now at noon, breaking news out of san francisco where investigators are trying to figure out what led to the death of a city worker run over by a garbage truck. and police are investigating a dead body that was reportedly set on fire. a mother accused of choking a young boy. who she thought was bullying her young daughter. find out if she will face any charges. good afternoon.

i'm christine christine rendon. 5 city worker has been killed by a garbage truck driven by another worker. it happened in the bayview district after 9:00 a.m. we're getting this video in from the scene. officials say the public works crew was clearing up materials this morning. somehow, the garbage truck hit and killed another worker. the circumstances are still not clear. >> this is an extremely tragic accident. everybody sends condolences to the victim's family. we're still getting information on who that person was. something we never want to have happen in the city. you go to work. you want people to go home, healthy and people are shaken up in the department. >> the city says the truck driver was a temporary employee who had been on the job only four weeks. investigations are underway. we're continuing to gather details. we'll have an update tonight at

5:00. sheriff's deputies are on the scene of a grisly discovery made on the side of the road in unincorporated morgan hill. ktvu's janine de la vega spoke to investigators and joins us live from morgan hill, not far from where the body was found lit on fire. janine? >> reporter: cristina, sheriff's deputies have oakland avenue roped off for a mile mile-- mile heerl. it's a rural road. it's well traveled because it's a shortcut for comullers. there was a burned body dumped down the embankment. down 8:00, someone driving down oakland avenue saw smoke coming from the side of the road. they stopped to investigate and found a person lit on fire smoldering about 20 feet away in the veg takes. sheriff's deputy say they pronounced the person dead. they started to treat this as a crime scene and collect evidence. they are not able to say how long the body was on fire.

>> we're obviously gonna treat this like a homicide scene. bodies just don't start 0 start on fire by themselves. we always treat these as suspicious. homicide we're gonna investigate it. we're gonna call out our crime scene investigators. we're gonna spend a lot of time out here and collect all of the evidence we possibly can. >> reporter: it's too early to tell if the person had any other injuries before they were set on fire. that information will come out after the coroner examines the body. the sheriff's department expects to be out here all day. this is santa clara county. sheriff's department, their first homicide. year. we'll have more on this at 5:00 and 6:00. reporting live from morgan hill, janine de la vega, ktvu channel 2 news. >> thank you. a man wanted for a double homicide in oakland is now in custody after 13 years on the

run. the this man was arrested in guadalajara, mexico. he is accused of killing two men over the dispute of the installation of a car stereo. he's in the los angeles county jail. it's not known whether -- when he will be brought to oakland. we just got word on the name of the man who dieded at the -- died at the burning festival. she's identified as luisa. she fell under a large vehicle at the festival and died. the incident is under investigation. a statement posting to the burning man blob called the woman's death a terrible accident. close to 100 police officers have been patrolling the event expected to draw record crowds of 70,000 people. the festival started in san francisco back in 1986 and moved to nevada four years later. passengers heading to hawaii out of san jose were detoured

to oakland for some nonemergency claim repairs. hawaiian airlines flight 45 left mineta airport at about 8:30 this morning and was on its way to maui when redirected to oakland because of a mechanical issue. an airport spokesperson said it was not an emergency issue and that repairs are underway right now. he said that passengers should be reboarding and heading to hawaii soon. is. the santa rosa man accused of assaulting a 12-year-old girl she believes was bullying her daughter was back in the sonoma county courtroom today. mike mike me hack was there -- mike mibach was there and he joins us live. mike? >> reporter: well, prosecutors said in court this morning they were not able to file charges. delia garcia brachford heard the deputy attorney announce his decision. he said after 28 interviews there was corroboration on both

sides. therefore, he could not proceed any further. with that, the 30-year-old mom walked out of the courtroom shaking but happy. >> i was really scared to -- i didn't know what was gonna happen. i'm really glad it's over and done with. >> reporter: a santa rosa mom was accuse -- the santa rosa mom was accused of grabbing the throat of a 12-year-old boy who she said verbally bullied her daughter at olivet school back in may. the boy told school officials who photographed red marks on his neck. garcia was arrested the next day but posted bail. after her court appearance she said she only talked to the boy about the bullying, never touched him. she said she still has no idea why the boy who she said is the son of a correctional officer would fabricate such a story. >> i don't know why he thought of something like that and what was going on in his head. i hope he never does this to anybody else and learns from this and just has an awesome

life. >> reporter: the santa rosa mom said she is still disappointing that it took prosecutors more than three months to come to this morning's decision. live this afternoon in san francisco, mike mibach, ktvu channel 2 news. >> thank you. less than an hour ago, b.a.r.t. unveiled the latest crime fighting tool. we were there for the announcement and sal castanedo has more. >> reporter: this b.a.r.t. app works on on trains and parking lots. they say the new app could make a difference in the way criminals are caught after they reported. b.a.r.t. announced the app is a quiet way to contact the b.a.r.t. police department. the app allows to you take a picture and sent it to police. it goes right to their dispatch

center. the prompts allow you to choose a location or gps can alert officers to where you are. you can report crimes for remaining anonymous. officers say this new tool may lead to more crimes being reported. in the past what we found is somebody is on the train where you are in a contained environment, they may not want to report something at that moment. what they end up doing is report it later. by then, often our suspect has traveled on and we're unable to locate them. >> that's the goal, things like panhandling on trains. that's not allowed. you can get a ticket. and if we have more and more people sending those alerts in into dispatch hopefully it prevents it in the first place. >> reporter: b.a.r.t. says passengers have been asking the agency for a way to report crimes without having to make an actual call. >> i was on the b.a.r.t. train one day and there was someone that seemed like they

were on drugs, very aggressive. other b.a.r.t. passengers were watching, snapping shots. it could have been submitted instead of them having a photo. they could have gone to authorities. >> reporter: the app is available for ios and android phones and can be used in spanish and chinese. sal castanedo, ktvu channel 2 news. >> thank you. in less than two hours, crews will begin to shut down the northbound direction of interstate 280 in san francisco. the closure affects the stretch of 280 from the 101 interchange to king street near at&t park. northbound traffic will be detoured onto highway 101. those northbound lanes are scheduled to remain closed until 5:00 tuesday morning. the freeway was shut down for the holiday weekend because there's lighter traffic. but drivers heading into the city are still being urged to use mass transportation. >> i feel like i will be forced to take caltrans. that's the route i'm gonna

four days after they were rocked by that 6.0 earthquake people in napa are struggling to get back on their feet. alex savidge has more on the lingering problems and the effort to get help from the federal government. >> reporter: a restoration team was out early this morning set up scaffolding to begin repairing broken tiles. for many businesses, the rush is on to reopen. >> just cracks and everything. >> reporter: at the cap heritage tasting room, the manager gary koehler showed you the quake damage, mostly superficial. contractors are coming later to begin repairs. he hopes to have the doors back open in a couple of days. >> you want to be open. we're coming into the season. september/october is the harvest. >> reporter: but much of downtown is now a work zone, with many stores and

restaurants fenced off and boarded off. you can tell by the large cracks on the outside of this historic building that the place has serious structural damage. that's why the building has been red tagged and this sushi restaurant downstairs likely won't reopen for a long time and now there is a push underway to brick in federal dollars to help pay for the recovery. this afternoon, napa county supervisors are expected to approve a disaster proclamation to speed up the process. the damage estimate stands at $300 million. that's just for homes and businesses but it's more than enough to qualify the area for federal aid and problems are continuing to pop up. >> lingering effects of living in earthquake country. >> reporter: another sinkhole opened up on this street this morning leaving many neighbors without running water. >> it's been a constant onslaught of this is damage, this is broken. can't do this, can't do that. >> reporter: city crews are working around the clock to fix dozens of broken water lines. they hope to them all repaired

by tomorrow. then, of course, it will be onto the next job. alex savidge, ktvu channel 2 news. the napa valley food bank is reaching out to people who might need help filling their pantries after the quake. they've extended hours to hand out bread, water, dairy products and other staples at its distribution center. officials say many lost their refrigerated food during the quake and simply can't afford to stock up again. today's distribution just wrapped up at noon. the napa valley wineries are calling on tourists to come back. 95% of the wineries are reportedly open for business. some say they have lost tens of thousands of dollars worth of wine but they add if tourists stay away, it could have an impact on the economy. september is harvest season and typically the busiest time of year for napa valley.

2 investigates goes inside a special program used by only a few police departments that keeps tabs it on drunk repeat drivers. the so-called hot list is a secret list compied by the dmv and distributed to police listing people with multiple dui offenses who aren't supposed to be behind the wheel. they use the information to keep surveillance on the people nearly everywhere they go. >> we try to use as much research as we can to identify the information about them to verify addresses. if we can find a work address for some of them, we'll follow them at work as well as at home. >> 2 investigates asked for a copy of the hot list, but we were told it's confidential except police. tonight at 5:00, we uncover some of the major challenges and criticisms the program is facing and ask whether it's working to keep you any safer on the road. the chp says a high-speed chase ended with an officer using a taser to subdue a juvenile driver. a chp spokesman said it all began in el cerrito, when a

police officer spotted a car that was reportedly used in a local burglary. officers pursued the suspect along interstate 80, then to 880 south. that's where our roof cam got these pictures. we're told speeds reached 110 miles an hour before the suspect exited the freeway at 98th avenue and stalled out. he tried to run off but was tasered and taken into custody. authorities said the juvenile is facing felony vehicle theft and evasion charges. a second problem at a pg&e station in santa clara county is again raising concerns about security of the power grid. it happened yesterday at the substation on metcalf road when pg&e says someone used wire cutters to cut holes in the chain-link fence and steal construction equipment. it's the same substation where snipers shot at 17 transformers last year. the snipers have never been caught, despite a $250,000 reward. >> since the april 2013 incident, this is the first time we've been out here for a

crime-related incident occurring back out at the substation. you know, obviously we understand this is a very critical infrastructure to the region. south bay congressman mike honda says the new security breach is troubling and says the facility remains vulnerable. pg&e allocated $100 million after last year's breach to improve security at critical substations. that will include replacing the chain-link fence at the substation in santa clara county with a wall by the end of the year. yesterday we had far less fog and not much of a breeze and temperatures warmed up. downright hot. today we're running about 2, 8 degrees cooler than 24 hours ago. that's because we had a much bigger fog bank. system moving into the north, a little bit more of a delta breeze. temperatures have dropped a little bit here. you can see some of that fog still there. yesterday, santa cruz/san mateo coast was fogfree. most of it was point reyes north. this morning it filled in quite well, made a push over the bay.

that along along with a strong delta breeze gives us a cooldown. the system is up near humboldt county that went through and some of the system is inching forward. higher clouds more likely friday. forget the 84 in walnut creek. that's not right. but 78 in livermore is. that's down 5 from this time yesterday. concord, 76. down 4. fairfield is at 80. but 72 santa rosa to 71 san jose. oakland, 67 and san francisco 64. most locations are about 4, 5 degrees below where they were at this time. lake county, already 87. 82 calistoga. they were down to 52. penitentiary says 72 and 70 up towards healdsburg. down to the south we have warmer air aloft. la honda dropped to 51. they are 71. foster city, nice 70. 68 palo alto airport. you get to menlo park, 74.

los altos hills, 77. the delta breeze was up to 29. now it's fading away. yesterday it was calm and east. it's showing a westerly component and ten miles an hour. a north wind at concord, 18. it's west at oakland. kind of a westerly dreeks. 85 in reno. 85 in ukiah. 83 in sacramento. everyone is close. fog will be back tonight into tomorrow as the system moves into the north. a few degrees cooler today. fog, sun, warm, even mild by the coast. water temperatures continue to be about 64 even with the fog, the coast is not that cool. 96 clearlake but a lot ofle os throughout marin county and sonoma and napa into santa rosa. to the east bay, lower 90s. 94 in brentwood. other areas such as concord and livermore are down about 4, 5. oakland at 75. near average for this time of year. santa clara valley, low 90s. but a lot of 80s including downtown san jose at 82. 60s on the coast. 70s the peninsula. 83 palo alto. 84 woodside and mountain view at 82. it looks like a cooler pattern

disappointing earnings from several retailers dragged stocks lower. trading has been light ahead of this labor day holiday weekend. taking a live look at the dow, which is down about 31 points to just over 17,000. the fbi is now working with the secret service to investigate reports that jpmorgan chase and four other financial institutions have been hacked. j.p. morgan hasn't confirmed the reported hacking but did say it has multiple layers of defense to counteract defense. bloomberg.com is reporting that russian hackers may be linked to the attack as possible
