into what happened and tuledges the city was -- it alleges the city was negligence. it alleges the fire was caused by unsafe conditions. they put in a work order for a smoke detector two weeks before the fire and it blames the department of public works saying there were no working fire hydrants. >> we are moving forward in terms of conducting a formal investigation into what happened. >> reporter: the fire department hasn't released its final report yet. it will have information about whether or not there were working smoke detectors in the unit. the city has 45 days to approve or deny the claim. after that attorneys -- after that attorneys will file a

lawsuit. melanie woodrow, ktvu channel 2 news. san jose police are looking for suspects tonight after a man was shot and killed this afternoon at 3:30 p.m. today in east san jose. witnesses tell ktvu channel 2 news the victim was walking with his girlfriend when men hopped out of a vehicle and shot him. witnesses spot a gray suv leaving the area. this is the 21st homicide this year. an officer involved shooting sent one man to the hospital. that shooting happen before 9:00 a.m. this morning at a house. police say they received a call about a rifle dumped in the street. officers saw a man running into a garage of a home. the officer opened fire when the man didn't comply with orders. the man was flown to the

hospital. a point to good-bye for a woman killed -- a final good- bye for a woman killed in a bank chase. misty holt-sing was taken hostage during a bank robbery on july 16. her husband said her sacrifice searched everyone's lives. >> she was the most loving, caring person. i am sure you have heard this over and over again. she just -- she -- she just gave. >> today's memorial was followed by a private burial. the district attorney's office will not final charges against a man who accidentally left his baby in a hot car for hours. ktvu's azenith smith is live where the baby boy was found and she learned why the district attorney is calling this case a tragedy and not a crime. >> reporter: after reviewing the facts the district attorney said the father did not commit a crime and he did not

intentionally leave his son in a hot car. >> everything that happened before this, during the time this was happening and after. >> the district attorney office looked at all the circumstances surrounding the death. the baby died of heatstroke after his father -- heat stroke after his father left him in a car for 9 hours. his actions did not rise it the level of a crime. >> the law would require a certain level of criminal negligence and recklessness and that didn't occur here. >> reporter: the facts show he was exhausted, had a change in routine and thought his son was at the babysitter's house. it was a different story in 2001 when they prosecuted a father who left his baby in a hot parked car. in that case he was convict offend involuntary manslaughter. the district attorney office

cars and most deaths happen during the summer. workers at a san jose recycling facility thought they stumbled on a bomb today at the california waste solution facility on timothy drive around 2:00 p.m. in the afternoon. employees spotted what looked like a pipe bomb and called police. they responded and thought it might be dangerous so people were evacuated and a bomb squad was called in. it was rendered safe and no one was hurt. police are looking for two women tonight who went shopping with someone else's credit card. police publicked this video showing the suspect -- published this video showing the suspect. the victim is from mountain view. investigators say the suspects used the card that evening at a bed, bath and beyond. police are asking for help in

ktvu's david stevenson is live with the effort to end injuries. >> reporter: 34 pedestrians were killed last year in san francisco. this stop light is part of a larger strategy -- larger strategy to make things safer in the streets. >> reporter: san francisco police and officials say drivers have too long treated this as a fryway -- freeway endangering pedestrians. in february a 78-year-old man was killed in a crosswalk. one of 9 pedestrians killed this year. >> it -- [ indiscernible ] >> three, two, one. >> reporter: mayor ed lee turned on a new traffic signal at the intersection and signed off on a transportation bond that will be on the november ballot. $300million is allocated

park. it began saturday near el portal. this fire is only 5% contained. 1 structure has been destroyed and no others are threatened. investigators are still trying to figure out what started it. the sand fire in the foothills east of sacramento is 65% contained. it started friday near highway 49. 3800 acres burned. mostly in steep terrain. 13 homes have been destroyed. evacuation recorders are still in effect. -- orders are still in effect. this lightning we have been seeing in southern california is a concern, the northern california area, the bay area could get some? >> that's right. you see all that moisture, volatile, driving to the north, not over us but by vegas,
