injuries. ktvu's maureen naylor now has details in santa clara where we learn much more about the incident at mcdonald's home. maureen. >> reporter: ray mcdonald was at practice here today on what is his 30th birthday. his arrest came at his birthday party over the weekend which today we learned many teammates attended. inside the 49er locker room. ray mcdonald was not at his locker or available to the media. but for the first time since his arrest, multiple teammates spoke out and expressed support. calling him a person of good character. >> i know ray is a great guy. everybody in this locker room knows ray is a great guy. >> the truth will come out. >> reporter: that was mcdonald sunday morning as he was leaving jail. the 49er was arrested on felony domestic violence charges after this 911 call. >> her fiance was hitting her at this address. and was trying to pull her out of the house, she's 10 weeks pregnant and refused medical. >> reporter: today police released new details. >> we know that the officers

observed visible injuries on the victim. therefor there was probable cause to arrest mr. mcdonald for the felony domestic violence charge. >> i was actually leaving. i was on my way out and i saw cops around. but as far as what went on, i don't really know. >> reporter: tight end vernon davis says he and the majority of the team attended the birthday party held at mcdonald's san jose home in the silver creek area. >> quite a few guys. it was a big number of guys. but i'm not sure if it was half or you know if it was 75%. i'm not sure. but i know guys came to support ray on his birthday. >> what creates a big legal problem for the 49ers is if there's a number of people who were present at the party and saw the couple interacting, they may have to testify in court. >> reporter: the 49ers say they're still trying to gather as much information as they can. >> domestic violence is not something that will be tolerated within the 49er organization, period. >> reporter: the alleged victim

does not need to cooperate for the case to move forward. >> the victim can says i won't testify, but that doesn't mean the case gets dropped. only the da can drop a case, and only the d.a. can initiate a case. >> reporter: and as of this afternoon, the santa clara district attorney's office said it had not yet received the police report. it is still unclear if mcdonald will be playing in sunday's game. live tonight in santa clara, maureen naylor, ktvu channel 2 news. more details now, the legal analysts we spoke to said the district attorney looks at several factors. those factors include the severity of the injury. if there's a history of domestic violence and whether alcohol or any threats were involved. so far the nfl has not commented on mcdonald's arrest. last week the league announced a new policy on domestic violence. commissioner roger goodell said a first offense will be subject to a minimum suspension of six

people in san francisco's china town are on alert after a series of home invasions.

ktvu's amber lee is in a part of the city where people tell her they no longer feel safe. >> reporter: police released this sketch of a person wanted in home invasion robberies. the most recent took place thursday. in this community known for being a tourist attraction, and not a magnet for crime. a line of dance worked its way through the streets of china town. a celebration of a newly elected community leader. but on the minds of those who live and work here, a major crime going on in the alley ways. >> we need to fight back. we need to be alert. >> reporter: since july there's been two burglaries and two home invasion robberies including one here on waiverly place. police say a man somehow got through the front door of this building and attacked a 65-year- old woman in her third floor room who asked us not to

identify her. >> this child tells me the man held a butcher knife like this one to her neck as he demanded money and hit her head three times when he didn't find catch, he took her iphone and bank card. after the robber left, she ran to her neighbor for help. in cantonese quan says he ran downstairs to lock the door who he believes was left unlocked by the garbage man. >> he will go in and slide the doors. either the door is unlocked or partially opened. >> i've lived here for 25 years, all my life. >> reporter: ana spoke to us with the agreement that we don't identify her. she says she lives in the same home that the burglary took place. >> i changed the location of my

a few days later authorities arrested six people on weapons charges however the shooter has not been identified and police have yet to recover the weapon used in the killing described as a black pistol with a large magazine. governor brown asked president obama to declare a major disaster for california following the napa earthquake. economic impacts of this event will be extensive. last month's 6.0 quake caused damage throughout the area. the governor also issued an executive order today clearing the way for additional financial assistance for those in need of help. and scientists say imagines from a new satellite confirm the quake occurred along the west napa fault. they point to rainbow colors showing varying degrees of earth movement. the extend of the movement suggests the fault slip

continues further north than they have managed to document. the san andres fault runs through pacifica. >> we could all fall into the ocean. >> reporter: seismologist of the usgs and stanford are studying the fault hoping knowledge can prevent such a catastrophe but they may not be able to complete their work. the project is running out of money. >> unless there's a big step up in the funding we won't be able to do the key experiment. >> reporter: the fault runs through the gulf of mexico to cape mendecino. seismologists have placed a project to study it. they've already drilled 2 miles deep in order to install

instruments within the fault's zone. but they need for hundred -- but they need more funds to complete the project. but getting the money doesn't look good. the national science foundation says it's considering over projects. scientists have been trying to convince the foundation to reconsider. seismologists say they can still keep the lab running even without the foundation's money but without it there's much they won't discover. >> we would like to be able to understand if small earthquakes that are happening today are pertaining something large will be happening soon. >> reporter: the residents are also hoping that the money will come soon. >> if people don't know what's happening people could get hurt. >> reporter: seismologists hope to hear back from the foundation by march. rob roth, ktvu news. the temperatures dropped

almost 15 degrees. there's a lot of fog out there. right now we have fog from cape mendocino south of point conception. the marine layer is very deep. up to 6,000 feet. coastal hills average about 1,000. so you go 2,000 feet you're 1,000 feet over that. all this moist cool air is pushing into bay area neighborhoods, into your neighborhood tonight. out toward fairfield and vacaville. low clouds tonight and tomorrow morning. current temperatures are on the mild side. upper 50s, low 60s. the winds are blowing out there pretty brisk -- briskly. here we go with the forecast mod el where -- model where we are in the morning hours. you're on your way into davis up here up into the delta area. and then you've got fog showing up in livermore. it's not showing it in this area at the mountain view but i suspect it'll get in there tomorrow morning. it'll wrap its way this way.

police in san jose are looking for a man involved in an attack. the people on the video appeared to be carrying out some vigilante. >> reporter: you can see the repeated blows from a father that father alleging the older man showed his private parts to his son. >> assaulting the alleged suspect of an indecent exposure is not okay. and that itself is a crime. >> this assault happened in san jose. in the video filled with expletives and punches, you can hear a woman screaming for someone to call 911. that eventually happened but not before the father left the older man bloodied. >> we never ever condone vigilantism. we want them to call police,

new information on what might be a nationwide data breach this time at home depot. and it may be one of the biggest yet, bigger than target. jana katsuyama is live in newark why targets may be victims of fraud. >> reporter: home depot actually september -- sent me a statement saying they are investigating. hackers might have been able to access credit card and debit card information from all home depot stores. >> yeah i use my debit card. they're probably not going to take as much as somebody if i

carry cash around. >> reporter: the security guard reported several banks are seeing evidence that credit card and debit card from home depot may have been breached from all home depot stores. if confirmed it would be larger from the target breach where data was stolen for three weeks. >> now they're being sold in batches. >> reporter: stolen card data is often sold online in black market. >> they give you everything like state, zip. >> reporter: several batches of stolen card datas went up for sale today online with the names european sanctions and american sanctions. which some say suggests retaliation for recent western sanctions against russia. the u.s. has not implemented a pin system which other countries have, the u.s. laws are set to change. >> it's going to be in the mid-

of nude pictures were not its fault. instead it's a part of a very targeted attack on individual accounts. the fbi said it is aware of the hacking incident but offered no further information. the ceo of the catering service company center plate has resigned after video surfaced of him kicking a dog. the company runs the food service at at&t park and levi's stadium. the video was recorded last july inside an elevator in vancouver. a man said to be hague is said to be kicking and choking a pincher named sadie. over 1,000 people signed a petition asking the company to fire hague. central valley farmers are asking the state's supreme court to review a lower court ruling that has allowed the project to go forward. the lower court approved the

state's plan to issue bonds for the bullet trains. the current cost estimate for the rail system is $68 billion. a new state law meant to help keep children safe on their way to school is about to take effect. starting september 15th. drivers must give 2 feet of distance while a passing a bicyclist. if they can't stay 3 feet away, drivers slow down and pass when it's safe. state law requires children under 18 to wear a helmet while cycling. more than 5,000 vehicles were stolen in san francisco last year. now a city supervisor says it's time to reduce the thief's pay the city tow when those cars are recovered. as ktvu's david stevenson reports some people can feel victimized a second time. >> reporter: 5,700 vehicles

were stolen last year. now there's efforts to make it easier for people to recover their stolen cars. >> you can get fees and add up to the hundreds and thousands of dollars. >> reporter: auto return which contracts with the city towed almost 1,200 stolen recovered cars in the first half of this year. owners are given 20 minutes to reclaim their stolen car from a police officer. and a grace period before the fees kick in. >> in some instances the fees may be higher than the value of the car. >> reporter: the fees include an administrative fee, other add ons storm warning fees ranging from 56 to $65 a day. >> we have to store that vehicle, we have to make sure that you know we do our part to make sure it's maintained. and if no one picks it up we have to auction that car off. >> reporter: the fees on stolen vehicles may need to be cut before the city signs a new

pushing the temperatures lower. now that it's stretched out it's started today and will continue into tomorrow. the fog and low clouds are going to have a clear shot at the inland valleys. this is the coverage for today. santa rosa down big time. antioch didn't quite get it. tomorrow antioch will notice the cooling. but the rest of the temperatures will work pretty well for tomorrow's forecast highs. you will see lots of mid-80s. there's plenty of fog at the coast. it's already pushing well inland. you have fog up in the delta. you have fog in fairfield. fog in livermore valley. you have big winds out here as well. just transporting all this moist cool air into the central valley. which helps the fire danger a ton ooze you know -- a ton as you know. it's calm in san rafael. but at the san francisco airport we have calm too. the winds were gusting to 30 miles per hour.

10-mile an hour winds to livermore. the fog has really been pushed inland. what we're looking at, for temperatures to continue to stay on the mild side. the pressure center drops down and you know the cycle, the cycle stays with us pretty much all week. as we have a semi per -- persistent low. it's not pinched back. in the afternoon hours it'll burn back. but you have all that cool air in place. toward the wintertime you can see temperatures 90s are well inland. mostly for us 70s tomorrow with low 80s. a nice cool day. good air quality. 76 in napa, 78 in vallejo. there's upper 80s out there in the far edges. the southern eastern edges of the bay area to get those. along the coast it's going to be cool. then upper 50s and maybe some drizzle. the five day forecast with the bay area weekend in view. that looks like last week which
