for labeling genetically modified food. good afternoon i'm tori campbell. in just a few hours the family of a man shot and killed by san francisco police officers this last spring is filing a civil lawsuit against the city. right now they are at bernal heights park where the shooting happened. that's where tara moriarty joins us to tell us what else the group has planned. >> reporter: friends and family of alex nieto are searched on top of bernal park. you can see there's a pretty big group of them. they're going to be marching down to the san francisco building where they will hold a rally. earlier this morning the family held a sunrise vigil. as dancing and buddhist prayers part of the ceremony to honor nieto who friends say was murdered by police.

nieto a student at city college of san francisco was shot by police after invest -- investigators say he pulled a taser on officers. officers say nieto was acting erratically before he shot. but his supporters don't believe he was posing a threat and they believe officers over reacted. >> they're trying to make the victim the aggressive. that's what we see in police. there's no justification for this. this is an execution. >> reporter: the nieto family says it is suing the city on the grounds that police officers used excessive force against him. back in march, police chief greg suhr held a town hall meeting but it turned ruckus and nieto was a security guard who friends said had aspirations of becoming a probation officer. ktvu's david stevenson will have much more on this story coming up at 9:00.

i'm tara moriarty, ktvu news. the family of a san lorenzo man has now filed a lawsuit. the suit alleges that deputies provoked the confrontation with 61-year-old david goines which ultimate led to the deadly shooting. goines was shot and killed at his home after sheriff officials say he went after deputies with a baseball bat. a s.w.a.t. team operation in antioch landed 12 people in jail facing a variety of charges. it happened on wednesday in the area of sicamore drive where several shootings and violent crimes had been reported in recent months. during the operation, officers arrested 12 people for outstanding warrants, possession of controlled substances, gun possession, and resisting arrest. happening now, crews at the 49ers levi's stadium are busy installing new turf on the field after tearing it up just yesterday. ktvu's janine de la vega joins us live from the stadium with

more on the work being done and whether this puts sunday's game in jeopardy, good afternoon janine. >> reporter: good afternoon tori. so far we have seen six trucks coming into levi's stadium holding just hundreds of rolls of sod. now i spoke to 49ers person and person in management and they told me the goal is to get all of the turf installed as quickly as possible but they don't want to rush it because they want to make sure it's done right. here's video we shot from news chopper 2 showing the new thank you -l -- the new turf being put on the field. we're told it's double cut with extra today -- extra -- to hold in place. they wanted to make sure the safety of the players was not compromised and are glad the

problem was caught in time. some fans attending stadium tours are disappointed they aren't going to get to see the field complete. >> it's a brand new field. it's the first season they're going to play and we have to worry about the field first not lake traffic is not enough, but you know now we have to worry about the actual field that they're going to be playing on. and of course, we want our players especially the 49ers to be healthy all season. >> reporter: the 49ers are saying the field will be ready for sunday preseason game against the san diego chargers. management says laying down the sod is just a short term solution on monday they will evaluate a long term plan and that could include replacing the turf again before the team's first regular season game played at levi's stadium on november 16. there's two more games being played between that time. it's unknown if this turf issue

will mean other games won't be played here. coverage starts at 12:30 with our special all access pass. levi stadium. then the the 49ers take on the chargers at 1:00 p.m. then join us after the game. and drivers may have noticed a significant back up. this is video taken around 10:00 this morning well after the morning commute and you can still see a back up. according to the target at the toll plaza. this morning's back up was because the number four cash lane was closed which is common on fridays although he did not explain why. a california senator is facing charges for drunken driving after he was arrested early this morning. ben hueso was reportedly seen driving the wrong way down a

one way street in downtown sacramento. he was arrested and booked into the sacramento county jail around 3:30 a.m. hueso has served in the california senate since march of 2013. he is the third senator to be arrested this year. the others have been suspended from the senate. it's been almost two weeks since a police officer shot and killed michael brown jr. in ferguson missouri. but after many nights of violent protests the mood has now shifted. chris cuomo talked to a new eyewitness and shows us the peaceful scene overnight. >> blessing over every commanding officer under him. >> reporter: impassioned prayer, protesters and police hand in hand. protesters now in the street. as others pause in solemn reflection.

these sounds of calm now set the scene here in ferguson as law enforcement begins to pull back back. missouri's governor asking the guard to gradually draw down. >> as we see the folks getting calmer, few arrests, fewer problems here, that mission we're going to draw down. we don't need the same force strength. >> reporter: this as new information clarifies reports of officer darren wilson's condition after the shooting. a source tells cnn officer wilson had a swollen face not a frantisek kaberletureed eye socket as some media were reporting. a new eyewitness michael brady says he saw the beginning of the tussle through his window and it looked like the officer was hit. >> did you see brown do a forward movement like if he was going to get hit. >> reporter: according to

police documents, johnson was arrested in 2011 for threats and making a false at the same time -- false statement to police. a coloring book box of crayons and a sock puppet now on display where handguns and molotov cocktails sat just a few days ago. >> this is what defines a community. this is truly the community of ferguson. what we see on this table today. >> reporter: michael brown's parents have also said they are at peace preparing for their son's funeral monday and denouncing violence for shaming their son's name. a disturbing warning from the pentagon saying the terror group isis is like nothing we've ever seen more dangerous than al-qaida before 9/11. u.s. war planes continue air strikes on targets in iraq. but top pentagon officials say

isis militants will regroup. the focus is on a long term strategy to defeat the terror group which has taken over parts of syria and iraq. the u.s. will need help from other countries says chuck hagel. lawmakers are working on legislation to require labels on genetically modified foods, but we'll tell you what food companies are doing to limit what shoppers actually know. a slight warm up on the way, ktvus rosemary orozco will be here to tell you what you can expect for your workweek. and a new law that allows dog owners to take their best friends to go out dining with them. we'll tell you the restrictions.

southern california has recalled 92,000 pounds of chicken cesar salad kits because possible listeria contamination. they were all delivered to sam's club. they have use by dates of 8-12 to 9-17. there's no reports of illnesses. congress is considering legislation that would require food makers to label genetically modified

ingredients. in response food companies are contributing to local congressional campaigns. the biotechnology company monsanto has given congressman jerimendi 2,000 this year. $1,000 from the grocery manufacturers association which says gmos are safe. >> the food industry says all the time gmos are safe. so far there's no conclusive science that eating gmos are dangerous too you but the jury is still out. placer county sheriff deputies say sharke brown, grigs and nash were caught filling duffel bags with baby

formula. they found more stolen formula in their car. it can be used to dilute drugs or sold online. aspire public schools will hold a ribbon cutting ceremony tomorrow for its triumph technology academy in oakland. will serve mainly low income students from k through fifth grade. the classes are heavily based on student learning but teachers and students have to earn their computer time. before computers are placed in a classroom, teachers must demonstrate classroom management and students must show they can work individually. it is now up to governor brown to decide if some california community colleges can started offering four year degrees. the state legislature agreed the proposal yesterday so it could take effect as early as next year: under the plan each

community college could only offer a four year degree in one particular subject. the goal is to make higher education more affordable and boost the skills of california's work force. even though many restaurants allow it already it's been illegal in the state of california to have dogs sit in the outdoor patio of restaurants until now. governor brown signed ab1955 into law which allows restaurants to have the option to permit dogs in outside dining areas. it will still be up to the restaurant owner and city law to make the final decision to allow k-9 friends. dogs and restaurants raised concerns over sanitary conditions and safety especially around young kids but many support it. >> for outside no i don't really see that as an issue. for example my dog is very good. he will just sit down at the very foot of the table and enjoy. we are very respectful of anybody around us. so if he were to cause any kind

of a commotion we would get up and move. it's all about being a respectful and considerate person. there are some restrictions, dogs are not allowed on chairs, seats or dining section. the new law goes into effect on january 1st. san jose is slated to pass an emergency drought declaration and some new restrictions next week. but one councilman says he wants to make it go a step farther. councilman sam licardo who is also running for mayor will be introducing a proposal that includes a number of ways to cut water usage. ideas include creating a water conversation core of young adults or teens they would be paid using recently authorized funding to water agencies to record complaints of water waste and help residents replace their lawns with drought resistant landscaping. licardo wants to work with the water district to fast track a plan to start using recycled

water for drinking. >> recycled water at a very high level of purification can recharge ground water reservoir supplies to a level that's more than safe. >> reporter: lic >> reporter: -- liccardo will get to present his plan to the council next tuesday. a campfire sing along is planned at the berkeley rose garden to mark the first anniversary of the largest fire in the sierra nevada. sparks from a cook out started the rim fire that burned 400 square miles including parts of stanislaus national forest, yosemite park. several days ago some logs that were still smoldering flaired up causing a half acre fire. >> forest eco systems are complex things. and when we think we understand them, mother nature throws us something else and we have to study it some more and try to understand it better. the forest service says it

will only declare the fire officially out when the drought is over and there are heavy winter storms. >> strong winds blasted dust and sand through the skies of southern california including palm springs. wind gusts reached 30 miles per hour it was part of an intense dusty system known as haboob. winds caused particle concentrations to reach unhealthy levels and people urged to avoid outdoor exertion. so far there have been no immediate reports of injuries or serious damage. here at home our mild summer pattern continues today. giving you a birds eye view of a beautiful blue sky over lafayette this morning. way in the distance pointing to the west you can see in the backdrop, just a few patches of fog. low clouds remain at the coastline at this hour: i think we'll be partly sunny to mostly cloudy along the

coastline for today. 64degrees at half man bay right now. 69 redwood city. low 80s in walnut creek. 71 in napa. 81degrees for you antioch. 80degrees in livermore at this time. so a warm lunchtime for our inland communities. and as we get into the afternoon temperatures will continue to warm but it won't be too hot. at least by summer standards. the on shore breeze quite robust through fairfield and the delta at this hour. i think this will actually lead to a bit of a cooldown for some of us this afternoon. temperatures will be down slightly over what we had yesterday. but that gust to 29 miles per hour through fairfield and on shore breeze at concord reported at 12. and we have a southerly breeze at napa 10 miles per hour. oakland you're checking in with an eight-mile-per-hour breeze. i'm going to show you the system that will continue to bring us very mild to warm pattern through the weekend. we have a trough that will be deepening over california. as it does it will keep the temperatures right about what we have seen in the last couple

well stocks are a little change in afternoon trading in wall street. janet yelen this morning is not giving investors a clear idea when the feds will begin to increase rates. taking a live look at the big board the dow is down 15 the nasdaq is up 12, sm & p down one. fit bit says it has never sold users private information to advertisers. the move comes after concerns were raised about consumer privacy. fit bit makes wearable devices that track and monitor fitness activity. fit bit says it has clarified it's privacy policymaking it clear the company does not
