a hayward teenager missing since saturday, why the search escalated and has moved across the bay and online. >> reporter: concern is mounting at the largest homeless encampment in the bay area. we'll tell you about the latest action taken by the city that involves these boulders and you will also hear from one of the people who lives here. and if you feel like it's getting harder to find a seat on b.a.r.t. lately, you are not imagining things. we'll tell you why those trains are getting more crowded these days. plus -- tonight, president obama will address the nation on his plan to defeat the terrorists in iraq and syria. the military action the president is expected to order. 7:00. we're live in san jose this morning, where the city is hoping some big boulders, you see some of them right there, will help curb crime in one knower notorious part of the city. janine de la vega is there and she will explain the city's plan and the problems it will plan to address. good morning. i'm tori campbell. >> i'm dave clark. let's talk about weather and traffic. steve knows everything about that. i hope so, dave. but thank you. some thick fog out there. usually we say fog and it's low cloud deck. now it's fog. it won't do much. there's some of it around. a lot toward the coast. it will burn off sooner. inland temperatures are on the cool side. it won't take long and then warm to hot. we've gone below monday. average tuesday. today will be above. fog, 60s to low 70s. around the bay 70s and 80s. we start off with 40s and 50s. a rather cool morning. 56 menlo park.

that's about 6 degrees warmer than yesterday, though. they were an even 50. foster city, 55. belmont is at 57. fog will keep things a little bit on the mild to cool side by the coast. it will be warmer for almost everyone else. warm to hot inland. fog near the coast. some of that fog is snaking its way around. it won't stop inland temperatures from hitting the 90s. 70s and 80s by the water. we're still looking at a commute that's getting busier by the moment. we see a lot of the slow traffic here at the bay bridge toll plaza. you can see it's backed up for a 25 to 30-minute delay and traffic is going to be a little bit sluggish on the bridge itself as you get into san francisco. so this is again a 30-minute drive time. san mateo bridge about a 15- minute drive time from the toll plaza over to the high rise. it looks like someone's car konked out. but it's not causing a major delay on westbound 92. eastbound 92 looks good to the east bay. 580 westbound, same old slow traffic coming in from the altamont pass. it does get slightly better by

the time you reach dublin/pleasanton. 7:02 back to the desk. the search for a missing teenager from hayward, it is now focused on san francisco and the 16-year-old was doing online. on monday, two dozen people with the rescue unit searched open space in the hills above hayward. after an argument with his father last saturday, the sophomore stormed out of his house without taking his wallet or cell phone. >> he will be okay. a lot of people are helping find him. >> yesterday, investigators say his facebook page was used by someone in san francisco. the focus will now center on efforts on the facebook site. they are trying to pinpoint his whereabouts. 7:03. the city of san jose has started bringing in boulders to

block access to one of the largest homeless encampments in the country. that is raising concerns among people who live there. the homeless encampment is near story and center roads and janine de la vega is there where you just talked to someone who lives there. >> reporter: yes. and he says there are a lot of people out here that don't trust the city officials and what they are telling him. now, i do want to show you these large rocks that have been placed here. we were told by one of the homeless people that crews actually dug into the dirt, poured cement and then placed the rocks here so that they wouldn't move. you can see they line this dirt parking lot. this is the entrance point to a homeless encampment. you might be able to see some people there accessing it in the distance. also, i do want to show you these poles that have been put in near the rocks and those have been arrested as a barrier to prevent vehicles from coming in.

these pictures provided by a viewer shows us the boulders being hauled in earlier this week on flatbed trucks. workers have been moving them into place because the city says it wants to prevent illegal activity like dumping. hundreds of homeless people live in the area down below near the creek in the encampment, known as the jungle. the city wants to put up a gate near the entrance. although city officials stress they will provide access to those who need it, such as outreach workers. one homeless man who said he's been told by authorities when the gate goes up, they will leave it unlocked as a compromise. >> they are not telling us when they are gonna put the lock on, and the lock could be put on, you know, in a week. we don't know. so that's a really issue for us as well. the uncertainty of everything. in a way, this is -- we feel like this is kind of verging on distrust from the city. >> reporter: there have been numerous cleanups in an attempt

to get the homeless to leave. but they've always come back. the cleanups have proved to be costly costing thousands of dollars. city officials say they've told us they would like to clean out the jungle by the end of the year and they are working on long-term solutions but it continues to be a challenge because there's not enough affordable housing in the city. reporting live in san jose, janine de la vega, ktvu channel 2 news. >> all right. 7:06. today, a judge in santa clara county expected to set a trial date for the man who is accused of kidnapping and killing morgan hill teenager sierra lamar. antolin garcia-torres faces a possible death sentence if convicted. he's accused of killing the 15- year-old girl who vanished on her way to school more than two years ago. her body has never been found. prosecutors say they are confident they have the evidence that will lead to a conviction and and the death penalty. in hayward police are searching for an arsonist who

reportedly set fire to two vacant businesses in a strip mall. the latest fire happened early yesterday morning at 4 -- at 421 industrial parkway. 24 hours earlier a fire was reported at 413 industrial parkway. this is new video shot this morning of the area where the fire began. in the latest incident, police say someone lit a gas can on fire near the front door of the business. on monday, they say someone kicked in the window of a nearby vacant business at 413 industrial parkway and threw a container of alcohol inside. the building was empty but the carpet inside caught fire. more than 1,000 in damages has been reported. b.a.r.t. is running on time this morning after a person was hit by a train last night causing delays on three different b.a.r.t. lines. it happened around 8:00 at the bayfair station in san leandro. a b.a.r.t. spokesman says the person was on the tracks and somehow landed back onto the platform after being hit by the train.

b.a.r.t. police say the person survived but suffered major head injuries and was taken to the hospital. b.a.r.t. police are investigating whether this was an attempted suicide or if someone fell onto the tracks. 7:07. some b.a.r.t. riders are complaining trains are just too crowded. they say b.a.r.t. is not doing a good job of handling an increase in ridessership. ktvu's alex savidge live this morning at the walnut creek b.a.r.t. station to explain why it may be hard to find an empty seat on trains. what's gone on, alex? >> reporter: essentially, it's an issue of more riders and fewer trains. that's why a lot of passengers are complaining. they don't have a lot of elbow room these days. according to the san francisco chronicle, b.a.r.t. saw a huge jump in ridership last month during the month of august. 27,000 more passengers compared to the same month a year earlier. at the same time, more than 100 b.a.r.t. cars on average are out of service every day for maintenance and upgrades. that includes improvements like new carpet, seats and air

conditioning systems. and what that essentially means is that on certain days you will find a ten-car train and the next day it could be a nine- car train or eight-car train. one man we spoke with a short time ago told me he's forced to stand more often on b.a.r.t. lately and he's frustrated. >> it doesn't make sense to me for them to go from a ten-car train to a five-car train and offcommute hours because they are crowded. standing-room only. >> reporter: and there isn't a whole lot of light at the end of the tunnel for b.a.r.t. passengers. b.a.r.t. officials expect ridership to continue to go up over the next couple of months. as for the shortage of cars, b.a.r.t. says it won't be able to increase its fleet until they begin getting new trains but that won't happen until 2017. so a few years off and until then, riders should expect that there won't be a whole lot of room on the trains, especially during the busy morning and afternoon commute ties. we're live this morning in walnut creek, alex savidge,

ktvu channel 2 news. >> all right. well, tomorrow b.a.r.t.'s board of directors will get a report, advising them on how to avoid messy confront takes with its unions and another possible strike. b.a.r.t.'s general manager tells chronicle the report was ordered after the heated negotiations that led to two separate strikes. this report includes 63 recommendations, they include starting negotiations six months before the old contract runs out instead of the current three months. also bring in meditators from the beginning rather than have them come in when negotiations are not going well. and don't use negotiators with "historically combative or add ver sayial styles." happening today, 90 city workers in vacaville are showing you for picket line duty -- showing up for picket line duty instead of their jobs. that's after the city council approved a 21% pay cut for people who maintain parks, streets and work on the water system.

that will immediately mean about $1200 less eve-- each month. >> all other city workers chose to take smaller pay cuts last year. >> the large number comes from the fact that since july 1st, 2013, they've had no concessions or pay cuts imposed on them similar to those that all of the others have had. >> we'll look at taking some seert of action against the city. we have to fight back. this is outrageous. >> union members say a 21% pay cut is the largest they've ever faced. some workers say the cut is so deep they will have to move. 7:11. no criminal charges are gonna be filed in the case of a deadly yacht accident last year. it happened during an america's cup practice run. british sailor an true b.a.r.t. simpson died last year when the catamaran capsized out on san francisco bay. now, a sailing website posted the police report yesterday.

during an event at the flint center yesterday, apple introduces two new iphones. the iphone 6 and the iphone 6 plus. they are both larger, thinner and lighter than earlier versions. they also feature a new glass face, an improved camera and a better patry life. the price starts at just under $200 with a two-year contract. those phones will start to ship on september 19th. the long-rumored apple watch also was unveiled. it can read your pulse, track your fitness goals and navigate through apps. there are three different models starting at $349. you are gonna need to own an iphone with the latest operating system to sync with the watch which will be

released earlier next year. the third big announcement is a pay by phone feature on the new iphones called apple pay. that is similar to something already available on android phones. you touch your phone to a special terminal, it instantly reads your credit information. apple says the information will not be stored on that phone, instead a program uses a special inciented account number and a security code that's only good one time. apple is working with several large retailers to roll out apple pay next month. almost everyone was excited to finally hear what apple had up its sleeve. reaction was mixed to the announcements, including the highly anticipated apple watch. >> i don't know why i would want a smartwatch myself. i think my smartphone does enough and it's not that hard to pull it out. >> people have stopped wearing watches because of the phone, the iphone, the phone that

apple created. >> most people are impressed with apple's new list of items but say it seems like apple is copying the competition since there's already google wallet and smartwatches on the market. we just checked, apple's stock is just slipped down to negative. it's down about a nickel right now in early trading. it was on a roller coaster ride yesterday. anticipation of the big announcement boosted stocks especially after it announced the apple payment but the stock fell again when investors found out it would only work with the iphone 6 and would not be available until after the holiday season. san francisco police now trying to identify a body found yesterday in a lake in golden gate park. workers out there found it in mallard lake near 27th avenue yesterday morning. the workers were knee deep in the lake, clearing out nonnative plants. that's when they noticed the body face down in the water. it was covered by weeds. >> what do you say?

is it a snake? they just look surprised and shook their heads and they said it can't be rule. >> police say it appears that body had been there for quite sometime. they are still trying to figure out if it was a man or a woman or if that individual was the victim of a victim into the family of a 25-year-old man killed in a deadly crash on highway 17, they are gonna announce they are filing a wrongful death lawsuit. dan mcguire was driving one of ten cars that was hit by an out- of-control tractor-trailer two months ago. he died instantly. six other people were taken to the hospital with injuries. mcguire was a graduate of san jose state. he worked at a silicon valley consulting company. a woman who was injured has also filed a lawsuit against the truck driver and his company claiming negligence. still, no final word from the chp on its investigation of that crash. 7:18. want to check in with sal. >> yeah. >> how are things looking at

the toll plaza? >> it's crowded. we start there a lot just because everyone really wants to know how the bridge is doing because when the bridge is bad, other commutes tend it follow suit. this is a look at about a 25, 30-minute drive time from here onto the san francisco side of the brick. certainly it's slow. also moving along and taking a look at 580, we have slow traffic in livermore especially getting up to the 580 interchange. but 680 is slow out of pleasanton down to fremont. we look at the south bay. northbound 101 at yerba buena area there is a new crash there and traffic is slowing down. northbound 280 traffic is going to be a little bit slow already coming out of the -- coming out of san jose getting in the valley. might see some minor lingering delays in west portal because of an earlier signal light issue at st. francis circle. let's go to steve. a little bit of fog. we say fog, usually sometimes it's low clouds more often than

not. what's around the bay is gonna get chewed you. there's plenty out there on the coast. not much inland. that means temperatures will warm up fast. these are the temperatures on monday. tuesday was a transition day. today we go above average of the almost all of these. santa rosa, today 88. san rafael. 86. plenty of fog. some of that could make highway 1 maybe dicey on driving. it's getting lower and lower as high pressure squashes it. i want to show you the snow in calgary, canada. a lot of this system is digging into the northern plains where highs on thursday will be 25 degrees below average. they are looking for snow, parts of north dakota, montana and maybe wyoming. we have temperatures that will be with us until saturday. system dropping down from the gulf of alaska, looks pretty

we want to update developing news we first reported 90 minutes ago. firefighters are making progress against an early- morning wildfire in the mountains above san dimas in the san gabriel valley of los angeles county. about six acres of brush have burned near a golf course. the fire was first reported around 4:00 this morning. no structures are threatened but helicopters have been brought in for waterdrops. the weather has been favorable as firefighters are not dealing with too much wind or low humidity. 7:25. security extra tight in new york city ahead of tomorrow's 13th anniversary of the 9/11

attacks. while there are no specific threats, intelligence experts say the city is still a target for terrorists. bridges, subways, historic landmarks like the statue of liberty, they are considered top targets. >> would be in their everyday life, get caught up in a situation where they end up killed and other people look at that and go, that could be me. i do that. i go into tunnels. i take the train to work. i drive across the bridge. i fly on airplanes. >> there have been several attacks on new york city besides 9/11. the first world trade center attack happened in 1993. in 2003, an al qaeda operative was convicted of trying to slice the cables on the bridge. and then a man was stopped from bombth subway. prom speaks to the nation tonight about stopping the terrorist group isis. what the president is expected

coming up on 7:30. you are looking live at a park in san jose where this morning it looks peaceful. it was a different scene yesterday afternoon. a teenager was stabbed here and people who live in the area and go to the park say they are stunned. ktvu's tara moriarty is there and coming up in minutes she will tell us what witnesses say led up to the violence and who police are now searching for. good morning. welcome once again to "mornings on 2." i'm tori campbell. >> all right, tc. good morning. i'm dave clark. let's check weather and traffic. i did my job for steve. i ducked outside. steve, blinding sunshine. >> there you go. >> beautiful. >> thank you. we do have low clouds. there is some fog out there. temperatures on the cool side

for some. inland temperatures will warm up quick. very warm air aloft. some of the lows are in the 40s and low 50s. it is a cool morning here, angwin 73. 1700 feet. about that. a couple of days ago they were 49. 50 healdsburg. 48 in petaluma. so there's a little chill. with all of the warm air aloft and hardly any sea breeze temperatures are on their way up. warm to hot. temperatures went from above to below. 90s for many. 80s and 70s, 80s closer to the water. here's sal. we're looking at the commute. things are very slow. again on 80 been having some bad days. a look at drive time here. you can see traffic is going to be taking 43 minutes according to the road sensors to drive from the carquinez bridge to the macarthur maze. every day it seems to be getting worse. this summer, we didn't have a lot of days like this unless there was a crash. there has not been a crash.

just very slow traffic. when you get to the bay bridge toll plaza, you will be waiting for another 25 minutes before you make it into san francisco. so you are locking at -- looking at, if you count the whole thing, more than an hour of driving getting into the city. as we look at the contra costa commute, highway 4 is also slow and so is 680. 580 very slow out of livermore into dublin, pleasanton and northbound 880 at tennyson there is a crash blocking the lane in the northbound direction. but a lot of the slow traffic is going the other way heading south. it's 7:32. back to the desk. now to our continuing coverage of a violent attack in san jose. police say a teenaged boy has been upgraded from critical to serious condition after he was stabbed in a park on his way home from school. it happened near hammond park, not far from highway 17. tara moriarty is joining us live from the park to tell us more about the suspects who got away. >> reporter: well, initially police had vague descriptions

of the suspects. they say they have better ones now and are working on trying to track down some leads. but they say this crime came as a surprise. now, that is because it happened at 3:00 in the afternoon in broad daylight. officers say a 16-year-old boy was walking home from school with a group of teens when they were confronted by the suspects. a fight broke out and when police arrived, they found the teen had been stand in the upper body. the -- stabbed in the upper body. the suspects drove off. multiple suspects fled in their vehicles. we have descriptions and we're following up on the leads. >> reporter: now. boy's wounds were initially considered life-threatening but he was taken to the hospital where he is now in serious but stable condition. friends of the victim say that he did attend -- or he does attend delmar high school. they believe he was jumped. we're trying to get more reaction from neighbors. we'll keep you updated. we're live from san jose, tara moriarty, ktvu channel 2 news. >> thank you. happening today --

president obama will speak to the nation about combating islamic state militants. brian flores is in the newsroom with the details about how he plans to do that and the action being done now ahead of the president's speech. good morning. the president's scheduled to speak at 6:00 pacific time tonight. it's expected to be a short speech. he will detail his plans. ahead of the speech, though, secretary of state, john kerry, arrived in baghdad. this is new video of kerry arriving and meeting iraq's new prime minister there. he said the meeting went well and is encouraged by iraq's commitment to fighting isis, also known as isil. kerry is on a mission to build support for a coalition to fight the threat from isis. tomorrow he will attend a meeting of arab nations in saudi arabia. but this is what kerry said to iraq's new prime minister this this morning. >> as i told you, the president will lay out tonight a more detailed description of exactly what the united states is prepared to do together with

many other countries in a broad coalition in order to take on this terrorist structure, which is unacceptable by any standard anywhere in the world. >> in the meantime, the president met with top congressional leaders at the white house yesterday telling them that he has the authority to act without congress. the president also said he wants to work with congress, however, to present a united front. he may also ask congressional support arming syrian rebels against isis strongholds backed by u.s. air support. the president may get pushed back by both parties saying that congressional approval is needed. the president is not expected to put the troops on the ground but is likely to use airstrikes to combat isis. a new washington post poll asked people what they think about expanding u.s. airstrikes

against isis into syria. 665% of americans support -- 65% of americans support the idea. 28% oppose it. you can watch the president's address right here on ktvu. we'll bring it to you live at 6:00 tonight. we'll also stream it on ktvu.com. all right, tori. 7:35. australian police carried out several raids around that country and arrested two men accused of activities supporting slauk terrorists in syria -- islamic terrorists in syria. take a look at this raid. the two men arrested are accused of recruiting people to fight in syria and raising money for terrorist activities. australia may elevate the terrorism threat to the second highest level because of a growing danger posed by supporters of terrorists. fish and wildlife crews are still trying to track down the mountain lion that attacked a 6- year-old boy on a hiking trail near cupertino. biologists have set up large wire traps baited with meat. two trackers and seven

specially trained dogs were also sent out to look for the mountain lion. the 6-year-old boy who was attacked sunday afternoon is recovering at home now. when the mountain lion is found, it will be euthanized. thieves seem to be putting a new twist on a familiar phone scam in santa rosa. police say someone has been calling people pretending to be a federal officer. he tells the victims that they have underreported income taxes and demands that they pay up for face arrest. investigators say what's so unusual is that in one case, the suspect had the same caller i.d. as the santa rosa police department's main number. police say this trick is called spoofing and they want to remind people that police never call anyone and ask for money. 7:37. happening today, san jose city leaders will formally present a controversial program for boosting the city's understaffed police force. the complex officer retention plan includes a measure to entice police officers to stay

on the force after they retire. hundred of police officers recently quit over san jose's pension reform efforts. critics say the new plan will not solve san jose's police staffing crisis. it may even cause several new problems. the city of san jose will soon have more eyes and ears for fighting crime. yesterday, the city council unanimously approved a measure to use private security cameras to monitor possible criminal activity. the program is voluntary for both businesses and for homeowners. it would give the police the power to tap into private security cameras all over the city. the family of a young woman shot and killed by a san mateo county sheriff's deputy, they are filing a civil rights lawsuit against the department. yesterday, at a news conference, the family released the 911 recording from the night she died. >> she just got shot.

>> now, 18-year-old garcia was killed on june 3rd outside of her home in half moon bay. her brother called 911 saying she was acting violently and was refusing to take her medication for schizophrenia. the sheriff's department said she ran towards the deputy, holding a knife. that's when he fired the single shot that killed her. >> he not only killed her, killed the entire family and the goal is to prevent any other family from suffering this kind of pain. >> now, the family's lawyer says proper mental health response training would have prevented her death. 7:39. the napa county sheriff's office is now reporting the first death linked to the 6.0 earthquake last month. 65-year-old lori thompson died from a brain injury she suffered during the quake when a tv hit her on the head. her family says the next day she felt dizzy and they persuaded her to go to the

hospital. she tied at queen of the valley medical center last friday. teen who was seriously injured during the quake when a fireplace fell on him is making progress. 13-year-old nicholas dylan is getting around in a wheelchair. his doctors say it could take months, though, for him to recover after they put metal plates and bolts into his broken pelvis. dylan plans to return to school in three weeks. he's trying to keep up with his school work but says it's not easy because he does not like being stuck at home. napa county officials are asking people who had damage to their homes and businesses to report it now. the county needs information about damaged buildings to see if it qualifies for federal loans and grants. the focus is on red tagged and yellow tagged buildings but the county says it wants to know about all damaged buildings. the county board of supervisors has received a report on damage to napa valley wineries. silicon valley banks wine division says the industry suffered $80 million in losses.

basically, they are going after what they call the cable. this is a huge protest involving a lot of companies. they are against proposed ftc regulations that allow internet service providers such as at&t, time warner, verizon and comcast to charge customers for faster service. they are calling themselves team internet. they are saying we believe in free and open internet with no arbitrary fees or slow lanes for sites that cannot pay. netflix is leading the charge of companies. it includes much of silicon valley. they say the revisions would create an internet of haves and have nots. customers with companies that pay the price will zip through the internet while other companies will sit and wait for the spinning wheel of slow internet connections. now, netflix says the internet should be neutral and that internet service providers should not be able to to demand extra fees or slowdown

so this story is far from over. >> continuing. 7:47. sal's watching our commute. you are watching highway 24. everything else. how are we looking? >> we're okay, dave and tori. highway 24 westbound, moderately heavy. the drive time has not been all that bad. it's about 12 minutes. this drive time has stayed about the same. anywhere from 8 to 12 minutes, driving from pleasant hill road to the caldecott tunnel. as you know, the eastshore freeway has been pretty slow the last few days reaching at least 30 minutes to drive from the carquinez bridge to the maze. when you get to the toll plaza, it's a 25, 30-minute drive getting into san francisco with no major problems but we have had a lot of slow traffic. in the east bade westbound 580 continues to be a dog of a commute. it's very slow right through livermore. it's become so typical that, you know, i don't spend that much time on it because you know what you will get. northbound 880 at tennyson they are clearing a crash. but southbound is slow from 238 to stevenson. most of that is very, very

preez for a few -- preez breeze for a few. misty drizzle by parts of half moon bay and el granada. phoenix, things are coming down. the desert southwest, looking quiet in southern california. for us it will be quiet. 80s through the interior. 90s with 70s and 80s by the water. we're still looking at traffic that's really slow. on 80 westbound, we have very heavy traffic this morning. it's backed up up for almost an hour on westbound 80 from the care keen niz bridge to the macarthur maze and this is new phenomenon. almost an hour to get down to the macarthur maze from the carquinez bridge. when you get to the bay bridge toll plaza, you will be waiting there for 20, 25 minutes just to get to the other side of the bridge in san francisco. we also had very heavy traffic on 580. almost all of it is slow through livermore and

pleasanton heading south on 680. northbound 880 we had an earlier accident at tennyson. southbound traffic is very slow. in the south bay, 101 is very, very slow. so is 280 and 85. that's more of a normal commute for the south bay. back to the desk. some b.a.r.t. riders are complaining of overcrowding on trains. they say it's not just more passengers. they've also noticed fewer cars. ktvu's alex savidge is live at the walnut creek b.a.r.t. station where frustrated riders are telling him too many times they've been forced to stand because they just find an empty seat. good morning, alex. >> good morning. passengers don't have a lot of elbow room. a lot more people are using b.a.r.t. and there are a lot of trains out of service on a regular basis. according to the san francisco chronicle, b.a.r.t. did see a jump in ridership during august. 27,000 more passengers compared to the same month a year earlier. and at the same time, on average, there are about 100 b.a.r.t.

cars or more out of service every day for maintenance and upgrades and that includes improvements to help out riders, new carpets, seats and air conditioning systems. that means what was a ten-car train one day would be a nine car or eight-car train the next day. one man said it's been difficult to find a seat. >> as an older rider, you know, it kind of -- 40-minute ride from walnut creek to san francisco, it impacts my health. if i have to stand for 40 minutes on a moving train, it hurts me. >> it's been rough. you have so many people packed into one spot. everyone standing over each other. it's been pretty rough. >> reporter: there isn't a whole lot of light at the end of the tunnel. b.a.r.t. expects ridership to increase over the next couple of months. as far as the limited number of cars, b.a.r.t. won't be able to boost the fleet until they get new trace. those won't come until 2017.

page yesterday. the search will now focus on facebook as they try to pinpoint where he might be? today a judge in zlar county is expected -- santa clara county is expected to set a trial date for the man accused of kidnapping and killing sierra lamar. he. he faces a possible death sentence if convicted. he's accused of killing the 15- year-old girl who vanished while on her way to school more than two years ago. her body has never been found. but prosecutors are confident they have the evidence that would lead to both a conviction and the death penalty. 8:05. in hayward, police searching for an arsonist who reportedly set fire to two vacant businesses in a strip mall. yesterday morning it happened the 421 industrial parkway. 4 hours earlier, a fire was reported at 413 industrial parkway. take a look at this new video shot. it was shot in the area where the fires started. in the latest incident, police say someone set fire to a gas

can near the front door of the business. on monday, they say someone kicked in the window of a nearby vacant business and threw a container of alcohol inside. the building was empty but the carpet caught fire. more $1,000 damage has been reported. about 90 city workers in vacaville are showing up for picket line duty instead of their jobs today. that's after the city council approved a 21% pay cut for people who maintain parks, streets, and work on the city's water system. that will immediately mean about $1200 less each month. vacaville officials say all other city workers chose to take smaller pay cuts last year. the large number comes from the fact that since july 112, 2013, they've -- july 1st, 2013, they've had no concessions or pay cuts imposed on them similar to those that all of the other bart units have had since that time. >> we'll look at taking action.

we have to fight back. this is outrageous. >> union members say a 21% pay cut is the largest they've ever faced. some workers say the cut is so deep, they will have to move. the city of san jose taking new action to control who comes near a large homeless camp. boulders are being brought in, blocking some access to the camp. and that's causing some concerns this morning. janine de la vega joining us live from san jose to show us what it looks like out there and also how the homeless are reacting. good morning, janine. >> reporter: good morning. we're right across the street from the happy hol yopark. we're in the dirt lot across the street. you can see behind me. city workers just showed up in the last ten minutes or so and they are going to be hauling those boulders that you see back there in the background. it looks like he's about to pick one of those up. we have been told they weigh about a thousand pounds.

i want to call your attention across the dirt lot over here to where they are going to place the boulders. they are gonna line them here. they are gonna use them as a barrier and then along the border, they have also erected some metal poles and they will eventually turn that area that you see over there into a gate and that worries those who live here. here's some pictures sent into us from a viewer showing the boulders being hauled in earlier this week on flatbed trucks. workers have been moving them into place because the city says it wants to prevent illegal activity like dumping to occur there. while one gate exists, again, there are plans to put another one up by today. although city officials stress they will provide access to those who need it such as outreach workers. hundreds of homeless people live in the area down below near the creek which is known as the jungle. there have been numerous cleanups over the years in an attempt to get the homeless to

leave but they've always come back. >> that's totally ridiculous. where are they gonna park? that's not gonna stop the drug traffic or the prostitution and things like that. so what is the purpose wasting tax payers' money putting down rocks and boulders and things like that? i don't see it. >> reporter: the homeless tell us if they can't park in the lot anymore, many will end up parking at nearby businesses. there's a lot of frustration felt by them. the city has expressed they would like to clear out the encampment there by the end of the year. they are working on long-term solutions to get the homeless into housing but it continues to be a challenge because there's not enough affordable housing. some have been given vouchers for housing but there is a long waiting list. where you see the gentleman walking, one of the city workers there are metal poles there. they are going to put up a gate there. would's been told some of the -- we've been told some of the homeless have been talking to city officials and they say they are gonna keep the gate

very cool morning, though. just a couple of soft 60s. there's the key at 1700 feet. 7 -- 72. i know petaluma made it to 48. now 51. we had a roaring delta breeze a couple of days ago. that's gone. fairfield is calm. that's all i need to know. that's all i need to know it time of year. temperatures there will be in the 90s. some of that fog will make it on the coast and highway. san jose's fog will burn off quick. 90s for some. 70s, 80s for others. here's sal a we're still looking at a lot of slow traffic, especially on 80 westbound as you drive from the bridge, one of the main stretches, a lot of people do this commute, taking almost an hour and then when you get to the bay bridge, you will be taking about 15 to 20 minutes. so the bay bridge commute has become better but the rest of the commute has not. westbound 580 also very slow through rirm and heading south.

that's become a typical commute and 880 slow from 238 all the way down to mission boulevard. san jose, the slowest freeway is 101. 280 is improving and so is 85. at 8:30 back to the desk. >> thank you. police in san jose, busy searching for suspects after a teenager was stabbed at a city park in broad daylight. this happened yesterday, not far from highway 17. ktvu's tara moriarty just talked to a boy who was with the victim. tara, you are joining us live from hammond park. good morning. >> reporter: well, good morning. the boy who did not want to be identified said he was walking home from school with three friends when he was approached by five boys sitting on these benches efthere and said five -- over there and said five more were waiting in a truck. violence broke out at 3:00 in the afternoon in a neighborhood police say is safe. the boy says the group asked his friends if they were in a

gang and when they replied no, they were hunted down by the suspects and a 16-year-old boy got stabbed. >> we're coming home from school and there's like five guys sitting on a bench drinking beers. one of them came up to us and said do we bang and we said no we're not gang related or anything like. one guy comes and punches my friend. i like turn around and i see my friend trying to run across the field right here trying to get attacked with a taser. the boy that we took to jumped a fence and got away but later realized his buddy had been stabbed several times. those wounds were considered life-threatening. but the teen has been upgraded an is expected to survive. police are not releasing very many details about the case. they say they are working a bunch of leads and we hope to get more information later today. we're live in san jose, tara moriarty, ktvu channel 2 news. 8:32. happening today, san jose city leaders will officially present

a controversial program for boosting the city's understaffed police force. it's a complex officer retention plan. it includes a measure to entice police officers to stay on the police force after they retire. hundreds of police officers recently quit over san jose's pension reform efforts. the critics say this new plan won't solve san jose's police staffing crisis. it may even cause several new problems. the city of san jose will have more eyes and ears for fighting crime. yesterday the city council unanimously approved a measure to use private security cameras to monitor possible criminal activity. now the program is voluntary. it's for both businesses and for homeowners. it would allow the police to tap into private security cameras all over the city. well, fish and wildlife crews still trying to track down that mountain lion, the one that attacked a 6-year-old boy on a hiking trail near cupertino. biologists set up large wire traps like you see right here. they are baited with meat.

two trackers and seven special dogs are also sent out searching for that mountain lion. the 6-year-old boy attacked on sunday afternoon, he's at home recovering. when the proper -- when the mountain lion is found, it will be put down. 8:33. no criminal charges will be filed in the case of a deadly accident during an america's cup practice run. british sailor, andrew bart simpson died in lay of last year when the catamaran capsized on san francisco bay. a sailing website posted the police report yesterday which blames a structural failure of the boat. simpson was a former olympic gold medalist who died after being trapped under water for ten minutes. the family of a young woman shot and killed by a san mateo county sheriff's deputy is filing a civil rights lawsuit against the department. at a news conference yesterday, the family released the 911

welcome back. 8:41. let's bring you up to date on some of the top stories -- police in hayward searching for an arsonist who reportedly set fire to two vacant strip mall businesses. the latest one was early yesterday morning at 421 industrial parkway. the second about 24 hours earlier was at 413 industrial parkway. damage estimated at more than $1,000. the city of san jose

installing boulders along a dirt road at story and center near a homeless camp called the jungle. the city says they are not restricting access to that camp but they are trying to keep cars out of the birth area and -- dirt aia and says this should -- area and says this should cut down on illegal activity like dumping. homeless people doubt this will work. they say the city keeps promising to keep them in stable housing but there's not enough available. and b.a.r.t. riders expect a couple of more years of trains that are crowded. a new report suggests more passengers and fewer train cars. ktvu's alex savidge joining us live at the walnut creek b.a.r.t. station explaining the shortage of seats out there. >> reporter: good morning to you. it's dadding-room own -- standing-room only. b.a.r.t. spokesperson told us a short time ago, it's a combin tion a of factor -- combination of factors. there are a lot more riders and

the system has aging fleet trains that need to be upgraded constantly. b.a.r.t. saw a huge jump in ridership during august. 27,000 more passengers a day on average used the system. that's compared to the same months a year earlier. at the same time, on average, more than 100 b.a.r.t. cars are out of service every day for things like maintenance and upgrades. a major improvement project underway right now. some trains are running in one less car and riders are noticing the difference. >> it's actually been pretty rough. you have so many packed into one spot. everyone is standing over each other. it's been pretty rough. >> reporter: b.a.r.t. began rehabbing cars last year. those improvements include new carpet, seats, and air conditioning systems. what that means is that 19 cars a day are out of service putting the squeeze on riders. >> it's that 19 not available

that's making it harder. so you are seeing cars that are shorter. you are used to the ten-car train and now it's nine cars. we know it's frustrating. please know we have every train available out on the system. >> reporter: b.a.r.t. says close to 87% of its trains are in service at any given time, although, riders would like them all to be out on the system. but the spokesperson said that's not possible. as for the long-term shortage of cars, b.a.r.t. won't be able to boost its fleet until they get new trains that begin arriving in 2017. and as you look down the road, there's not much good news on the horizon for passengers. b.a.r.t. officials expect the ridership will continue to increase over the next couple of months. we're live this morning in walnut creek, alex savidge, ktvu channel 2 news. happening now -- a battle for the net. that's what netflix calls the fight against the big cable companies. pam cook is in the studio to

explain the goals of a nationwide protest. >> well, the battle for the net begins here on the netflix website. looks pretty normal except for today on the lower right-hand side of the screen. you see this spinning wheel. it symbolizes what you see when you are waiting for internet connection or a page to load. now, netflix is asking you to take action. if you click there you see the battles for the net. it's asking you to sign their letter to lawmakers. it wants to you share on facebook, and twitter, basically this is a huge protest involving a lot of companies going after what they call team cable. comcast, veery done, time warner and -- verizon, time warner and at&t. there are a lot of companies that have joined this protest against proposed fcc regulations that would allow internet service providers to charge customers for faster service. >> if you don't want to see

more of this when streaming video, then join in supporting net neutrality. >> now, bimio is joining, along with much of the silicon valley. they say the proposed regulations would require a world with haves and have nots. the haves would pay the higher fees. the have nots would be the rest which the protesting companies say amount to slower websites. in its defense, at&t claims that the new regulations will allow lower rates and greater broad want availability in rural areas in particular that have been ignored. you can take a look at all of the people who are for and against it on this, including politicians. you can see who is on team

welcome back to "mornings on 2." 8:55. happening today, a judge in san francisco will hear arguments in the lawsuit against the accrediting commission that put sanctions on city college of san francisco. that lawsuit was brought by city attorney dennis herrera. now, in the lawsuit, he says the commission is carrying out out what he calls a vendetta against the college. herrera and school officials say the sanctions against city college could make the college lose its accreditation. enrollment at city college has dropped since the commission threatened to pull its accreditation. well, you may have seen it online. it's so adorable. it's worth seeing it again. a white house photographer caught a seemingly bored little
