now he is free on bail. why the judge feels this convicted killer deserves leniency. >> and violent men changing their ways, the programs that are helping them break the cycle of domestic violence. >> complete bay area news coverage starts right now, this is ktvu channel 2 news at 6:00 p.m. >> good evening. i am heather holmes. >> i am frank somerville. police are looking for one of two men involved in a home invasion this morning in oakland. ktvu's cristina rendon tells us it started as the victim was getting ready to go to work. >> reporter: the frightening experience for an oakland man started as he was headed to work. he was approached by two armed robbers just before 5:30 a.m. this morning. they forced the man back inside his home with his girlfriend sleeping. >> i believe i heard there a gun shot and some foot steps and running. >> police surrounded the block.

they arrested one robber but another got way. >> he said that when the guy was running, i guess he was hopping the fence and sounded like the gun went off. >> reporter: he received an alert about the home invasion. they have a neighborhood watch program and some hire private paroles but that didn't -- patrols but that didn't stop the thieves. >> bottom line is the more aware you are you will help lesson the odds -- lessen the odds. >> reporter: police plan to use surveillance video to help the investigation. >> a wake up as far as knowing -- being aware of your sow roundings -- surroundings. >> the family is shaken up. we checked the crime stats and found while most violent crimes are down, home robberies have

doubled. cristina rendon, ktvu channel 2 news. the unsolved killing has police asking for the public's help. four years ago he was walking home with his fiance. that is when investigators say two men tried to rob the couple near the b.a.r.t. station. he was shot and killed. the government is offering a $20,000 rearound for information leading to an arrest. -- reward for information leading to an arrest. the mountain lion shot and killed was the same one that attacked a boy on sunday. they made the match by testing the dead mountain lion's dna. it was a perfect match. the mountain lion did not have rabies so the boy no longer needs to receive treatment for the disease. the mountain lion bit the boy's neck and head. new at 6:00 p.m.

he has been convicted of voluntary manslaughter and now a judge says he deserves leniency. in 2012 after a year's long battle over a shared driveway a deadly altercation between neighbors ended with a killing of a mother. ktvu's john sasaki is live where the sentence was handed down today and friend of the victim are outraged. >> reporter: they are. he learned he will spend four years and 8 months behind bars. he walked out of the court this afternoon saying nothing. while the judge sentenced him to state princen he stayed it for -- prison he stayed it for a month. they argued over their shared driveway to the pointed he

harassed her for years. in 2012, it ended with him knocking her to the ground where she hit her head and died. >> she the aggressor. that is manslaughter. >> reporter: for killing her he was convicted of voluntary manslaughter and convicted of stocking her and assaulting her husband. he could have wound up in prison for 12 years but since he was an outstanding member of the community the judge gave thim shorter sentence -- him the shorter sentence. >> that is a sentence, three years for people who stole cars and vandalize homes. here we are talking about a death. somebody who suffered that long. >> we did want probation and we asked the court for probation because this was an aberration. it was two neighbors that

fought for years about the driveway. and then this situation happened. when in fact all parties could have walked away from. >> reporter: the attorneys will appeal the verdict but he has to turn himself in by mid- october. i talked with her husband and he said he is disappointed it wasn't longer. john sasaki, ktvu channel 2 news. a wildfire in southern california is growing rapidly and some people are under evacuations tonight. the fire is burning in orange county. since it first started this morning it has burned 1200 acres. crews say no homes are threatened but an evacuation center is open for people in the area. firefighters are making progress battling three other wildfires around california. thousands of acres burned in yosemite national park, the largest of the fires in klamath

is 45% contained after consuming 108,000 acres. 4900-acre fire in yosemite is 50% containedtained and the shasta county is 45% contained. >> we are just now entering into our wind events for southern california with the conditions. so to tell you we are all nervous, yeah. >> usually seasonable firefighters are let go in october and november but officials say we still have a lot of fire season ahead. president obama has declared a federal disaster for the areas effected by the napa earthquake. it means the federal government will pay 75 pest of the repair and -- 75% of the repair. the president must decide on a request to help pay for damage to private property. >> they will now go through a site by site estimate of what their damages are and what it

will take to recover them as close as possible back to their original condition. >> napa earthquake was the strongest since the earthquake in 1989. and 60 inmates have to be transferred to other filts because of earthquake -- fulfills because of the earthquake -- facilities because of the earthquake damage. the damaged areas have to be assessed and repaired. right now only portions of the jail are closed. a safety effort is underway tonight. east bay mud is replacing the largest water main pipelines in the bay area and some are 100 years old. officials say the pipelines would likely break during the next major earthquake. they supply water to 800,000 people in the east bay.

new developments in the police shooting of a san francisco man. the medical examiner's report is shedding light on what happened. >> the officers have a right to defend themselves. and they believed he had a firearm. >> police responded to calls of a man pointing a gun at bernal heights park on march 21. the medical examiner's report said alejandro nieto was shot 15 times. the report shows pepper spray and a taser near where the body was found. >> this stinks of a cover up.

it stinks of some type of conspiracy. >> alejandro nieto's family says some of the information is not relevant to the shooting. his medical records show a history of aggressive and bizarre behavior. and non-compliance to medications. one of the most popular players in the nfl has been benched for sunday's game after being indicted on child abuse charges. adrian peterson is accused of hitting his son with a switch or stick to punish him. his son was staying with him over the summer in texas. it was handed down today. then a couple hours ago the team announced he would not play this weekend. tmz obtained these pictures of the child's injuries from police. you can see the cuts there to the thighs and hands. adrian peterson's attorney says his client is a loving father who was using his judgment as a

parent to discipline his son. san francisco 49ers ray mcdonald is set to play in sunday's game against the bears at levi stadium. ray mcdonald was arrested in san jose on labor day weekend on suspicion of felony domestic violence against his fiance. today the district attorney postponed a hearing on the case which was scheduled for monday. jim harbaugh says all of the headlines about domestic violence have been a learning opportunity. >> just see what we can do to grow and learn and that is really what the conversations have been about. hopefully we will be better for it. not just as a football team but as a society. >> jim harbaugh said everybody is more aware about how many people are effected by domestic violence. new at 6:00 p.m. ray mcdonald's arrest and video of baltimore ravens running back ray rice ignited a debate

that are designed to tell the meter when a vehicle leaves. this allows the meter to reset. it appears some of the censors are too sensitive. a large truck driving buy -- truck driving by could trip the censor. when that happens it shows the time has run out which could result in a ticket. >> the tickets aren't cheap. they are $45. and you can't help a big truck driving by and turning your censor off. >> the city is following up with every complaint to ensure a ticket was reverse if it was wrongly issued. lot of voters are unimpressed with the performance of congress. the most recent survey found 13% of voters approve of the job being done by congress. 75% disapproved. 12% had no opinion.
