cristina rendon, ktvu channel 2 news. new developments tonight in the death of a man killed by san francisco police. a new report from the medical examiner says alejandro nieto had marijuana in his system and that his taser had been fired. and he had 15 bullet wounds. alejandro nieto was killed after officers responded to a man pointing a gun. it turned out to be a taser. his death led to allegations of police brutality. ktvu's david stevenson is here with details on the medical examiner's report and the angry reaction from alejandro nieto's family. >> reporter: this medical examiner's report has been long awaited by investigators and friends and family. many said they are not happy with the findings. >> reporter: at a shrine to alejandro nieto friends and family denounced the medical examiner's report. >> this stinks of a cover up.

>> police have not yet released the woman's name. investigators are triking to determine the -- trying to determine the motive. one of the most popular players in the nfl is facing child abuse. adrian peterson was indicted on injury to a child. adrian peterson is accused of injuring his young son who spent the summer with him. it happened when adrian peterson was trying to discipline his son. a warrant has been issued for adrian peterson's arrest. tmj obtained these -- tmz obtained these pictures. you can see dutes the thighs and hands. the -- cuts to the thighs and hands. the attorney issued a statement, he described his client as a loving father who used his adjustment as a parent to discipline his son. he used the same kind of discipline with his child that

he experienced as a child growing up in texas. adrian peterson has never hidden from what happened. the attorney says adrian peterson used the switch or tree branch to spank his son and he regrets the incident but never intended to harm the child. the nfl players union says it is considering all options on whether to fight the suspension of baltimore ravens running back ray rice. the players association received official notice of his suspension today. the release of surveillance video monday showing rice knocking out his then fiance prompted the nfl to increase punishment punishment and prompted the ravens to cut him from the team. now to the arrest of 49ers -- san francisco 49ers ray mcdonald. the district attorney has postponed a court hearing that was set for monday. they don't yet have the case from investigators. ray mcdonald was arrested in

san jose over labor day weekend on suspicion of domestic violence. the 49ers have made it very clear they have no intention of suspending ray mcdonald till the legal process plays out and he is expected to play this sunday. jim harbaugh's pres conference this afternoon, we asked how the team is handling domestic violence in sports. >> i think everybody, you know, is learning. everybody is more aware. is taking the opportunity to, you know, to -- to be aware of domestic violence. you know, just the -- you know, the -- how many people it effects. >> jif jef -- jim harbaugh said it is providing the team a chance to grow. spent weeks on working on traffic and turf and now crews at levi stadium are ready for football.

49ers host their first home game this weekend. ktvu's ann rubin found out the team says all the preparation paid off. >> reporter: officials say they are grateful they had all the pre-season games and soccer games as a warm up but they consider this weekend to be the true unveiling of levi stadium. >> reporter: time for practice is over. 130 yards from the attack site. and today there was another mountain lion sighting. it was spotted before 10:30 a.m. a resident reported seeing a mountain lion standing over a dead deer on the shoulder of the road. deputies searched the area but the mountain lion was gone. crews were replacing pipe that feed water to people in the bay area. the pipes are more than 100 years old. ktvu's tom vacar tells us why it is on the fast track. >> reporter: here in the hills east bay mud is replacing three pipelines. plus a high pressure 2-footer. >> these date back to the '20s. they are at the end of their life. they need to be replaced. >> reporter: it is not just that they serve 800,000 people, these pipelines are a few

hundred people away from the fault that could destroy them. >> we know the pipes will be shaken pretty hard during the earthquake that we know is coming. >> reporter: this is in a small area surrounded by homes, highways and railways that were not here when they were first layed. but no service will be lost because the existing pipes will be commission as the new ones -- commissioned as the new ones. this is one of the most urgent projects. it is far past time to renew a system that is outliving its youthfulness. >> we need it see generational investment in our water distribution system. 50% of our pipes are more than 50 years old.

has been rescued after they crashed in the bern pacific -- western pacific. this is video of the carrier based in san diego. right now it is on a 9 month region. one of the pilots is in fair condition but the search continues for the second pilot. the cause is under investigation. california will remain the way it is for now. a measure aimed at splitting california up will not appear on the ballot. it was organized by tim draper. he argued california is too big and diverse. he submitted 1.3 million signatures in july. today they project only 6% of those are valid. critics say it would split california into wealthy and poor areas. days of tax free internet

this is ktvu channel 2 news at 5:00 p.m. the sound of construction. a new beginning for those who lost so much. and now the prospect of financial assistance for the towns and cities hit hardest by the 6.0 earthquake is looking better. the funds will be flowing into the napa valley after president obama issued a disaster declaration. ktvu's mike mibach has more. >> reporter: we are getting there but not quite but scenes like this is very common in the downtown area as they are doing the rebuilding process three weeks in. as for that disaster declaration, great news for the infrastructure but as for theome owners, for -- the homeowners, for those businesses, for those folks, they are still looking for cash to get them back up and

police released new pictures of two men suspended of a home robbery.

the men kicked in a door the morning of august 12. police say the men then forced the victim to empty a safe. an hour after the invasion a black ford fusion similar to this one, dropped off one of the suspects at a bank in san jose. they used the victim's debt card at 5 different locations. the mother is describing the moments she and her daughters were mowed down by a car on their way to school. the video of the crash is pretty graphic. you will see here on the left hand side the three walking along and the car plows into them. >> all i scene was my daughter's hoody and hair. and just started screaming my kids. my kids. >> parents and teachers pulled

the girl out and comfort them. both children had just bumps and bruises after all this. this happened in new hampshire and police say the driver may have been distracted by the children in her own car or she may have had issues with the break. the driver is not facing charges. continuing coverage on a mysterious light with a glowing tail. it was seen over the pacific. a lot of people sent us pictures on facebook. what is it? ktvu's john fowler went out to try to find out. >> reporter: from antioch and contra costa county it appeared above mount diablo. >> there was a really bright light. >> she snapped a photo. it appeared to climb slowly towards the north. >> glow. slow. and it trailed. and i took -- look at this. this is weird. >> people from los angeles to the bay area and into oregon

saw the object. viewers sent us many photos. >> you can see how white that is. >> reporter: she was amazed. >> the clouds started turning from white as it was feeding, it started turning green. we weren't sure what it was. >> reporter: some think it is related to a solar storm that is hitting earth right now. >> a comet or maybe it was an aurora from the solar flair. >> the reports make it seem like a rocket or maybe a piece of space junk. we don't know what it was at this point. >> reporter: he says other similar unidentified objects were spotted in the southern california sky six hours earlier. no explanation yet. >> now it is a mystery. which is cool. >> reporter: there is no way to slow if they are related but they say if you watch the sky in the mornings and evenings, you will almost always see something fascinating.
