phillip: please be juicy. emotions are running hot tonight after a young man running with his girlfriend is shot and killed on a street filled with children. >> i just can't take this anymore. it's awful. >> good evening, i'm ken wayne in for frank somerville tonight. >> and i'm julie haener. police are searching for a car full of suspects after a young man was shot down in the middle of the street. ktvu's maureen naylor is live to tell us what disturbs neighbors the most.

>> reporter: police tell me they expect to wrap up the investigation here within a half hour. we also have new information to pass on, including more information about the young man who was shot here in the middle of the street earlier today. a purse, a hat, and what appeared to be a handgun were among the items littered in this san jose street, where a young man was found shot around 3:30 this afternoon. >> he appeared to be walking on the street. we're still trying to determine if the suspect or suspects arrived in a vehicle, or were walking always. >> reporter: david he is -- escalara. >> i just can't take this anymore. it's awful. this just has to stop. >> reporter: cathy says escalara was walking to her house. when she herred he was shot, she and her granddaughter came to the area, and saw he was

shot in the street. >> just stay alive, stay awake. >> reporter: even worse, the victim's 9-year-old nephew, watched him lying bloodied in the street. >> to see someone like that, it's sad. it really is, knowing he has a mom, and he has sisters. >> three or four rounds of shots. >> reporter: this woman, who is 8 months pregnant, said she heard shots then a car drive off. she says the biggest concern is the street is packed with children. >> i'm pregnant, i usually walk down the street, trying to get my exercise, and hear something like that, just makes me want to stay home. >> reporter: police say the motive is not clear, for if the violence is gang related. they acknowledge gang tagging and problems repeatly. >> there's always some type of violence going on on that street. nobody wants to walk down that street. >> reporter: police say at this point, no arrests, and they have yet to release any suspect

description. this marks san jose's 21st homicide so far this year. maureen naylor, ktvu, channel 2 news. police in san leandro arrested a man who they say attempted to kidnap an 11-year- old girl this afternoon. the girl was walking at 163rd and east 34th street. she said the man approached in a car and started talking to her. when he opened the car door, he tried to pull her in. the child told a deputy about the incident. the man was arrested. his identity has not been released. also in san leandro, police chased two burglary suspects. officers spent about three hours tracking town the pair as they hopped fences and ran through backyards. news chopper 2 is overhead when officers released a police dog, cornering suspects in a back shed. both of the men were taken into custody. now to some developing news in the east bay where there is a huge traffic backup right

now. the highway patrol has closed two connector maps at the macarthur maze. drivers use those ramps to merge onto 580 east in oakland to hayward, and all points south. all traffic is being detoured toward the bay bridge. traffic is backed up past university avenue in berkely. there is no estimate yet on when the freeway will reopen. it is the peak of tourist season, but tonight, the scenic attractions at yosemite national park are shrouded in smoke. here are still images from the park's web cams. you can see the dense layer of smoke, over a half dome from the fire at the edge of the park. here's the view from the valley, looking at el capitan. with the smoke, you can barely make out the mountains in the distance. highway 120, and big oak flat, the two key roads linking the bay area to the valley have

been closed. the park service says the fire has burned 2600 acres, and is just 5% contained. there are some evacuations in the area, and two camp grounds have been closed. the cause of the fire is under investigation. >> the three day old sand fire is now 75% contained. it's destroyed 13 homes and 38 outbuildings and charred 3800 acres. cal fire says this blaze is still threatening more than 500 structures. some evacuation orders will remain in place tonight. however, some people were allowed back in their homes today. >> like a weight off your shoulders, just not nothing, and not being in your own bed. >> cal fire says the fire started when a vehicle drove over dry vegetation. officials estimate they will have it contained by friday. 2 investigates has learned attorneys representing the family of a mother and toddler killed in a fire in san francisco public housing have taken the first step towards filing a lawsuit towards the

city. ester ioane and her son were killed in the fast moving blaze back in april. it happened in their apartment at the sunnydale housing apartment. the claim filed today alleges the first of caused by unsafe conditions. including a lack of smoke detectors. >> i think for the family what this means is at some point, we're starting to move forward in terms of vindicating their rights, and conducting really a formal investigation into what happened. >> the fire department has not released its final report yet. that is expected to contain crucial information about whether or not there were working smoke detectors in that unit. a san francisco security guard accused -- appeared in court today, faces felony charges including kidnapping with the intent to commit sexual assault. court documents say they dressed as police officers and took two men from a bar in the

mission district. the victims were allegedly driven to the home and handcuffed with their heads covered by a cloth back bag. he is held in lieu of $2 million bail. he is due back in court august 11. the mayor of san bruno is calling for the remove al of the president of the california utilities commission. the city of san bruno reviewed emails and documents. it indicated a cozy relationship between the two, and are asking for an independent monitor to be brought in. >> pg and e has made illegal efforts to infuse the cpsu utility makers to protect the interests. sadly, the cpsu has participated in the illegal conduct. >> we're going to make a determination of what kind of action is required.

let's be clear, we will take action if somebody has fallen short. >> the cpsu plans to respond to the accusations. there are now 99 days until the midterm election in november. political polls suggest there is a good chance republicans will take full control of congress. ktvu's ken pritchett is here now with the numbers and what's at stake for the president. >> democrats currently hold 55 seats in the senate to 45 for the republicans. now what the republicans need are 6 seats to take control of the senate. recent polling suggests they're leading, or competitive in 10 or more senate races. >> when president obama made a quick fundraising stop in the bay area last week, he wasn't raising money for himself, it was for democrats trying to hold onto congress. understandable, as recent polling indicates he's at risk of losing senate. >> the question is, is this going to be a good year for republicans or an incredibly goodier.

>> reporter: the president's approval ratings in the 40s is one factor. >> a lot of the democrats who are runs for reelection have seen their own poll numbers drop. the ratings that everyone's doing now, looking at the national scene is starting to show a pretty good likelihood now that the republicans are going to take control of the senate. >> reporter: red dominates the race as leans republican. three seats where democrats are retiring, are either leaning republican or a toss up. congress returned to work today one week before its summer vacation. with the midterm election approaching, there may be little incentive to reach a compromise on politically divisive issues, such as immigration. >> it is my house speaker boehner and house republicans will not leave town for the month of august for their vacations without doing something to help solve this problem. >> reporter: but cook says more stand still is likely ahead, prior to the election.

the sonoma county sheriff's department released one of the two weekend drowning victims. he drowned when his kayak capsized. the second body was discovered a half hour later near guerneville. an underwater camera was used to locate the remains. deputies say the teen was visiting from texas. >> the search is on for vandals

who broke off sprinkler heads at an alameda baseball diamond, flooding the field. the damage left a lot of disappointed kids in the dugout. >> these young boys and girls came to this alameda summer baseball camp today, ready for action. but they couldn't always the field. vandals had flooded it. >> it disappointed me a lot, because i love fielding ground balls, line drives, getting other people out. >> and you can't do that now. >> nope. >> the babe ruth league maintains it. grounds crews were busy replacing sprinkler heads today. they say sometime over saturday night, someone deliberately turned on a sprinkler system, and broke off the sprinkler heads, sending thousands of gallons of water bushing onto the field for hours. >> this whole area here was a pool of water. >> reporter: these photographs show some of the damage. the infield wet and muddy.

this deal gives buyers and sellers an edge. >> reporter: ken, most people, whether you've bought, or solid, or are planning to, have checked online at one of these sights. today, they say as a result of this merger, consumers stand to benefit in three big ways. today, jeffrey is putting in the final touches, before he, his wife judy, and their realtor put their home on the market. these days, that includes listing with zillow, and trulia. sites this couple already use for selling their home and buying the next one. >> especially in this market, i think thinks go pretty quickly. if and when something comes up, you know how much it is. >> they're very pervasive. there's not anybody who's not looking online. if any clients i meet, they're already done their research. >> reporter: a company spokesman told ktvu today, they

have more than 1,000 employees at their 4 offices nationwide. zillow will acquire the within. in june, zillow reported about 80 million unique visitors. actuala, 54 million visitors with limited overlap. the company say they expect consumers will benefit from greater access. more services online, and on mobile. a big growth area attracting customers like this home shopper. >> i find it really easy to use, and sort of intuitive. it's been great. >> reporter: real estate experts say the sites have changed the real estate industry, giving people instant access to listings, and even demographic, and crime data at the click of a button. the deal does not ensure their long term success. >> the revenue has been pretty strong growth, but neither have made a profit. i think one of the big benefits of this mergen is they will be

able to combine some of their expenses. >> reporter: the shareholders of both companies will need to approve the deal before it's finalized. they expect that could happen sometime in the early part of 2015. reporting live in san francisco, jana katsuyama, ktvu, channel 2 news. we just learned today how much you'll have to pay to park at the niners new stadium in santa clara. the vip parking passes cost $50. nearly all of the lots are right across the street from the stadium. other parking lots will cost $40. if you don't want to pay to park, you can always take light rail, caltrain, or one of the buses through the area. the first 49ers preseason game at home is set for august 17. a teenager is recovering tonight after being hit by a car on his skateboard in fremont. it happened just before 5:00 tonight along passeo parkway right across from central park.

investigators say the teen had just left the skatepark there, when he was hit in the crosswalk by a gray toyota matrix. first responders say the teen was out of consciousness on his way to the hospital, but his injuries are not as bad as first feared. >> he had some head trauma. no helmet on the skateboard, sounds like he probably landed head first on the cement over here at the curb line. went through a cat scan. it does not appear anything is life-threatening at this point, so he got lucky. >> the driver pulled over and stopped immediately. it just appeared the boy glided in front of her, and neither saw the other. >> reporter: new traffic signals today to try to prevent more deaths and injuries there. the lights are at the intersection of sunset boulevard, and yorba street. two other pedestrians were

seriously injured in subsequent accidents. >> it's one of the 6% of city streets that are responsible for 60% of the serious and fatal collision. >> reporter: today mayor ed lee activated the new stop signal to improve the city's aging streets and roads. the california highway patrol began a max up enforcement operation today near highway construction zones. caltran says more than 700 active projects are currently underway, costing more than $11 billion. traffic tickets issued in a construction work zone carry twice the usual fine. authorities say the enforcement effort is aimed at protecting the men and women working along the state's highways. slight chance of sprinkles out there tonight, and again into tomorrow morning, all of that subtropical moisture driving well to the north. is very reminiscent of what

a court decision today clears the way for the sale of the los angeles clippers basketball team. a superior court judge ruled against donald sterling this afternoon. his wife shelly negotiated a $2 billion sale to steve ballmer after the nba banned sterling for his rationally charged marks. today the judge ruled shelly sterling does have the authority to sell the team. the santa clara district has decided no charges will be brought against a father who left his child in a hot car where the child died. azimuth smith says the father

has suffered enough. >> the santa clara district attorney says it looked at all the circumstances surrounding 9- year-old geovany hernandez. >> everything that happened during the time this event was happening, and then after. >> reporter: the baby died of heat stroke after his father left him in a hot car for at least 9 hours back on april 16. the deputy da says hernandez's actions did not rise to the level of a crime. >> the law would require a certain level of criminal negligence, and recklessness, and that just didn't occur here. >> reporter: he legitimately thought his son was at a babysitter's house. she says it's a different circumstance than in 2001, when a man was convicted of involuntary manslaughter. the d.a. office says they were unable to

prove intent. >> on average, three deaths a week through the summer months in the country. >> reporter: the common thread in all of these cases, distracted parents who lead busy lives. a family friend had this reaction to the d.a. not pressing charges. >> thank god. they have suffered enough, i think. i think they have suffered enough. >> reporter: the father has no history of child abuse or neglect. some safety measures parents can do to prevent this from happening, leaving their purse or briefcase next to the car seat, or leaving a toy in the front to remind them a child is in the back. azimuth smith, ktvu, channel 2 news. governor jerry brown has kicked off a three day visit to mexico to focus on environmental cooperation. it includes people from government, business, and economic development. today, governor brown met privately with mexico's government to talk immigration. they also want to create better

new at 10:00, there appears to be a second problem with a new skatepark in san francisco. our crews have noticed an increase in the amount of graffiti at the skatepark. the $2 million park just opened july 1. last week, we told you about neighbor complaints about noise. they say skateboarders are in the park well after the 9:00 p.m. closing time. one neighbor says he hears them in the park until after midnight. the city tells us, it's going to build a taller fence to try to keep them out. the santa clara bomb squad was called in to investigate a suspicious device found at a facility. police evacuated the area. officers say the apparently homemade device was similar to a pipe bomb. they later told us it had been quote rendered safe, which

means they blew it up. antioch police are investigating a shooting that left a man injured. it happened near spalding street. antioch police say they received a call about a rifle dumped in the street. they saw a man running into the garage of the home. police say the officer opened fire after the man didn't comply with orders, he was airlifted to a medical center and no word on his condition. a trove of personal information at bay area junk yards. whether they were involved in accidents, seized by police, or handed over. vehicles still contain sensitive, private documents. >> ktvu's eric rasmussen made some stunning discoveries. >> reporter: $2 gets you on the yard. 2 investigates wasn't looking for a new bumper.

everyone's live, and brought everyone closer. >> today's memorial was followed by a private burial. >> reporter: the federal aviation administration is proposing a $12 million fine against southwest airlines. it all stems from repairs that southwest made in 2006. they were supposed to prevent the aluminum skin from cracking on boeing 737's. southwest put the jetliners back into service even though the faa says they weren't in compliance. the airline has 30 days to respond to the proposed fine. >> it was a mixed day on wall street. later this week, the dow jones industrial average closed up 22 points, while the nasdaq composite fell 4. today's choppy trading came after news that existing home sales fell in june. burlingame based virgin america filed the paperwork for an initial public offering.

a very close call for a mother pushing her baby in a stroller in san francisco. video posted on live leak shows an suv nearly running into the two, as that vehicle drove up onto the sidewalk. the quick reacting woman manages to pull the stroller out of the way. it happened last friday at third and harrison in the south of market area. police say the suv had collided with another car just moments before. no one was seriously hurt. new concerns tonight, surrounding the growing ebola outbreak in west africa.

the deadly disease could easily arrive in the united states through infected travelers. today, the centers for disease control sent out an alert to healthcare providers to help them spot symptoms of the disease. the outbreak is the largest, and deadliest on record. with more than 650 deaths and more than 1200 infected. back here at home, a bay area woman has been adopted the outbreak carefully. she's been adopting a child from sierra leone. she has been preparing for a potentially dangerous trip that se says is worth the risk. >> reporter: hoping for the best, but preparing for what will likely be a difficult journey. >> hand sanitizers. >> reporter: frightened that

20-year-old nick finano of sherman oaks. the victims were either in, or near the lightning. lightning also damaged a home, and a car, and injured a golfer on catalina island. that storm raised the question, are lifeguards here in the bay area prepared for the possibility of thunder and lightning? ktvu's noel walker went to ocean beach today to find out. >> reporter: there are things you prepare for to spend a day at the beach. >> my parents told me that it was going to be cold. >> reporter: and things that can catch you offguard. like when several lightning strikes hit a crowded venice beach in southern california yesterday, injuring 13 people, and killing one man in the water. >> no one expected lightning to strike like it did. really caught everyone by surprise. really uncommon. >> reporter: lifeguards are watching out for hazards beyond the ocean's reach. >> when something like this happens, it makes everyone more aware, up and down the coast.

and it's moving slowly, but it's about 22 miles from the livermore valley. so if you get a sprinkle or two, i wouldn't be surprised. most of it looks like the showers, most of them look like they're going to stay east of our area. most of the bay area proper. the fog will push in tonight. look how warm it is right now. 71 in concord. 73 in antioch. humidities here, 35, 40, 50%. so it's real sticky, real muggy in here. livermore, 72. overnight lows are in the mid- 60s, and low 60s. the winds are coming slightly onshore. we've got wind at fairfield, but not seeing that big robust sea breeze. it's going to be a little stagnant in the morning when you get going, and you're going to be noticing these very mild to warm overnight lows. 65 in antioch. 63 in livermore is the overnight lows, in some cases, these could be daytime highs. the fog along the coast is

there, and it will be lingering nights and mornings. right now, you see clear skies over the bay bridge. for the most part look for the fog to push in tonight. these are the high clouds. that fog is going to push right up to the coast here. you see the high clouds come in overhead. we've got the high clouds, tropical moisture, surface. they're going to meet tomorrow morning about 7:00 a.m. then fog burns back to coast. high clouds linger. partly cloudy, partly sunny. with the humidity around, that's high pressure creating a compressional heating event. it's going to be warmer. humidity, it's going to be kind of uncomfortable. 92, in st. helena, 84 in vallejo. with the humidity it's going to be hotter than that. 86 in santa clara. 86 in san jose. right along the coast, 66 in
