need that permission before it could do so. testing would be done near its seattle headquarters. the start of oakland's summer nights program kicks off this evening. the event is meant to kick up -- there's plenty of free food, games and entertainment. a little dog that had been stranded in a small island in the delta has been rescued. this is a picture of that dog. it was caught using a trap. the the dog had been barking in an island in a slew in stockton for three months. but no one could catch it

he acknowledges value when it's being used for education but he says that much time children stray. >> they need to spend more time reading. >> the fact that i have a device that i can use to access lots of information maybes it easier for me to use that and help kids use it in a process that helps them become better thinkers. >> reporter: students are also concerned about microwave radiation. san francisco police just confirmed to us the second suspect they were looking for is now in custody. police say he was arrested this evening in sacramento. he's identified as 42-year-old anthony rucker. he faces charges of assault with a deadly weapon and battery among other charges. police say he will be extradited to san francisco. the woman injured trying to

it's been pretty cool around here. strong on shore wind, these are the highs that we had today. 85 in antioch. 85 in livermore. pretty cool. look at livermore just 72. high temperatures tomorrow and these inland spots are going to come back into the mid-80s. by sunday it's going to be warmer still. low 90s. so a warm up in store for your bay area forecast. that red flag warning that was in effect earlier this evening for northern california has within dropped. we have fog showing up in many places. hayward, oakland, orinda and oakley. there will be a lot of fog tomorrow morning. the computer model i showed you on the earlier hit. it's just pushing all that fog rapidly inland. that's why fire danger has been manageable i think this week. we haven't had a lot of problems with fire. it's going to change as we head into sunday and monday. temperatures will increase and the fire danger goes up. san francisco tomorrow is going

to top out. for a daytime high in san francisco. not much warmer than 60 or 65 degrees. the forecast then for the next couple of days as this low moves out the high moves in. temperatures go up, highs will be in the 90s on sunday, monday and tuesday. it's not going to be a heat wave. it's going to be quite a bit warmer around here. because it's going to be a very cool week. we had drizzle this morning. we had measurable precipitation along the coast. in the form of drizzle. 87 in clear lake. 78 in san helena. 78 in san rafael. these are warmer by a couple of degrees. inland temperatures mid- and upper 80s. that's the hot spot. there'll be a couple of upper 80s. by sunday you will really notice the temperatures increasing we'll be talking about air danger and even air quality as well. 74 in san mateo. 70 in redwood city. the bay area weekend is finally
