propositions from improving the water storage to raising the cap on medical malpractice awards. and there are a number of smaller awards that could have an impact. voters must decide if they are ready for a seen. bay 101 casino in san jose, operators are looking to reallocated. they want to move five miles away for a tax benefit. ktvu's azenith smith is live at the proposed location with the debate surrounding measure e. >> reporter: if voters pass measure e this is where bay 101 casino could end up. a way from schools and businesses. it will bring in much needed revenue to the city. opponents argue it will ruin the city's image and small town feel. >> reporter: it is likely the single most important issue facing milpitas voters. if approved it would allow bay

101 casino to move from its current home in san jose to milpitas. he calls it a no brainer. >> if they move it it brings $8.4 million in annual tax revenue. >> reporter: it is money that would expand public safety and bring 900 jobs. they could expand their tables and their tax rates would lower to 10.5%. >> if we don't take it another city will. >> reporter: one of three former mayors along with police and fire associations who support it. local businessman is strongly against it. >> we are visualing giants signs on 880, 680 say -- visualizing giant signs on 880,

right now they are campaigning. supporters for measure bb are hoping to convince voters to pay the highest county sales tax in california. >> reporter: a time change, bike light give away and a pitch for measure bb. >> we need more protected bike ways. >> reporter: it add as half cent sales tax to 9.5%, 8 billion dollars over 30 years. and funds transportation upgrades. repaves streets and improves bike, and rail service. they claim 30 years of sky high taxes will kill growth. many commuters today think it is worth it. >> it is very congested everywhere. we need more transportation in

general from buses to rails. >> reporter: measure bb needs a 2/3 super majority to pass. two years ago it fell 721 votes short. now changes to bb's language have swung some taxpayer group whose were opposed to it now to support it. john fowler, ktvu channel 2 news. according to our poll tomorrow could set a record and not in a good way. 18million people are registered to vote in california but the poll estimates 8 million people will actually cast ballots tomorrow. that is 46% of registered voters. the lowest turn out in the past century was in 2002. tomorrow we could see the lowest voter turn out ever. and stay with ktvu for continuing election coverage. you can go to our website

www.ktvu.com to find your polling place. in petaluma police are looking for stolen property that isn't easy to hide because it is huge. new at 6:00 p.m. ktvu's ken wayne is at please headquarters with details on the thief who made off with heavy equipment. ken? >> reporter: it is a mini excavator worth $40,000. we want to show you a picture of what it looks like. this is similar equipment. it was parked near to a commercial building and was taken over the weekend. with highway 101 widening work there is a lot of heavy equipment parked around here over night. police have seen a spike in property crimes and stolen construction equipment but in this case they are getting bolder. >> they get clever on how they will take something. how they did this one we are not sure. there is a lot of equipment out

there. we had other thefts. nothing like this in terms of value. >> reporter: police say a flatbed truck was spotted in the area over the weekend and the thief may have loaded it up and drove away. one construction worker told me they suffered thefts but they have gps tracking devices on their equipment. ken wayne, ktvu channel 2 news. now to continuing coverage. slower than expected demolition of the eastern span of the bay bridge is just one of many factors that pushed the project over budget. the most recent projections will be released tomorrow. demolition of the old span has been delayed because of nesting sea birds. also bolt issues and problems with corrosion are expected to cost $30 million.

officials need money for routine main maintenance. bart trains are running after a service -- after service was stopped after a body was found on the tracks. it was discovered on the pittsburg/bay point and pleasant hill stations between the concord and north concord stations. a train operator discovered the body about 9:00 a.m. this morning. >> part of the investigation is going to be what happened. we don't know if a train hit the person or the person was deceased from some other means. >> b.a.r.t. says somebody reported seeing someone on the traction about 4:30 a.m. but it is not know if that is the same person who was found dead this morning. new information about a man charged with killing a mother of four in oakland. documents show he confessed to the crime. he made a court appearance today and told the judge he is trying trying to hire an attorney. he was arrested last week. documents show he lives in

. former california highway patrol officer accused of sharing revealing pictures of women who were under arrest apologized today. sean harrington is accused of forwarding himself photos of women he arrested for dwi 2 himself and others. outside the courtroom his attorney said his client is sorry and also suggested the possibility of a plea deal. >> his apologies extend to the women who were victimized but i want to make it clear, it extends to all of the members of law enforcement whose reputations are potentially tarnished. >> his arraignment was postponed till november 14. other cases that he was involved in are under review now and could potentially be dismissed. we know the name of a man who was shot in san francisco

much more than that. >> i feel really bad. he was more concerned about the pictures. >> reporter: and poof, gone. there were pictures on the phone stolen out of the car. pictures of the baby they tried for six years to have. >> long time. >> long time coming. [ talking at the same time ] >> yeah. >> miracle. >> reporter: now they are hoping for another miracle. hoping to get the pictures back. >> what they took is just -- irreplaceable. >> photos documenting everything from the trip to the hospital to meeting their dotter for the first time. -- daughter for the first time. . >> pictures in the surgery room. i missed all of that. all of those pictures are -- i didn't get to see that. >> reporter: priceless memories now just kept in their mind's eye.

low 80s. upper 70s. the down side is dry. i don't see rain in the five- day forecast. which is not good thing. considering the situation with water. i would like to see rain starting now in the five-day forecast. right through the period. through the winter. that is off to do. there is the fire hose. that is the rain. this pattern is productive but it is not in our area. it is well north. thousands of miles of moisture off the pacific. straight line. going fast. and pacific northwest, as long as it stays like that will get a drenching. we get a few clouds and we get a wind shift that will start up once the high pressure builds in. takes the winds in this direction. right? north, northeast. off shore. can be a big fire danger concern. you know, but i don't see that happening. especially this late in the season and the rain we had.

right now winds are westerly, which is typical for most of the area. that is the deal. it will go off shore into the middle of the week and that is how you get temperatures into the low 80s this time of year. 59 oakland. 56 walnut creek. over night lows will be chilly. in the north bay 39 santa rosa. 37 napa. that is cold. it is going to be cold. this week cool mornings mild to warm days. the jet stream remains up here. high pressure stays in charge and temperatures near 80. that is for lots of us. even around the bay. low 80s as well. nice dry one through the
