dignity act. the law allows terminally ill patients to end their lives with lethal drugs prescribed by a doctor. debora villalon is here with a powerful message that maynard left behind. >> reporter: maynard was a californians, went to cal and irvine but moved to oregon. she became a figure of the death with dignity movement because it was what she wanted for herself. >> if all my dreams came true. i would somehow survive death. >> reporter: maynard talked about her fight with a brain cancer. >> i remember looking at my husband's face at one point and thinking i know this is my husband but i can't say his name. >> reporter: maynard's family describes her as a lifelong adventurer, independent so her

decision not to lake cancer take her but to die -- to let cancer take her but to decide to end her life was no surprise. >> i will die upstairs in the bedroom that i share with my husband. with my mother and husband by my side. pass peacefully with music in the background. >> reporter: so she did saturday night peacefully and in the arms of loved ones according to compassion and choices. the ends of life organization maynard had been working with. she had tentatively picked november 4th and filled her final months with the travel she wanted. seeing alaska, las vegas and the grand canyon with her friends and family. >> you don't know the amount of relief that i don't have to die the way that's been described to me that the brain tumor

would take me. >> reporter: maynard's videos were seen worldwide. she noticed her choice wasn't for everyone but insisted everyone should have the choice. and in the end her advise wasn't on death but living. >> seize the day, what's important to you. what do you care about what matters? pursue that. forget the rest. >> the trip to the grand canyon was with maynard's mom called her last harrah. and on her last days, she suffered her worse seizure. and her family says they will keep fighting for death with dignity laws. over the last 25 years there's been six efforts to pass those laws here. they have all failed the most recent in 2007 and 2008. right now there's a new push to try to get such a law passed in

california. professional and recreational crab fishermen are taking a look at the dangers of the ocean following the deaths of four fishermen in bodega bay. two men from bodega bay and a man from san joaquin county they all drowned. a fifth man survived and is recovering. today a commercial fisherman in san francisco told ktvu that the waves were always treacherous close to shore. >> they probably should have been watching the swell a little closer. >> all it takes is one. >> all it takes is one wave. that's all it takes. and being that close to the beach. then you know you have to contend with the rocks. >> john torren to the best -- torrentino say most professionals don't wear life jackets because they're cumbersome and hard to maneuver with them. no one on board was wearing a

life jacket. today the pilot injured in the rocket galactic crash is awake and recovering. he has not spoken. his co-pilot michael alsbury died. the ntsb is combing the rocket's debris. it could take them a year to determine the cause of the crash. richard branson said his company will learn from the company but will go on to pursue commercial space flight. continuing coverage of a bay area teacher in jail accused of child molestation. tonight our exclusive interview with joseph martin. as he prepares for his case to go to trial again. martin spent nearly two decades teaching in concord until his arrest last year. he testified on the witness at his first trial but this is the only time martin has spoken to a reporter on the record with his side of the story.

>> he also shares his advice to teachers everywhere. ktvu's amber lee with the interview you will see only on 2. mr. martin, can you hear me? >> hi. >> hi. >> reporter: joseph martin has been in jail since his arrest last year. when a former student in his fifth grade class accused him of molestation, others soon came forward. he faces counts against 14 boys. >> reporter: did you ever molest these boys? >> absolutely never, ever ever. >> reporter: martin appeared confident and relaxed. his first trial ended in january. jurors were split on counts. his retrial starts monday. >> my heart was in the right place and there was no sexual intent with any of this. i do believe i will be acquitted when the jury see it is truth. >> reporter: the 46-year-old tells me he's thought for more

than two decades including 18 years at wood side elementary in concord. he said the case against him started with a former student visiting him in the classroom. >> the initial complaint was just a misconstrued affection which i do in front of my whole class. which consists of pats on the shoulder, back of collar bone and hugs that are only given with students if they are comfortable with that, with their permission. >> reporter: earlier this year, we spoke with two boys involved in martin's first trial. their mother told me martin singled out her son, gained her trust and in her words groomed them for molestation. martin was acquitted in the charges be those two brothers. but other students came forward with similar stories. >> it became a group hysteria nightmare and it was because the investigation was not done properly. >> reporter: martin blames his ordeal on a police investigator whom he described as inexperienced and improperly

trained. he told me he only patted disruptive students as a calming attempt. >> i would say i'm devastated about the whole thing they went through. >> reporter: patrick clansey says the prosecutor recently informed him that 73 of the 95 outstanding child molestation counts will be dismissed in court tomorrow. 22 counts remain. >> martin has spent nearly a year and a half behind bars here at the martinez jail. still he says he has confidence in the justice system. he says he's learned from his ordeal. >> if you work with kids, don't touch them at all, period. it's a sad world that we live in to say that. but that's the way you need to be to protect yourself is what i learned. >> would you teach again. >> reporter: when i asked him if he would teach again he says he doesn't know. for now he's looking forward to the day he's reunited with his wife and two young daughters.

in martinez, amber lee, ktvu channel 2 news. new at 10:00, a week of violence in oakland included another homicide just a few hours ago. 54-year-old unidentified man was shot and killed near st. martin catholic school in west oakland just before 5:00 tonight. he was found dead inside an apartment. police haven't released a motive or any suspect information. now another person was killed and three more were wounded in separate shootings over a five hour period last night and into this morning. no word of any arrest in any of those cases. a 32-year-old san jose woman is behind bars after a head on crash. officers say they spotted stephanie almeda inside a honda. when police ordered her to get out she took off in the car.

the chase ended in danville. officers say they found meth, syringes and stolen items in the car. there were no injuries. police have identified a man shot to death last week. demarco jay thomas of stockton was killed tuesday evening outside the sea breeze market on university market. east bay regional park district police are handling this investigation. witnesses said they heard more than a dozen shots and police say they recovered a handgun at the scene. investigators are looking for a white suv or pickup truck seen in surveillance video. it sped away from the area. the end of daylight savings time means more than just setting the clock back. the new mandatory water rules now in effect. a high school athlete with dreams of harvard in his future. tonight in the mission district, remembering those who died took a special meaning. working overtime to secure last minute support in a hotly

oakland celebrated day of the dead today with help from

some aztec dancers. this is the 19th annual dia de los muertos festival. along with altarring honoring the dead there were three stages for live performances, rides and games for children and a lot of latin american food. the celebration is a long held tradition in mexico to help families connect with the spirits of loved ones who have died. on the other side of the bay. san francisco's mission district is packed with hundreds of people celebrating the crowds of blocked streets around garfield square. that's also where katie utehs joins us with more. >> reporter: ken, death can often divide families but in this neighborhood it has united entire communities. you can see there's still people out here on this dia de los muertos. one family it was an opportunity for them to call for justice for one man killed

hand. live in san francisco, katie utehs, ktvu news. bay area voters got a head start on casting their ballots with early voting. the registrar's office opened today at the courthouse in oak land. we talked to some people who say voting on a sunday is a lot less crowded and a lot more convenient than heading to the polls the traditional tuesday. >> i have to work on tuesday. so this is the first time i'm voting in california as an adult. i'm excited to have the option to do early voting. >> reporter: the alameda county registrar's office will hold early voting tomorrow and will be open again between 7:00 a.m. and 8:00 p.m. on election day. with the election almost here now, the candidates in a highly contested race in the south bay are in overdrive. azenith smith caught up with mike honda and challenger

election is expected to have low voter turn outs. in milpitas, azenith smith, ktvu channel 2 news. new details tonight about that hit-and-run crash in southern california that killed three teenagers on halloween night. police say they've made several arrests in the santa ana crash. tonight the families of the 13- year-old twin cities and their 13-year-old friend came to the memorial that's been growing since the crash happened friday night. the arrest happened this morning, but police have not released the names of those arrested yet. they plan to give me details tomorrow during a news conference. authorities were looking for two men who escaped an suv on foot shortly after the crash. police say the girls were in a crosswalk and that the honda sieve was speeding when they were hit. media rights group are raising questions tonight about a no fly zone over ferguson missouri apparently aimed to stop media choppers

from filming protests. but the associated press reports recordings of phone calls obtained under the freedom of information act show both police and federal aviation authorities talking about the true reason was to restrict immediate outlets. the white house has come under criticism for not implementing a travel van on the country's ebola outbreak. >> we have no philosophical objection on a two dealing with visa issues or travel issues if we thought it would keep the american people safe. but we think the better way is to actually increase the traffic into these countries of health professionals and of people who can actually help with the response. >> powers just returned from

liberia. sháe says there is a positive -- she says there is a positive news to report. she says that burials have decreased. an employee who contracted ebola is now being treated in france. the french health ministry says the patient is a foreign citizen but would not disclose his identity. this is the first patient since the french nurse came back for treatment. she has since recovered. the base is prepared to deal with ebola if the need arises. the commander held a team member for service members and base residents.

the last month. the average price of regular is down nearly 40-cents in both oakland and san francisco and it's down more than 40-cents in san jose. bay area prices are a little more expensive than the national average which fell below $3 a gallon for the first time in years. noelle walker went to the pump and has reaction from those filling up. >> reporter: a trip to the gas pump has been less painful than it's been in a while. >> it's going down which is great. >> reporter: the national average is below $3 for the first time in four years. >> the savings are beneficial. i'm down here getting a dollar off per gallon and it works. >> reporter: in san jose we found one of the few places in the bay area selling price below $3 for $2.90 a gallon at this safe way station in novato is price is $3.09 a gallon. >> i come here because the price is good and cheap here.

loss of a man with big labs for the future. zachary bradley was a happy 20-year-old, smart and funny with a bright future ahead. friends and family say the uc berkeley sophomore was aspiring to be a doctor and loved music. >> reporter: bradley was attending a rave on halloween night when his life tragically ended. he fell 20 feet behind a restricted area. >> i'm very sad to hear that. >> it's very, very sad. i know a few of my friends had him in their section. a lot of good things were spoken about him. >> reporter: sarah was at the rave that night too. >> personally what i saw was that the security was actually really, really tight that night. so it's really shocking for all of us. >> reporter: members of bradley's fraternity are

grieving privately with his family. we're told his mother flew in from out of state and preparations are under way to take bradley back to his home state of arizona. >> i'm very sorry. i send my condolences to the family members. >> candyce, definitely a positive influence on the berkeley campus and we're all going to miss him. >> reporter: members of his sorority say they will hold a memorial for bradley. this week thousands are expected to attend funeral services for two northern california sheriff deputies killed in the line of duty. tonight the fundraiser was held to help pay for the memorials. sacramento sheriff deputy danny oliver and placer county sheriff detective michael davis jr. were both killed during a shooting rampage on october 24th. >> they are every day out there putting their lives on the line and it's something that a lot of people don't think about.

>> the service for deputy oliver will be held at 10:00 a.m. tomorrow at the adventure christian church in roseville. services for detective davis will be held at the same church on tuesday at 10:00 a.m. both services are open to the public. lyft is reporting the death of a passenger. a crash happened early yesterday in heavy rain on interstate 80 in citrus heights just outside of sacramento. and the victim was involved in that crash was a 24-year-old man from west sacramento. his father says he was returning home from a halloween party. the company says this is the first time that a lyft passenger has been killed in a crash. runners from around the globe took advantage of the clear weather in the bay area this morning to run a foot race along the san francisco waterfront. the 17th annual u.s. fall half marathon start at 7:00 this morning. the international field included entrance from germany, norway and egypt. one runner told us why today's

race was different from others. >> this race really is a great energy. because people aren't really trying to race. people are just running and having a really good time and just being around other runners. so you get that runners high. the 13.1-mile long route took runners along the city heights and finished up right where it started at aquatic park. on the east coast today tens of thousands of competitors laced up their running shoes for the new york city marathon. kenyans won both the men and women's division. shiphan was the first to cross. mary catani crossed with two hours, three minutes, just two seconds before the next runner. in 2007 just 127 runners ran four laps around central park. 50,000 runners finished the

course today. a crowd attendance showed up today looking to change the name of the washington redskins team. the mayor of minneapolis led the crowd chants the phrase change the name. those who are against the name remember a time when american indians were hunted. >> they were charging 200 bucks to kill a red skin. >> redskins owner schneider says he won't change the team's name which he says honors native americans. a young college student given just a short time to live today received an award for her courage. >> today has been the best day i've ever had. thank you. >> that's 19-year-old freshman basketball player receiving the

pat summit award. she was given only a few weeks to live. the game was moved to accommodate the fans that came out to cheer her on. usually there's only about 100 or so fans but huge crowd for this one. >> she made the first basket of the game fittingly. the crowd on their feet. it is an adorable addition to the sacramento zoo. why this might be a great place to spend christmas time with your family. >> back to work, back to school in the morning. meteorologist mark tamayo has details about a warm up headed our way.

we'll wrap up a beautiful weekend out there at least for today. lots of sunshine, a brisk northwesterly wind in place keeping things in the clear side. a few high clouds beginning to drift into northern california. no rain clouds expected with this. we could have some of this energy dive in from the north over the next few hours with partly a few mostly cloudy observations in the north bay. high storm trackerii with nothing to show you. current numbers are with the clearing skies and also the cool air mass in place. temperatures are cooling out there. and already it's back down to the lower 40s in napa. 42degrees. san francisco 55 and san jose checking in 50 degrees.

here's our live camera looking forward the bay bridge. the headlines for tonight we do have this, fair skies, few high clouds for your monday forecast and the key headline here a bit of a warming trend. look at the projected lows i'm going 35 degrees in napa. mid- to upper 30s in parts of the north bay. once again we could have patchy dense fog resurface. san francisco 50 degrees and san jose 46. so a few scattered high clouds for tomorrow. but a dry week ahead as high pressure still in full demand of the weather. you get that dense fog that develops. that could be the factor approaching the area especially for tuesday morning. the storm tracker may head to the north of the regional. temperatures heading in on tuesday. the warmest locations could be hovering in the upper 70s close to 80 degrees. just a little cooler for the thursday forecast. here we go with the forecast model tomorrow morning.

just showing you just a few traces of high clouds moving into with the north bay that's just it. partly to mostly sunny skies for the next few hours. and temperatures will be a little warmer than today. we're taking upper 60s to 70s out there. fairfield 71 degrees. these temperatures will be checking in tomorrow afternoon. fremont 69 degrees and san francisco just beautiful 66. half-moon bay 65. here is a look ahead your five day forecast. temperatures heading out tuesday, wednesday, that will be the warmest day of the week. and on tuesday day for election day we're going to warm things up just nicely as well. by 7:00 patchy fog in the morning. then by 3:00 mostly sunny skies temperatures in the upper 60s to mid-70s. as we mentioned wednesday the warmest day of the week. a few cloudy observations for thursday and friday. we're looking in the rain clouds but nothing showing up just yet. i would say it's still pretty early in the rainy season. but i also said that about a

thousand times last year. so hopefully this year will be different. they are just a little over a -week-old and they are absolutely adorable. check out these photos from the sacramento zoo of three new african lion cubs. aren't they cute. they were born to a first time mother at the zoo back on october 24th. the mother and cubs are doing just fine. they are being kept in a private den so the cubs can bond a little more. the cubs will be placed into the zoo exhibit by christmas. and raiders try to win in seattle since 1988. >> we will hear from coach harbaugh. sports wrap is coming up next.
