as we start with the east shore freeway and talk about 80 westbound. the traffic is looking good. there is no vallejo ferry, 7:00 ferry to san francisco. they are running bus service instead. also looking at bay bridge toll plaza it's backed up to a 15-20 minute drive time heading into san francisco. 580 westbound coming in through the altamont pass see some slowing already in the past. when you get to livermore it does look okay. if you are driving on the dun bar ton bridge or san mateo bridge, so far those commutes are good. let's go back to the desk. >> happening now the start of a day long protest against a deadly police shooting in san francisco. the family of alex nieto is questioning the officer's account of what happened.

ktvu alex savidge is in san francisco where the sunrise ceremony began about an hour ago. >> reporter: it has been an emotional morning for the family and friends of alex nieto. they are taking part in a sunrise ceremony in honor of the 28-year-old that was shot by san francisco police here at this spot several months ago. several dozen people are taking part in this ceremony. there was a prayer service here a short time weak million nieto supporters are calling for police to be held accountable for what is an unjustified shooting. the city college of san francisco student was shot by police back in march after he pulled a taser on officers. police thought he had a gun. witnesses reported lesseing nieto acting erratically and threatening people as they walked by him. but his family and friends don't believe that version of events and they say officers

over reacted. >> the goal is to have justice for the murder of nieto. seeing the cops that shot him get some kind of punishment because ten days isn't enough time to review why somebody took somebody's life. >> reporter: nieto's family is planning to file a civil rights lawsuit against the san francisco police department in connection with this shooting. and there is also more action that is planned later today at noon. nieto supporters are ing to march from bernal heights park down to the san francisco federal building where the lawsuit will be filed. and at 3:00 this afternoon at the federal building there will be a rally held there. this sunrise ceremony will go on for an hour. live in san francisco alex savidge ktvu channel 2 news. the national guard is

leaving ferguson, missouri. missouri's governor gave the order after another calm night following nearly two weeks of protests and violence over the fatal shooting of michael brown. the captain in charge of security in ferguson says the city has turned a corner. late last night he spoke about what he called symbols of progress. >> when we can see a table with a coloring book, a box of crayons, and a sock puppet instead of weapons and molotov cocktails, this is what defines a community. >> the highway patrol reported seven arrests yesterday but that is compared to 47 on tuesday. time is 6:05. we are following developing news from southern california. a police officer in san bernardino in grave condition after a shootout with several men. this happened about 2:00 this morning. police say two offices were patrolling an area known for criminal activity.

they confront the six men on a dead end street and shots were fired. one of the officers and one of the suspects were hit. that suspect was pronounced dead at the hospital. that officer is in surgery right now. happening today the 49ers will be putting in new sod at the team's new stadium in santa clara. the niners want to make sure the turf will be ready for the chargers. tara moriarty is join us live from levi stadium. tara. >> reporter: we understand that this turf is being put in as we speak. there is truckloads of it here. for all of the money spent on levi stadium, the turf simply wasn't cutting it. players say it was dangerous because it was coming up in chunks. wish you could twist an ankle or tear a knee. this afternoon we were able to get these images from news

sand base fix. live from santa clara. >> then the 49ers take on the chargers at 1:00. and join us after the game for the point after. new information on a fire that killed a woman and her three-year-old son. fire investigators have ruled the fire was accidental but they don't know the exact cause yet. investigators say an electrical outlet showed signs the fire could have started there but they also suspect disguarded smoking material or items piled on or around the heater may have been the cause. the report also found smoke detectors were missing. they were later found in a kitchen cabinet. 2 invests obtain documents that show a work order for one smoke detector had been put in two

weeks before that fire. but the electrician wasn't able to get access to the apartment and the smoke detector was not repaired. the victims family has filed a claim against the city. san francisco police are searching out to the public to help solve a brutal beating death in the city's dubois triangle neighborhood. this was taken shortly before brian higgins was found beaten on a sidewalk almost two weeks ago. investigators says the video shows a man chasing higgins who's image is blacked out. >> we don't see the altercation. but there is some sort of an altercation. higgins was part of a gay spiritual group called the rad can ferries. his family took him off life

support last week. police are searching for a group of men that beat another man unconscious and stole his cell phone. this happened on 16th street near mission. a man was approached by six men. they kicked and punched him until he fell to the ground and was unconscious. when the man broke up he had a broken tooth and his phone was missing. if you have any information about this, call san francisco police. san jose is going if if -- >> concerns about the popular als ice bucket challenge. why a roman catholic diocese does not want its schools giving money to this cause. >> and right now we are looking at a commute that is getting slower as we look at highway 4. this is not too bad just yet but there is slow traffic on

>> 73-year-old carr min bentamaro was last seen last fight. she is 5'4" with a medium build. straight gray hair. take a look at the photo on your screen. she was wearing a dark green puffy down style jacket and blue pants at the time. if you have any information, please call berkeley police. a campfire sing along is planned at the berkeley rose garden. on august 17th, 2013 sparks from a cookout started the rim fire that burned 400 square miles including participants of the national forest, yosemite park, and destroyed the family camp. park rangers say most of that land will never recover. several days ago some logs still smoldered and flaired up and burnt half an acre.

sheriffs deputies continue to look for a man that jump into the backseat of the car robbed the driver and passenger and fired shots at them. investigators say the gunman pistol whipped the passenger, made both men give up their wallets and order them to drive. they were told to stop a fewmies later and the gunmen got out of the car. >> the driver immediately sped away it was then the suspect fired a couple shots at the vehicle. >> at least two bullets hit the side and back doors. our time is 6:15. the als ice bucket challenge took a bad turn inize kentucky. four firefighters were seriously hurt. firefighters were helping the band with their video challenge. they were spraying water on the students but the firefighters that are in that bucket portion of the fire truck got too close to power lines and they were

6:24. bart riders expect 15 minute delays at least on a section of the pittsburg bay point line for several days. bart is performing track maintenance between the concord and north concord martinez bart stations. only one track available for trains going in both directions. the work starts tomorrow morning. it will continue through tuesday afternoon but not during the weekday morning commute. bart will continue that work the following two weekends.

bart police have a new program aimed at catching thieves that are targeting parked cars. 2 invests takes a look at whether this program is working and which bart stations have the most break ins. there have been 547 break ins this year at the 33 bart stations that have parking. hayward had the most with 85. and the pittsburg station saw 44. >> i don't like feeling like i can't even leave the smallest thing in my car and i can't believe anything in my trunk. >> bart police say the new program is helping. police have budgeted about $50,000 for fingerprinting services. and so far this year police have lifted 12 readable fingerprints. while that is just a approximate of the hundreds of the break ins, they have identified five suspects linked to several bart parking lot burglaries. bart says it send 50 ovates

officers to advanced fingerprinting training. prosecutors have filed 75 charges for turning back odometers on dozens of cars. george and his wife danielle own and operate california car sales on auto center drive in antioch. they have evidence the couple sold more than 100 vehicles with odometers that were rolled back. the couple is due in court next week. california attorney general kamala harris is planning to appeal a federal court ruling surrounding the state's death penalty. it was ruled unconstitutional last month after a judge said it takes too long to carry outeat and the unpredictable delays are arbitrary and unfair. since they reinstated the death penalty, only 13 excuses have been carried out and there have been none since 2006 because of a stalemate over lethal

6:30 is the time. steve is here. warming up or cooling down? >> cooling down. maybe next week looks warmer. morning fog. there is more of a westerly breeze. if you don't have is the fog it will still be sunny but not as warm as yesterday. the weekend forecast looks like a cooling trend into saturday and a little rebound on sunday. but the fog being help the along by what? an area of low pressure. it's taking the path more toward theofed. the wind will pick up in the sierra as well. if you have a robust westerly breeze, it can mean darn cool. yesterday at this time it was nine miles an hour. that is a hunch difference. oakland 62. we will go 68 at noon. high of 72 degrees. the low clouds enhancing for some. they will be on the pickup tonight. fog, sun, breezy. not as warm inland.

maybe even some drizzle. 80s through the interior. 60s and 70s by the water. here is sal. we are looking at a commute where traffic will be busy if you are driving in some areas. but right now i think i should go to the bay bridge toll plaza first and show you that things have improved even from the beginning where all of this was full at 5:45. things are getting better. if this pattern continues, you might want to wait it out for a bit and wait it home. that's what happens on fridays. now that everyone is back to school, we can't be sure that will happen but things are looking good for the bay bridge commute. about a ten minute drive. san mateo bridge also looks good at 15 minutes across there. now we saw the san mateo bridge. let's go to the maps and show you the dumbarton bridge traffic looks good. this is a look at the south bay freeway system. you can see a lot of green here. not a lot lot of red. 6:32 let's go back to the desk.

it's for a man that was shot and killed by san francisco police last march. alex savidge is live at san francisco's bernal heights park where a memorial service and a protest are being held. alex. >> reporter: dave, good morning to you. those taking part in the sunrise ceremony are angry and frustrated over this shooting. they have come here this morning to pay tribute to the 28-year-old man who was shot to death by san francisco police several months ago. and this is the spot where it happened here in bernal heights park. several dozen people are out here this morning. there are aztec dancers, there was a prayer service a short time ago that was held here. supporters are calling for police to be held accountable for what they believe was an unjustified shooting. nieto a student at city college overstrains was shot by police back in march after he pulled a taser on officers. police thought he had a gun.

san francisco student shot to death by police will be wrapping up. alex savidge ktvu channel 2 news. meantime there is optimism in ferguson, missouri that tensions may be easing. last night was the second straight night since that shooting on august 9th that city streets have cleared early and the number of demonstrators thinned out. with conditions getting better, the governor of missouri ordered the national guard to leave. michael brown's parents say they are committed to saying the police officer that shot and killed their son goes to prison. also new this morning we have exclusive details about a plan to crack down on water abusers in the south bay. janine de la vega is joining us thousand from san jose where she spoke with the city councilman. >> reporter: when we first arrived here at the park in

downtown san jose, the sprinklers were on and as you can see, the sidewalks here are still wet. so there is some water waste going on. one of the ideas is to stop watering grass on city owned land that is being used as a play field. far they will draft an emergency declaration. councilman sam liccardo who is also running for mayor will introduce a proposal that shows a number of ways to cut water usage. they would billion paid using recently authorized funding to water agencies to record complaints of water waste and help residents tear out their lawns. liccardo also wants to crab wait with the santa clara water district to fast track a man to use recycled water for drinking. >> if we can replenish the under ground water supply using

recycled water, we can create a reliable source of water right here in santa clara county. >> as i mentioned under the proposal city owned land with grass not being used would not be used and grass on city land is being used for decorative purposes would be placed with drought tolerant plants. they plan on presenting this on tuesday. reporting live from san jose janine de la vega ktvu channel 2 news. a new study shows the western u.s. has lost 63 trillion gallons of water. ha is enough to cover the entire region with four inches of standing water. scripts institute researchers say they came up with those numbers by measuring the earths crust. the crust rises when there is a lack of rain and snow. time is 6:37. the next time you go out to eat there is no need to leave your

dog home. governor jerry brown just signed a new law. it officially allows dogs to be on the outdoor decks and partages of restaurants. brian flores is joining us live now. you're at walnut creek. this clears up a technicality about the law. good morning, brian. >> reporter: good morning, dave it certainly does. many restaurants allow dogs to sit outside in patios and outside decks. the whole time the restaurants didn't know it was illegal in the states eyes until the governor changed that yesterday. governor brown signed ab1965 which city allosteries aunt -- which allows restaurants to decide whether to have dogs in outside seating areas. there are some stipulations you should know about if restaurants choose to allow dogs on their decks or patios. dogs will not be allowed on chairs, benches or seats.

restaurant employees are banned from having direct contact with pet dogs while on duty. and if they do, they have to wash their hands. pet dog needs to remain on a leash or in a pet carrier and in complete control of the pet owner. while this passed overwhelming there are some that say having dogs at restaurants is unsanitary. live in walnut creek brian flores ktvu channel 2 news. after winning their protests of a rain delayed loss in chicago, the giants were still not able to beat the cubs after the game resumed after another rain delay. it took almost two hours to resume tuesday's game. the cubs started with a 2-0 zero. giants second baseman joe hit an rbi single in the sixth but that would be the giants only run of the game. they lost 2-1. things went better for the giants in the third game of the series which started 40 minutes later. the giants were down 3-2 in the

from santa barbara. the problem with the current turf, it was coming up in chunks and posing a safety hazard. right now they are laying the new turf inside. this is from yesterday when the field was barren. the grass was installed back in april and touted as this super friendly, eco, easy to recover grass. >> you know it can be dangerous if the turf is tearing up in clumps like ha. guys can pull muscles or twist ankles. football is a tough sport already. so if you can eliminate some things that might hurt a player, then you've got to do it. >> reporter: the san diego chargers head coach says his team will inspect the field before game time. the chargers have been told the game will happen and the 4er camp said it will indeed be
