p.m. 8 shots fired by officers and allegations of excessive force. a police shooting is under scrutiny. good evening. iei am haener. >> and i am frank somerville. >> the suspect tried to hit an officer but the suspect who was later arrested said he never intended to hurt anyone. ktvu's david stevenson is live with the surveillance video that some say doesn't tell the whole story. >> reporter: the police department says it is confident its officers acted appropriately though the defendant say the surveillance video proves otherwise. >> reporter: the surveillance video doesn't show the shooting, just what happened before the gunfire. >> i didn't do anything to deserve to be shot at. >> reporter: he is charged with assault with a deadly weapon against a police officer and resisting with violence following a domestic violence call. >> i didn't attempt to hurt any officer or anyone else. i didn't put my hands on

anybody. nothing. >> but police say they fired their guns at him believing he meant to run over an officer. >> they did about say anything to me. -- didn't say anything to me. >> reporter: it captures the 8 shots fired. he was not hit by gunfire but could be seen driving away from the scene. she says this shows one officer who fired was in no position to see whether he posed a threat to other officers. >> he was not armed. no one says he is armed. they have to come out with a reason why they unloaded their weapons into his car. the prosecutor told us she can't discuss the facts but the police department said i understand the total circumstances that lead to the officers using lethal force, i am comfortable the officers acted appropriately and were

honest in their statements during the investigation. he hopes to have the charges dropped. a hearing is set for next month. reporting live, david stevenson, ktvu channel 2 news. a one-year-old baby is recovering after he was shot while playing outside in oakland. his injuries are not life threatening. it happened just after noon today. police say the boy's family was present at the time. investigators are working to determine who had the gun and where the gunfire came from. police tell us there has been trouble at that house before. golf pro greed to a plea deal agreed to a plea deal. andrew nisbet was arrested last december before he was about to receive a pga award. he taught in livermore.

he was charged with 75 felony counts but today he pleaded guilty to 7. three for abuse. three for solicitation of murder and one for possession of child pornography. authorities say he tried to hire a hit man when he was in jail. andrew nisbet faces 27 years in prison when he is sentenced october 9. punishment was handed down to a bar today who served alcohol to two men, 19 years old, they were killed in a car crash. ktvu's ann rubin spoke with the father of one of the men who believes a temporary suspension of the liquor license isn't enough. >> he believes the penalty for serving alcohol to underaged kids should be steep, longer than 30 days. >> the notice went up today. and the father says it is about time. he is just too emotional. >> we have been waiting for a

long while for this closure to happen. >> reporter: they were killed in a car crash in january 2013. the 19 year olds had been drinking. an investigation led here. >> from the point of the fatal crash our agent was able to track back to this location the 19 year olds were served alcohol at the location behind me. >> the investigation found the bartender never checked their i.d.s. the owner says he appealed this one. the suspension lasts for 30 days and while she feels it is too long the father believes it is not enough. >> should be permanent. to each their own. >> while nothing could bring back his son he hopes by drawing attention tounderage drinking -- to underage drinking future accidents could

be prevented. >> get checked before they are given alcohol. please, if you are a bartender do your job. check the license. >> reporter: they will likely remain closed till the suspension is over. like in san jose, ann rubin, ktvu channel 2 news. there are new developments tonight in the domestic violence scandal that put the nfl under fire. the league says it can't confirm whether it received the video showing baltimore ravens running back ray rice punching his fiance. the ravens coach says he didn't see the video eether eeth -- either. >> i was picturing her whaling on him and him smacking her and her head was this far from the wall. so why did i conclude that?

because i wanted to. >> they have evidence that law enforcement gave the nfl a copy of the video back in april. the owner of the ravens says he regrets not pursuing the case more vigorously. >> i assumed it wasn't a forceful blow that moved her head three feet into the wall. that is what i regret. >> today cameras caught rice getting flowers delivered to his home. he was suspended from the nfl this week. initially he received a two game suspension. today barbara boxer and 15 other women in the senate called for the nfl to create a zero tallerous video to -- tolerance policy in the nfl. a symposium today wrestled with law and ethics in sports. ktvu's john fowler was there

and reports the pressure is mounting on the nfl to improve its ethics. john? >> reporter: with three days before the home opener here at levi stadium executives at the symposium declined to talk about players and domestic violence. >> reporter: today this symposium on sports law and ethics dominated by domestic violence in the nfl. >> we can do this. >> reporter: some say the league must get tougher on abusers. such as san francisco 49ers ray mcdonald. the team says he will play sunday and until due process is complete. but experts say sports teams are not bound by the constitution and should do the right thing. >> how are we going to come to grips with the facts we are paying a lot of money to reward

investigators are trying to figure out what started a house fire. the call came in after 5:00 a.m. this morning. nobody was home at the time time but concerns about smoke prompted officials to evacuate homes nearby. b.a.r.t.'s board of directors is looking at ways to

prevent future strikes. leaders went over a report. it suggests negotiations should start earlier. six months before contracts ecpire. and it recommend -- expire and it recommends they decide on an arbitrator ahead of time. we spoke with a board member who says there is a lot to take away from the criticism. >> the b.a.r.t. board needs to be a third party in the labor management negotiations. >> the board of directors will study each of the recommendations and look at how to make changes before the next round of negotiations. new at 6:00 p.m. time is running out for a healthcare facility in the east bay and today hoping to find a way, anyway to save doctors medical center, some nurses and patients went to the office of the head of the area's healthcare district.

ktvu's john sasaki shows us why the protesterstesters -- [ indiscernible ] >> reporter: doctors medical center is teetering on the edge. supporters took a road trip. they drove to confront one person who they feel has a key role in the closure. >> he was elected to have a hospital. >> they said they want him to resign or be recalled. he is board chair of the district and a lobbyist for chevron. >> it seems like it was his job, the job he is getting paid for, to ensure chevron does not have to contribute to keep the hospital open. >> reporter: she says the hospital saved her life. >> every second counts. every minute counts.

step by the police union. cal fire is calling in additional firefighters for the gulch fire, it is burning in heavy brush and steep terrain. 100 homes are under evacuation orders tonight. cal fire says the fire started yesterday as a vehicle fire and burned 1200 acres. the fire is only 15% contained. with this hot weather comes high fire danger and we be seen a couple fires today and our chief meteorologist bill martin will tell us if the hot weather will continue. >> tomorrow will be hot again. fire danger on the table. 98 in antioch. 101 livermore. not right now. these are day time highs.

the department of veterans affairs talked to a thousand female vets last year and many of those women who suffered posttraumatic stress disorder or victims of sexual attacks did not seek out help even though they are entitled to it. there are 185,000 female veterans in california. the a's and giants are looking for a win in early baseball action today. >> while team u.s.a. got more than it bargained for in world basketball cup action. mark is up next with sports.
