video backs up the events. patti lee has seen this video and has the story. >> reporter: i looked at different angles but whether it corroborates or contradicts the police version of events depends on who you ask. >> reporter: richard perez is seen entering liquor and deli stopping to make behind a customer. >> he came last night, i think he's too much trouble. >> reporter: delek described his behavior as unusually rambunctious. >> i asked him to leave, leave, leave. >> reporter: he asked a police officer who was outside to get him to leave. there's police officers because of so many disturbance calls.

you can see delick watching from the door way while another customers comes in. then he raising his arm to fire. police say the shooting was unavoidable. >> the suspect attacked the officer and physically grabbed his gun. the officer was by himself. the fight went on for almost a minute. the officer was able to stand up and start retreating. the officer came after him and the officer fired his weapon. >> reporter: after the officer fired his gun, the suspect is seen going back into the store holding his stomach. we chose to not show this

video. the officer is a six year veteran of the department he is on leave as is with any officer involved shooting. now the the in fact,'s troubles and another player benched as domestic violence cases intensifies. today carolina panthers deactivated hardy. hardy was convicted this summer. hardy says he is innocent . and peterson was deactivated after prosecutors in texas say he disciplined his 4-year-old son with what's being described as a switch. the vickings are expected to decide by tomorrow whether the team will take further action against peterson. >> super excited i can't wait

domestic violence during the team's 17th strike out violence day. the founder of futures without violence threw out the first pitch as part of the day. the team held a fundraiser for casa de las madres for domestic violence victims. new at 10:00, the coast guard helped rescue six men on a boat that was sinking in the oakland estuary. officials received a 911 call about a boat taking on water near shoreline park around 6:30 this afternoon. the men were told to put on life jackets and stay in the boat but when the rescue boat arrived all six men were in the water. they were checked out by paramedics and no one was hurt. a load of grapes spilled on to the freeway in sonoma county all because the truck

driver could not stop coughing. the driver was coughing when he drifted off the road. when he tried to pull on to the road, crates filled with cabernet savignon grapes came spilling out of the trailer. >> as a result we have grapes all over the freeway. >> reporter: it's quite a site. 25 plastic bins of grapes grapes slid on to the road. caltranss crews came out to make sure the road was clean and safe. it does not appear that anyone was hurt. the hot and dry conditions continue to keep northern california fire crews very busy. several wildfires are raising in the sierra foothills to mendecino county. the kings fire near pollock

pines started just yet. about 2,500 acres have burned so far, and tonight crews report just 10% containment. a calfire spokesperson say it is area has only a few homes and is mostly forest. and a fire near colfax has burned about 150 acres. several homes there were evacuated yesterday. shortly after that fire started but those evacuations were lifted last night. firefighters have this fire 30% contained. and crews in mendecino county are working to contain a fire that happened yesterday. those ordered to evacuate will return. 10 structures remain threatened and five others have already been destroyed. at last check this fire is 417 acres and 50% contained. we went out there, but probably two or three minutes and just came down. instead of watching a title fight a group of friends endedded -- ended up in a bay

friends gather together to watch a big boxing match are now in the hospital after a deck collapsed and fell in oakland last night. almost one dozen people are recovering including three still in the hospital after that collapse. a 15-foot fall caused broken bones and required surgery for several people. cristina rendon spoke with one of the victims. >> it's real traumatic. >> reporter: this wood deck is twisted and collapsed. >> we went out there say probably two or three minutes and it just came out. >> reporter: johnson says family and friends were gathered on the deck of the oakland home just before they were set to watch a boxing match last night. seconds later it collapsed. pinning him and the others underneath. >> it was scary once we found out what was going on. and a lot of people were

determine what caused the unfortunate accident. reporting in oakland, cristina rendon. >> reporter: inspectors will likely be at the house tomorrow trying to determine what caused the unfortunate accident. an 11-year-old girl was killed when police say the car she was in lost control. that crash happened in burlingame just before 5:00 this morning. the chp say it is driver of the suburban veered off the freeway and down an enbankment. the right rear area of the vehicle where the girl was seated hit a tree killing her. the passenger was taken to the hospital. the chp does not believe drugs or alcohol played a role in that crash. a north korea court sentenced a california man to six years of hard labor. matthew miller of bakersfield reportedly tore up his tourist visa the government says at the

airport when he entered the country on april 10th. the court says he intended to quote experience prison life so he could investigate the human rights situation. miller appeared in court this morning and was denied any chance to appeal his case. authorities from two other states have now joined in the man hunt in pennsylvania after a state trooper was ambushed and shot dead friday night. investigators say a shooter or shooters ambushed two troopers at the state police barracks in a remote area. corporal bryan dixon was pronounced dead. trooper jackson was critically injured but is said to be speaking now. >> i've never seen any state troopers at one time in here. >> they're concerned breaking into a house. we have a lot of vacant houses in here where they could go in to hide. >> reporter: a nonprofit group

has offered a $50,000 reward for tips leading to an arrest. but police say they have little to go on. they don't have a description. they don't know what type of gun was used and they don't know if the troopers were targeted. tonight there are reports that several arab nations are offering to launch air strikes in syria and iraq. american officials who spoke on condition of anonimity offered to help in air strikes. this after the beheading of an aide worker. today david cameron called the killers monsters. >> step my step, we must drive back, dismantle and destroy isil and what it stands for. we will do so in a deliberate way but with an iron determination. >> reporter: the obama administration is seeking to

build a coalition of as many as 100 countries to stop that militant group. however president obama says he will provide no ground troops in that effort. investigators in santa rosa are looking for a cause the house fire that killed an elderly woman. the fire was reported at a two story victorian there on 11th street. firefighters said they had a difficult time fighting the blaze because the doors and windows on both stories were blocked by items. contra costa fire is investigating a suspicious fire at an abandoned school. the one alarm fire severely damaged this portable classroom. this fire is suspicious because there was no power running in the building. all right, you could call it a large ice breaker.

welfarely quiet week -- well, fairly quiet weekend here in the bay area. finally some cooling. quick update on a major hurricane hitting cabo san lucas. hurricane odile with 100 miles per hour. already producing winds gusting to over 90 miles per hour. one of the sights near cabo san lucas. right on through tuesday, this is moving up to baja. eventually category one late monday and then a tropical storm for tuesday into wednesday. right now though, we have a category three storm right now moving into cabo san lucas. possibly producing rain showers in southern california as we head toward the midweek

forecast. back here in california, we're tracking two, the happy complex and king fire as you see to the east of pollock pines. temperatures not extremely hot. we're cooling off to this part of the state. wind out of the southwest at 10 miles per hour. it's that time of year, fire danger is a big concern and very dry out there. as far as temperatures from this afternoon. we had hot numbers inland. san jose topped out 89. and san francisco downtown 70- degree. right now though we are in the clear. mostly clear skies out there. and temperatures still pretty mild inland out toward fairfield and concord in the lower 70s. san jose 67 and santa rosa in the upper 60s. for tonight, partly cloudy skies a bit of a breeze out there. not much in the way of fog right now. we're looking out to the bay bridge. some fog will regroup right near the immediate coastline tomorrow morning and possibly right around the bay.

a little bit cooler for tomorrow. the extended clouds and we're tracking shower chances at least a slight chance of a few showers. overnight lows first thing tomorrow morning. lots of 50s to right around 60 degrees. this area of high pressure is moving out of town. so it'll be a cooler monday with partly to mostly sunny skies. there's a weather system out here in the pacific. we're going to keep an eye on this for more cooling late wednesday into thursday there's a slight chance of a few showers. now here's our forecast model we will put this into motion. you see the rain approaching northern california wednesday. and a slight chance wednesday into thursday morning. something we'll be watching out for that time frame. at least for tomorrow we're cooling off everybody cooling off. as you can see santa rosa upper 70s. fairfield upper 80s. oakland 38. san jose in the upper 70s and san francisco will go 67. here is a look ahead your five day forecast. the theme over the next few days cooler temperatures, slight chance of a shower

wednesday and thursday. then we're going to back up for day six and seven with the weekend in view. but if you're tired of the heat there's some relief tomorrow. hundreds of people celebrating tonight after a swim across the bay. this morning marked the 19th annual alcatraz invitational swim. the open waters is 1.2 miles from the island to the height street pier. some people tell us this is an event they look forward to every year. >> i'm very excited. jumping off the boat and swimming across the bay. it's like 100 people it was great. >> once you get out there in the bay, it's not as crowded as i thought it would be. >> reporter: fog and warm temperatures. scientists say the bay's waters are running about 5 degrees warmer than normal this month making it more comfortable for all those swimmer.
