sprinkles. a lot of this evaporating before it hits the ground. something known as verga. we're seeing a lot of that along the afternoon. if we do one last shift here, we've got a few light cells you can see into san francisco. across the bay bridge. so maybe a little bit of drizzle falling there. but this is shifting to the south. throughout the course of the evening the bay area will still have the possibility of getting scattered showers. we'll track what's rest of the system for you. we'll look at which areas received a worthy amount coming up. more information on the case of a girl who says she was sexually assaulted in a public bathroom in the middle of day. it's a story we first told you about sunday. now san leandro police have a sketch showing what the attacker may look like. allie rasmus live with how this suspect looks like. >> reporter: the victim is young. elementary school aged.

she told investigators she went to use the public restroom and a man came up behind her and assaulted her. >> good with faces though. i will definitely keep an eye out. >> reporter: but this face didn't ring a bell to the neighbors we talked to. >> he doesn't look familiar to me. >> reporter: the assault of a young girl has neighbors upset and desperate for investigation. they say having at least some idea of what the perpetrator may look like is helpful. he is described as an african american man with tattoos on his arm. >> i'm glad they have a sketch now. if i see that face or anyone familiar i will definitely call authorities because it's not okay and it's scary. >> reporter: the pool was empty this afternoon. on the weekend it's a big drew for residents. this is where the girl had been playing when about 4:00 she went into the clubhouse bathroom. a man came in and sexually assaulted her. >> you have to have a key to get in there. it makes me think that it was somebody who actually lives here. how did he get in there if you

need a key. so it's kind of, kind of scary. >> reporter: it's one of the questions san leandro police detectives are trying to answer too. >> one of the things that could be, they were a visitor and borrowed somebody's key or the possibility is if they just followed another resident and they were posing as a resident themselves. >> reporter: they're looking at the possibility the suspect lives here. this complex has hundreds of units. investigators hope this sketch stirs somebody's memory or maybe their conscious. >> there's somebody out there that knows who this is. and hopefully they will call us immediately. >> reporter: some of the residents said they would like to get this sketch posted in and around the complex. live in san leandro, allie rasmuss. four people are under arrest in connection with an investment scam that cost some

of their victims a life savings. a fifth suspect is still at large. they offered investment complexes that turned out to be empty store fronts. authorities say they've lost a combined total of at least $700,000. authorities also said the suspects targeted undocumented immigrants because they were unlikely to report the crime. the hotly contested immigration debate is taking center stage in san leandro county. as they discuss housing options with local families. azenith smith with the story. there was frustration on both sides of the meeting. >> reporter: the board voted to meet forward with looking at families interesting in temporarily housing roughly 1,500 minors. tensions ran high at the

thought of it. impassioned pleas with helping what is being called an american humanitarian crisis. >> i have a 12-year-old brother and i cannot imagine him in a detention center. >> these are 12, 8-year-olds, 9- year-olds who have traveled here for hundreds of miles. >> reporter: they're calling on them to help place minors with local families as they overgo the immigration process. >> to allow them to remain in miserable conditions is a policy of massive, serial child abuse. >> reporter: but for almost every person in favor of this idea there are those who are strongly against it. >> this is a slap in the face to those who did come to our country legally. >> this is indeed a humanitarian crisis unfortunately it's also a

manufactured crisis by the politicians here and abroad that are trying to use these children as pawns to further a political agenda. >> reporter: opponents saying the county should focus on problems in its own backyard and this plan could further the immigration problem. >> we're talking about 57,000 children right now. and although you say we're only talking about a few here to be hosted here in santa clara county, it's a few now. are you going to say that we are only going to host those that are in the county now. >> and ma'am clerk. >> reporter: after two hours of debate the board of supervisors with a 4-1 vote deciding to move forward saying the program will help little impact on county services and budget. well this program still needs to be flushed out as to how to recruit families, select the children and the funding. coming up at five o -- five o -- 5:00, we will interview a man who says he knows firsthand

what those detention centers are like. police are looking for a man from windsor who disappeared during a hike. steven michael morris was reported missing. they were all camping in the shasta trinity forest. that's when morris left the group for a day hike and never returned. friends say he did have some power bars with him but wasn't prepared to spend the night when temperatures dropped to the 20s. kayla moore died last year while in police custody in berkeley. her case sparked demonstrations against the police department. in a lawsuit the berkeley police association is accusing the city's police review commission of improperly leaking confidential information about the case to uc berkeley's newspaper the daily californian. the police department is asking for a retraining order to excuse its members from attending commission proceedings until the source of the alleged leak is identified. there are new developments

about that fishing boat that capsized just off the shore at ocean beach in san francisco. the captain is still missing and tonight authorities are speculating that he may have faked his own death. we're also learning that the captain has a police record that includes arrest. and this new information, john this case seems to get stranger by the day. >> reporter: crews right now are waiting for high tide a little over two hours from now to try to bring this fishing boat ashore. this is on national park land and federal officials say it may have to be dismantled. the boat paloma became on shore. >> reporter: investigators today combed through luggage found aboard but still no sign

of tim librant who radioed he was jumping over board with a life jacket. >> never seen him. never seen him before. >> reporter: but fisherman burton says he does remember the paloma said he almost bought it. about the time police say limbrant failed to appear in court for a case of meth possession. >> he has some responsible there to fess up to. other than that, i hope he's alive. >> reporter: we're back live now the coast guard says once it has this boat ashore they'll be able to ensure nobody was trapped inside. commercial fishermen say wooden boats like this one difficult to ensure. the owner is supposed to be responsible for all clean up costs but in this case almost certainly taxpayers will be fiting the bill. john fowler. cooler weather is helping

fire crews battle a massive wildfire in shata county. the eiler fire started last week. the fire was started by lightning and so far it's burned more than 28,000 acres. it's also destroyed eight homes and several other buildings and hundreds more are threatened. but the higher humidity is helping firefighters and they know have that fire 20% contained. the eiler fire is one of dozens burning in northern california. thousands of fire crews are on the ground some of them coming from as far as montana. and an updated look at the areas that could get wet. >> new details about a professor accused of secretly taping students. >> this is extremely concerning because the violation of trust. >> the new hidden camera

disturbing new information coming to light in the case of a bay area professor who police say secretly video taped students in his bathroom. economics professor mark landis is believed to have taped some of those students at a party last year at his apartment. prosecutors say they have video evidence stretching back event further that could bring even more serious charges. david. >> reporter: gasia, landis is facing charges for incident that is happened last year. according to this arrest warrant, authorities believe he may have been taping people as far back as 2011. former san francisco state

university professor mark landis is facing charges for secretly video taping victims. current and former sf state students one of whom found the hidden camera last november and discovered 180 videos on an sd card similar to this one. >> it's extremely disturbing because of the the violation of trust. >> reporter: a passport, last will and testimony, two memory cards with videos dating back to 2011 were recovered from his apartment. a 35 minute video shows the professor placing the camera in his roommate's bedroom. that video captured two people

having sex in that bedroom. 16 were interviewed and said they did not give permission to be interviewed by landis. one refused to place charges. >> this is very disturbing. many don't want their family and friends to know. >> reporter: landis attorney did not return our calls today. he is due back in court september 9th. on ktvu.com we posted the full arrest warrant for you to read. an american two star general was shot and killed today at a military training camp in afghanistan. the pentagon says a man dressed like an afghan soldier opened fire with a machine gun at a military academy in kabul. that's where afghan forces are being trained. today the officers that were killed is identified as harold green from falls george

virginia. the pentagon says he's the highest ranking u.s. officer to die in the line of duty since the september 11th attacks. 15 other people were wounded including several americans and a general from germany. >> possible to eliminate completely eliminate that threat i think particularly in a place like afghanistan. but you can work hard to mitigate it. >> it's believed that the shooter had been serving as an afghan soldier for some time and he was killed during that incident. >> reporter: police today issued a statement acknowledging that they should

have notified the public about the use of drones. to this end we will first develop a community outreach plan before we take steps to deploy the uas. some people in napa were jolted away this morning by a magnitude 3.2 earthquake. the u.s. geological service says it struck at about 5:40 this morning about 3 miles south of napa. the quake was felt as far away as fairfield. so far no word of any injuries. doctors say it's unlikely that a patient being tested for the deadly ebola virus in new york city has actually contracted the disease. this comes as a 46-year-old woman from ohio is being tested for ebola after recently returning from a trip to western africa where that virus has already claimed almost 500 lives. the second american diagnosed

with the disease arrived in atlanta today. she is missionary nancy writebol. she contracted the virus while working as a missionary in africa. >> she's showing signs of improvement, she's showing signs of progress and is moving in the right direction. >> reporter: writebol and american doctor brantly have both been given an experimental drug named zemont. and it appears at least for now that the drug is working. ebola is spread by coming into contact with the bodily fluids of an infected person. the bill will provide millions of dollars to veteran programs. army pilot john cole suffered

brain and spinal cord injuries in a helicopter crash in afghanistan last year. his family says the program has been vital to his recovery. >> coming here is when we kind of saw his recovery just take off. the talking, the eating, his walking has gotten immensely better. >> reporter: the bill was passed after an investigation showed long waits and poor treatment at v.a. facilities across the country. it will provide almost $17 billion for veterans to get health care services outside of the v.a. and requires greater oversight. the family of a cal football player says the university is to blame for his death during a team work out. the warning signs they say the school missed. plus a warriors player gets to stay in jail for his birthday. the charges against him that could get him suspended from the team. if you're so tough, crack this thick slice of

golden state warriors player maurice spraites was arrested early this morning in tampa florida on drunk driving charges. he was arrested around 3:30 in the morning a day after his 27th birthday. he was later released on bond. he's currently under a three year contract with the warriors. mosquitoes infected with west nile were detected in santa clara. so today spraying will begin in

perhaps drizzle. a few light sprinkles here in areas like windsor, rohnert park and petaluma. we had a few light showers falling. looks like it has shifted farther into the lake. as we get into areas like san francisco, this darker shade of green here pulling up the possibility of maybe a few scattered showers falling over san francisco. over the downtown area. as stretching into alameda maybe a little bit of drizzle for you. the center of the storm still over california. moving its way into monterey. that is going to leave the possibility of that wrap around moisture coming right through the bay area. so isolated showers will remain for us. let me run you through the futurecast model. as we get into the evening hours you can almost see how it comes this direction and then shooting down. we wake up tomorrow morning we don't see anything here on the futurecast model but with all this cloud cover in place, i think we'll have patchy drizzle. maybe everyone a few showers.

and college athlete who collapsed during practice. the family filed a lawsuit today they claimed there were warning signs that went unnoticed. and they're raising new questions about a trainer for the team. ken wayne now with the questions for the team. >> reporter: his family's attorney filed a lawsuit today against the uc board of regents. >> we filed a lawsuit in a tragedy that should have never occurred. >> reporter: the agu family gathered with their attorney. he was nicknamed premed ted because he wanted to be a doctor. family lawyers say football staff should have recognized the 258-pound agu was in

danger. >> unfortunately ted lost his life due to the lack of supervision and training and by the cal medical and athletic staff. >> reporter: an office revealed agu suffered sickle cell anemia but his death was caused by a heart condition something that should have been detected by an ekg prior to him joining the team. a doctor for sports medicine who worked with cal athletes in the past says an ekg can usually spot such a heart condition. >> it's not standard care and the american heart association does not recommend it officially, but i think with every passing year people understand there's tests out there including the ekg that can be useful in screening. >> reporter: lawyers say agu's trainer at cal was the same trainer linked to the death of another player at the university of central florida six years ago. erik planter died during practice in florida in 2008. >> the trainer in orlando florida where that young man

died was named robby jackson. it's not a similarity of names, it's an identical person. >> reporter: the cal athletic department put out a statement late this afternoon saying quote, while we cannot discuss any student's specific medical history we follow protocalls for student athletes with identified medical conditions. i asked the call department if agu had an ekg, they said they didn't know. ken wayne, ktvu news. an arrest warrant has been issue for a man who richmond police say shot two people. investigators say 18-year-old demetrius robinson rang the bell and then began shooting when the door opened. a 2-year-old and a man in his 20s were wounded. two small children were also inside the apartment at the time but weren't hurt. all is clear tonight after

a garbage truck accident in walnut creek snarled traffic and sent a driver to the hospital. the driver was heading south when he hit a pickup truck during lane change this morning. the waste management truck then crashed through the center divide and ended up on its side. three southbound lanes and two month bound lanes were blocked. the other driver suffered minor injuries the lanes were cleared by mid-afternoon. ktvu's maureen naylor is in san jose to explain why members of the city council could not agree on how to spent all that extra money. maureen. >> reporter: frank, both sales tax measures failed late this afternoon including a general sales tax and a more specific one to give money to public safety. what's interesting, there was enough support on the council for a increase but the city leader simply could not agree where the money would be spent. the council first voted about 3:30 this afternoon on a

general sales tax where the money would go to public safety, libraries and roads among other things. after that failed they voted on footing a quarter sales tax. that failed. but council members were divided on their support and opposition between the two items. >> i'm not surprised. we recognize that there's a different of opinion here. and i would expect there's folks playing this in various forms politically and that's just what happens. >> reporter: sam liccardo was in support of the public safety sales tax measure. his opponent supervisor dave cortezi had pushed for the general sales tax. we have reached out to him for comment as well. this means the city will have to wait until 2016 at the earliest before they'll have the opportunity to put a general sales tax increase on a ballot before voters. live tonight in san jose,

maureen naylor. u.s. stock markets fell today to their lowest levels since may. the dow closed down 129 points. investors are apparently worried about rising tension between russia and ukraine. an accident between two double decker sightseeing buses in new york injured 200 people. it happened in time square and the force of the crash brought down a light pole. all but one victim was on the street at the time of the accident and most of them were hurt by the falling traffic light. three of them suffered serious injuries. right now the police department is investigating. mike hahn is no longer on a list of most vulnerable house members. since may the political sight roll call has listed hahn on the list. fellow democrat rocana under

hundreds of people can finally pick up their cars that were damaged by the massive flood at ucla. repairs on the pipe that burst were completed yesterday. starting today a new fda labeling requirement for gluten free food went into effect. manufacturers must now ensure that anything with a gluten free label contains less than 20 parts per million of gluten. that includes ingredients made from wheat, rye and barley

carmont hotel. the star grocery which was just hit by at least one vandal. a store employee gave us photos of the damage caused by someone throwing rocks through two store windows. it happened on july 22nd. while the owner and employees were surprised by the attack, they found that there was more to the story. they found on a website that they were targeted by an animals rights group because they sell meat. >> they commit many of these acts so it's a serious situation. >> i don't think breaking a window is going to stop anyone from eating meat. it's not going to stop this

store from selling meat. if anything it just makes animal rights activists look extremists. >> reporter: the person who posted on the bite back website goes by the moniker lone wolf. repairs the store windows cost about $1,300. john sasaki, ktvu channel 2 news. an investigation is under way in redwood city where police say vandals set fire and spray painted an elementary school. fire crews responded to a small fire on the campus of taft elementary. the same people who started the fire also vandalized the school. police think the vandals are teenaged boys between 14 and 15 years old. anyone with information is asked to call police. large truck carrying parts of the old bay bridge crashed in oakland this morning. it happened on third and market. the large truck overturned and came to rest on its left side. our news chopper 2 was overhead just moments after the accident happened you see the truck on

its side. the truck was hauling trash to sester field. a young black bear cup is recovering at the lake tahoe wildlife center after suffering some serious burns during a wildfire in washington state. we want to warn you here that some of the pictures are pretty graphic. the cub was only 27 pounds and was severely burned on all four paws and was actually walking on her elbows. a homeowner found the cub and with the help of the department of wildlife she was flown to california. apparently the bear specialist from the department of fish and wildlife in washington had heard about us and he called and asked if we would be willing to day care care of this one. >> reporter: veterinarians say cinder is healing but that she's weak and underweight. if all goes well they hope to return her back to the midwest

and returned to the wild. the man who found her found her under her his home and gave him apricots and took her to the vet. and we have a few showers for the next 13 hours then we're going to be warming it up. i was hoping we would see a few scattered showers overhead. lets go back to the satellite and radar early this morning. several areas reported measurable rain. concord, areas right around novato and petaluma. we get into parts of the north bay this is where we have seen it pretty much all day long. over santa rosa and windsor. but only trace amounts being

reported at a time. so most of this is just very light rain. perhaps not even hitting the ground at times. might have a little bit of drizzle. we had a little bit earlier right around tiburon be that has since evaporated. maybe you had a few patches of drizzle fall over your area in the last half hour or so. tracking some in san francisco, stretching across the bay view district and into alameda. we had a few bits of green here earlier and now it looks like it is shifting over parts of oakland and moving on. but again some of this not necessarily making it all the way do the ground but this is what we're going to see over the next several hours. as we get into wednesday morning we will still have the possibility of a few scattered showers. it has to do with the low that is making track toward monterey. as it does, the circulation around that low continuing to dry. that wrap around moisture right through the bay area. so for tonight and into tomorrow morning. we have the possibility of scattered showers for us thunderstorms will remain in the sierra. if this is going to be your

report their spending. but the site was actually off by $619 billion from the government's actual output. and depending on the department only two to 7 percent of spending was fully accounted for online. >> that's almost half the size of the discretionary budget. it's about the same size as the entire pentagon's budget. it's a lot of money. the audit says even the white house failed to report programs that it oversees to the website. federal officials say they will be making changes based on this investigation. new at 5:00, a new pilot prisoner transport program is under way in san francisco and the sheriff says so far so good. the new protocall puts sheriff deputies in charge of bringing prisoners to the county jail. instead of san francisco police. as ktvu's claudine wong reports, the hope is it will keep more san francisco police officers on the streets.

>> reporter: it's a new routine. and a new assignment for deputy sheriff rafael cabrera. >> i was assigned to the san francisco general hospital. >> reporter: but now several times a day he hits the streets. >> so right now we're heading to the tenderloin police station. >> reporter: his assignment all part of a new pilot program with sfpd. these deputy sheriffs transport prisoners from the tenderloin to mission statement to the county jail. it's something sfpd officers normally have to do themselves and it can take a while. >> up to two to three hours for a police officer to arrest, detain, and then transport and book somebody in the county jail. >> reporter: the sheriff says if sheriff deputies do that job instead, san francisco officers can spend more time on the street. >> very welcomed. very welcomed. >> reporter: the pilot program costs nothing says the sheriff. >> it's a stretch for us right now but as i committed, we will
