his profile showed he worked in san mateo and new york city. he now works in the netherlands. his son was on board malaysia airlines flight 17 that was brought down in ukrainian air space. his facebook page notes he studied in amsterdam and he moved there in april. it says he has a girlfriend. where comments were flooded. he was on his way to malaysia to meet a family on vacation. >> reporter: she the only confirmed american who was one of the victims of the 298 victims of malaysia airlines flight 17. we spoke to that neighbor, he did not know him. reporting live, cristina rendon, ktvu channel 2 news. >> we have also learned the crash killed a group of delegates planning to attend a

ktvu's mike mibach was in the courtroom today where alton smith addressed the judge. >> alton smith entered in a black suit, immediately his attorney went to work. his made a motion to the judge requesting the three violations alton smith pled no contest to reduced to misdemeanors. the judge ruled in favor of the defense. >> what i care about is danger to the public. i think my office has been faithful to that. you do the right thing. i think it was the right thing to charge it as a felony. >> reporter: the 49er linebacker addressed the judge. >> thank you, your honor. i would like it apologize for my actions. i would like you to know i will follow whatever orders you give me. thank you. >> the judge sentenced alton smith to three years probation, 12 days in jail with one day

her arm causing her to drop her money. police say she grabbed the money and ran to the bus. she faces robbery, assault and abusing a child. the sheriff's department released the name of a man who was shot and killed by ushered yesterday afternoon. the deputy -- by a sheriff's deputy yesterday afternoon. the deputy was responding to a man beating a woman yesterday. he is a 36-year-old, andre milton. the woman was treated and released for her injuries. the sheriff's department said they had a history of domestic violence. to the south bay. new rules go into effect that could force many medical marijuana dispensary to close. they force clubs to reapply for permits. ktvu's cara liu is live in san jose to tell us about the effort to over turn the new

rules. >> reporter: a lot happening today here at city hall. this morning the city began to take applications for medical marijuana dispensary to operate in san jose. officials tell me they received 14 applications as of this afternoon. the city said it is a start of a 12 month transition period and they began anticipating applications today for businesses who want to be in compliance. it was passed a month ago. new regulations include requiring clubs to be a thousand feet away from schools, homes, playgrounds and other sensitive locations. >> until it took effect we had no regulations. go from zero regulations to a frame work that reach as balance between protecting neighborhoods and allows access to medical marijuana, you go from zero to something that for

man forced from his home may have the answer he was looking for. the 97-year-old found himself homeless after his landlord determined he could no longer take care of his room or himself. but as ktvu's rob roth reports she a man with a song -- he is a man with a song in his heart whose fortunes have just changed. [ singing ] >> reporter: if you ask him, he will get out and sing you a song. he will do it even if you don't ask. at 97 he doesn't miss a beat. he was a veteran of world war ii, korea and vietnam. he was living independently at the retirement residents till 11 days ago when he was ordered

to leave. he says he was told he wasn't keeping his room clean enough so when they charged him a $1,500 cleaning bill he couldn't afford rent. he had to go. >> devastating. >> reporter: after being forced out he began staying in motels. until his money ran out and then he ended up here at the napa valley homeless shelter. >> at this point in time i am afraid i am not coming out alive. i said that. >> watching him walk into a environment that no older person should have to be in, that was it. >> reporter: she is a placement specialist for senior citizens. she has been helping him find a place to live. >> they felt he wasn't able to maintain his independent status
