we're live in san jose where two fires appear to have been intentionally started at an elementary school. we were there. we'll bring you the story. a man is deading outside a shooting outside this downtown oakland nightclub early this morning. we'll tell you what police say led up to the gunfire and the evidence investigators have to go on. the first confirmed case of ebola in the united states. what we know about the critically ill man getting treatment in texas. we had opportunities to put

the wind is picking upg along the coast. it's another of a north- northwest breeze. gusts to 31 above the caldecott. it's on its way, it being an offshore breeze. 67 fairfield. 60 livermore. there's a huge difference. half moon bay wack 48 at 4 -- was 48 at 4:00 a.m. the breeze is picking up in deal city. for some it's cool. for others it's getting warm. 63 la honda. 52 menlo park. big differences on some of the temperatures. the rain is long gone. they will be fine for the giants' game tonight. we have clear skies for us. it look like it will be this way for a while. fire danger is up. the beach weather as good as it gets wednesday, thursday into friday. you might feel under the weather, head to the beach. it will be really nice. sunny and warmer. breezy to windy for some. if you do get the breeze, it can be darned warm. 80s to near 90s. 70s, 80s by the water.

here's sal. we're looking at contra costa county because a crash on 242 has messed things up. not only on 242 but also on highway 4. a lot of the traffic is coming off highway 4 and getting off 242 which is a lot of what people do. the crash is blocking the left hayne -- left lane. they are moving it. let's take a look at the bay bridge toll plaza, the traffic continues to look pretty good throughout. i want to mention, pretty good for this time of the morning. northbound 280 in san jose is getting slower. it gets better after highway 17. 85 is slow from 87 and 101 is slow from the capitol expressway. back to the desk. >> thank you, sal. we begin with breaking news. we first reported at 6:30. investigators say they are now looking into two intentionally set fires early this morning at a san jose elementary school. ktvu's janine de la vega and her photographer were two of the first people on the scene

and, janine, we learned you even called 911. >> reporter: yeah. george and my photographer were just in complete disbelief when we were driving by. we saw the flames. we couldn't really make out what was on fire. but here at simons elementary school, this is the spot where it was happening. it was here in a courtyard. it was four cones and pylons. i brought one of these so you could see exactly what we saw, two people sort of throwing into the flames. this wasn't one of them. but this is what it looks like. here you can see the aftermath. we were watching. again, two people were throwing things into the flames. we immediately stopped and started shooting this video. this was at 5:00 a.m. you are looking at the courtyard of the elementary school. two people were there throwing the pylons and other items into the fire. that's when i called 911 to report it. we saw the two people run off. we immediately jumped back in our van and drove around to the other side of the school to see if we could catch them and

encountered teenagers. san jose firefighters arrived shortly after and extinguished the fire. they had just been to this same location an hour earlier at 4:00 after a neighbor reported another fire on campus which was smaller in the same location. arson investigators were called. >> there's the potential for this fire to go up into the trees and then possibly over into one of the buildings. we extinguished it. there was no structure exposure reported it to police and our arson unit and it's being investigated. >> reporter: police canvassed the neighborhood looking for potential suspects but could not locate anyone. fire officials found a vodka bottle near where the fire was started. it was taken away for evidence. firefighters say, again, it was not at that first fire that vodka bottle ail peered here at the second -- appeared here at

the second fire. but officials tell us they will be using our video to try to capture the suspects scene in the video. they are gonna look into the two teens we questioned because they claim they were just witnesses of the fire. again, a pretty unbelievable story. we were just here checking out the school because we had heard the reports of the earlier 4:00 a.m. fire and couldn't believe that we ran into and saw this second fire. there was also a school district employee who was there and also witnessed it and i think that's what scared off these two teens. we were quite a distance away across the way of the street. so we couldn't make out any faces. one of the things i do want to mention, this is not going to affect school here at simonds amount -- elementary because school is not in session this

week. jag, ktvu channel 2 news. >> all right. police searching for suspects in a deadly shotting. it happened at 1:00 on clay street. ktvu's alex savidge joining us live from oakland to tell us what led up to the gunfire. good morning, ail length. >> reporter: dave good morning to you. all investigators know, there was some kind of argument outside of this nightclub early this morning. that led up to the gunfire here. one man was hit and he died later at the hospital. it happened close to the entrance to the bella ultralounge. as we push in, you can see there is a surveillance camera above the front door. investigators right now are going over surveillance video checking that video hoping it may be able to help them make an arrest. the shooting happened just after 1:00. this club 0 is on clay at 12th street. security guard told me the place was pretty crowded when it all happened well over 100 people inside. the man who was shot was rushed over to highland hospital. that's where he died. it's unclear if he had been

inside the club beforehand. a cook who works at the lounge told me he saw people running and screaming just after the gunfire. he says the club does have a security team but it's hard to control what happens outside. >> outside, it's like the -- i don't know what's going on. you never know, you know, what gonna happen to you, you know. >> reporter: this was the 54th homicide of the year so far here in oakland, although this city has seen a dramatic drop in the number of killings recently. homicides are down 25% so far this year compared to last year. the count at this time last year stood at 72 homicides. no arrests have been made in connection with this morning's shooting. but investigators spent the morning talking with witnesses in the area and trying to figure out what this dispute was all about and also going over surveillance video and other evidence trying to identify the people involved in

this crime. we're live in oakland, alex savidge, ktvu channel 2 news. 7:08. we have new information about a young father shot and killed over the weekend in san jose. detectives now say 24-year-old richard watkins was killed by a stray bullet. he was standing outside of his home on azukar avenue waiting for a relative to park a car when he was shot. investigators say the gunman had confronted that relative and for some reason opened fire. the relative was not hurt. but watkins died there at the scene. so far, no arrests have been made. 7:09. a vallejo police sergeant is under investigation after police in bend, oregon say he pulled a gun during a fight. police say michael kent tribble was part of a dispute outside of a bar early sunday morning. they confirm he showed a gun but say no shoates were fired and no -- shots were fired and no arrests were made. the incident is still under investigation because of conflicting statements of some of the men involved.

according to the daily republic newspaper, tribble was involved in the deadly police shooting of guy garot in vallejo in 2010. that shooting was ruled justified. the oakland as are heading back here to the bay area after losing last night in the wild card game. they blew a 7-3 lead. and the game went to extra innings. but then this happened. oakland scored one. but the royals scored 2 to win 9-8. this is the third straight year, the as have been in the postseason and each ended in disappointment. >> every time we thought we had them down, they came back. and it's a testament to the kind of team they are, i think the bottom line we had opportunities to put that game away and we weren't able to do it. >> heartbreaker. well, the royals, they now move

onto the american league division series. they will be playing the los angeles angels. now it's the giants' turn. they will play the pirates at 5:00 tonight. but they haven't -- the winner of tonight's game will play the washington nationals in the national league division series. ktvu's brian flores is out this morning getting reaction from both as and giants' fans. he'll have that report at 7:30. for the first time, interests have diagnosed a patient with the ebola virus in the united states. the patient is in a dallas hospital this morning in critical condition. he traveled to texas from west africa a week and a half ago and was showing no symptoms at that time. but his health steady declined. he had gone to the hospital twice before doctors learned he had come from liberia.

the safety checks now in place and the concerns from a ucsf doctor who is one of the world's leading experts on ineffectous diseases -- infectious diseases. that's coming up at 7:45. 7:12. a bold theft in a busy east bay restaurant. coming up at 7:30, what was stolen from right under a woman's chair as she ate lunch. but parents are on high alert. extra security at several schools after a man tried to lure different girls into his car. garming. right now -- good morning. right now traffic is doing well if you are driving in some

a fund-raiser planned today to mark the 21st anniversary in a crime in petaluma that shocked the nation. a man with a knife kidnapped polly klass from her bedroom. richard allen davis was later sentenced to death for polly's kidnapping and murder. today an italian restaurant chain will raise money for the klaas kids foundation at all 19 of its bay area restaurants.

klaas kids helps the families of missing children. in the meantime, police in petaluma are searching for a stalker targeting girls walking home from school. investigators say the man has tried to lure several girls into his car near three schools since crasses began last month. police have increased patrols around petaluma and casa grande high schools. they are also warning students across petaluma to be alert. >> right now, we have one person with repeat events or a couple of different people that are out there looking for targets. we don't want nep -- any targets. >> police have one suspect suspect in the case. they are looking for a man arrested on femny stalking charges last week. he was bail out of jail one day before the latest school incident on monday. 7:16. santa clara county prosecutors have dismissed murder charges filed against two brothers in a

highly publicized cold case. it's all because of a romantic relationship between two key investigators. the husband and the brother-in- law of kathy zimmer were charged with killing her 25 years ago. now, police found her body in the back seat of her car in the san jose airport parking lot. the charges against the two men were dropped because a prosecutor had an affair and a crime lab -- with a crime lan technician who tested the evidence. the army veteran at the center of a white house security scandal is due in court today. 42-year-old omar gonzalez has been indicted on charges of entering the president's mansion armed with a folding knife. gobz jumped over the -- gonzalez jumped over the white house fence and was able to make it in before being stopped. gonzalez's family says he suffers from post-traumatic stressdy order after three tours in iraq. we're learning of another

breach involving president obama recently. this happened two weeks ago when he was at the cdc in atlanta. according to the washington post, the president rode in an elevator with a security contractor who was a convicted felon and carrying a gun. secret service agents only found out he was armed after they questioned him when he refused to stop taking pictures of the president in the elevator. the secret service is supposed to screen anyone with access to the president and anyone who has a gun needs special clearance. the head of the secret service faced tough questioning from lawmakers at a congressional hearing investigating the security breach at the white house. several members of congress told julia pierson they lost confidence in her ability to do the job. they asked her to explain how an intruder was able to get so far into the white house. >> we all are outraged within the secret service of how this -- how this incident came to pass and that's why i have requested for a full review.

firefighters in new jersey worked hard to contain a fire that broke out near the famous boardwalk. it spread to several other businesses and apartments on the second floor. two buildings partially collapsed. at least 17 people, including six children managed to safely escape. there's still no word on the cause of this fire. 7:25. people who live in the east bay hills, they are worried about higher fire danger this week because of higher temperatures and offshore winds. groves of eucalyptus trees that helped spread the flame during the 1991 firestorm, they are still a problem. 25 people died. 4,000 homes were destroyed in the fire. nine years ago, a local agency asked the federal government for millions of dollars to chop down eucalyptus trees in the east bay hills. the government says it will make an environmental impact statement early next year. >> the government needs to do whatever it can to reduce the fire hazard. if that means trimming back those trees, then they need to trim back the trees and

maintain them. >> there are also big questions about whether the trees should be trimmed or just completely chopped down. either way, the homeowners say they want something done now. 7:26. independent engineers are downplaying the safety threat from the highly publicized bolt problem on the new bay bridge. they have issued a report stating a simple coat of paint and grease could help protect the bolts. their extensive tests on more than 2500 bolts determined that they are strong and safe, especially if they get extra protection from corrosion. last year, caltrans discovered a third of the bolts failed when they were tightened, raising concerns the new bridge was not safe. 7:27. this happened more than two dozen times now in the south bay. people having gold chains snatched right from their necks. the common links among all of the victims. >> reporter: it's heartbreak

necks. in the past five months, police have investigated. while the robberies happened in different locations and at random times of day, there is a common link between the victims. they are all of indeiant decent -- in-- indian decent. >> they snatched the chain and he sat on the motorbike. >> the police think the suspects drive down the street looking for victims. now, they've released photos of a suspect and a getaway car. the suspect described as an african-american man in his 20s about 6 feet tall. he may be working with a group of men with similar descriptions. oakland as season, it's over after a disappointing loss in the american league wild card game. as were looking good but they

blew a 7-3 lead. the game went into extra innings. oakland scored one in the 12th. kansas city scored 2 for a 948 of win -- for a 9-8 win. giants are hoping there's better luck for them against the pirates. brian flores has more. >> reporter: good morning. we're talking about hope and heartbreak for many fans this morning. tough loss for the as. still can't get over that game. third straight year the as made the playoffs ending in disappointment. we're live here at at&t park. this is where the hope part comes in especially for san francisco giants' fans. there's a viewing party scheduled to be here for the team later on this afternoon as the team takes on the pirates around 5:00 today. now, madison gum garner will take -- bumgarner will take the hill tonight. this is a winner take all game to advance to the postseason.

tonight. we're live in san francisco. brian flores, ktvu channel 2 news. 7:37. police in southern california say so far, no arrests will be made following a domestic dispute that killed a suburban los angeles mayor. officials say the mayor of bell gardens, daniel crespo, got into an arc mmpt with his wife -- argument with his son when their son intervened. when they were fighting, his wife went to another room and grabbed a gun. >> we do know that the father, daniel, senior, became physical with his son. early reports he punched him in the face. >> police say the wife shot her husband several times and he died at a hospital. mrs. crespo was detained. she was questioned and then later released. the facts of the case are gonna be turned over to the prosecutor who will decide if charges will be filed. the family of a 9-year-old

boy reportedly slap by a fremont schoolteacher has filed a lawsuit against the teacher and the school district. it alleges negligent hiring, negligent supervision, assault, battery and other charges for the incident at patterson elementary school back in april. investigators say the teacher fred burg became angry and slapped the boy after the third grader made a mistake on a slap test. burg was placed on paid believe but later returned the school despite several protests from parents. all california teachers and employees are now required to take child abuse training every year. the legislation was signed by governor brown into law on monday. it changes state law from strongly encouraging training to making it mandatory within the first six weeks of every year. this new requirement starts the next school year. there will be no formal punishment for school districts that won't train their employees but they will be open to the liability of any

possible lawsuits. san francisco public schools received a federal grant to help students who have been exposed to violence. the education department will provide almost $3 million over the next five years for violence, intervention, prevention, as well as counseling. homicide is the leading cause of death among young people between the ages of 15 and 24 in san francisco. stats show that 67% of the children in the bayview hunters's point neighborhood have been exposed to one traumatic childhood experience. the minimum wage in berkeley goes up one dollar. it's increasing from the $9 state minimum wage to $10 an hour. it then rises to $11 next year and to $12.53 by october 2016. business owners express concerns about whether they can survive the increase. labor groups proposed a $15 an hour minimum wage. the list is out of the top

diagnosed here and the warning from health experts. >> good morning. doctors and health experts trying to figure out what may have gone wrong in this new diagnosis in the deadly ebola at a texas hospital. now, the man diagnosed was visiting family in north texas after arriving from the west african nation of liberia on september 20th. he started to have symptoms on september 24th. he sought mel care two days later -- medical care two days later. he was sent home and only admitted on sunday when his symptoms became worse. he's in an isolation ward in a dallas hospital. one well-known doctor says what happened is alarming. >> the emergency room physician had asked this person do you have any recent travel outside of the country and the if the person said, i just came back from liberia, that would have been an enormous red flag. >> we also spoke to dr. kelly

who traveled to help fight the ebola virus. he's also concerned because he says he was screened before boarding the plane but was not asked any questions in europe or upon arriving in the u.s. >> i don't think this is gonna be the last case of what we'll see in america. >> the texas man just diagnosed with ebola is in isolation as a precaution. his family, the paramedics who transported the man in an ambulance and hospital workers are all being monitored and not working with the public at this point. now, at 10:00 this morning, our time, texas governor rick perry will hold a press conference to discuss how his state will handle this ebola case. reporting live in the newsroom, pam cook, ktvu channel 2 news. >> thank you. 7:45. investigators near fresno say someone broke no a foster farms chicken shed and used a golf club to kill 920 chickens. sheriff's deputies say at least one person pulled back a fence to the shed on september 20th, went inside, and killed the

downtown. that's northbound 28 on the right. you can see traffic is slow. it stays that way until you get to cupertino and then it gets better. also looking at the commutes on 580 westbound. that's been slow from livermore into pleasanton at 680 continues to be under the speed limit right from the 680 interchange as you drive down toward fremont, it finally gets better by the time you reach the main part of fremont. as we push in here on 880 southbound, it's backed up from 238 solid all the way down to stevenson. most of that is stop-and-go traffic. let's go to the toll plaza, we always watch that and the best approach, i think would be 580. 880 is pretty jammed up. it's about a 20, 25-minute drive into san francisco. now here's steve. >> thank you, sal. >> you are welcome. very good morning. clear skies. for some it's windy, it's warm. for others, it can be windy and cold. for others, calm and cool. we had 40s to 60s on the temperatures. some lows were in the upper

60s. some of the higher elevations i've seen 30, 35 miles an hour. the coast is getting a northwest breeze. all this dry air is spilling in from eureka down to san diego, even venally. 59 to start in san diego. i've seen anywhere from 52 to about 64 degrees. 64 in pacific heights. 52 in the mission. it depends if you get the breeze. outer sunset, 63. 79. i would not be surprised to see low to mid-80s. oakland starting off 60. pretty good breeze coming off the higher elevations of the caldecott, about 31 miles an hour. 84 for a high today. this is a setup that we -- if you live out here, we see it in september and october. 49 walnut creek. 60 in livermore. there's some areas that are very warm. 67 fairfield. novato, 50. half moon bay has gone from 48 to 63 in two and a half hours. that's because the breeze has picked up. some of the higher elevations are starting to warm up. gilroy is 49. san jose state at 60. so the car thermometers might be doing all of this if you are

traveling around. 23, gusts to 30 for fairfield and vacaville. that's making it out to parts of eastern solano. had reports of windy conditions towards oakley. some areas got a northerly breeze. the component is offshore. 59 for bodega bay. that's the coolest i've seen in a long time. monterey 62. a couple of days ago they were 55, 56. the 30s in the mountains. 47 ukiah. 46 eureka except for fog. there's a lot there. in pittsburg it will be okay for the giants' game. about 70s to 60s on the temperatures there today. for us, clear and that means heating up. now, the high is kicking in. already the north wind, the sinking air into friday. that will equal a warm to hot pattern. we'll start a cooling trend. the next few days higher fire danger, the north-northeast breeze. even though we had recent rain,

hong kong's leader tried to convince prodemocracy demonstrators to go home. the leader expressed support for the chinese government's plan to nominate candidates for the election of hong kong's next leader in 2017. the protesters who have been filling those streets, they want to be able to choose their own candidates. today while the leaders with speaking, the protesters yelled for him to design. the protesters say if the leader does not resign by tomorrow, they will step up their actions including occupying several government buildings. a man from south san

francisco is under arrest accused of sexually assaulting a young girl during sleepovers at his house. police say 43-year-old ronald lauren attacked at least one girl multiple times over the last two years. authorities say the assaults happened during sleepover parties. however, they did not say what his connection is to the victim or why children would sleep at his house. police also say there may be more victims. they are asking anyone with information about this case to come forward. the family of the san francisco mother who was hit and killed by a truck driven by a city gardener, they will get $15 million in a settlement with the city. 35-year-old christine was lying in the grass at holly park with her baby last september when she was run over by the gardener's pickup truck. the 58-thomas bernoski drove away from the scene. he was fired from his job. he pled not guilty to vehicular manslaughter and felony hit and

run. a number of bills were signed in a state law by governor brown just before a midnight deadline last night. some of the most closely watched have to do with sexual assaults and gun control. another will affect the way you shop. this morning we have more details on the legislation that will go into effect on january 1st. audrie's law will increase criminal penalties for teenagers convicted of certain sex acts. it's named in memory of audrie pott, a 15-year-old girl who died two years ago. the teenager was slawmed while she was passed out -- sexually assaulted while she was pass the out drink at a party and the photos were shared. she committed suicide. the teens received sentences of 30, 45 days in juvenile hall. another law, rape kit testing. the law requires hospitals to submit rip kits to forensic

labs within five days of collecting dna and forces the labs to process those kits within 120 days. nancy skinner believes the legislation will help with the enormous backlog of rape kits an get perpetrators off the streets. skinner plans to join advocates in oakland to discuss and celebrate the new law. new gun control legislation is also state law. it allows family members to ask a judge for a restraining order against a family member that they consider dangerous. the judge can then decide to take away that person's gun and prevent any new gun purchases. this new law takes effect january 1st. california's now the first state in the country to ban single use plastic bags. starting next july, large grocery stores cannot give or sell plastic bags to customers. the following year convenience stores and pharmacies will also be covered by the ban. the law does allow plastic bags

for fruit, vegetables or meats. more than 100 california cities an counties already ban plastic bags. 7:56. starting today in san francisco, there are 32 more places access free wi-fi service. google gave the city $650,000 to set up the system. the free wireless internet service will be available at 32 open spaces in the city. they include parks, civic center plaza, justin herman plaza and union square. kind of nice. >> yeah. 7:57. deadly gunfire early this morning right outside and oakland nightclub. coming up in minutes what we found out from the police and the witnesses. >> reporter: we're live at a san jose elementary school where we witnessed an arson. we caught the suspects on camera. we'll tell you how it is helping in this situation. good morning. right new we're looking at highway 101 and we can see the

the bay bridge toll plaza and you can see traffic is slow. it's about a 25-minute drive although maybe a little less and we're counting all of the time. that means the time on the bridge as well. it will be a couple of crowded spots on the man. the commute has been slow on 880 northbound from about the coliseum past high street. but the real slow traffic on 880 is slnd. we had a couple of crashes in hayward. minor things. most of this traffic i'm outlining all of the red. the traffic is slow to milpitas. our own crew arriving to cover a story this morning found themselves in the middle of developing news in the south bay. they saw one of two fires being intentionally set at a san jose elementary school. janine de la vega joins us live from simmonds elementary. it sounds like a dramatic day for you guys so far.

>> reporter: we report on crimes and fires. we don't expect to be witnesses of a crime like this. but that's what happened this morning. we were driving by simonds elementary school because we heard there was a fire here earlier. we saw orange pylons that are in the courtyard being thrown in the fire. this is the video. we immediately stopped an started shooting. this was in the courtyard of simonds elementary. two people were in the picnic table watching the fire and throwing garbage and debris inside of that's when i called 911 to report it. we saw those two people run off. we immediately jumped off in our van and drove around to the

other side of the zran to see if we could catch them. instead, we encountered teens who claim they saw the suspects as well. san jose firefighters arrived shortly after. they put out the fire. it was in the same location at 4:00 a.m. after a neighbor reported that first fire on campus. an arson vear was called out to -- an arson investigator was called out to investigate. >> what comes to mind is the school burning down. it may seem nothing to them. but it can grow into loses the entire school. >> reporter: police canvassed the neighborhood looking for potential suspects but could not locate anyone. fire officials found a vodka bottle near where the fire was started. it was tangen for evidence -- taken for evidence. we were interviewed by police, my photographer, george, and i. they are gonna use our video to try to catch the suspects. police are looking into the claim made by the teens that we

questioned minutes after the fire. as far as this affecting simonds elementary school, school is not in session. again, this was just a garbage debris fire. it did not damage any part of the school. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thanks, janine into the two men accused of setting fires in alameda are due back in court. yesterday, 27-year-old steven petersen was charged in three of the seven fires that were set early sunday morning. 22-year-old an true gutierrez, a transient, is accused of setting the our fore. police video shows a dumpster being set on fire. both men have asked to be assigned public defenders. oakland police out there searching for suspects in a deadly early-morning shooting. it happened about 1:00 this morning right outside of a

downtown nightclub on clay street. just moments ago, alex savidge -- you got new information from the police. good morning. >> reporter: good morning to you. police say this was a 27-year- old man from berkeley who was shot here outside of the bella ultralounge in downtown oakland early this morning after he got into some kind of an argument outside of the club. you can clearly see right above the front entrance a surveillance camera. investigators tell me they are going over video from this business and others around here hoping it will help them to make an arrest in this case. the shooting happened after 1:00 this morning, this club is on clay at 11th street. a security guard who works here told me the police was pretty crowded when this all happened well over 100 people inside. the men who was shot was rushed over to highland hospital. that's where he died. and police say that he has been identified as connie souls iii from berkeley. now, according to a report in the contra costa times. the victim had been inside the

lounge before the shooting with some friends but then he got into some kind of a physical fight with another man outside of the club. police aren't sure exactly what the dispute was all about. >> from what we can gather, we know there was some sort of physical altercation between the victim and the suspect. at some point, our suspect pulled out a brirm and shot our victim -- firearm and shot our victim. that's about the extent of it. >> reporter: according to the department, this was the 52nd homicide of the year so far in oakland. the city has seen a dramatic decline in the number of killings. homicides according to the department are down 30% so far this year compared to the same time last year. no arrests have been made in connection with this morning's shooting outside of this club. but investigators spent the morning talking with witnesses and again going over surveillance video hoping that can help them in this case. an employee here at the club tells me the place has a good security team but they can't control what happens outside of the club. we're live this morning in

downtown oakland, alex savidge, ktvu channel 2 news. >> we also have new information about a young father shot and killed over the weekend in san jose. detectives now say 24-year-old richard watkins was killed by a stray bullet. he was standing outside of his home on azukar avenue waiting for a relative to park a car when he was shot. investigators say the gunman had confronted that relative and for some reason opened fire. the relative was not hurt but watkins died there at the scene. no arrests have been made as yet. a vallejo police sergeant is under investigation after police in bend, oregon say he pulled a gun during a fight. police say michael kent tribble was part of a dispute outside of a bar early sunday morning. they confirm he showed a gun but say no shots were fired. and no arrests were made. police say the incident is still under investigation, though, because of conflicting statements of some of the men involved. now, according to the daily republic newspaper, tribble was

involved in the deadly police shooting of guy girar in vallejo in 2010. that shooting was ruled justified. santa cruz county sheriffs need help to identify a man who pretended to be a good samaritan to an intoxicated person. the suspect, you can see him on surveillance images. he gave the victim a ride home on september 21st. when the victim fell asleep, the suspect, who also had a little girl with him, ransacked the place, stealing two big screen tvs, furniture, a laptop, golf clubs, men's suits even a tuxedo. if you have any information, get in contact with the santa cruz county sheriff's office. well, san jose voters will get a chance to overturn the tough new retricks on -- reeb strictions on pot clubs but knoll in the 2016. the city council decided to put the measure on san jose's next regular election ballot in june of 2016.

they say it would have cost san jose tax payers 3.5 million to hold a special election before then. that palot measure would -- ballot measure would loosen the restrictions and force many medical dispensaries to close their doors. uptown oakland has been named one of the ten best neighborhoods in the u.s. that's the area of oakland around the 19th street b.a.r.t. station. it includes the paramount theater and frank ogawa plaza where city hall is located. the american planning association prices the entrepreneurial spirit and notes that the area has been revitalized over the last 15 years. the organization says the neighborhood sponsors many cultural events such as the first friday festival which attracts up to 20,000 people. >> yikes. all right. 8:10. it happened at a busy walnut creek restaurant. but it looks like no one noticed this. coming up in 22 minutes, the bold theft caught on camera. the president in a same

president obama is about to meet with israeli prime minister benjamin netanyahu at the white house. this is video from last year. it will be his first trip to washington, d.c. since israel's summer war with hamas. that conflict heightenped tensions between the two leaders who have long had a tense relationship. they will discuss u.s.-led nuclear talks with iran. the army veteran at the center of a white house scandal is due in court. omar gonzalez has been indicted on charges of entering the presidential mansion armed with a folding knife. he jumped over the white house fence and was able to make it deep in the white house before stopped by secret service agents. gonzalez's family says he suffers from post-traumatic stress disorder after three tours in iraq. we're also learning of another security breach

involving president obama. it happened two weeks ago when he was at the cdc in atlanta. according to the washington post, the president rode in an elevator with a security contractor who was a convicted felon who was also carrying a gun. secret service agents only found out the man was armed after they questioned him when he refused to stop taking pictures of the president in the elevator. the secret service is supposed to screen anyone who has access to the president and anyone who mass a gun needs special clearance. well, the head of the secret service faced some really tough questions at a congressional hearing on the security breach at the white house. several members of congress told secret service director julia pierson they lost confidence in her ability to do the job. she was asked to explain how the intruder omar gonzalez was able to get so far into the white house. >> we're all outraged about how this incident came to pass. that's why i've asked for a

full review. it's obvious, it is obvious that mistake were nad. >> i wish to god you protected the white house lake you protect your reputation here today. >> now, pierson also said she doesn't agree with lawmakers who say secret service agents should have shot that intruder. we're also now hearing of a possible explanation for the reason north korea's leader, kim jung un, has not been seen in public for weeks. a south korean newspaper reports he's recovering from surgery for two broken ankles. the paper says there has been a dramatic weight gain. the paper says he weighs more than 200 pounds and hurt his ankles by wearing shoes to make himself look taller. a report says the world has lost half of its species of wildlife in the last 40 years. the london zhu logical society

-- zoological citing 100 years ago there were 100,000 tigers in the world. now there are just 3,000. about 35,000 walruses were discovered crowded together on a shore in american alaska late last month. according to the wold wildlife fund, climate chainen has melted so much of the ice, it's now more difficult to find ice in the ocean. a spokeswoman for world wildlife says these walruses are sending the same messages polar pears have tried to convain, the arctic -- convey, the accuse wildlife is changing -- arctic wildlife is changing. twilight is living on.

welcome back to "mornings on 2." 8:24. police in petaluma searching now for a stalker targeting girls walking home from school. investigators say this man has tried to lure several girls into his car near three schools since classes began last month. police have increased patrols around petaluma and casa grande high schools as well as miwok. they are warning students across met be on alert -- petaluma be on alert. >> we have one person with repeat attempts or a couple of different people out there looking for targets. we don't want any targets. >> police say they have one possible suspect in the case. they are looking for a man arrested on felony child stalking charges last week. he bailed out of jail one day before the latest school incident on monday. people who live in the east

bay hills are worried about increasing fire danger this week because of high temperatures and offshore winds. homeowners say groves of eucalyptus trees that helped spread flames during the 1991 firestorm are still a problem. 25 people died and 4,000 homes were destroyed by that fire. nine years ago, local agencies asked the federal government for millions of dollars to cut down eucalyptus trees in the east bay hills. the government says it will make an environmental impact statement early next year. >> the government needs to do whatever it can to reduce the fire hazard. if that means trimming back the trees, they need to trim back the trees and maintain them. >> there are also questions about whether the tree should be trimmed or completely cut down. either way, homeowners say they want something done now. a rash of robberies happening in the south bay. after the break, what the

the gate. 63 san jose state. 60 fremont and los gatos, 61. there's a little bit of a breeze north half moon bay, 6 to 17 which is why they are 68 degrees. other lecations, especially east bay and parts of solano county are also warm. pittsburg has fog. it will be okay for the giants' game. no clow, no rain -- no clouds, no rain. breezy to windy for some. 80s to near 90. here's sal. traffic is going to be a little bit slow in some areas. first of all we're gonna start here at the toll plaza. we've seen some improvement on westbound 80. it's about a 20-minute delay which is better than normal. we'll take anything we can get. the metering lights are not superslow. now let's go to 880 which is slowing down getting up to the coliseum and up to about high street. then it starts to break free.

but southbound 880 is very slow. southbound 880 at brokaw, they are clearing an accident in san jose. we have a map of that. the traffic is going to be okay. hurlingham at bellview, they are working an injury accident at the corner. back to the desk. a brazen wallet snatcher caught on camera on video at a restaurant in walnut creek. ktvu's tara moriarty joining us live now from tender greens downtown. you say the police were able to track down images of the thief. you are getting reaction from people to all of this tara? >> reporter: that's right. a lot of people are shocked that such a crime could happen in such a quaint town. others say you simply have to be on your toes these days. this is a look at the surveillance video from monday around lunchtime where you see a woman standing in the bottom right-hand corner of the frame. she scopes out the place, acheles for a good position behind the victim.

then after half an hour, grabs the wallet from the purse. she steals credit cards and returns the wallet to the victim's purse. she quickly exits the restaurant. the victim is up aware. >> the thief is sitting right behind her. pretty brazen. >> she's probably very good at what she does. she knows she's cold front dent that she can go -- confident that she can go in and pull it off. >> reporter: police the wallest snatcher went on a $3,000 spending tree, racking up a pile of bills in the victim's name. anyone who recognizes the suspect in the video is asked to contact walnut creek investigators. police in the south bay warning about a rash of robberies where gold chains are snatched right off people's necks. in the past five minutes, police investigated 21 chain snatchings in sunnyvale.

negligent supervision, assault, battery, and other charges for the incident at patterson elementary school back in april. investigators say teacher fred burg became angry and slapped the boy after a third grader made a mistake on a math test. he was placed on paid leave but later returned to the school despite several protests from parents. happening today, the minimum wage in berkeley goes up by $1. it's increasing from the $9 state minimum wage to $10 an hour. it will then rise to $11 next year and then $.53 by october -- 12.53 by october 2016. business owners are concerned whether they can survive the rate hike. labor groups proposed $15 an hour. the oakland as are done for the season after a disappointing loss in the american league wild karld game. the as -- wild card game.

developing news in san jose. officials investigating two

fires intentionally set early this morning at simonds elementary school. now, our south bay news crew got there just seconds after the second fire started. ktvu's janine de la vega is there at the school now with pictures you won't see anywhere else. good morning, janine. >> reporter: good morning. we were in shock. we could come here to simonds because we heard there was a fire at 4:00 a.m. the fire was already out but when we pulled up an hour later at 5:00 a.m., we saw a second fire and this is what is left of it. i want to show you exactly. this is garbage and debris. this is what we saw. two people were standing nearby. we saw one of them throw a pylon like this into it. and fire officials are telling us they are lucky it didn't spread. if you look up to the spree, you can see some of the leaves are singed. it's lucky it didn't spread. we did capture the suspects on video. we immediately stopped and

started shooting video. this was in the courtyard of simonds elementary school around 5:00 a.m. these two people were near the picnic tables watching the fire and throwing items in t that's when i called 911. we got back in the van to drive on the other side of the school. we encountered teenagers. they claim they saw the suspects. an arsean investigator was called -- arson investigator was called. school officials want to realize how serious they realize their actions are. >> i think they need to realize what could a happened if the building had gone up and the impact on the community and everything else. >> reporter: police canvassed the neighborhood looking for potential suspects but could not locate anyone. fire officials did find a vodka bottle near where the fire was

started. it was taken for evidence. we were interviewed, my photographer, george and i by fire officials. they are gonna use the video for the investigation to try to catch the suspect seen in that footage. police are looking into the claim made by the teenagers that we questioned minutes after we saw the fire and those people run away. now, again, two fires, one at 4:00 a.m. one at 5:00 a.m. in the same location. so again, something that the fire department is looking into. the school district again feels grateful that none of the buildings caught on fire and there's no school this week at all on campus. this isn't gonna disrupt anything. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> all right. thank you. for the first time a patient in an american hospital has been diagnosed with ebola. kowt's pam cook joins us -- ktvu's pam kick join us in the

studio with -- pam cook joins us in the studio with what happened. >> people are panicked. shortly after the news of that u.s. patient being released, there were more than 50,000 tweets about ebola in one hour. now, the man diagnosed had been on a trip to liberia. that did not show any symptoms until several days after arriving in texas to visit family. he started having symptoms on september 24th and went to see a doctor. at that point, he was sent home and only admitted to the hospital on sunday when his symptoms got worse. he's currently in an isolation ward of a dallas hospital in critical condition. his family, the medical personnel who came in contact with him are all being monitored for any symptoms and are not working with the public. >> of course, now with the issue that has us all concerned, be there be a case of someone diagnosed in the united states who bail infected as a result of patient contact in the united states. >> now, doctors say his fellow passengers on the plane are not

at risk because you can only contract ebola through direct contact with bodily fluids of someone sick with symptoms. but we spoke to a doctor at ucsf who recently traveled to western africa and he's very concerned. >> wasn't asked anything in brussels when i landed. nothing in america when i landed and that's at risk with people passing through borders and boundaries. >> dr. kelly doesn't believe there will be a massive outbreak in the u.s. because our healthcare system is so much more advanced. coming up at 10:00, texas governor rick perry will hold a news conference at the dallas hospital where the patient is being treated and the go will discuss how his state will handle this ebola case. >> very interesting. thank you. 8:48. let's check back with sal.

pretty much people have been banking for you. good today. >> it's just a moderate commute. kind of a typical one where we see slow traffic exactly where we expect it. there's one glitch. that would be 880 southbound. we'll talk about that in a month. let's take a look at 101 in san jose northbound. it's really slow as it normally is from near the -- before the capitol expressway all the way into sunnyvale. 280 and 85 are very slow at the end. there is a crash, southbound 880 at brokaw. i want to put it on the maps. traffic is slow. as we pull back, a lot of slow traffic in the east bay along 880. on the eastshore freeway, westbound 80 from the carquinez bridge to the maze a 42-minute drive drive. when you get to the bay bridge toll plaza, that's backed up for a 25-minute wait before you make it across to the san francisco side. >> some interesting temps around the area. it's clear inland to the coast. but ocean beach is 72. the embarcadero is 64. don't see that all of the time.

welcome back. 8:54. investigators in fres fro say someone broke into a foster -- fresno say someone broke into a government farms shed and used a golf club to kill over 900 chickens. someone pulled back the fence on september 20th. they went inside and killed all of those chickens. detectives say whoever is responsible is pretty sick. people should be alarmed by this. we don't know a motive for this. foster farms is offering a $5,000 reward for nfg -- for information. governor brown signed new gun legislation into law. it allows family members to petition a judge for a restraining order against the family member they consider dangerous. the judge could decide that take away that person's gun and prevent new gun purchases. the new law goes into effect on january 1st. 8:55. independent engineers are downplaying the safety threat from the highly publicized bolt problem on the new bay bridge. they issued a report saying a

simple coat of paint and grease could help protect those bolts on the new eastern span. there are extensive tests on -- their extensive tests determined they are strong and safe, especially if they get extra protector from corrosion. last year, caltrans found a third of the bolts failed when they were tightened and that raised concern that the new bridge was not safe. starting today in san francisco, there are 32 more places to get free wi-fi. google gave the city $600,000 last year to set up this wi-fi system. the free wireless will be available at 32 open spaces in san francisco. they include parks, civic center plaza, justin herman plaza and union square. ben affleck just reveals he's doing something in his upcoming movie "gone girl" that he's never done before. speaking candidly with mtv, he announced he went completely nude for a scene in the movie.
