governor jerry brown and challenger neil kashkari face off in their own debate before the election. good evening i'm julie haener. >> and i'm frank somerville. it was the veteran against the first timer tonight. one man 35 years older than the other, one with little to lose, the other with everything to gain. ktvu's ken pritchett attended the debate at the senator hotel across from the state capital. ken is live now with how it went. ken. >> reporter: frank, it was certainly a spirited debate but the question is what impact if

any will it have on the election now two months away. especially with governor brown enjoying a 16 point lead in the latest field poll. >> issue that is hit home. >> reporter: there were two definite team's in tonight's debate. brown on california's recovery. >> four years ago when i went to sacramento the place was in shambles. we were being turned a failed state just like greece. that's not the case anymore. >> reporter: the other theme kashkari's contention that recovery is still not at hand. >> his 40 years in government has left him out of touch with the struggles of working families. he's declared a california come back but in all, our middle class is all but detroyed. >> you learned your job well there working at sachs. kind of like the arsonist puts out the fire.

i really appreciate that. >> reporter: kashkari painting brown as the problem. >> i did not come from a rich family like you did. >> reporter: most talked about kashkari's pledge to kill high speed rail. >> he's raising your taxes to fund what i call the crazy train. >> that will have $8 billion of impact economically. it's a good bet for the central valley. it's good for california. >> reporter: there was certainly a different style. brown is a more experienced debater and tonight he seemed more on the offensive. at one point in reference to that 16 point lead not poll,

brown said kashkari himself didn't have much expectation to win. that will be decided in november. as for any more debates the governor seemed to close the door on that idea tonight. ken pritchett, ktvu news. >> on ktvu.com we posted more video on tonight's debate. you can watch an extended tip on tonight's hot topic. tesla plans to build its coveted production factory in nevada not california. nevada governor is asking state lawmakers to sign off on more than $1 billion worth of incentives. late tonight he announced the electric car maker plans to build its factory near reno. elan musk said that the plant is about more than incentives. >> nevada is a state that is very agile. where you can get things done quickly and get things done.

>> the plant is expected to raise millions of the dollars for nevada. new information on the five alarm fire that burned this afternoon and burned for several hours right in the heart of san francisco's mission district. right now firefighters are still on the scene at mission and 22nd street. and at this hour that part of mission is still closed to traffic. more than 100 firefighters were called out. >> reporter: nine hours later they're still pouring water on it. worried that it's smoldering down deep and could flair up. you can see this store is gutted. it's merchandise trashed.

so much merchandise it made the fire very difficult to fight. from news chopper 2, fire ripping through the roof of a three story retail building. on one of the city's busiest corridors. well before these flames pushed through. >> difficult to fight, nasty, challenging. >> reporter: nauseous smoke billowed from the building and spread over the mission. >> i'm scared to go home because i don't know how much toxins are in the air. >> i think it's pretty frightening and sad. this is my neighborhood. >> reporter: smoke inhalation spent two firefighters to the hospital for observation. several bystanders were momentarily sickened as well. the stench of burning plastic was powerful. this is the store that was burning, big house wholesale, crowded inside and out with clothing, luggage, toys and gifts. more merchandise arriving in a shipment today. in a store so packed

firefighters couldn't maneuver or get hose lines inside. >> family owned it and there were some employees working there too. >> reporter: this neighboring merchant says everyone ran out of the store when the fire started in the back. >> i came in here, took him inside but there was too much smoke. i talked to him and i said what happened and he said i don't know. >> reporter: firefighters fought the fire from the outside for worries they would be trapped. customers reported aisles were narrow and piled to the top. owners agreed to clear out. fighting the fire from the rear helped keep it from spreading to adjacent building. but the packed store was damaged by smoke and fire, its owner calls it a total loss too. considering how easily an ember might have traveled the chief

says this ending was as good as it gets. >> with the windy conditions it could have been much worse. we have could have lost half the block or the entire block. >> reporter: hours later, this fire is still getting doused because of such dense debris inside. the chief says that lay out is always a challenge. there is no obvious cause here, and it's still too hot inside for investigators to poke around. debora villalon, ktvu news. and now to amber lee who spoke to the owner of the store who says she grew up working at the store. >> reporter: the opener says she doesn't know how the fire started but she saw flames coming from the store. the business of selling goods

of mom and pop stores, lots of property and today's business. but more importantly no loss of lives. >> crazy. so so crazy. my heart is still pounding. >> reporter: picking up the pieces of the owner of the store will be hard. tonight the fire chief tell us in her opinion the building will likely have to be torn down. reporting live in san francisco's mission district, amber lee, ktvu channel 2 news. now to lake county where fire crews have made good progress in their efforts to contain a wildfire. the so called saratoga fire has burned 20 acres north of clear lake. right now the fire is 20% contained. it started burning at 4:00 yesterday and has destroyed two structures. at the moment calfire is investigating a car accident in the area that may have started that fire. environmentalists have filed a lawsuit to block logging at the site of a

massive fire in the sierra. the rim fire last year was the third largest fire in california history. it burned 400 square miles of the stanislaus national forest. now the burned forest has been marked for logging but the lawsuit is asking for that logging to be blocked in order to protect the spotted out which uses dead forest for its habitat. a senior at dianza high school in el cebrante is in big trouble for selling pot cookies that made other students very sick. the students were groggy and slumping over in their chairs. they were taken to the hospital. two other students were sick to their stomachs. that prompted a call to police and a quick investigation with other students. >> they did a great job. they knew some of their students were hurt or ill. and they stepped forward and they investigated themselves and they were coming to us letting us know who was involved, who was doing things. how it was being done. they gave us all the details

right away. >> reporter: police say a 17- year-old girl was selling and giving away pot cookies. she was arrested on nine felony counts including possession and selling of drugs at school and child endangerment. school officials say she may be expelled. still no verdict tonight from the san francisco 49ers on whether ray mcdonald will play this sunday following his arrest for domestic violence. the team is set to fly to dallas tomorrow for the niners season opener on monday. the 30-year-old was arrested early sunday morning at his home in san jose. his fiance had visible injuries though no charges have been filed. a 70-year-old man knocked unconscious by an attacker and the callus reaction that has the man's family so upset. >> my dad was laying there for over an hour. approached by a would be kidnapper. >> he tried to grab me from my arm and he was pushing me in

female comedians today. she super paveed the way. >> always care about what you look. >> reporter: stand up comedy lydia popovich dedicated her act to rivers tonight. >> she's the first female comedian i saw that made me realize that as a woman you can actually do comedy. i had never seen a woman do stand up before. >> reporter: a woman who never let show business beat her down. >> i was bankrupt, my husband committed suicide. i mean, it's okay. and i'm still here. so it's okay. >> reporter: rivers is survived by her daughter melissa and grandson cooper, her funeral is scheduled for saturday in new york. the new york city clinic where rivers suffered cardiac arrest is now being investigated. rivers had gone to yorkville endoscopy. any complication in a procedure

would routinely be investigated. at this point there's no indication of wrong doing. now two new developments in an attempted kidnapping of a teenager in richmond. police say they arrested a man this evening after someone in the community recognized his photo on ktvu news. these are the pictures that helped lead police to joshua man. late last night a 15-year-old girl said someone tried to grab her as she walked to school. but she got away and reported the incident to police. today the teen told ktvu off camera it wasn't long after that she saw the same man again. >> and i felt like if someone was behind me. like outside of the truck, and i turned around and it was the same person. >> reporter: the teen's family snapped the photos of the man and that quick thinking paid off. police say the girl and her family did everything right from fighting off the attacker to snapping the pictures. >> new information about a body found in a car in san jose.

san jose police now say it appears to be part of a murder suicide. news chopper 2 flew over the crime scene last thursday. officers say they found leon do in the car dead from a stab wound. homicide detectives think that her son killed her then killed himself near by. detectives also said they don't think there are any more suspects in the case. in san francisco, police say they've arrested five males for the robbery of two german tourists. only one of the suspects is an adult his name is adrian sanchez. the other men are juveniles. >> a reward is being offered in los gatos for information involving vandalism in the downtown area. since late july at least three

new video tonight of rapper mitchy slick walking out of the marin county jail. he was behind bars for allegedly holding a woman captive at his home in el anselmo. police say the rapper could be facing several felony counts including one for kidnapping. but prosecutors allowed his release tonight siting a lack of evidence. more on the case now from ktvu's john sasaki. >> charles mitchell or mitchey smith had been in jail. you can see him on this video. the rapper was arrested after turning himself in. >> there are charges being placed against him for

kidnapping, false imprisonment, brandishing a firearm, being accused of conducting this criminal activity as a member of a gang. >> reporter: investigators are saying little about the crimes or the victim. >> it would be inprudent for us to provide any information about the victim in the case. including her safety. >> reporter: the district attorney has decided to release the rapper until police have gathered more information. >> occasionally i see him driving out of the house. never talked to them, never everyone know them. >> reporter: last night the sheriff's office raided his home but missed catching mitchell. a neighbor showed us these photos. >> they were just going through the house. there were lights inside the house so i guess they got into the house. >> reporter: the mayor spokesman told me the footage was from an event celebrating

marshawn lynch. she says she does not know mitchell and did not give permission for the use of her imagine. community members came together in san francisco this evening in a march for peace. escorted by police and to the beat of drummers. the demonstrators marched to the beat of drums. >> we're here because we first want to bring various members of the community together. hopefully -- hopefully form a collaboration. a young volunteer from berkeley dies over seas. tonight at 10:45, allegations that the peace corp. mishandled his medical care.

new at 10:00, the search for an attacker after a 70-year- old man was assaulted at a park. the victim still has not regained consciousness. it happened on sunday while the man was picking up recyclables. azenith smith spoke to the victim's family and says other people might have seen the

attack but nobody stopped it. >> reporter: this man is in critical condition, doctors told his family his chances for survival are slim. >> my dad already went through two surgerys to remove his two side of his skull. >> reporter: outside the medical center, wong's daughter who asked not to be identified said her father is supposed to turn 71 next week but she's not sure he will make it to that milestone. >> my dad is a very peaceful guy. he's very quiet. never raised his voice. he loved this country very much. >> reporter: last sunday around 6:45, wong was collecting recyclables when he somehow got into a confrontation with partygoers. one of them knocked him in the head knocking him unconscious to the ground. >> he's a 70-year-old male. there's not too many 70-year- old males out there causing problems. >> reporter: what happened afterward is just as troubling.

the group continued with their partying for an hour until his wife found him. >> he's got grand kids at home, he's got kids. i don't think anybody deserves to be treated like that. >> reporter: those who frequent this park are stunned. >> why would they do something like this. why? for what? >> the fact that people can do this and the fact that other people stand by and let it happen it's very sad. >> reporter: tonight's wong's daughter is pleading for anyone to come forward knowing someone must have seen something. >> yes, please help us. my dad was laying there for over an hour, nobody called 911 and nobody wept there to help him. >> reporter: the suspect is described as an african american male, 6'tall, 180 to 200 pounds. he was last seen headed into a beige car after the attack. anyone with information is asked to call heyward police.

azenith smith, ktvu news. san jose police have identified the father wanted for punching a man in a public restroom. 41-year-old francisco olivo is being charged with assault. he is seen here attacking an elderly man in a blue shirt. the suspect believed the elderly man had exposed himself to his son. the incident happened in the evergreen area of san jose. police in fairfield are looking for a sexual battery suspect after a series of attacks along a well traveled road. police released this sketch of the suspect. the latest incident happened yesterday when a 17-year-old was attacked as she was jogging near west american drive and sand stone. the man is described as a white male in his late 20s about 5'7" tall with blond hair. police say the description matches several other incidents

in that same area. a furniture store owner is being accused of stealing thousands of dollars from his customers. nguyen peter tran is wanted. first in vacaville then in gilroy and most recently at galaxy furniture in san jose. today a new furniture business moved in and found 10 truckloads of furniture stuffed in a box. in all truong took $20,000 from his customers for furniture he never delivered. there's a new push for federal transportation officials for state to get tougher on drunk drivers. it involves changing california's legal blood alcohol to .05. >> reporter: police say a man

who had been drinks got behind the wheel and drunk a woman and her daughter. >> i don't want people to drunk and drive, no way. >> reporter: federal officials said drunk driving is a national shame. 10,000 deaths in 2012 the latest year available in california more than 800 dead. 28% of all highway fatalities caused by drunk driving. our quick survey today found strong backing for a stricter law. >> i would support it. i don't think anyone should drink and drive. >> when people drink they are not clear on what they're doing. >> reporter: 120-pound woman could have just one generous pour glass of wine and be over the legal limit. >> one glass of wine really makes me feel relaxed.

maybe i shouldn't drive when i'm so relaxed. >> reporter: mothers against drunk driving tell me they take no position on the stricter limit. the restaurant and beverage restaurant is against it, as you would guess. >> perfectly responsible behavior. if you lower the legal limit it would not have a corespondent change on drunk driving. >> reporter: this now may force people to think twice before driving after even a single drink. in concord, john fowler, ktvu channel 2 news. chevron has agreed to a settlement for air quality violations at it refinery in richmond. the san roman company has agreed to pay a $278,000 civil penalty for 27 violations. that includes vapor leagues, permit violations for storage

the oakland raiders are settling a class action with cheer leaders who sued them. the two agreed to a deal with nine raiderettes. they accuse the team of refuseing to pay for expenses. a computer science teacher

has been arrested accused of possessing child pornography. napa police served a search warrant at the home of michael ryder yesterday. they said it all began with a cyber tip that someone at the address was up loading child upon to a i cloud cyber account. ryder is a teacher at a napa school. he has been placed on leave. camela harris told students at pride elementary they've become important role models because attendance is up. she says the more schools that kids miss the more likely they will drop out of high school. harris is pushing for two bills that would help track truancy and state transfers at a state level. >> so we can know when our children are in school and when they're not and then we can engage when they're not and create an initiative such as the one that's being done here. >> pride elementary is cutting

down on absences by figuring out what families need and providing resources such as bus passes and doctor visiting to keep kids in school. minimum wage workers demanded a wage they could live on. in downtown oakland more than 100 people rallied in support of a minimum wage increase to $15 an hour. it's currently $9 an hour in california. they also want the right to unionize. the workers marched to a burger king whereabout 12 people were sited for refusing to leave the intersection. fast food giant mcdonalds said any minimum wage increase should happen gradually the justice department is opening an investigation of the

ferguson missouri police department. ferguson police say they welcome the investigation and this by the way is separate from a probe into the killing of brown. the american medical missionary stricken with ebola in syria is being flown back to the united states tonight. the nebraska medical center in omaha has one of four special bio containment units in the country which are designed for highly infectious diseases. sacra's family in massachusetts says he is very sick but was able to walk to the plane. a a lava warning is in effect tonight for people living on the big island in hawaii. lava could reach a rural community within the next week if it keeps advancing through cracks in the earth. you can see this path here that's cut through this forest. lava has been advancing about 800 feet per day since july 10. lava from this volcano has

from heartbreak to anger. two investigates looking into claims that a bay area peace corp. volunteer could have been prevented. the parents of 23-year-old nick cassel have filed a claim

against the peace corp. they say they want to prevent another family from going through what they have. katie utehs on the internal records and reports that are raising questions about his medical treatment overseas. >> he had a great smile. his smile filled his whole face. >> reporter: nick cassel came on to his own at cal berkeley. >> he just blossomed into a diplomat. >> reporter: nick knew he could make a difference in the peace corp. >> i think he wanted to be a part of that. >> reporter: his dream assignment in china. but seven months in while attending a conference the 23- year-old became ill. >> this was washington, d.c. and i'm like why are they calling me at 2:00 a.m. >> reporter: emergency visas in hand the two left their brentwood home for china. >> it's like you're in a room and everybody knows what's going on except for you. >> reporter: until a peace corp. medical officer finally blurted it out. nick was likely brain dead. sue a former nurse knew they would stop the ventilator that

kept nick breathing and on february 7, she and dave watched their second son die. >> there's this book, that i used to read to him that was called love you forever. and i read that to him. i said good night to him. >> reporter: back home preparing for nick's funeral. another discovery, nick's cause of death, gastritis. commonly known as stomach flu. >> no one dies of dehydration with a medical service minutes away. >> reporter: a review obtained say it is peace corp. doctor that treated him did not appreciate potential signs of a more serious illness.

records show nick reported nausea and fever for several days. a peace corp. doctor saw nick, prescribed an antibiotic then left. around 2:00 in the afternoon, hotel staff found nick passed out in his own vomit. the family's attorney has filed a claim with the peace corp. >> nick's death was entirely avoidable and preventable. >> reporter: but an independent doctor who reviewed the case for the peace corp. disagrees writing, it is my opinion that any suggested changes in the care that was delivered on january 28 would not affect the unfortunate outcome in this case. the cassel's say -- cassels say they just want to make sure other volunteers are safe. >> nick loved the peace corp., i want to honor his service and i want it to be better.

offshore with the strong winds. 64degrees. that buoy a few weeks ago set a record at 68 degrees. we've had very warm water. no it's not el nino but it will factor into this hurricane just off cabo because it's going to get pretty far north. falls apart but hurricanes need warm water to stay afloat or stay together. this one stays together for a long time. a lot of warm water up in san diego. hurricanes need 78 degrees water to stay intact but that warm water allowed to get further north. thunderstorms as we go into the weekend and beyond. the temperatures today look like this. we had lots of 80s. and 90s in antioch. the fog there at the coast. the fog is going to be in your house, or around your house. in your neighborhood tonight. just as it was the last couple of mornings so ton of fog everywhere. deep strong marine layer. we have gusts to 30 or near 30
