"mornings on 2" starts now. 7:00. a terrifying morning or a santa clara couple. a live look at their home on cabrio where about four hours ago a burglar climbed through an open window. shortly after that he came face to face with one of the homeowners. in two minutes tara will tell us what happened next. good morning. welcome to "mornings on 2". i am tori campbell. >> good more. i am dave clark. let's talk about weather and traffic. steve, not so hot? >> it will be warm. it will be warm to hot. the coast looks nice. fog free. it's clear. there is not much of a breeze. yesterday at this time there were many locations 25, 35. that's not the case. we have a heat advisory route.

i think it's marginal to be honest with you. one forecast model is hot. we have to get to 95 to 105 to set records, and that's not going to happen. not what you have napa at 44 degrees. come on. fairfield 51. yesterday that time they were 70. 40s 24 walnut creek. a bunch in marin county. also santa rosa. 49 menlo park. so there is warm air aloft. without a north or northeast wind -- fairfield has turned north. yesterday it was 30 miles per hour. that's not the case. we have a slight offshore. it will be above normal and the coast looks nice. water temps in the 60s. so we're looking for that easterly breeze. there will be a lot of 80s on the coast but i don't think there will be 90s to 95. it will be breezy for a few, but there was a better component of it yesterday. 80s to 90s coast bay and inland. here's sal. a decent start today on this thursday. sure, there is a lot of slow

traffic but we don't have any major crashes right now. we have a couple of fender-benders out there. let's go to the bay bridge toll plaza where -- sorry. they are waiting for me on the east shore. here it is. westbound 80. you can see traffic from the carquinez bridge to the macarthur maze 20 minutes. sometimes it's worse. by 8:00 we might see an increase. now we can go to the toll plaza of the bay bridge. that's a 25-minute drive into san francisco with no major problems on the span. and the problem we had in san francisco on 80 at 1-0 one has been cleared. highway four at bay point is clowe slow as you come over the hill to concord. 680 is slow through walnut creek. 580 is slow through livermore. we are beginning here on "mornings on 2" with developing news from santa clara. police officers arrested a burglary suspect accused of breaking into a house and then stabbing a man. ktvu's tara moriarty is in

santa clara at that home. you have some new information about the victim. good morning, tara. >> reporter: good morning. neighbors are pretty shocked around here. they say that the victim is a man in his 50s and it was his sister who initially confronted the burglar after he snuck in through an open kitchen window. all of this unfolded around 3:00 this morning. the police say the prowler entered through an open window. detectives say a woman confronted the burglar when he slipped through the window. her brother heard the commotion and came running. that's when he was stabbed several times with a knife by the suspect. neighbors say they are just surprised by the violence. >> yeah. i have lived here a long time and it's a quiet neighborhood. things are becoming, ever since the down turn in the economy, there has been more crime around. this is the first time anything like this has occurred that i know of. >> reporter: officers say the suspect is a 24-year-old man.

he was taken into custody. found in some bushes nearby. the victim is expected to survive but has multiple stab wounds. we are not sure why the window was left open. perhaps because of the recent hot weather. we're not sure. but of course we will keep you posted on this developing story. live from santa clara, tara moriarty, ktvu channel 2 news. 7:05. bart riders are facing a parking crunch. a steady increase in ridership is forcing commuters to basically fight for spots at some stations. ktvu's alex savidge is live in present hill to explain the plan to deal with the problem. good morning, alex. >> reporter: good morning to you. bart is planning to use technology to make sure that riders don't waste a lot of time searching for open parking spaces at garages around the bay area. often it can be tough to find spots, open spaces at these garages. you can see the pleasant hill garage is getting wizzier -- busier here this morning.

the plan for bart in the long term is to install more signage that alerts drivers when all a of the daily use spots have been taken up. these signs work in conjunction with sensors in all of the parking spaces. the problem that exists right now is pleasant hill is just one of two stations with a system like this in place. at many of the other bart stations around the bay area it's a free for all during the morning commute hours. drivers spent a lot of time driving through garages searching for an open spot. oftentimes they are forced to find off-site parking. parking at bart stations is only getting tougher these days and that's because average ridership is up significantly compared with last year. more than 400,000 riders use bart every day. the system has just 46,000 parking spaces to offer. many commuters say it's frustrate to go find a spot. one man has found a way around. >> i ride a motorcycle.

it's usually a spot and it's free. >> reporter: according to the "san francisco chronicle" part of the solution to this parking crunch is to install parking garage alert signs like the ones they have here in pleasant hill at four more stations. they expect to have those systems installed within the next year and, at the same time, bart is also considering using text and email alerts to send those out to riders to let them know that a particular garage at a particular station is already full so drivers don't waste their time driving around searching for a spot. we're live this morning in pleasant hill. alex savidge. 7:07. two people pretending to be good samaritans robbed a south bay graduate student. her car broke down monday morning while she rode to work. a couple pulled up and offered her a lift if she paid for gas. when they reached a gas station the victim reached out to pay at the pump but then the couple bolted with her belongings,

including a guitar, an ipad she had borrowed and her book bag. >> it's frustrating because i thought these people were helping me, but instead they robbed me. they stole all my belongings. >> the 22-year-old victim is an opera singer and says she has little money, earning what she can by giving voice lessons while attending santa clara university police have identified the suspect but he is still on the loose. a public memorial for a former san jose police chief who made ground breaking changes in the police department. joe mcnamara died last month at the age of 79 after a long battle with cancer. mcnamara was san jose's police chief from 1976 to 1991. he has been credited with the diversifying and modernizing of the police department that received praise from around the nation. this morning's 10 a.m. memorial service will be at the

california theater in downtown san jose. police in san rafael searching for a gunman captured on camera rob ago gas station. it happened early tuesday morning on the shell station on del pro sidio boulevard. you you can see the suspect in the white jacket and black hat. the employee was outside near one of the gas pumps, but came back inside thinking the customer needed help. well, that's when police say the man pulled out a gun and told the clerk to give him money and lottery tickets. now, that suspect in his late 30s to mid 40s. he is about 5'11" 190 pounds and has a thick mustache. 7:09. there are new concerns about the security of apple's icloud. over the summer hackers had found loopholes in apple's account recovery system and down loaded backup files to leak nude photos of celebrities, including jennifer lawrence and kate

upton. apple unveiled a new security system, but now hackers have already found a way around the new security, which mostly consists of notifying users when someone tries to change a password. and some of those celebrity photos ended up on youtube and blogger, now a hollywood lawyer, is threatening to sue google, which owns youtube, for $100 million. he says the photos have still not been removed despite requests to take them down early last month. time is now 7:10. the giants are heading to washington, d.c. to play the nationals in the next round of baseball's playoffs. that's after the giants beat the pirates 8-0 in last night's wildcard gauge in pittsburg. >> and the curveball is hit high and deep to right field. it is gone! >> shortstop brandon crawford did it. that's a grand slam. in the 4th inning the giants beat the pirates 8-0. pitcher

7:13. the attorney for the family of jahi mcmath returns to court next week to try to have her legally declared alive. she is the oakland teenager who was declared brain-dead ten months ago after suffering complications from tonsil surgery. the family wants a judge to reverse that decision, saying she is showing signs of brain activity. a judge's ruling she is still alive would make the family eligible for state benefits. a bay area restaurant chain has wrapped up a fundraiser to help the families of missing children. it was tied to a tragedy 21 years ago. all day yesterday they raised money for the klaas kids foundation at 19 of the bay area restaurants.

the organization was founded by marc klaas. his daughter polywas murdered in 1993. >> since then we have had megan's law, which is about the registration and community notification of sex offenders. we have had the amber alert, which is an immediate alert system for missing children. >> the klaas kids foundation helps in the search for missing children across the entire country. time is 7:15. the autopsy report on robin williams is being delayed several weeks. the actor and comedian died in august of an apparent suicide at his home in tiburon. the marin county corners office says more testing and analysis is needed. so now the autopsy is due to be released by november 3. happening today, pg&e will hold a simulated emergency

to 30 minutes at the toll plaza before you make it on to the bridge. the livermore valley, one of the slowest communities. today 680 southbound is not that bad. 85, 280 and 101 showing signs of slowing down up to cupertino. here's steve. sunrise and it's clear and it's darn cool for some and it's not too bad forkers . there is not much of a breeze though. i can only find a little bit in the east bay hills and that's it. heat advisory? i don't know. i don't know. well, we'll go with it for now. it's not my call. but i'm just telling you what's out there. it looks marginal to me. there is not going to be police ring hot temperatures. san francisco would have to get to 96 degrees for a record. it will be mild. it will be nice. breezy in the hills yesterday at this time. the breeze was much stronger. low humidity. so the fire danger is up and there is a component of an easterly breeze for some and

ktvu's janine de de la vega is there and she will have more on the project easing congestion. good morning. welcome to mornings on two. i am tori campbell. >> good morning. i am dave clark. let's talk about weather and traffic. i ducked outside. >> oh, yeah? >> steve, it's a nice morning outside. >> there is a big cricket over here. >> well, clear. it is cool outside. there is a lot more 40s here. you know, i tell you, you know and i know if you have been out here long enough you can feel that breeze. you know it's like, man, it's going to be hot today. don't have that feeling. when you get 40s on temps this time of year it's hard pressed to get that hot unless we have a north or east breeze. there is a little component at the coast very nice. 85 in san francisco. they were 82 yesterday. not even close to a record. downtown oakland now again the breeze can pick up, if it does, that will send us into very warm temps. it looks like upper 80s and

90s. danville is 49. 49 menlo park. a lot of 40s in the north bay, marin county, mendocino county. la honda 67. foster city 52. there is very warm air aloft. it will be sunny. it will be nice. this is a pattern where it's up on the coast yet inland temps are like this is no big deal. we had this in july and august and it's not that bad. a lot of mid 80s around the water. here's sal. >> we are looking at a commute where things are slow in the south bay, getting closer northbound 280 through san jose. you will see some slowing. it's slow all over the place. if i show you the map of the south bay you can see 28 0 the red sensors there where i showed you that traffic. 85 is also slow in the area. east bay traffic also pretty slow from 238 mostly all the way down to about stevenson. most of that is under the speed limit or less than the speed limit posted there. southbound 680 is also getting

into the act. westbound 37 just found out about a problem at atherton avenue. the delay is 30 to 35 minutes. time is 7:31. there is relief this morning for san jose commuters who have been dealing with traffic problems near the busy 280/880 interchange. a milestone has been reached in the big construction project, one that started two years ago. ktvu's janine de la vega joining us live now from san jose. tell us about the changes. good morning, janine. >> reporter: good morning. we are here standing on stevens creek boulevard. it is usually very busy because this is a thoroughfare for people on their commute in the morning and in the afternoon. it's also right next to the valley fair shopping mall. when you combine that with all the three way enfrances here at 880, this area gets jammed.

but this morning at 5 a.m. two new reconfigured ramps at the 880/stevens creek interchange opened. drivers now get to use a new off-ramp from 880 to stevens creeknd a new on-ramp from southbound 880 and 280. drivers won't have to deal with narrow lanes any more. the new ramps have been widened and traffic signals have been installed at each of them. the valley transportation authority says it should improve the traffic flow and prevent cars from weaving. tomorrow a new reconfigured off-ramp it stevens creek from 280 to 17 will open in the same area. >> the third of three ramps are opening. this ramp will provide a signalized stop for everyone accessing stevens creek boulevard. >> reporter: all of these changes are part of a larger construction project to revamp this whole why are near stevens creek. construction crews need to build a flyover ramp from 280 to 880

which will separate highway traffic from traffic here on stevens creek. that won't be complete until 2015. reporting live from san jose, janine de la vega, ktvu channel 2 news. firefighters are preparing for another day of high fire danger as a heat wave hits the bay area. the national weather service has issued a heat advisory for the bay area that goes into effect at noon today and could be extended through saturday. tomorrow is expected to be the hottest day of the week. and as steve just said, it will be unusually warm on the coast. that's in the 80s. but it won't be excessively hot. just kind of the regular heat we are used to. 90s. record drought conditions are adding to the fire danger. cal fire has already responded to 5,000 fires this year. that's 1,200 more than an average year. a fire station in the east bay open after being closed for two years. fire station 75 just reopened after receiving a $2.5 million

granted from fema. some firefighters have already had a firsthand look at the high fire danger from the drought while battling the king fire, which has burned 97,000 acres east of sacramento. full containment of that fire is expected by saturday. >> we're very fortunate to be reopening this fire station this time of year because this is probably going to be our highest fire danger. >> the early start to the fire season has taken a toll on many fire district's budgets. cal fire is on track to exceed its budget for the year before reaching the height of the fire season. 7:34. new surveillance video to show you showing a walnut creek theft suspect going on what police say is a shopping spree with a stolen credit card. now, police say the woman seen in front right here purchased more than $1,000 worth of merchandise at target. it's just one of the stores she hit. police say it's a woman we showed you yesterday morning seen on video grabbing a

woman's wallet from her purse at this restaurant in walnut creek, stealing the credit cards and the cash and then she put the wallet back. now, the victim in this case, sandra freethy, is talking about what happened. >> i was just focused on my friend talking. i come here all the time. you know, nice restaurant. nice people around. but you never think that it's going to happen. >> she says she is disappointed with the stores that were victimized saying her credit cards specify the cashier should ask for identification. if you have any information about this suspect call walnut creek police. police in palo alto also searching for a bold thief. now, this thief stole all four tires off a parked car. now, police say the man in this picture took the wheels off the car september 19 at the civic center parking garage. police say there were several guards on duty at the time.

new this morning, 7:35, we are learning no same-sex marriage cases will be on the agenda when the supreme court begins its new term next week. justices have been weighing whether to hear cases on same-sex marriage bans in several states, including utah, oklahoma, virginia, indiana, and wisconsin. the justices will meet again october 10 for a private conference to consider additional new cases. a decision about which cases the court will hear could be announced that day or on october 14. your time now 7:36. hundreds of people expected to line up this morning at st. anthony's dining hall in san francisco, but not for a free meal. volunteers will be passing trays, cups, forks, and other items from the temporary dining room to the new dining room right across the street. fundraising for the $22 million project started three years ago. st. anthony's has served more than 40 million meals to people in need since 1950 and the

first meal in the new dining hall will be served at 10:30 this morning. it is 7:36. well, the giants are moving on in the playoffs after an exciting wildcard win over the pittsburg pirates. the guy leading the chant there, hunter pence. they celebrated with champagne showers in the clubhouse thanks to this grand slam by brandon crawford in the 4th inning. also excellent pitching by bumgarner. the grand slam put the giants giants up 4-0 and they never looked back. so the big win means companies are moving ahead with plans for playoff merchandise. ktvu channel 2 reporter brian flores is live in san francisco where the first playoff t- shirts are being made. not wasting any time, brian? i see you have one on? he looks very fashionable. >> reporter: i am not wasting any time. yeah, they are being printed out

stores and at center plate. >> reporter: how many shirts are you planning on printing out? >> a couple thousand this morning. we anticipate 15 to 20,000. >> reporter: if the giants make it further into the post- season, say the championship series, how many shirts do you print out then? >> we are prepared. we can do 15,000 shirts a day. so it's just a matter of what they call outpour. we will be prepared to work around the clock. >> reporter: how good is this for business? >> it's fantastic. people love it. you know, all your friends like watching us right now on tv and stuff. it's fun. it's more fun than it is profitable, to be honest with you. we really enjoy it. >> reporter: i believe it. appreciate you coming ef . thank you. >> no problem. and these shirts will be printed out this afternoon or going to be out in stores this afternoon. i want to bring up the schedule if you are watching the games. i can't see why not, you wouldn't be watching the game. first two games of the giants series against the nationals are in d.c. it is the best of five series. game one tomorrow with the first pitch just after noon time. game two is at 2:30 saturday

you starting with highway 24 between walnut creek and oakland. it is about a 12-minute drive. nothing too unusual, but nearby you are going to see slow traffic on of 680 out of conquered down to the danville area. highway 4 is also slow. a report of a new stall westbound 80 at highway 4 in western contra costa county. the bay bridge toll plaza you can see traffic is backed up. it's slower than usual and that's because of earlier problems in san francisco that slowed the commute across the bridge. livermore of course slow traffic there. and slow traffic all over san jose. 101, 280, and 85. 8:01. let's go back to the desk. we are continuing to follow the developing story in santa clara where a burglary ended in a stabbing. a short time ago we learned that the suspect is now being investigated for two separate attacks. tara moriarty has been on the scene for three hours talking to police and neighbors.

she joins us now with more on this new information. good morning, tara. obviously, we are having a problem with tara's microphone and we will get more on the situation in santa clara in just a moment. dave. time is 8:07. bart riders this morning and throughout the week, they are facing a parking crunch. a steady rise in ridership is forcing commuters to fight to find a parks spot at some bart stations. ktvu's alex savidge to explain what the problem is and how bart plans to deal with it. >> reporter: there are no plans to build more parking. instead, bart plans to use improved technology to make sure that commuters don't waste their time searching for a parking spot at the various garages around the bay area like this one here behind us at the pleasant hills station which can fill up fast during the morning hours according to people we're talking with this morning. the plan for bart is to eventually install more signs like the ones they have here at

the entrances that alert drivers when all of the daily use spots are gone. those signs work in conjunction with sensors in all of the parking spaces. the problem, though, is this is one of just two stations with a system like this in place. at many other bart stations around the bay area it's a free for all during the morning hours. people don't know if there are available spots in some of the garages. people spend a lot of time driving through, searching for an open space to park in and eventually some people have to go to off-site parking. and parking is getting tougher because average ridership is way up compared with last year. one rider we talked to this morning, early this morning, told us it can be a pain to find a spot and that's why she leaves for her work early. >> the main reason i started early is the parking. that's how i started. >> reporter: you said your work. i want it to come in early? >> that's exactly right because i don't want to be in that zoo. >> reporter: more than 400,000

riders use bart every day. the system, though, has just 46,000 parking spaces to offer. part of the solution to this parking crunch, according to a report by the "san francisco chronicle," the agency planning to install parking garage alert signs at four more stations within the next year. and then at the same time bart is also considering using text or email alerts to let riders know ahead of time when a particular garage is full and it's really not worth looking for a spot there. we are live in pleasant hill. alex savidge, ktvu channel 2 news. we want to go back to our developing news. tara moriarty has been at the scene of an early morning burglary and stabbing in santa clara. she joins us now with new information. tara. >> reporter: yes, we have two separate crime scenes right now. police saying that the suspect is perhaps responsible for another stabbing that happened around the corner from the home that was burglarized. if we pan to the left you can

see on monterey, that street is actually blocked off over there. we understand that the suspect tried to rob someone on the sidewalk. stabbed that person and then targeted this house. now, this all unfolded around 3:00 this morning. police say the prowler entered the home on the 3100 block of cabrio through an open kitchen window. a woman confronted the burglar. when her brother herd the commotion he came running. he was stabbed several times with a knife by the suspect. >> this is unusual. typically, we get vehicles broken into and on occasion again we get homes that get broken into for miscellaneous merchandise. but for someone to be confronted and stabbed multiple times, that is very unusual and rare. >> reporter: officers say the suspect is a 24-year-old man. he was found in some nearby bushes. he was taken into custody and police say that he is on probation for some prior offenses. both of the victims in in case are expected to survive, but we

samaritans drove off taking her belongings including a guitar, a bar owed ipad and her book bag. >> it's frustrating because i thought these people were helping me and instead they robbed me. they stole all my belongings. >> the 22-year-old victim is an opera singer but says she has little money, earning what she can by giving voice lessons to a small group of students while she goes to santa clara university. police say they have identified a suspect, but he is still out there on the loose. happening today, a public memorial for a former san jose police chief who brought ground-breaking changes to the department. former chief joseph mcnamara died at the age of 79 last month after a long battle with cancer. mcnamara served as san jose's police chief from 1976 to 1991. he has been credited with diversifying and modernizing the police department that brought praise from the entire country.

this morning's memorial service is at 10:00 at the california theater in downtown san jose. the autopsy report on robin williams is being delayed several weeks. the actor and comedian died in august of an apparent suicide at his home in tiburon. now, the autopsy report was scheduled to be release bid last tuesday. the marin county coroner's office says they need more testing and analysis. newspaper the report is scheduled to be released -- now the report is scheduled to released by photograph 3. the lawyer for the family of jahi mcmath goes back to court next week trying to have her legally declared alive. jahi is the oakland teenager declared brain-dead ten months ago after suffering comp kagues from tonsil surgery. the family's lawyer wants a judge to reverse that decision saying jahi is still showing signs of brain activity. a judge's ruling that she is still alive would make jahi's family eligible for state benefits. there are new concerns about the security of apple's

icloud. you may remember this summer hackers had found loopholes in apple's account recovery system and downloaded backup files to leak nude photos of celebrities, including jennifer lawrence and kate upton. so apple unveiled a new security system designed to protect users from hackers who gain access to accounts. but hackers have already found a way around the new security which mostly consists of notifying users when someone tries to change an account password or download icloud backup. some of those celebrity photos ended up on youtube and blogger. now a hollywood lawyer is threatening to sue google, which owns youtube, for $100 million. the lawyer who represents about a dozen women says the photos have still not been removed despite requests to take them down early last month. all right, tori. time is 8:09. the giants are heading to washington, d.c. they are going to play the nationals in the next round of baseball's playoffs.

in yesterday's protests over the plan to build a supermarket and other stores on the land known as the gill track. the protesters want that site turned into a community farm. now, the free speech movement was sparked on october 1, 1964. that's when thousands of students protested on a campus ban. huge demonstrations followed before the university granted students the right to free speech. >> and it's not just complaining. it's organizing and it's really working together to envision what free your speech can mean. it's speech for freedom. >> events marking the anniversary of the free speech movement will be held all month, including panels, movie screenings, and performances. hundreds of people are expected to line up at st. anthony's dining hall in san francisco this morning, but not for a free meal. volunteers will pass trays and

janine de la vega is out there live. coming up in about two minutes she will tell you more about the project aimed at easing congestion. good mornings. welcome to "mornings on 2". thursday, october 2. i am dave clark. let's talk about weather and traffic. steve is right over there. >> thank you, dave. we have clear skies. a little chill. had a nice email from judy. she says it's 48 degrees this morning. i believe it. we had a lot of 40s. more bay -- north bay. east bay. heat advisories out. but i think this applies to areas that aren't used to anything over 55 or 56, which will be 85 today. inland temps it's nothing they haven't seen or felt or dealt with before. finally bouncing off some of the morning lows. 64 sfo. a lot of 50s here. a lot more than yesterday. there has been a huge difference. some of the higher elevations are warm. about 70 degrees. i can't find really a strong offshore breeze. there is a component of it. 60s for some. it will be warm.

it will be hot for some. it will be above average on the temps. you can see slight easterly breeze but generally less than 5 miles per hour. lots of sunshine today. the coast is the place to be as we'll have a very warm ocean temps. there is no fog and that easterly breeze looks like it translate into lots of 80s. warm it hot. it will be breezy for some but nothing compared to what we saw yesterday. so 80s or soft 90s. mid 80s for some near the water. here's sal. >> we are looking at traffic that is going to be busy on 80 westbound as you drive into the berkeley area out of the carquinez bridge. 23 minutes to the macarthur maze. it usually takes less than half that time when there is no slow traffic. there is plenty of it this morning in western contra costa county and alameda county at the bay bridge toll plaza. that is backed up for a 25 to 30-minute delay. we have a lot of slow traffic in the area. we also have a lot of slow traffic all over san jose.

northbound 101. 85. 87. even 17 is slow coming down from the mountains. just everyone on the road. we haven't had a lot of major crashes. a couple fender-benders. but almost everywhere is slow. back to the desk. there is relief this morning for san jose commuters who have been dealing with traffic problems near the busy 280/880 interchange. a milestone has been reached in a big construction project that started two years ago. ktvu's janine de la vega joining us live from san jose to tell us more about the changes. good morning, janine. >> reporter: good morning. we are here on stevens creek boulevard. it is a major thoroughfare for commuters here. they use it to access 880, 280, and 17. two newly configured ramps to 880 just opened up here this morning. no more narrow lanes. vehicles have a lot more room as they enter the freeway. construction for this project began in 2012 because of all the congestion at the stevens creek corridor. it takes drivers to the valley fair mall and the shops.

it was over 50 years old. the valley transportation authority knew things had to change. drivers will now get to use the newly reconfigured intersection for the off-ramp from southbound 880 and the new on-ramp to southbound 880 and 280. the ramps were widened and realigned. signals are also at the new ramps there on stevens creek boulevard. >> a lot of competing traffic movements in this area. everybody is trying to get onto the freeway at the same time. get off of the freeway. we are looking at the new signals will control most of that. >> the bridge over 880 and stevens creek was widened for pedestrians and cyclists. the vta says the changes should improve safety and traffic flow. drivers will see more improvements tomorrow. the newly reconfigured off- ramps from stevens creek and 217 will open. there will be a signal there as well. this is part of a larger

construction project that will include a flyover ramp from northbound 280 to northbound 880. that, though, won't be complete until 2015. so overall, even though we're seeing these new ramps open, don't are surprised because you are still going to see construction here because of that flyover that's expected next year. reporting live from san jose, janine de la vega. it is 8:35. firefighters are preparing for another day of high fire danger. the national weather service has issued a heat advisory for the bay area. that goes into effect noon today and could be extended through saturday. tomorrow is expected to be the hottest day of the week. steve has been saying it will be unusually warm along the coast, in about the 80s, and the usual warm inlands and in the east bay and silicon valley in the 90s. record drought conditions are adding to the fire danger. cal fire has already responded to 5,000 fires this year.

that's about 1,200 more than an average year. and a fire station in east bay is back open after being closed for two years. fire station 75 in rodeo just reopened after receiving a $2.5 million grant from fema. some firefighters have already had a firsthand look at the high fire danger from the drought while battling the king fire which has burned 97,000 acres east of sacramento. full containment of that fire is expected by saturday. >> we are fortunate to be reopening the fire station this time of year because this is probably going to be the highest fire danger. >> the early start to the fire season has taken a toll on many fire districts' budgets. cal fire is on track to exceed its budget for the year before even reaching the height of fire season. new this morning, we are learning no same-sex marriage cases will be on the agenda when the supreme court begins its new term next week.

justices have been weighing whether to hear cases on same-sex marriage bans in several states, including utah, oklahoma, virginia, indiana, and wisconsin. the justices will meet again october 10 for a private conference to consider adding additional new cases. a decision about which cases the court will hear could be announced that day or on october 14. time is 8:37. we are learning more about a santa clara school district trustee who has been ordered to stay away from his son's middle school after being accused of harassing the principal and other staff members. the san jose "mercury news" reports staff members at peterson middle school in sunnyvale want a temporary restraining order against christopher stamp -- lus to be made purplenent. it was issued after the principal accused stampolis of making violent gestures during several confrontations when he was late picking up his son.

the house. >> we are in monterey around the corner. >> reporter: this is what you could hear on the police radio around 3:00 this morning when police say that the prowler entered the home on the 31 00 block of ka breeo avenue. a woman confronted the burglar. when her brother heard the commotion he came running. >> so her brother heard the confrontation. came downstairs. wanted to see what was going on and tried to step in. as he was doing that he was assaulted by the burglar and stabbed multiple times. >> reporter: now, the weapon used as a knife and officers say that maldanado was found in some  nearby bushes. again, he is in custody and police say he is on parole for a prior burglary. as far as the victims go, we know that the one in the home was stabbed several times. but both are expected to survive. we are live in santa clara. tara moriarty, ktvu channel 2 news. >> thank you for that update. 8:48 now. we want to check with sal. see what's happening on the roads. how are things looking at 280,

sal? >> 280 and all of san jose really has a lot of slow traffic still. i want to show you our 280 picture, which is getting out of downtown san jose. it's getting a little better but still definitely slow. it slows to sunnyvale and cupertino area. as a matter of fact, the map is filled with red. when you see red speeds are 25 miles an hour or less. but it's not only the south bay. livermore valley 580 is completely slow from pleasanton. so is 680 to fremont. bay bridge toll plaza a 25 to 30-minute drive time into san francisco. let's go to steve. sal, thank you. very good clear morning. chilly for some. not too bad for others. coastal locations actually some of the warmest. inland terms are a lot of 40s here. more so than yesterday. we kind of lost the breeze. might pick up later. we have a heat advisory out

pacifica beautiful 80 degrees. the city at 85. tomorrow will be maybe a little warmer. i think we top it out then. patchy fog returns saturday. sunday, monday look cool. >> thank you, steve. 8:51. dealing news. public health agencies are now reporting the first confirmed case of the enterovirus in alameda county. we are working to get more information about this local case. 542 people have come down with had respiratory illness. it seems to be affecting children with a history asthma or breathing problems. the enterovirus virus is linked to four deaths, including a 10-year-old girl in rhode island. turning now to another serious health care. we have an update on the man with ebola in dallas. well, thomas eric duncan fights for his life in a hospital. the family he came in contact with has been ordered to stay inside their home or face criminal charges. palm cook is in the newsroom

with the caution caution. >> reporter: texas health officials say it is out of precaution to prevent the potential spread of the deadly ebola virus. stormis duncan's relatives were -- thomas duncan's relatives were told they couldn't have any visitors without approval from the local or state health department at least until october 19. they also have to be available to provide blood samples and other testing that doctors deem necessary. duncan has been upgraded to serious condition. he remains in isolation at the hospital. he was visiting his girlfriend when he came down with the symptoms. she has five children at four different schools in the dallas area and classmates and their parents are very concerned about possible exposure to this deadly virus. >> i got scared because i thought that kid came to this school and probably had contact

with him. i know it doesn't get contacted by the air, but you never know. >> reporter: now, the children were in school on monday and tuesday after duncan was taken to the hospital with symptoms. the schools are being cleaned and sanitized and will remain open. the ebola virus has a incubation period of 21 days. it could take before we know if anyone else in dallas has contracted the virus. another male patient is in isolation at a hospital in honolulu. doctors warn it's too early to tell you about they are following federal guidelines for people who have traveled to west africa in the past three weeks and have experienced certain symptoms such as fever and headaches. now, starting in the next ten minutes or so a major global health symposium will tackle detection and treatment of the ebola epidemic, which is said to be the worst we've seen since the height of aids. we will have more on this
