can't speak too much right now. but -- you know the truth will come out. >> the defensive lineman ray mcdonald out of jail and speaking out after being arrested on charges of felony domestic violence. good evening everyone, i'm mike mibach. >> and i'm holder holmes. he was -- heather holmes, he was booked into the jail this morning after reports of violence many at his home in -- at his home in san jose. this comes just days after nfl commissioner goodell announced harsher penalties. we have team coverage now on developing news beginning with ktvu who spoke with the 49ers' mcdonald as he walked out of jail and she's live now at levi's stadium. >> reporter: the 49ers' defensive end was rather quiet at first. after spending the night behind bars. but then he did tell me a lot was going through his head and he called it a crazy situation. our cameras were rolling as

49ers' player ray mcdonald walked out of the jail just after 11:00 today in a t-shirt, shorts and flip-flops trying to hail a cab. but the defensive mineman at first didn't say much about the arrest then he opened up. what do you want to say to your fans -- [ inaudible ] >> the truth will come out you know. hey i -- i can't say too much on it right now. but you know the truth will come out. i mean, everybody knows what kind of person i am. and -- >> reporter: what kind of person are you? >> you know -- i'm a good hearted person. >> reporter: just after 2:00 this morning, police arrested the 9-year-old for fell m -- 29- year-old for felony domestic charges in san jose. the "sacramento bee" is reporting mcdonald was involved in an altercation with his fiancee. who according to the paper is ten weeks pregnant and showed police her bruises. the article goes on to say

other 49ers' players were present at the home. >> it's not the old 49ers i can say that. this younger group is -- i don't know. sometimes they seem like they don't have their head on their shoulders. >> reporter: last september, 49ers' linebacker al don smith was arrested for dui in the same neighborhood as mcdonald. smith is now facing a nine game suspension. >> we want them to be the best players that they can be. and not have any distractions off the field. and making unethical and idiotic decisions is really hurting this team. the fans. >> referee: this comes as nfl commissioner roger goodell on thursday changed the league's personal conduct policy regarding domestic violence. implementing a six game suspension for a first offense and a banishment from the league for a second offense. 49ers' general manager trent baalke issued a statement saying -- >> taxi. >> reporter: this is not the first time mcdonald has been

arrested. four years ago he was booked for suspicion of driving under the influence. in santa clara, ktvu channel 2 news. >> lot of questions still out there including how the nfl commissioner is going to respond. >> absolutely. and also just what type of impact this is going to have on the 49ers. joe joins us now and i guess first and foremost, will mcdonald be at practice tomorrow? >> i expect so. let the law run its course but there's an obvious issue anytime is a play serai caused o -- player is accused of breaking the law. depending on the law the effect can be decidedly secondary. if the accusations are true, the 49ers and mcdonald can expect a severe penalty. the league was heavily criticized just this summer when baltimore ravens' running back ray rice received just a two game suspension for an assault on his then girlfriend that was caught on videotape. commissioner goodell candidly stated last week the league probably got that wrong.

fellow 49er smith will serve a nine game suspension for a series of transgressions that didn't involve any kind of physical assault. the league will most likely wait for the criminal justice system to run its course before handing out a penalty. but if mcdonald is found guilty, the 49ers should expect a maximum sentence. what would that mean? on strictly a team performance basis? the 49ers are already without smith for nine games and fellow pro bowler bowman who will miss the first half of the season due to injury. think another starter out of the mix and there's no question the 49ers' defense will be impacted. the team's reputation may be impacted to an even greeter extent -- greater extend. sports coming up later. more details now and according to an nfl tracking data base, the 49ers lead the league in players arrested. ray mcdonald was the tenth arrest of 49ers' players since the beginning of 2012. last week linebacker aldon smith was suspended for the

time for lunch. >> we got this morning and the city -- got things open and we're back open. it's a good thing. >> reporter: in some neighborhoods crews are working through the holiday to restore water. knocked out again by a 3.2 aftershock this morning. napa's mayor says it didn't cause any physical damage. >> just in people's psyches. you know? mainly -- aren't we don't yet? >> reporter: although napa is hurting, she says having people shop local is the only way they'll recover. >> when things like this happen, it -- people just step up to the plate and they care. >> reporter: and the mayor tells me fema crews here inspecting the city to determine whether or not they'll receive any federal aid. but regardless, the city already is working on getting a one stop shop location set up for people to get some help and that is set to open in about one week. live in napa, christina rendon, ktvu -- ktvu channel 2 news. a church damaged by the earthquake opened its doors for sunday's services this morning. ♪

the first baptist church welcomed people back today. this time, last week, the chunk was blocked off after crews deemed it too dangerous to enter. the bell towers separated from the building and it had to be repaired. during today's service, pastor al marks showed the congregation the damage and talked about what might have saved the church. >> this part had to come down. the fire marshal that came earlier in the day said that we had not retrofitted the bell tower it probably would have come down. >> it was felted in 1992 following the quake in '89 and officials say the damage would have been much worse without the retrofit. set to open a new emergency assistance center tomorrow in napa. the center will be located at the napa valley marriott on the solano avenue in the meeting room. quake victims will be able to meet with trained red cross caseworkers who can assess their needs.

and provide information as well as assistance to help them move toward recovery. that new center will be opened from 10:00 in the morning until 7:00 in the evening and as we mentioned a week later, napa is still seeing some significant aftershocks including another one just this morning. >> that's right meteorologist mark tamayo is here now with details of the series of aftershocks that continue to rock the area there. >> yeah thankfully most of the aftershocks have been in the magnitude 2 range but today this morning we had a magnitude 3.2 to report. in fact around the epicenter of last week's main shock magnitude 6.0. they correspond to the earthquakes' aftershocks since the last week a week ago. -- quake a week ago. in fact here's a tally report coming out to 36 reports of these are the quakes the red areas indicating the aftershocks. greater than 2.0. now the developments for today, two to report. the one happened at 1:56 this morning. that was the magnitude 3.2. that was the same spot as the accept earn of last week. and then another quake to report as you can see just

we're following breaking news tonight. one man was shot and killed tonight in oakland. it happened near 50th avenue near the coliseum public market where the west wind coliseum swap meet is held. police say they are investigating the shooting as a homicide. right now we do have a crew there on the scene. gathering more details and we'll bring them to you as they come into our newsroom. happening now, want to give you a live picture of interstate 280 in san francisco. which as we've been reporting is temporarily closed as crews continue to do some retrofit work there. caltrans says that traffic has been flowing smoothly despite that closure. on thursday, crews closed the northbound lanes from the highway 101 interchange to king

street on interstate 280. they are removing large sections of the roadway to replace aging hinges. they will allow the roadway to expand and contract during an earthquake. and we spoke to a caltrans see spokesman about 45 minutes ago and he says they are on track to reopen the freeway on schedule at 5:00 on tuesday morning. continuing now on the crisis in iraq. and a second day of humanitarian aid drops on the town as the iraqi military says it has broken the long siege that has trapped thousands of people without food and water. the united states continues to carry out air strikes in support of the iraqi fighters on the ground there in the town. and as mary mali knee reports the joint effort is paying off. >> we have to protect americans, that's the number one issue. >> reporter: the u.s. is continuing air strikes in iraq. sunday officials announced the u.s. hit isis targets near the town. the town of about 20,000 is

here's san francisco and some patchy fog in the distance. i think some fog will be a factor into the coast for the overnight hours. for tomorrow mild coast some hot numbers inland once again approaching the mid 90s and then the developing headline a little bit of a cooling trend showing up on the long-range weather maps. overnight lows first thing tomorrow morning. partly cloudy skies and some coastal fog and maybe a few patches around the bay itself. temperatures to start out the monday morning will be in the low to mid-50s. a few neighborhoods starting off the day on the mild side and lower 60s for concord and livermore and mountain view 60 degrees. so once again here's the satellite perspective. we are in the clear a few high clouds heading way up to our north and this is typically the time ofier we have the nice -- year we have the nice weather. that was the case for today. overnight some patchy fog regroups but we'll call it a warm to hot labor day for your monday. but here's the change and the weather system moving in from the north, this will drop the temperatures a little bit beginning tuesday and into wednesday. so think tomorrow probably will be one of the warmest days of the week with upper 0s for the beaches and -- 60s for the beaches and temperatures inland on track to reach the mid 90s. at the coast a popular spot if

the highway patrol is investigating a solo car crash in alamo overnight. that left one person dead. it happened at about 12:30 on stone valley road near miranda avenue not far from a fire station. the chp says the driver of a jaguar traveling eastbound went off of the roadway. the car then hit a light pole and it caught fire with the driver trapped inside. investigators are looking into alcohol or drugs playing a role in the crash. the california highway patrol is looking for the

driver in a deadly hit and run near petaluma. the chp says it happened just after 4:00 p.m. yesterday on bodega avenue near king road. the suspect was driving a 2007 chevy pickup truck when the driver drifted into the shoulder of the road. the truck then spun out and then reversed into a sedan trapping a driver inside. the chp says the other driver a 51-year-old man from napa died there at the scene. we're told the suspect took off on foot. we have new developments now in a shooting in livermore. police arrested three males after five people were shot at a house party earlier this morning. officers made the arrest during a traffic stop just around 9:30 a.m.. we are told police released two people but one suspect is still in custody. police say 21-year-old anthony jesus torres was booked and charged with five counts of attempted murder and shooting a firearm into a home. the shooting happened around 12:30 this morning at a house on south q. and third streets

in livermore. allie rasmus reports on what happened right before the party. >> reporter: it's a picturesque neighborhood with fences and tree lined streets. third and south q. streets in livermore is not the place she ever thought she'd see crime scene tape. >> for this neighborhood, nothing -- like this has ever what happened. ever -- happened. ever. >> reporter: livermore police patrolling the area heard those gunshots too this morning. they arrived at this home on south q. street to find five people struck by the bullets. >> three females, two males. and all adults. >> reporter: all in their late teens to early 20s. they were among the 20 people gathered at a house party that evening. according to witnesses, three people from out of town showed up to the party uninvited. >> everyone is partying but during that there's a verbal confrontation between the three individuals and someone else at the party. they were asked to leave. >> reporter: about 30 minutes later police say a white sedan pulled up to the front of the

home and someone inside the vehicle started shooting. >> five really loud pops like back-to-back. just bang bang bang bang bang. >> reporter: police say the five victims suffered nonlife- threatening gunshot injuries. >> they were my friends. to me, it's unexpected because usually the only -- they only invite people they know. >> reporter: she was supposed to be at that house party last night. >> i went with my gut instinct and didn't go. >> reporter: she spent the morning trying to get in touch with her friends. she was glad to hear everyone who was injured is expected to survive. livermore, allie rasmus, ktvu channel 2 news. the sheriff's office is investigating a double shooting at a house party overnight in contra costa county. it happened in oakley on ridge crest court and cinnamon ridge drive. when deputies arrived they found two men suffering gunshot wounds. they were both taken to john muir hospital in walnut creek. no word though on the extent of

their injuries. another person at that home was hit with an object and treated there at the scene. so far no arrests have been made. a man injured by a car in oakland is still in critical condition condition. the man was hit yesterday afternoon police say at east 12th street and third avenue near lake meren. the investigation into finding out if he was in the crosswalk is still underway. in oakland a police lieutenant says the officer was making a turn at a slow rate of speed while responding to a call. there's a warning out today about a mountain lion sighting in woodside. the sheriff's deputies received a report about one year the county park about 10:30 this morning. they were investigating the report and advising residents there to be cautious. it's especially important not to approach a mountain lion that's eating or with kittens. but that generally they will try to avoid confrontation. a traditional coin toss by lawmakers maybe to blame for breaking a statue in the state capitol that's been around for more than 100 years. the million dollar marble

keeping people from enjoying the holiday weekend along northern california lakes and waterways. several boats were out on folsom lake today but this year this labor day is coming with a very different view. the historic drought dried up a lot of the lake and officials are holding off on the 5-mile- per-hour speed limit until after the holiday weekend. business owners are trying to make up for what has been a very lackluster summer season. >> i'd say probably we're -- 60% of what we were last year. >> this was the last hurrah for the summer. so -- you know, this is all the rental companies, this is their big push to try to get whatever revenue you can for you know for the rest of the year. >> business owners like all of us is hoping for some rain soon to keep people on the water for just a few more weeks longer. and now to a developing story in sis cue county. two wildfires are threatening as many as 250 homes near happy camp and there's also burned close to 100 scare miles in the national -- square miles in the national forest but cloudy

skies and lower temperatures are slowing the spread of the fires. they are the largest of 17 fires sparked by lightning. almost three weeks ago. officials say the fires are now 15 management contained -- 15% contained. let's check in with our meteorologist mark tamayo but i don't think it's going to happen huh? >> today we're wrapping up august and september and october we bring up fire danger at other levels. for september into mid-october. we really warmed you have this afternoon. look at the 90s out to cob cord and livermore and antioch and fairfield. 92, 93 degrees, san jose 82 and even strong the lower -- san francisco the lower 70s at 71 and pacifica 67 degrees. right now on the maps, not much in the way of fog. we just have some higher clouds approaching southern california and the bay area. we are in the clear for the most part but some patchy fog is trying to regroup just offshore close to the golden gate bridge. a bit of a breeze out there showing you the wind speeds in oakland.

the airport winds sustained at 17 and gusting to 28 miles an hour. so some more wind reports for you sfo winds out of the west and sustained at 23. and san jose winds out of the west checking in at 15 miles an hour. here's our live camera looking out towards the oakland estuary and the fog out here in the distance or at least the haze. this is the live camera and forecast headlines for tonight for the evening mostly clear, a warm to hot labor day and it will cool things off by tuesday gradually and into wednesday out there. current numbers -- oakland on track tomorrow to reach the upper 70s the not 80 egg thes -- if not 80 degrees. on track by 2:00 to reach the upper 70s and san jose right now checking in 79 degrees. in the clear and the forecast for tomorrow, the south bay easily by 2:00 we're going to go-go 84 degrees -- go with 84 degrees down in the south bay. warm to hot inland and another hot day in the forecast for tomorrow for places like concord and livermore and antioch and brentwood.

overnight lows first thing tomorrow morning. partly cloudy skies and a lot of 50s. a few neighborhoods in the lower 60s from mountain view, livermore and antioch. so we are in the clear right now from the north to the south. as high pressure still in command of the weather. patchy fog though for tonight and into early tomorrow morning. it will be warm to hot the labor day and we're thinking the warmest locations 95 to96 degrees. a weather system from the knot is not going to bring us any rain. we like the rain but cooler air and it will increase the on shore breeze. by wednesday warmest locations instead of the mid 90s, some mid 80s by midweek. here's the forecast models showing you the clouds trying to regroup late tonight into early tomorrow morning especially south of the bridge. we could have a few patches sneaking into the bay as well. for the coast partly cloudy skies. and then for the inland neighborhoods lots of sunshine and the string of 90s out to concord and live more and even san jose. the south of san jose we're expecting 90s and san jose will be at least in the middle 0s and could be approaching -- 80s and could be afroing parts of the valley in the upper 80s to near 90s.

and the a's are not. the giants didn't even need the force behind them as they were going for a three game sweep of the brewers today. the at&t park. san francisco fell behind in the 1st inning but then the bats exploded. with a run in the 2nd pence scored pagan in the 3rd. the giants getting started on a day that would see them pop the run total for a game this year. sandoval on the way to a big day. singles to score joe panic. it's 3-1 giants and they have three in the inning and clipped away at the starter kellogg. sandoval on the way to the three hit, three rbi game. a double short of hitting for the cycle. sandoval with a towering home run to the arcade in right in the 5th. that's a two run shot but boy it was over. the gianted pounded out 15 runs on 16 hits and they win their sixth straight. the giants did not gain any ground on the division leading dodgers. matt kemp breaks a tie after the padres with this hit in the 5th. the dodgers beat san diego 7-1.

and maintain their lead over the second place giants at two and a half games. when the a's began their crucial four game series with the angels on thursday, they were just one game out of first place. the angels then proceeded to pull off a sweep that leaves oakland five games back. oakland fans at anaheim trying to will their team to win. and avoid that sweep. scott kazmir has been so good this year. that this was not his day. the scoring of very bad inning got started when ibar hits the single to score josh hamilton. kazmir proceeded to walk the next three batters. bob melvin saw enough and kazmir pulled after the inning and a third. dan o terri gave up this little blooper to score two more before the inning was over. the angels scored six times and the a's' fate was sealed. but trout wasn't finished. a second hit in the 7th off jesse chavez, this one will find thunder mountain. homer number 31 on the year for
