coast. we are losing the offshore breeze. 30s and 40s and 50s. low 60s. the today though pretty big difference. >> we are looking at a commute where traffic is going to be busy right now if you are driving on the freeway. let's take a look at the livermore valley. this is the slowest traffic in the bay area right now. and it's not a surprise that all of this traffic that i'm outlining here is stop and go. now we are seeing a little bit of slow traffic here also in the dublin area. let's go to a live picture. i want to show you the bay bridge toll plaza is also slow.

it's filled up rather quickly. that happened. that escalated quickly. the traffic continues to be a little bit slow. and on the east shore freeway getting there, it's about a 19 minute drive. it's 6:01 let's go back to the desk. topping our news this morning a shooting inside a san leandro walmart sent customers running for safety. it happened at the store on davis street just before midnight. ktvu san mateo is live at the store with more on what witnesses are saying. tara. >> reporter: witnesses say it was a man that was accused of shoplifting that fired the shots. this after security tried to detain him. all of this happened shortly before midnight. from what we can see there is two suspects. one taken away by ambulance in if a neck brace. it appears no one was shot. this shooting did unfold around 11:50. security stopped two people at the front of the store on suspicion of shoplifting.

a scuffle broke out. >> i just heard gunshots. maybe three at a time. there was more gunshots going off more people started heading toward the back. and then we were safe. >> we have not heard back from san leandro police but witnesses say the guard was unarmed and it was a suspect that fired the gun. we don't know how many guards were involved in the struggle. typically walmart has a male and female guard stationed here at the front of the store. police took the other suspect into custody. about an hour ago police zeroed in on a car that may have belonged to one of the suspects. it was driven away by a woman. we will keep you posted on this developing story. tara moriarty ktvu channel 2 news. time is 6:03. we are learning more about the investigation of an assault at levi stadium just before a

49ers game. janine de la vega is joining us now to tell us what the 49ers are saying about this attack. >> reporter: we have been told over and over that security is a top priority here at levi stadium. now the two suspects in the attack they have been arrested for felony assault. this incident took place just before kick off yesterday between the 49ers and the kansas city chiefs. police tell us two men were in the bathroom at the 300 level on north side of the stadium when they were attacked by two other men. the victim was taken to the hospital for treatment. they were arrested minutes after the assault took place and booked into the county jail. police are investigating what prompted the attack and if the men knew each other or if they were fans of opposing teams. a 49ers spokesman tells us they were aware of the attack and supporting the police investigation. we reached out to authorities to get an update on the victim's condition and the investigation and as soon as we get that, we will bring that to

providing special service for today's game. the boat leaves oakland at 12:50. you're advised to buy tickets online because service is expected to sell out on the ferry. oakland police investigating another homicide out of a downtown nightclub. it happened early yesterday morning at 14th and franklin streets. it stemmed from a fight inside the vinyl nightclub. three people were shot. one person died at the hospital. yesterday's shooting is a couple blocks away from another deadly shooting. 27-year-old connie shoals iii was killed in a fight outside the bella ultra lounge. no arrest has been made in either shooting. a 20-year-old hayward man was arrested after he stabbed his mother to death.

neighbors say joseph was home for the weekend and family members came to them for help. >> he said -- she said he kill her he kill her. the came walking and stood up in front of us while the neighbor was calling the police. i ask him why? >> badiali is being charged in court tomorrow. when you are in san francisco, have you noticed it's hard to find a gas station. the tight housing market might be part of the reason. housing projects are replacing 23 gas stations including five gas stations on upper market street and four of them on valencia street. by the year 2017, there may be 40% fewer gas stations in san francisco compared to a decade earlier. some san francisco supervisors

the man accused of a deadly beating inside of a south as far as gym is scheduled to face a judge. police say 46-year-old kenneth asaco used a steel gym bar to hit diego on the head last month. he died the next day. time is 6:11. a new report out finds that islamic state fighters are using ammunition from the u.s. and other countries originally

given to security forces fighting against isis. according to the new york times, ammunition transferred into syria and iraq often ends up in in the hands of isis. the head of the cdc will brief president obama. it's receiving about 800 calls and e-mails every day about the deadly virus. duncan is in critical condition at a dallas hospital. the people who live at the apartment where he was staying were put under quarantine and authorities have also located a homeless man they were looking for who may have had contact with duncan. an american photo

journalist that is diagnosissed with the ebola virus in lee beer yeah arrived back -- liberia arrived back in the u.s.. he will under go treatment at a omaha, nebraska hospital. he is also the fifth american to be brought back to the u.s. for treatment. a doctor who was treated for the ebola virus last month is back in the hospital this morning. dr. rick sacra was admitted to a massachusetts hospital over the weekend after experiencing coughing and a fever. doctors do not believe though that this is a reoccurrence of ebola. the ebola crisis could soon effect airport security. health officials are considering doing some kind of screening of people entering the u.s. and several other ways to limit the riskover americans being infected. however top government health officials say they are opposed to putting a ban on travelers from ebola infected countries.

they say it could effect efforts to stop the deadly disease. happening today the supreme court begins its new term. it will take up the issue of same sex marriage. it would be up to the justices to decide whether the constitution protects the right to same sex marriage in all 50 states. currently it's legal in 19 states, banned in 31. other closely watched issues for the court this term includes cases involving abortion rights, affirmative action and religious and housing discrimination. two local fishermen were in the right place at the right time to help rescue six kayakers.

>> the shark knocked this guy out of the water. it came out of the water and it punched about six or eight holes in the kayak. the kayak was sinking. >> one of those rescued kayakers said that shark was about 18 feet long. we can tell you everyone was shaken up but no one was hurt. olympic gold medalist michael phelps announced he is putting his swimming career on hold and entering a training program. he was arrested for a second time. he has a total of 22. >> time is 6:15. let's check with sal and make sure everybody is behaving at the toll plaza. how does it look? >> it is crowded dave and pam.

chicago 47. 43 bismarck. omaha at 50 degrees. toronto and the great lakes, st. louis, to dallas. everything comes up and over the ridge of high pressure. it's weakening a little bit. starting to back off slightly. some of that is very thick. a little cooler coast and bay. it started yesterday for some. it's not a full swing cooling pattern yet. the trend is to cool it down. still 90s inland. fog, sun, warm for some. cooler for others. we are getting into a southern pattern. 90s for some. 60s and 70s and 80s for others. over all the temperatures are beginning to edge downward here. looks pretty good. not 90 degrees or 82 like it was on sunday. but still game time temp at 74.

it looks like we bottom out thursday. there are hints of another warmup on the weekend. demand for a's iphone 6 is about to get bigger. the chinese news site says that apple has already received 4 million reservations for iphone 6 models. and there are reports that tesla will unvail the model 3 this week. that is the mass market electric car. several analysts expect it to come on thursday. there are also reports that tesla will add several high- tech features to the sedan that could include one that helps drivers to keep their cars in their own lanes. honda recently announced a similar feature on crv. there is a new reminder of the bryan stow beating. coming up in 20 minutes fan

from charleston, south carolina but it was bumped by a flight from jordan. no one on board either flight was hurt. the uss america will be commissioned saturday during fleet week. they just finished its maiden voyage touring south america. the home port will be san diego. fleet week starts on thursday and continues through october 13th. the drought is having an impact on this year's giant pumpkin festival. organizers of the oak grove festival says there was a

dramatic drop. usually about 100 pumpkins are submitted. this year there was only 35. because of the drought they can't afford to water the pumpkins as often as they have in the past. >> we used compost on top of our soil to hold the moisture in. >> it is sad because it is their love and their passion. >> still despite the drop in average size, this years winning pumpkin did manage to break a festival record weighing in 1,928 pounds. last years winning pumpkin weighed 1,998 pounds at the half-moon bay pumpkin festival. after the first of the year there will be more state

[ laughter ] the lows being very cool and the days being very high. by the way i saw that gone girl this weekend. it's pretty creepy weird. yeah. 74 at game time. yesterday was 82. day before 91. temp has been coming down in

the city. 74 degrees. low clouds are there. they just need something to get them going push them along. that probably won't happen until tuesday fight or wednesday. some fog is raring to go. that will give the coast another cool down. there are very low readings here. higher elevations still too much warm air aloft. fog, sun, warm. still warm to hot. 90s for some. 60s and 70s and 80s by the water. >> right now traffic is moving along relatively well in some areas. and it's getting a lot more crowded in others as we begin with interstate 880. bay bridge toll plaza has

filled up. it's backed up to the mccarthur maze. and if you are driving on highway 4, a lot of slow traffic on highway 4 through antioch and bay point. the time 6:29. frightening moments for customers after a shooting. it happened inside of a san leandro walnut. ktvu tara moriarty is there at the store on davis street with more on what happened. what unfolded out there. good morning tara. >> reporter: good morning. it happened just a couple minutes before the store was supposed to close. there were only a handful of customers inside fortunately. they heard shots ring out. that is when they started scurrying. this happened shortly before midnight. there was two suspects. one taken away by ambulance if a neck brace. unfolding just before midnight.

>> i was in the back shopping being helped by one of the workers. and then we heard the gunshots and heard people screaming. we started heading to the back. and we ended up in the back room. >> we hope to get an update soon. witnesses say that the guard was not armed and that it was the suspect who fired the gun. we don't know how many were involved in the struggle. typically walmart has one male, one female stationed here at the store. luckily no one was hurt. police did take the other suspect into custody. live from san leandro i'm tori campbell. ktvu channel 2 news. person a being treated for life threatening yours. one of our viewers sent us this photo of the crash. this happened at 7:30 last

night. witnesses say the person who was hit crossed the street against the light and then ended up on the hood of that car. police say the driver did stop after the crash. >> reporter: walnut creek police have arrested a man in connection with an over night fire. that fire destroyed a storage unit full of wine bottles. brian flores is joining us from walnut creek with more on the damage caused and the man arrested for arson. brian. >> reporter: hi, pam, good morning. we are on the 1200 block of royal way here at walnut creek. as i look toward my left, your right this is the damage left after a fire. believed to have been started by an arsonist. a known transient. arthur holden. walnut creek police say he is a known transient and was seen on

surveillance camera footage from a nearby business at the time of the fire near the scene. police say also was found is a gas can and apparently a card board box was used to cover another surveillance camera from another business. holden was arrested about a block from here. fire crews from contra costa fire department battled the fire. it appears they were able to knock it down to that storage facility which was full of wine bottles. this is a small strip mall. if you are familiar with the area. as for holden, he is currently being held at the martinez detention facility. it remains unclear if he had some type of relationship. we are live in walnut creek brian flores ktvu channel 2 news. time is $6:33 -- time is

6:33. the giants are back in san francisco after pulling off an incredible win in washington, d.c.. ktvu alex savidge is live inside the stadium with more on the mind set the team is taking heading into today's game. >> reporter: the giants are feeling good after that win this weekend. they know they have a chance to close things down. of course the team does not want to get overly confident. they are feeling good because they have that post season mojo working for them. saturday night it was a marathon 18 inning game and the giants won it many dramatic fashion. brandon bilk a solo home run. it went over the wall and put the giants on top or helped to put the giants up two games to none.

fun. the fun gets under way at 2:00 this afternoon. live inside at & t park in san francisco alex savidge ktvu channel 2 news. more controversy surrounding the new shorter hours for a popular hiking trail in the south bay. it has been a week since the tighter tour few took effect. the entrance opens later in the morning and closes earlier in the evening. the hours are designed to crack down on heavy traffic in nearby neighborhoods during the hours when most people are asleep. people that want to hike the three mile trail, they don't like the new shorter hours. they say the park district should just build a new larger parking lot. the district is investigating that possibility. hewlett packard is expected oomiak ha big announcement. they are planning to split into two separate companies. one will focus on the pc and

printer business. the other hardware and software. time is 6:36. indications that governor jerry brown is due to back a candidate in the race for mayor of oakland. the campaign of city council member libby shaft tweeted out the governor will make an announcement at her headquarters later this afternoon. there are 15 candidates running for mayor of oakland including incumbent mayor jean quan. one way tickets cost $$0.25 more. day passes are $0.50 higher. time is 6:37.

we are learning new information about a los angeles angels fan that was brutally beaten in the parking lot of angels stadium. los angeles television station is reporting the victim was a police officer and u.s. marine. we are still working to confirm that information but the attack happened friday night after the angels lost game two of the american league division

series. police say the angels fan was walking with his cousin to the parking lot when three men attacked them. the man is now in critical condition. his cousin was not hurt. witnesses say the stadium's parking lot needs better lighting and security. the angels have since been eliminated from the playoffs. the attack at angels stadium is a harsh reminder of the brutal beating of bryan stow back in 2011 in the dodgers stadium parking lot. stow still suffers from brain damage and still has seizures and strokes. the jury recently decided the dodgers are partly responsible for stow's injuries saying the dodgers did not provide adequate security. yesterday there was a violent attack at levi stadium just before the 49ers game. janine de la vega is in santa clara this morning with new video ktvu news just uncovered in the last 30 minutes that could shed light on this assault. >> reporter: the video shows a 4ers fan punching -- 49ers fan

punching out two other 49ers fans in a bathroom. we have blurred out the faces of the victims to protect their identity. but in the video you can see is they are knocked to the ground and one appears to be unconscious. this is the video again that appears to be taken in a bathroom where you see a man wearing a red niners shore with gore's name and number 21 punching out another man in a niners shirt wearing kaepernick's number 7 shirt. that man fell to the ground and a man starts throwing punches and starts beating up another fan. the person that posted the video says the attack was prompted because the man was impatient waiting for an open stall. we are working to confirm all of this with the santa clara police department. what we were told is last night two men were in the bathroom at the 300 level on the north side of the stadium when they were attacked by two other men. the victims were taken to the hospital for treatment but the extent of the injuries is

70s that is putting that footprint of that very warm air on top of that fog. 48 sebastopol. a little cooler the water temps are still way above average. again it has nothing to do with el nino. 33 up in tay moe. 50s and 40s monterey. 59 sacramento. 36 in minneapolis. chicago 47. very cool weather. and then also systems because of a ridge of high pressure teeter totter effect sends everything up and drops down from canada and swings through. that is why it has been so is cool. you can see it right there. up we go. that is a ridge of high pressure. it will weaken here over the next few days. the fog is ready to go. it just needs a little lift. but dense fog here. coast and bay. temperatures inland will still be in the 90s.

welcome back. we do have breaking news from washington, d.c.. the supreme court has rejected appeals from five states seeking to prohibit same sex marriages. they are indiana, utah, oklahoma, virginia, and wisconsin. the order immediately ends

mop interrupted a symphony. protestors broke out in song calling for justice for 18-year- old michael brown. some in the audience applauded the protests along with members of the symphony and members of the flash mob left on their own. a grand jury is hearing evidence to determine whether the officer will face charges. police continue to look for the man that rammed his car prompting a officer to open fie. that happened on east 14th. it all started when an officer tried to pull over a man for reckless driving. he then led the officer on a chase before driving into a cul- de-sac and ramming the officer's car. the officer says he fired shots in self-defense. >> this is a nice area. people do a lot of walking
