p.m. >> a smiling mother, a playful girl, the day this picture was taken the two were killed in a crash by a drunk driver. and today the man police say killed them was charged with the crime. a long list of crimes. good evening. i am julie haener. >> and i am frank somerville. >> 9 different charges including two copt of murder. -- counts of murder. he killed the mother and her daughter while driving under the influence. new at 6:00 p.m. ktvu's john sasaki is live from concord and the family is speaking out now. >> her father has a lot to say and this is where it happened on this bridge. >> she was the apple of her grandfather's eye. >> lovely baby.

every time -- all the time with me, they play. >> this video of the girl and her mother was taken the day before they died in concord on june 27. >> my first granddaughter. >> reporter: the pair were in a car when they crashed into an suv heading in the opposite direction in their lane. >> while driving over twice the legal limit with alcohol in his blood, crossed over striking her car head on killing her and her daughter. >> reporter: today the man who had a blood alcohol of .195 was arraigned today. two counts of murder and voluntary murder and -- vehicular manslaughter. >> he was warned. >> reporter: he pleaded not

guilty to all charges. >> he was a time bomb ready to go off. >> if you want to drink, fine, don't drive. >> reporter: this is the final picture of mother and daughters hours before the crash posted to facebook. his next court appearance is september 15. john sasaki, ktvu channel 2 news. the sheriff's deputy who shot and killed a 13-year-old is returning to duty. he will earn to full patrol duty next week. he was placed on paid administrative leave after he shot and killed lopez when he mistook the teen's pellet rifle for an ak-47. they look identical. earlier the district attorney announced no charges will be filed in the case. this weekend community members is planning a demonstration to

protest his return to patrol. happening now, a protest planned for oakland and right now a small group of people are gathering. these are live pictures from news chopper 2. that is in support for the people of ferguson, missouri. that is where angry crowds demonstrated every night since a unarmed teenager was killed last weekend. in ferguson, missouri today the situation remained calm so far and tonight there is new information about the shooting of michael brown. the police department there eare lease -- released the name of the officer who fired the deadly shot. darren wilson has been interviewed twice since the fatal shooting. police announced today michael brown was a suspect in a robbery and released surveillance video of the crime. police say this video shows michael brown and his friend stealing a box of cigars worth

just under 50-dollars. the robbery happened 10 minutes before the shooting. when the officer confronted him there was a struggle and that is when brown was killed. the family is outraged the video was released. >> the family feels that was strategic. it was a character assassination attempt. that is the sentiment of everyone. they think the timing is suspect. >> regardless of the timing the friend who was with brown when he was shot confirmed they had taken part in the theft scene in the surveillance video and once again we are monitoring the demonstration that is getting underway in oakland. if anything happens we will update you. we are learning new details about a man accused of stabbing a woman on a a.c. transit bus.

tonight the suspect's father is talking. his son is behind bars without bail following had incident on monday night in berkeley. ktvu's cristina rendon is live from where it happened with what the father is saying about his son and about the victim. >> reporter: i spoke with his father outside of court this morning and he is absolutely heartbroken. he says his son had a history of mental illness but he was off medication and risk on the streets. -- living on the streets. >> reporter: seeing is his son in court is not the life he imagined for his son. >> it hurts any father to have somebody go out and harm somebody else. >> reporter: he was devastated when he heard he was accused of stabbing a passengers on autobus monday -- passenger on a bus monday night. >> the nature was -- it hit the heart. >> reporter: the victim a woman

was stabbed in her eye, right arm and left leg but survived thanks to a passenger. >> i thought it was over. i thought my life was coming to an end. >> reporter: his son battled with mental health challenges since three. he was homeless and off his medications. >> there were many times i had him institutionalized. >> i have anger issues myself and i would never walk up to anyone and try to take their live. >> reporter: he doesn't want to diminish his son's actions. his heart goes out to her and the man who saved her. >> i don't want to take away from that. i am grateful to god that she is still with us and i can't imagine what they are going through. >> reporter: he is charged with

attempted murder and assault with a deadly weapon. he also has a prior conviction of burglary and in that case his son was deemed incompetent to stand trial. cristina rendon, ktvu channel 2 news. police and the chp are investigating after a woman stole a taxi cab and drove the wrong way down highway 4. this video shows the taxi driving east in the westbound lanes. the 40-year-old caused two crashes and forced officials to shut down the highway. in both collisions drivers tried to avoid hitting the taxi. there were multiple minor injuries. they believe drugs may have been a factor. the southbound lanes of highway 17 are back open after beg shut down for two hours. a tree fell across the lanes.

these pictures from news chopper 2 show crews working to clear the rode way. it came down -- roadway. it came down before 2:00 p.m. highway 17 southbound didn't reopen till 4:00 p.m. this afternoon and by then the traffic was a mess. music fans spent hundreds of dollars to see paul mccartney close down candlestick park last night. some were left stranded outside stuck in all the traffic. ktvu's david stevenson is live now with the story of one fan who is now fighting mad. david? >> reporter: that fan is one of many who described a traffic nightmare last night and she wants her money back. traffic a parking attendant told her to go home. >> the parking attendant said they were turning away thousands of people. >> the california highway patrol told us it responded to several crashes near candlestick park along with disabled vehicles and scalpers walking along highway 101. it contradicted to a traffic tie up that was caused by thousands of music fans unfamiliar with parking around the stick. >> i can tell you the traffic plan to get in and out was the same as it was at the jay-z concert. >> she says the city should have done better planning. >> i assumed the parking lot was full because tailgaters game without tickets. they didn't want to go to the concert. they just wanted to have a party. nice music and fireworks. >> reporter: police say paul mccartney delayed the show start by 45 minutes to try to

think is the same people. surveillance video shows the latest drop early monday morning. you can see two people in a white suv dropping off several boxes of cats and kittens. one person rings the door bell and both take off. 15 minutes later a worker found the cats. >> we don't know, it could be somebody who collects cats and doesn't think to get them spade or neuter. they were likely kept indoors. >> the shelter says the same vehicle dropped off cats three previous times and workers are now back to spaying and microchipping every cat to get them ready for adoption. sea world said it is building larger enclosures for killer whales because of fall out from a documentary.
