south valley. please give yourself extra time. 6:02 let's go back to the desk. thank you, sal. just hours ago a burning garage in concord forced a family out of their home. it happened at 3:30 this morning on san carlos avenue near clayton road. this is a photo of the garage engulfed in flames. three people lived in the home but no one was hurt. investigators still searching for the cause of that fire. a concord teacher accused of child molestation is due back in court today for his retrial. joseph martin is talking to the media about his case. tara moriarty is joining us now from the courthouse with his exclusive jailhouse interview and the message martin has for his students. tara. >> reporter: yeah joseph martin says he is devastated by the whole ordeal and devastated for his students. and everything they went through. he says the investigation into his conduct was not done

properly. and that it evolved into a group hysteria nightmare. >> did you ever mom lest any of these students? >> absolutely never at all. >> reporter: the 46-year-old spent nearly two decades teaching in concord. mostly at wood side elementary. that is when a former fifth grade student accused him of molestation. martin says he only patted or hugged potentially disruptive students as a calming technique. >> if you work with kids, don't touch them at all, period. it's a sad world that we live in to say that, but that is the way you need to be to protect yourself is what i learned. even a handshake can be misconstrued. >> reporter: martin initially faced 150 counts involving 14 boys. his attorney says prosecutors told him that 73 of the 95 outstanding counts are expected

to be dismissed today. 22 counts remain today. coming up we asked martin if he would ever teach again. his answer in 45 minutes. sharing nude photos taken off the cell phones of women he arrested. expected to turn himself in this morning. shawn heir ring ton has been accused of two women removing nude photos from their phones and texting those photos to other officers. reportedly there may be a third o causer -- third accuser. heir ring ton who resigned from the chp on wednesday is scheduled to be arraigned this

afternoon. you have probably noticed already but gas prices are down. the average price of a gallon has dropped 40-cents in san francisco and oakland. janine de la vega is joining us from san jose where gas prices have fallen even more. janine. >> yes, pam, they have. a gallon of regular unleaded here at this gas station will cost you $2.97 if you pay cash. now yesterday it was $2.84 a

gallon. not sure what caused that increase. people are still considering it a bargain. now there is another gas station here on the same street where gas is selling for $2.90 a gallon. many people can't remember the last time gas was this low. the national average is below $3. it's the first time in four years. several reasons behind this a drop in oil prices, drillers are tapping new sources of oil in the u.s., and americans are driving more efficient vehicles. it's created an increased in supply and weaker demand. it is a welcome sight for consumers. >> right now i'm working over at salinas. to commute all the way to salinas this is wonderful. >> we spoke to one person this morning who drives for his job and he tells us the lower gas prices are saving him $150 a month. he travels to san francisco from san jose. some tell us they are spending the extra money they are saving to pay bills.

others are using it to buy lunch. economists say the drop in gas prices will fuel other spending because people feel as though they have gotten a little raise. we expect this gas station to have long lines as the morning goes on because typically it does have normal. but for a list of where we can find those gas stations, somewhere a link on our website at ktvu.com. reporting live from san jose janine de la vega ktvu channel 2 news. >> all right we like to get to that list of the low prices. thank you. we have new details about the possible cause of that deadly crash of virgin galactic spaceship. investigators say the ship's tail booms they are called feathers they deployed early. they are supposed to help the spaceship reenter the atmosphere. the system requires a two-step

process to deploy. the ntsb says it's too early to say whether this was the cause of the crash and that the investigation may take up to a year. we'll be looking at safety culture. we will be looking at the design, the procedure. we have many, many issues to look into. much more extensively before we can determine the cause. >> now that deadly crash happened during a test run on friday. the co-pilot was killed. the pilot was able to parachute to the ground. he is still in the hospital deadly injured. the company has already sold more than $700 tickets for future flights. it costs more than $250,000 each. thousands of people are expected to attend funeral services for two sheriffs

happening today a man accused in the deadly shooting of an oakland mother of four is due in court to enter a plea. carlos was arrested last week near sacramento.

he is suspected of killing pearl as she and her husband drove home from the grocery store. they described that deadly shooting as a road rage incident. but so far police have not given any other details. a uc berkeley community is planning a memorial. 20-year-old zachary bradley was attending a rave on halloween night when he fell about 20 feet from a restricted injure behind the stage. the alameda county coroner's office is investigating the six around bradley's death. >> personally what i saw was that the security was actually really, really tight that night. so it's really shocking for all of us. >> a spokesperson for oracle arena is not commenting saying the investigation is being left up to police. bradley's mother is making arrangements to take his body back to his home state of arizona. passengers on a halloween

cruise in the bahama's say things got too scary when the boat hit something and started taking on water. about 1,000 people were on the bahama's celebration cruise ship friday night when they felt a large jolt. and then the captain told everybody put on a life jacket and prepare to evacuate. that boat was taking on water and leaning to one side. >> the halloween horror cruise and more did we get more than we expected. >> it was the scariest halloween i've ever had. >> because it was real. >> yeah. >> those passengers spent all day yesterday on grand bahama's island. so far there is still no word on what the ship hit or if the passengers are going to be reimbursed. someone in the bay area may be hold orange to a power ball ticket worth $360,000. it was sold saturday night in

it shouldn't surprise you it's about normal. we will start off with northbound 101 in san jose. there is a crash and this crash is now causing delays as you come from the blossom hill road area of san jose and continues up to the south bay area. as a matter of fact, if we look at the south bay here, northbound 101 that is about the biggest problem we have there. if you are driving to livermore eastbound 580 at grant line, there is a crash. westbound 580 traffic is slow all the way to livermore. report of a new crash west 80 at pinole valley road. let's take a look at the toll plaza. as dave mentioned, not too bad. 20-25 minutes get into san francisco. speaking of the city northbound 101 traffic looks good approaching the 80 split. at 6:20 it's time for today's forecast. not too bad right steve? sal, it's a blue monday. >> oh, it is. you and i and everyone else. >> blue monday.

thank you, sal. we do have high clouds around but that has not stopped the napa airport saying a little cold here. we are 39 degrees. high clouds. if it wasn't for the high clouds, i think there would be a lot more 30s or 40s. higher clouds and mostly sunny. the higher clouds, they will start to push east here later in the day. san francisco climatology says you should be 62-66 this time of year. this time of year we will be 62- 66. the ridge of high pressure is right there. it's on its way. before it gets here, a lot of high clouds are spilling over the top. hence we have high clouds and partly cloudy skies to the north. mostly fair to the south. almost all the observations at 6:00 a.m. say partly cloudy so these clouds will be with us in the morning and start to cut in and out a little bit later. 39 napa airport. livermore down to 41. half-moon bay 45. san jose 45.

higher clouds right there. you got an idea the ridge of high pressure. but partly to mostly cloudy here in the morning and then partly sunny to mostly sunny. 39 napa airport there is one. 40s on the coast. if it wasn't for the cloud cover, it would be a lot colder than this. petaluma is 43. calistoga 44. right at 40 for alamo. even 50 for pittsburgh. it's cool farther south. but a partly cloudy day, partly sunny. a chill in the morning air. upper 60s to near 70 for some. it will be warmer. we'll show you how much warmer coming up in 12 minutes or so. steve i have the heater. it was kind of cold. >> it was chilly.

it's still going to be. the morning commute westbound at the bay bridge, i would say it's normal. it has backed up for a 25 minute delay. getting into san francisco there are no major problems. and we've been monitoring bart. bart had early morning problems but it has recovered according to the people the dispatchers i speak to. the train system looks good. interstate 880 is doing very well. it reminds me of when i was taking finals at uc berkeley. it's like why is the weather so good now? this is distracting. it is nice weather. this is a look at 80 westbound as you head out to the pinole valley road area. there is a crash being moved to the side. traffic is slow through hercules. the time 6:31. let's go back to the desk. the woman from a bay area, the woman that sparked a national discussion about death

with dignity she ended her life over the weekend. brittany maynard was diagnosed with stage four brain tumor last spring. alex savidge is in our newsroom with more on how maynard made the decision to die on her own terms. >> reporter: dave, good morning to you. maynard fulfilled her final wish this past weekend surrounded by family and friends at her home in portland, oregon. she took a lethal dose of a medication prescribed by a doctor. >> if all of my dreams came true, i would somehow describe it -- [crying] >> reporter: maynard moved top oregon from california. the 29-year-old was diagnosissed with an inoperatable brain tumor. she decided november 1st was the day she would take her own life. her online videos were seen by millions around the world. maynard's public decision brought many young people into

this conversation. the organization compassion and choice says she has died peacefully on saturday after taking medication that was given to her months ago by a doctor. after her diagnosis maynard spent her final months traveling. she went to alaska and the grand canyon. her family describes her as a lifelong adventure and hopes her death will teach others how to live. >> seize the day. what is important to you. what do you care about? what matters. pursue that, forget the rest. >> reporter: she grew up here in california and attended cal and uc irvine. oregon law allows someone to end their life with doctor prescribed drugs while california law does not. right now there is a push so- called death with dignity law. of course maynard public

decision to die has reignited a national debate. we are live the newsroom alex savidge ktvu channel 2 news. >> what a story. thank you. time is 6:33. meantime four crab fishermen were killed over the weekend off the bodega bay coast. two men from bodega bay a man from san joaquin county and an unidentified woman all drowned. their boat capsized. a fifth man survived. professional fishermen says it is common to not wear life jackets since they can get in the way of fishing. family members say they are starting the process of planning memorial services. also this morning oakland police are investigating the latest homicide in a very violent weekend in the city. it happened late yesterday near a catholic middle school on tenth street in west oakland

not far from interstate 880. a 54-year-old man was shot to death at this point there is no information on suspects or a possible motive but another person was killed. three others wounded in separate shootings during one five hour period late saturday night and early sunday morning. no word of any arrests in any of the shootings. bay area drivers are really getting a pleasant surprise when they go to the gas pump. gasoline prices are down and i mean way down over the past month. the average price of a gallon has dropped $0.40 in san francisco and oakland. janine de la vega is joining us live now. you are in san jose where the prices have dropped even more. >> reporter: yes, they have, dave. in the last ten minutes, this gas station just dropped its prices to $2.85 a gallon. it used to be $2.97. take a look at this.

jump on making the voices heard. brian flores is live in oakland near the county registrar's office to tell us how voters can vote today. >> reporter: high dave, good morning to you. we started yesterday. voters could get an early jump on casting their ballots. we are live here off the courthouse offal listen and oak -- off fallon fall and -- off fallon and oak. but again if you want to get an early jump on your voting, you can cast your vote today. the alameda county registrar's office at the courthouse off fallon and oak. voting analysts say turn out again expected to be pretty low for the state for this midterm general election. some are saying this could be the lowest turn out ever but they do say there is a hotly

contested race voter turn out could be okay. >> i have to work on tuesday and this is the first time i'm voting in california as an adult. so i'm excited to have the option to do early voting. >> reporter: one of the races that could generate a good size turn out is in oakland. they will meet in their final political show down before voters go to their polls. the forum will be held at head royce school. some election analysts are predicting a 43% turn out. if that is the case, it would be the lowest turn out in state history. the lowest was in 2002 when governor gray davis was elected. >> thank you. meantime a hotly contested

south bay congressional race puts honda in front of -- he says running on his record he is touting the bart extension project as one of his major accomplishments. his challenger 38-year-old ro khanna says his expertise is in the economy and bringing manufactures back. >> all we have to do is let people know what we have done. >> folks want to change. i respect his service. >> both of those candidates are spending date in getting out the vote efforts. there are 36 senate seats

about his case. tara moriarty is joining us from the courthouse with this exclusive jailhouse interview. >> reporter: joseph martin has never spoken to the media until now. amber lee sat down with him in jail and asked him the one question everyone wanted to know. >> did you ever molest any of these students? >> absolutely never at all whatsoever. >> reporter: the 46-year-old spent nearly two decades teaching in concord. mostly at wood side elementary school until his arrest last year. that is when a former fifth grade student accused him of molestation. martin says he only patted or hugged potentially disruptive students as a calming technique. >> believe in our justice system and i know my heart was in the right place and there was no sexual intent with any of this. i do believe i will be acquitted when the jury sees the truth. >> reporter: martin initially faced 150 counts involving 14 boys. his attorney says prosecutors

told him 73 of the 95 outstanding counts are expected to be dismissed today. that means 22 counts will remain. his first trial ended in august. the jury acquitted him of charges involving three students. when we asked if he would ever teach again, martin said he did not know. for now he is anxious to reunite with his wife and other two daughters. >> thank you. our time is 6:46. police in southern california expected to give us more details today about the arrest made in a hit and run crash that killed three teenagers that were out trick or treating. it happened friday night in santa ann that. 13-year-old twin sisters and their friend was in a crosswalk when they were hit. the driver took off. yesterday police made several arrests. victims families are pleased about the arrests but says it won't bring back the girls. >> it's not going to bring my

to him. we are going to talk to sal right now. you know what is happening on highway 24 and everything else. >> it's not too bad. right now on 24 westbound there is a little bit of a slow down but it's not all that bad yet any way. nine minutes. pleasant hill road to the caldecott the traffic is flowing pretty smoothly with a couple of slow downs. traffic will be busy as you get to the toll plaza. you are waiting 15 minutes here. it's a total drive time of 25. i want to take a look at contra costa county because southbound 680 will be slow as you drive from right about 242 as you drive into pleasant hill and walnut creek. highway 4 is also slow from about pittsburgh into bay point. today's weather. mostly upper 60s is what i see. >> what is the magic number today? >> 68. >> there you go. a lot of high clouds streaming over.
