american man possibly mixed race. he's balding. 5'5". about 145 pounds. >> 7:07. there may have been another big security breach at a major retail chain. home depot and its customers may be the latest victims of a cyber attack. jag is joining us live in san jose to tell -- janine is joining us live in san jose. >> reporter: every customer i've spoken to tells me that they've grown to expect these type of security breaches. just because they hear about them so often. they are eager to see what home depot and law enforcement uncovered. the security website reported that numerous banks were seeing evidence that home depot may have been the source of stolen credit and debit cards up for sale in underground markets. the website indicated several banks believe the breach could go back to april or may of this year. if that's the case. it could be larger than the

security breach at target last year during the holidays. that breach -- in that breach, there were 40 million cards data that was stolen in just three weeks. home depot released this statement. at this point, i can confirm that we're looking into some unusual activity and we are working with our banking partners and law enforcement to investigate. if we confirm that a breach has occurred, we'll make sure customers are notified immediately. >> it almost seems inevitable. it keeps happening. i used the credit card for all of my purchases. i feel like i have a little bit of backup. they make me up if there's something that was used and it wasn't me that did it, they will, you know, take care of the cost. >> reporter: the u.s. has not implemented a chip and pin system to make credit cards more secure. u.s. laws are sent to change and merchants will be able to

and russia. now a statement from ukraine's president this morning says he and russian president vladimir putin reached an agreement on a cease-fire. but a spokesman for the president of russia says that's not accurate because russia is not a party to the conflict and therefore cannot agree to a cease-fire. now, that spokesman says what was agreed to were steps that would lead to a cease-fire. back here at home, police in santa rosa think a motel room killing over the weekend was a marijuana deal gone bad. the victim, 21-year-old max winerib was shot several times sunday night inside a room at the vagabond inn. investigators say he met people at the hotel and talked about buying marijuana. his family is offering a $5,000 reward for information that would lead to an arrest. well, the ground is still shaking in napa ten days after the 6.0 earthquake. the usgs reports an after shock

measuring 2.7 hit the napa area around 3:20. no reports of any damage but certainly people probably felt it. now building inspectors say there are now 129 red tagged buildings in napa deemed too unsafe to enter. 20 buildings were taken off the red tag list following the latest inspections. governor brown has asked president obama to declare the napa earthquake a federal disaster. in this letter to the white house, the governor says, economic impacts of this event will be extensive. the earthquake caused significant damage throughout the region. a disaster declaration would trigger the release of federal funds for recovery efforts. the governor also issued an executive order clearing the way for additional assist tins for those in need of help. this alert, this one send by the university it's an early- warning system. it was sent ten seconds before the quake hit.

the conference is aimed at developing a statewide emergency system. supporters say it will give people critical seconds to take cover help their loved ones and also shut down public transportation. scientists from the usgs as well as stanford university they are trying to get information from the san andreas fault that could help predict future quakes. they set up a lab right on the fault in the central valley part of parkfield. they've already drilled two miles down into the fault. they've installed instruments inside the zone but they need $10 million more from the national science foundation to conduct a key experiment. the foundation says it may provide the money to other projects. >> the goal was to get inside of an earthquake and understand how they happen. how do they start? does anything happen before they begin. the scientists say they can keep their lab running without the help of the foundation's money but it won't learn nearly as much. they've been told, they are gonna find out by december if

they will be getting that $10 million. santa cruz police are offering a special reward for information about a serial shoplifter. this is the latest picture of the mustached suspect. police say he has stolen electronics from the store three times since july. he made his fourth attempt last tuesday but ran away after being confronted by a costco employee. if you recognize the man, please call police. officers will give tipsters this drinking glass complete with a painted on mustache as a reward. the blog claims the glass will be signed by the city's chief of police. that's an interesting reward. >> it is. 7:17. i gotta tell you, we've got a lot of traffic problems. >> brian flores following all kinds of problems. >> and animals in the roadway. i wish i had better news on this wednesday.

drugstore chain in the nation will stop selling tobacco products. they beat their own october 1st deadline by removing tobacco products from the shelves. they say selling tobacco is not in line with the healthcare mission. they got a lot of support after the move was announced back in february. an attack. it happened inside of a public rest woman -- restroom and was caught on camera. why the police say are saying not so fast. the downside to having your stolen car recovered. why it's costing some owners, hundreds, maybe thousands of dollars in the rush to get rid of a fee in san francisco that has people saying, they feel victimized twice.

sunny skies. welcome back to "mornings on 2." city supervisor scott wiener wants to make sure the owners of stolen cars last year are not victimized a second time. by towing fees. auto return takes stolen cars to their storage yard. when the owners go to claim the car, they are told they have to pay hundreds, maybe thousands of dollars in towing fees. while a $254 city cost that's normally waived for a stolen car, there is a $218 towing fee plus the storage expenses and that can range from 56 to 65 a day. >> we should have a reduced towing fee and storage fee for cars stolen. they shouldn't be stolen the same at someone who parks illegally. >> scott wiener wants a hearing about all of this. he want as reduction in the fees before the city signs a new contract with that towing

good morning. welcome back to "mornings on 2." we are following developing news in the east bay. you are looking at a live picture of a growing memorial in pittsburg for a woman hit and killed by a driver who then sped off. alex savidge has been reviewing surveillance video showing the deadly crash and coming up in two minutes, he's gonna tell us about a major new development that police told him about about within the past half an hour. thank you for joining us. the system that moved into the north picked up that fog bank and said i'm taking it up and down the coast all the way down to southern california. 50s and 60s. most of these temperatures haven't moved. 60s for almost everybody here on the peninsula including menlo park. 61, la honda. los altos hills, 60. belmont, 60. palo alto airport 63. that's a lot of gray. it will be slow to burn off. inland temperatures will be in the 78 os for most or 70s for some. these will be below average, coast aband 60s and 70s. a couple of multiple darr accidents this morning -- car accidents this morning. highway 17, our photographer sid made it to the scene there. this is north of scotts valley. this is -- at least three of the cars there, some damage to at least three of the cars there. we hear 12 cars were involved this morning. this affected traffic both directions on highway 17 through scotts valley into lexington hills. as you can see, it's pretty foggy there as well. but traffic, at least moving

through there slowly but surely but it did cause headaches for most of the morning. take a look at the maps. the other multiple car accident, southbound 6le 80 at least -- 680 at least four cars involved. we also understand there was a deer running on the freeway in the number five lane that was causing commuter headaches. and then taking a look at the bay bridge toll plaza, highway 24 there is another obstruction there. look at the bay bridge toll plaza, traffic backed up all the way to the maze. back to the desk. we're following major new developments in that deadly hit- and-run case in pittsburg that happened over the weekend. a short time ago, we found out that a newly release load -- released surveillance tape has led to an arrest. alex savidge has more information. >> reporter: good morning. i spoke a short time ago with the victim's husband who came out here to the crash scene.

he's grateful for the hard work of police and a police kasten with pittsburg police confirmed a short time ago a man was arrested at his home in baypoint and investigators do believe that man was the driver of a pickup truck that struck and killed a woman. this past weekend here along willow pass road. that arrest came hours after police released this surveillance video that showed the deadly crash that happened about 7:00 on sunday night. you can see the pickup truck veer off the road. it took out a light pole before hitting the victim. 50-year-old michelle braz was left to die here at this scene. the wife and mother lived a few blocks away. her husband who spoke with us a few minutes ago told me it's good to know police have made an arrest and it does provide some sense of relief. >> i'm just glad and happy that a person like this is off the streets so they don't hurt anybody else. and i'm really proud of the diligent work the police station did and the detectives

in finding out who the perpetrator is and they have him in custody so they can expedite the justice that needs to be inflicted. >> reporter: the victim's husband believes the surveillance video was critical to helping investigators make an arrest in this case. police have not identified the man who they took into custody last night. they've also not spoken or offered any information about why that man may have left the roadway and jumped up on the curb or why he left the scene on sunday night but police say they will have more information later this morning. we're live this morning in pittsburg, alex savidge, ktvu channel 2 news. >> state regulators have imposed a record 1.4 billion fine against pg&e for the deadly explosion. the state puc made that ruling four years after the pipeline killed eight people and

destroyed homes. the 1.4 billion has to come from shareholders not pate rayers. but the puc angered many city leaders by desiding a stbl amount of that money will go to california's general fund. >> this reflects a payday for governor jerry brown. when we believe this money should be directed to a safer pipeline system. >> pg&e is likely to appeal the decision. it now has 30 days to do so. >> a plan to build a new ceremony is sparking a controversy. to for the past decade, developers have been working on the creekside memorial ceremony in the southern foothills of mt. diablo. at 220 acres, it would be one of the largest cemeters in the bay area with a capacity for more than 100,000 grave sites. >> this is a photo showing part of the area. people opposed to the plan say they are concerned about the amount of water the cemetery will use. those in favor say it's badly

needed to accommodate the area. the planning commission is expected to decide on the plans this fall. 7:35. california's drought has more people closely watching their neighbors and thousand they use water -- and how they use water. bay area water agencies are getting a lot of calls reporting water waste. the santa clara valley water district received 240 complaints in the month of august alone. that's four times the number reported earlier this year. oakland's lake temescal is back open. the lake's water quality has improved. last month, swimming out there was bad because of potentially hazardous toxins from an algae growth. now the lake is open through next month. park rangers will keep an eye on and monitor that water. a series of plaques honoring members of the lgbt community was recently unveiled in san francisco. it looks like a few details

on the alleged victim when they arrested mcdonald. the 49ers are still investigating. they haven't made a decision on whether mcdonald will play in this sunday's season opener against the cowboys. this arrest could be the first test of the nfl's new policy on domestic violence. three days before mcdonald was arrested, nfl commissioner rooger goodell announced the first offense for domestic violence will result in a minimum suspension of six games without pay. a second offense could lead to being banned from the nfl. a san jose police officer charged with sexual assault while on duty is now facing a new charge. back in may, jeffrey graves was seen on surveillance video show throwing a -- throwing a $20 on the counter and walking out with a bottle of vodka. that happened at 2:30 a.m. graves is also facing charges that he raped a woman while on duty while last year after

welcome back to "mornings on 2." 7:43. san jose police are looking for witnesses to an attack inside a men's restroom that was all caught on camera. ktvu obtained the cell phone video. we have blurred faces of the everyone involved. police think the incident that happened monday night at fowler creek park may have been a case of vigilante justice. in the video, a man who is a father beats up an older man that he accuses of exposing himself to his son. now, someone eventually calls 911 but not before the older man's face is bloodies and stolen. we talked to a visitor who thinks the attack may have gone too far. >> there was a lot of communicating of different cultures. i don't think they understood the idea that it's possible for him to not know what's going on. >> police have interviewed the

older man who speaks limited english. they hope to talk to other people who saw the incident to determine exactly what happened. the centers for disease control say the latest ebola outbreak is out of control as another american doctor is infected. yesterday a missionary doctor tested positive and was placed in isolation. it's not here clear how he contracted the disease sis he was not working with patients. the director of the cdc cdc says it mate be much worse than expected -- it may be much worse than expected. >> getting more work done in the communities, safer burials, all of these things will begin to get this outbreak under control. >> president obama is promising u.s. support and aid to help battle the outbreak. the fda has given the green light for a new human safety trial to begin this week. this will be the first-of-its-

kind trial on humans. 7:45. some pediatricians have a new idea for some students, let teenagers go to school later in the day. recent studies have found starting the school day after 8:30 in the morning. it helps improve learning and overall health, the american academy of pediatrics said starting classes before that that cuts into teenagers sleep. now, educators say the biggest obstacles are how do you shift schedules so that after-school activities are not affected and school buses can be available to both younger and older students. one school in michigan already taking this very seriously. starting this week, it's giving students the option. they could go to classes only in the afternoon. the nextus academy starts at 12:30 and ends at 4:30. students can choose if they want to go to traditional classes in the morning or do

their other work online. the school said it will evaluate how the new schedule is affecting students a as the year -- students as the year moves on. the highway patrol is talking about a new law designed to keep bicyclists safe. drivers have to allow three feet of distance when they pass a bicyclist. if you can't stay three feet away drivers have to slow down and pass when it's safe. drivers who don't aobey this, you could be fined. the fines start at $35. the law doesn't state what about the bicyclist passing the car. >> we were talking about that. it doesn't specify that. it's kind of interesting. what if you are ahead and the cyclist comes up next to you. is that space supposed to be created there as well? >> yeah. better news for drivers getting into the south bay is what brian says. santa cruz area? >> yeah. >> it's been bad.

>> yes. better news, at least for the most part. good morning. want to go to some live pictures. our forecaster sid out there -- photographer sid out there. we've been talking about this northbound accident affecting both lanes. this is the northbound direction. the cars have been moved out of the way. they've been towed out of the way. there is a huge backup still. that residual traffic that's going all the way into los gatos all the way down to santa cruz and then this is video of the cars that were damaged up to 12 cars were damaged in morning. as you can see, there was the low clouds, possible floog. unclear whether that played a role in the crash but we'll be keeping an eye on that. highway 17 still major backups. the other major problem in the concord area. southbound 680, there was a multiple car accident affecting the number one and two lanes. up to 6 cars affected there. the sig-alert has been lifted. but as you can see, residual

killing has not been recovered. home depot is apologizing after news surfaced that someone may have broken into the company's computer network and stole credit and debit card numbers. janine de la vega joins us from san jose at a home in home depot with what she's learned. >> reporter: home depot posted a message on its website and through its soak media this morning. -- soak media this -- soak media this morning -- social media this morning. if they find that credit card information was stolen, customers won't be responsible for the charges. there's evidence that the credit and debit card info may have been stolen from late april to early may. it could have involved all 2200 stores in the u.s. if that's the case, it would be larger than the breach at target last year where data from 40 million cards was stolen. a home depot spokeswoman

you have this new information. >> reporter: detectives have been working on this case around the clock. they say last night they arrested a man at his home in baypoint. they do believe that he was the driver, behind the wheel involved in this deadly hit-and- run crash over labor day weekend. this arrest came a few hours after police released this surveillance video from nearby that crash scene that shows the crash itself on sunday night. police captain did tell me that video was quite help for investigators. the police say he was we hind the wheel of a chevy pickup truck that veered off willow pass road. taking out a light pole before hitsing the victim -- hitting the victim. michelle braz was found dead at the scene. this wife and mother lives nearby in baypoint. her husband told me it's good to know police have made an arrest. it does provide some relief. >> i'm glad and happy that a person like this is off the streets and so they don't hurt

welcome back. 8:42. let's bring you up to date on some of the top stories for you -- home depot hit by a cyber attack, credit and debit card information may have been stolen. a cybersecurity company says that info is being hoff offered for -- offered for sale. experts say all 2200 home depot stores may be involved. if that's confirmed, this would be bigger than the data breach that hit target stores last november. san francisco police investigating several home invasions and burglaries in the chinatown neighborhood. a suspect recently got into an apartment held a butcher knife at the throat of a 65-year-old woman and stole her cell phone and bankcard.

video was posted showing the execution of james foley. it appears both men were killed by the same man who called their executions retribution for u.s. airstrikes on isis targets in iraq. sotloff was a freelance journalist captured a year ago while reporting on the conflict in syria. the president said that the horrific acts only unite us as a country and stiffen our resolve to take the fight against these terrorists. >> whatever these murderers think they will achieve by killing inmow sent -- innocent americans, they have failed. americans are repulsed by their barbarism. we will not be intimidated. >> the president said the u.s. will continue to lead an international effort guns what he called a barbaric and empty vision that isis represents. they are threatening to to behead david haynes.

according to the guardian, they are looking at every possible option to protect the person. claudine wong, ktvu channel 2 news. 8:45. new this morning, after weeks of battling the ebola virus, a missionary doctor from north carolina is talking about her experience for the first time. nancy britebol contracted ebola while working at a clinic in liberia. while there, her duties included disinfecting staff entering or leaving the treatment area. on july 25th she was diagnosed with the virus. shortly after that, she was flown to a treatment center in atlanta and then on august 19th she was release. this morning she talked from the north carolina campus of the charity she was working for in liberia. >> i can't wait to put my arms around all of our children and all. our grandchildren. and we hope that will be soon.

>> now, today's news conference comes as a third american missionary doctor tested positive for ebola while working in liberia. the head of the centers for disease control says the outbreak is out of control. the fda is already giving the green light for a safety trial to start this week. san jose police are looking for witnesses to an attack inside a men's restroom caught on camera. ktvu news obtained the cell phone video. we've blurred the faces of everyone involved. police think the incident that happened monday night at fowler creek park may have been a case of vigilante justice. in the video, a man who is a father beats an older man he says exposed himself to a son. someone eventually calls 911 but not before the older man's face is bloodied and swollen. we talked to a frequent park visitor who thinks the attack went too far. >> it was a lot of miscommunication. if you heard something like this, you would be all up in

montague expressway. i'm gonna drag the map here, talking about the earlier accident on highway 17. again, traffic being affected from scotts valley as you approach los gatos. take a look at the bay bridge this morning. it doesn't look too bad but there is a small accident as you approach treasure island. traffic from highway 24 backed up all the way to the caldecott tunnel. it could be a very messy commute as you approach the bay bridge toll plaza. san mateo bridge, not any better. pretty busy as you approach the high rise into foster city. busy on the dumbarton bridge. a lot of fog, gray skies even with sunshine inland. temperatures will be below average. a lot of 70s, 80s in locations that were really hot on monday and the fog says i don't think i want that to last. this time of year, you get some heat and it's out of there. that's the system responsible up in vancouver, also seattle. a little piece of the energy is

hurricane strength and move northward. the remains of dolly has moved in. the combination of these two could give the desert southwest some rain. it doesn't look like it will make it into southern california. it should stay into arizona and new mexico. the fog is in place but a cool and breezy pattern. morning overcast, if you have it, you probably feel the breeze. now, it takes a little bit stronger system than this to cool down. ukiah and clearlake. but everyone else 70s and 80s. 60s, 70s. temperatures will continue to slide right in here. these are bele average. san jose should be closer 82. not much change. looks very quiet for the first week of september. >> it. britain's prince harry will be getting a difficult from 4eus mother, princess diana when he -- from his mother, princess diana, when he celebrates his birthday. her wedding dress will be given to harry and his older brother.

welcome back. 8:54. persistent thieves in edwardsville, cab sis repeatedly smashed the front of this convenience store trying to steal that atm. the video shows one of the men trying to open the atm when they couldn't, they smashed a van into the building over and over and over again. in the end, they only stole the atm's computer which they later threw away. but they did cause $30,000 damage to that store. police are out there looking for the suspects. it may be hard to track them down because that getaway van has a phone number on it, too. witnesses were able to stop a thief at a high school in danville but the damage done, that's putting school activity there in jeopardy. police were called to san ramon

valley about 4:00 yesterday morning they say a 41-year-old man from alamo was stealing copper from the lighting system. the police stopped them. none of the lights work right now. the school doesn't know if the lights can be rewired in time for tomorrow night's freshman football game. hopefully, we'll be able to get it fixed by then. if not, we've been down this road before. we'll come up with other plans. now, the coach says that the lights can't be fixed in time, the game probably be played earlier in the day. california's drought has more people closely watching their neighbors and their water use. the san jose mercury news reports, bay area water agencies are getting a lot of calls from people reporting water waste. now the santa clara district received 240 complaints in august alone. four times the number reported earlier this year. good news oakland's lake temscal back open.
