30 seconds ago in the 2014 midterm election in california. why it could be a record- breaker when it comes to no- shows. >> reporter: we're live in san jose where the polls just opened covering the rate for the mayor in san jose. we'll tell you who has the lead and what each of the candidates are saying on this election day. plus -- the police investigating a serious bedbug problem. why the city of concord may seek an arrest warrant for a landlord. "mornings on 2" begins right now. good morning. we are live in an east bay neighborhood this morning. jack-o-lanterns out there. people who live there are getting some alarming news. police say a child who went trick or treating in this area came home with a small bag of meth in her candy. ktvu's alex savidge is there. coming up in minutes, he will tell us how the drugs were

discovered and what the police are doing this morning. welcome to "mornings on 2." it's tuesday, november 4th, election day. i'm tori campbell. >> i'm dave clark. let's talk about your weather and traffic. steve's here. you were talking about fog earlier. >> there's some pockets of it. >> i saw some in walnut creek. >> a little bit. north bay, east bay. nothing too extensive. but it does seem to pick up about this time, 7:00 in the morning. sal and i have been touching on that. fog and mostly sunny. a couple of 30s. a few reports coming in. novato, a couple locations in lake county. it will be a day with slightly warmer temperatures and more sun. yesterday had a lot of high clouds coming in in the morning, then it cleared out in the afternoon. still, some low clouds. but overall, it looks good. san jose starting off 46. go for a high of 72. that's 3 better than yesterday. you can see the signature of the ridge of high pressure building in. it's about reno, chico, fort bragg north. 40s on the temperatures or a few 30s. but a lot of 30s.

some 50s. san francisco/sfo. 50 at angwin. 41 petaluma. sebastapol is 42. 44 calistoga and healdsburg. mostly sunny. it will be warmer tomorrow into thursday. i will have more on that, talk about our next rain coming up in ten minutes. but today a lot of 70s. sal, we've had a few reports of fog. any updates? >> the fog is not causing a big traffic jam, steve. but we've had a lot of slow traffic out there caused by -- just by slowing. a lot of people on the road at the same time. look at northbound 280 coming up through downtown san jose. now, we've had a couple of things in san jose on 87 and 680. i don't see anything on 280 except slow traffic. southbound 280 at 101, there was a crash -- sorry, some sort of a hazard, but again, this northbound traffic is just being caused as far as we know by normal morning traffic into the valley. 101 and 785 are slow. i want to mention that

westbound 80 has been pretty slow in hercules, richmond, heading out to the entire area all the way down to berkeley. it gets better in berkeley and oak. if you go over to 608 southbound -- 680 southbound, we've had a couple of minor things there. bay bridge toll plaza, that's backed up for the typical 20, 25-minute delay. 7:04. back to the desk. >> thank you, sal. a warning for parents in hercules after more than candy was found in a child's trick or treat bag. ktvu channel 2 reporter, alex savidge is live in hercules to explain what you should look out for. good morning, alex. >> reporter: good morning. this was an 8-year-old girl who somehow wound up with meth in her candy bag. police say it happened while she was trick or treating here in the promenade neighborhood of hercules on halloween night. it's unclear at this point whether it was passed out

accidentally or intentionally. police say on monday morning, her father was looking through the bag of candy and found a small ziploc bag filled with a white powder. he called up police and testing showed that substance was, in fact, methamphetamine. there was about .10 of a gram. the area where the girl was trick or treating is not that large. it was made up of fewer than ten streets. right now police are trying to pinpoint where the drugs may have come from. officers say this startling discovery really should serve as a reminder to all parents. you should always check your children's halloween candy for anything unusual before they eat it and also if anyone -- police are saying if anyone has information about who may have passed out this small bag of meth hon halloween night -- on halloween night in this area, put a call into police. alex savidge, ktvu channel 2 news. >> thank you. pleasanton police are warning women to be careful

after two gropings were reported last wednesday night. the first one happened near golden road around 7:00 in the evening. a woman said she was walking from downtown and a man followed her, then grabbed her. the second incident occurred an hour later when two men were walking near case avenue near pleasanton middle school. a man grabbed one of the woman, then ran away. police describe the suspect as a light-skinned african- american man who weighs about 240 pounds and is between 5'6" and 5'10" with a shaved or bald head. all right, 7:06. well, the polls just opened up in the 2014 midterm elections here in california. and one of today's most hotly- contested races is for mayor of san jose. the two candidates are up early. they are making a final push to get people out to the polls and vote. janine de la vega joining us live from san jose. you are with one of the

candidates. good morning, janine. >> reporter: good morning, dave. yes, i am. we're in the evergreen neighborhood of san jose. this is where candidate dave cortese will be voting in the next few minutes. now, we spoke with his opponent, sam liccardo in the last hour. both of these men have a long history of public service, but differing opinions on a variety of things. we're joined now by dave cortese, a county supervisor and some of the latest polls show that you have a light lead. how are you feeling coming into this election day? >> well, cautiously optimistic, janine, and -- but we don't take anything for granted. i've learned that you run the races like you are neck-and- neck all of the time. we'll be getting out the vote all day. we have hundreds of volunteers knocking on doors and still phoning people up until 7:59 p.m. to get out the vote. >> reporter: and we spoke with sim liccardo. he was talking about how he has

support from three former players around the current mayor. what is your pitch to some of those voters out there who may still be undecidedded on this election day? >> well, in neighborhoods like this, people are concerned about public safety. in the last five police chiefs for the city of san jose have endorsed our campaign. and in their own words, it's because they believe i'm best equipped with rebuild this this police department, to restore the lost officers. there have been 400 that have left over the last fire years and to bring back neighborhood patrols. so that the property crimes can subside. >> reporter: thank you so much, dave cortese. i want to go to some video that we shot last night of the campaign headquarters of his opponent, sam liccardo. he was busy at campaign headquarters vying for votes. he has the support of several mayors and the majority of the city council members.

liccardo has been viewed as a candidate who will follow the path of chuck reed, someone who champions -- someone who champions fiscal responsibility and planning for growth. liccardo has favored pension reform which has made him unpopular with law enforcement but maintains public safety is a huge priority and plans to spend the day walking the precincts and talking to voters. >> i'm the candidate who has a clear plan for improving safety and a plan for paying for it. i didn't just write this plan in a book, although i did. but i put it into action. last year identifying the $30 million we would need to accelerate hiring the police department. we've put that into action, adding a third police academy, restoring pay to keep officers on board. >> reporter: and cortese will be voting here at his polling place in the next few minutes. there's other media waiting for that to happen. at 8:00 a.m., he will be

voting. they are really encouraging everybody to get out there and vote. this is expected to be a very tight race and an important one. janine de la vega, ktvu channel 2 news. >> all right, janine. a busy day has begun. thank you. in oakland, voters have to choose between 15 candidates for mayor and with so many choices, each candidate has tried to highlight what sets them apart from the crowd. >> we lifted the hiring freeze for new officers. we sped up recruitment and training. we also partnered for the first time with an outside law enforcement agency, alameda county sheriffs to put immediate presence on the streets. >> i stand for raising the minimum rage to $15, reorganizing the police department to make it more fckettive. >> we have to go beyond adding police. we have to invest in education. >> to make things more

complicated, oakland uses rank- choice voting that means people mark their first, second and third choices for mayor. if no candidate gets more than 50% of the vote, the ballots are reprocessed considering the second choices and the third if necessary until someone gets more than 50%. coming up for you in 30 minutes, we'll let you hear from three more candidates. voters in berkeley and san francisco will decide whether to impose taxes on sodas and other sweetened drinks. if it's approved, berkeley's measure d would add a penny per ounce tax on sugary drinks. a majority vote is needed to pass it. the money would go to the city's general fund. in san francisco, measure e would impose a 2 cent per ounce tax. that needs two thirds approval and the money would pay for nutrition and physical education programs. by the way, diet drinks would not be taxed under either proposal. 7:11. two bay area cities will be voting on raising the minimum

wage. in san francisco, proposition j would raise the current minimum wage of 10.74 an hour to $15 an hour, making it the highest in the nation. the increase would be phased in over the next four years. in oakland, measure ff would raise that minimum wage to 12.25 an hour, starting next march. labor activists in both cities say workers would benefit from the pay hike but critics say the increase would hurt small businesses. california voters will be deciding several other big races today. at the top of the ballot, the governor's race between jerry brown and republican challenger neel kashkari. voters will decide six statewide propositions and a full slate of state offices and mike honda is facing a challenge from fellow democrat, ro khanna in the south bay's 17th congressional district. >> a real busy day. >> yes, it is. still ahead -- now we're

d.c. today on this election day. the u.s. senate, which has been controlled by the democrats since 2007, could be taken over by republicans. ktvu's pam cook joins us now in the studio to let us know whether it looks like this will happen. >> today's midterm elections could be shifting the balance of power on capitol hill. a total of 36 states are up for grabs today in the u.s. senate. of those races, democrats are expected to safely win 11. those shown in blue. republicans are expected to pull off 15 victories. those are the ones in red. that leaves ten seats up for grabs. the states shown in green. these are the states political observers are watching closely as republicans seek to recapture the senate majority for the first time since 2006. now, campaign volunteers have been knocking on doors across the country to get out the vote and their efforts. many political observers say whether or not republicans end up taking control of the senate

could be determined by which party has more voters going to the polls. and they say in midterm elections, the party of the president is at a disadvantage. so in this case, the odds are stacked against the democrats. >> every time a white house is in power for six years, that six years always costs the white house seats. >> now, in the house of representatives all 435 seats are up for grabs today. but even democrats predict that they will be unable to take control away from the republicans. now, stay with us here at ktvu channel 2, on air, online and on social media for complete election coverage all throughout the day and evening. we'll bring you live results as the polls close this evening and then the finalups right here on the ktvu channel 2 morning news tomorrow morning. tori? >> all right. thank you, pam. controversy is brewing in la fayette over sex education. a local group is upset about a partnership between a high

school and planned parenthood to teach sex ed courses. some parents are calling it irresponsible and are upset the school district didn't tell them in advance about the lessons and want another group to take over. but the principal said notices were sent to parents ten days before the program started. sal is watching traffic in this same general area and all over the bay area. >> well, we're looking at a lot of slow traffic. steve and i have been talking about the fog. it's appeared. at first, it was kind of hiding from our traffic cameras. but here it is in la fayette as you head over to the caldecott tunnel. westbound 24 about an average time, 14 minutes between pleasant hill road and the tunnel. between walnut creek and oakland, you won't see it terribly slow -- i mean, slower than usual. but you are going to see that fog. when you get to the bay bridge toll plaza, the traffic there is normal as well. it's about a 25-minute drive coming into san francisco. 580 is slow through livermore and into the dublin area.

680 is slow heading south. the nimitz freeway is very heavy, heading south from 238 all the way into fremont. let's go to steve and there it is, steve, the fog. yes. we have some areas, pockets of it. once it lifts it will be mostly sunny, warmer today. even some patchy low clouds. not just fog but even low clouds as well. a little haze off in the distance here. but it will be a mostly sunny around warmer day. a lot of upper 60s to near 70. i have to get on my toes. 72, 72, 73, 72 for san jose, livermore, palo alto and also napa. and tomorrow will be warmer. san francisco, forecast low and high, 54, 70 coming in and the average is 52, 66. so above on both counts. record low 42, 1935. oakland downtown has been running about 6 degrees warmer on the oakland airport. 55 oakland downtown.

62 we'll go for a high of 72 today. ridge of high pressure has nosed in in a big way. higher clouds filter through and when you get the recent rain in november and the long colder nights you get some of that fog and low cloud decks. clouds are lifting out of the picture for us. 37 novato. then went to 43 back to 39 and then 45. it's all over the place. usually a little breeze responsible for that. walnut creek, 44. brentwood has cooled off to 47. holding steady, low 40s, san ramon, alamo, la fayette a little warmer. 25 up in tahoe. 33 reno. 42 ukiah. kelseyville, coyote valley and also clearlake around 37, 39. there have been a couple of 30s. there were a few more yesterday. a quiet week. we have cool to cold mornings.

nearly three years after the costa concordia cruise ship ran aground off the coast of italy, the remains of the final victim have been found. the body was found in a cabin on the eighth deck. after the boat ran aground in 2012, he reported ily gave his life jacket to a passenger as he helped others into lifeboats. 32 people died. the ship's captain is on trial for manslaughter and abandoning ship. he denies the charges. 7:24. well, the ntsb is wrapping up its on scene investigation into the crash of virgin galactic's

experimental space ship. the parts of the ship are being moved out into hangars. investigators want to know what caused the ship to break up mid- flight friday and crash. the copilot was killed. the pilot survived but is badly hurt. richard branson is not giving up on this but he's focused on safety. >> it's been many years that i think can do the job but we won't start to take people until we've finished a whole mass of series of test flights. >> they originally planned to start the flights early next year. they've already sold 700 flight reservations at $250,000 each. 7:25. investigators at los angeles international airport are now looking for answers into a frightening accident.

late yesterday, a fuel truck crashed into an empty jetliner parked at an airport terminal. the accident did not cause a fire or fuel leak but l.a.x. emergency crews had to come to the rescue of the driver who was trapped inside his crumpled truck. he's now being treated for his injuries at the hospital. there's still no word on what caused the crash. calling police over bedbugs. why the city of concord is bringing in the cops because of a creepy problem. >> reporter: the polls are now open and experts say that today will be a historic day in terms of voter turnout, but it's not a good thing. we'll explain -- coming up. good morning. we're still looking at a lot of heavy traffic. some areas are lighter than usual. most of it is like this in the south bay. we'll tell you more about this coming up. a little haze around the edges and fog out there, especially around la fayette. it looks to be in the east bay. we'll show you how much.

7:29. that's the polling place and polls are officially opened. but it is expected to be a quiet day for most polling places across the state. tara moriarty has been out talking to people this morning and coming up in minutes, she will tell us why some folks are telling her they don't plan on

casting a ballot. i like going to polling places. usually very friendly people there. usually they are lonely. let's talk about weather and traffic. i ducked outside. i'm looking at that scene beep hind steve-- behind steve. it was like a purple haze. [laughter] >> very suspicious. >> high clouds. foggy for some, dave and tori, especially out to the east bay. mostly cloudy. some partly cloudies, marin county up to sonoma. we do have a few high clouds. kind of a sun halo almost. ice chris cals from the cirrus clouds. the low clouds will burn off. we'll have a mostly sunny today. a piece of cloud deck zipping through the north bay. mostly sunny, but most of the energy seems to be running to the north. 40s, did have a few 30s especially up in lake county and santa cruz mountains. 40s and 50s, mainly 40s but a few 50s. 40 gilroy. i think they made it to 42.

fremont, 48. morgan hill, 45. overall, everything is lifting north over the next few days. it will take a turn to the north tomorrow. mostly sunny, thick, morning fog. there's not a lot. but there's enough to go around where it could reduce visibility to a half-mile or less for some. 70-degree temperatures for many. tomorrow will be warmer. more on that in 12 minutes. here's sal with an update on the traffic. what's going on? it's pretty slow. this is the heart of the morning commute. we're going to go right to some of the busiest commute areas. first of all, the bay bridge, it goes without saying it's always busy. the slowdown beep gins before the macarthur maze from 580. you have a big backup trying to get to the bridge. when you get on the sunol grade, you will notice traffic is slow. most of this is 608 from 580 to fremont will be below the speed limit. motorcycle crash reported northbound 101 near the expressway and 101 is backed up

all the way down to about blossom hill road. 85 is also slow and 280 is slow from 680 really all the way up into cupertino. back to the desk. >> all right, sal. it's time for you to decide. it's election day. the polls are officially open all over the bay area. but you may not see as many people today at the polls. ktvu's tara moriarty joining us live now. you are in daly city to kind of explain why. good morning, tara. >> good morning. voters walked in here at the strike of 7:00. we're here off lake merced boulevard in daly city. we actually saw a father and his son heading here. it was the son's first time voting ever but mostly the crowd has been older, white and conservative, which is typical of voter turnout. we know that less than half of registered voters are expected to hit the polls today. that would be an all-time low voter turnout. part of the reason is jerry brown's re-election bid which

polls are indicating an easy victory. so he's spent no time or money on getting his campaign message out. that's translated to little motivation to vote. one man we talked to said that money and taxes was the big reason that he showed up today. >> i feel it's important to vote. it's a challenge. you know, people to have read and start to discern. my personal belief, i want to curb some of the government activities and bring it down to a financial responsibility that we all take on ourselves. >> reporter: experts say that what you are seeing -- is this election is spot voting. that's where voters turn out in certain areas of the state where there are tight races. so far, the water issue seems to be the proposition that voters here in san mateo county are most concerned about. live from daly city, tara moriarty, ktvu channel 2 news. >> all right. thank you. 7:33. well, voters in oakland have

perhaps the most complicated ballot today. they have to choose between 15 candidates for mayor, using the rank choice voting system. >> i will move immediately to restore the walking neighborhood beat officers to every beat so that we prevent crime. >> i'm the only candidate who has committed in writing for 900 police officers. and a plan that doesn't involve parcel tax or bonds or anything like that or any new taxes on residents. >> many candidates were out last night shaking hands, greeting evening commuters at b.a.r.t. stations, including jean quan. >> if i'm gonna be blamed for everything that's gone wrong the last ten years, i want all of the credit that's gone right in the last three years. for the first time in almost 20 years, oaklanders are saying the city is going in the right direction. >> now, the rank choice voting system in oakland means people, you mark your first, second and third choices for mayor. if no candidate gets more than

50% of the vote, then the ballots are reprocessed, considering the second choices and third, if necessary, until someone gets more than 50%. coming up in our next hour, we'll have much more coverage of oakland mayor's race, including a list of all 15 candidates. 7:34. governor jerry brown is running for re-election today but he's done very little campaigning for himself. instead, hee focused his efforts on two propositions. proposition 1 would authorize selling bonds to pay for improvements to the state's water quality, supply and infrastructure. governor brown says it's needed to improve california's water system and improve long-term planning for drought years. opponents say prop 1 is too expensive and they argue it does little to relieve the drought and threatens rivers and streams. proposition 2 would boost the rainy day fund requiring

regular debt payments. an earlier measure established a fund but did not require the legislature to set aside money into it. opponents say putting money in the fund will mean less money for schools. stay tuned to ktvu on air, online and on social media for complete election coverage today. we'll bring you live results as the polls close as well as final numbers right here on the ktvu morning news tomorrow morning. 7:36. the city of concord seeking an arrest warrant for a landlord who is accused of ignoring a growing bedbug problem. the city claims the owner of an apartment building on california street refused to exterminate the bedbugs, despite several recent violation notices and even fines. the landlord now faces the possible sentence of six months in county jail, a $1,000 fine or maybe both. so far there's been no response from the property owners. firefighters in pleasanton trying to figure out what

caused several homes under construction to go up in flames. these homes are in the area of valley and bernal avenue near 680. two of the homes were destroyed. two others were badly damaged. this started at about 2:00 this morning. firefighters had a hard time putting it out. >> there was extremely large a of fire. if you look into this, you see it's obviously under construction. the fire hydrants in the construction zone don't have water in them yet. >> now, no one was hurt in today's fire. investigators are gonna stay out there throughout the morning trying to figure out what caused the fire. 7:37. we're now hearing from the only survivor of a boat accident that killed four people who are crab fishing off the coast last weekend. the boat capsized saturday morning after getting hit by a big wave. 66-year-old phillip sanchez was able to swim 25 minutes to shore. he severely cut his arm and injured his back but says he

was determined to stay alive. >> i got pushed off sitting on the ice chest and i got shoved sideways and i just seen bubbles. the guilt, why me? that's the hardest part. >> sanchez says he feels lucky, but he's also coping with the loss of his friends. no one wasser waking life jackets -- no one was wearing life jackets. the coast guard is still investigating. 7:38. san jose investigators want to know what made several employees at the double tree hotel sick. now, hazmat teams responded to the hotel about 7:00 last night. six employees complained of nausea. guests were evacuated. the crews werer that tested the -- there tested the air and have not determined what made them sick. workers were treated at the scene. no one else reported feeling sick. >> we're finding out more information about an outbreak that made several people sick

at a hotel at the sofitel hotel. at first we were told 12 people became sick. now the san mateo county health department is saying at least 40 people have come down with a stomach bug. the cause of the outbreak, that's still a mystery. health inspectors say no violations were found in a check of the food operation which leads them to believe it was a norovirus. it's a mix of a coffee shop and animal adoption center. the country's first permanent cat cafe opened in downtown oakland last week. customers can order drinks and meet cats that are up for adoption. walk-ins for the cat zone are limited and only when space is available but you can reserve a time for a ten-dollar donation. the cafe has been very busy. people have told us they tried to visit the cafe but told they were only accepting people with reservations. new york evened a temporary cat

7:43. new disturbing details about the driver accused of hitting and killing three teenagers who were trick or treating in southern california. police now say the driver had recently bleeded guilty to a separate hit and run where he was accused of driving under the influence. police say the girls were in a marked crosswalk when they were hit. police also say the driver did not try to stop or help. instead, he reportedly ditched the car and took off with his two teenaged sons. 7:43. well, thieves have been targeting san rafael construction sites and building contractors are being warned about thieves stealing tools from unoccupied job sites.

now, it happened at least eight times in recent weeks at homes being renovated. police say the thieves either break in or they come in through unsecured areas of the job site. close to $30,000 worth of drills, saws and other tools have been stolen already >> the money part i'm kind of resolved with. the emotional part, kind of the violation thing is lingering. >> now, at another job site the thieves also raided the homeowners' wedding gifts that were stored there. there's now a san rafael police detective focused only on these crimes. investigators are asking people if you see anything suspicious around construction sites, let them know. 7:44. world series mvp madison bumgarner had one wish at the victory parade but he will have to wait until the next time around. according to the chronicle, the san francisco police department asked if there was anything they could do for them at this year's parade, he said how

is about proposition 1 and 2. there are two democrats running in a nonparfy son election. it's largery become a referendum on the regard decision, around teacher tenure and charter schools. tuck is an executive. he's being backed by the charter school movement. superintendent torluckson is being backed heavily by the teachers association. the superintendent job is actually not hugely significant actually. mostly implements what the state board of education does. it's symbolically significant. i think turlockson has son things as -- done some things. two democrats running against each other. a very key race for the teachers as it relates to tenure in particular. a lot of money going in. a lot of attention being turned to this race as the one competitive one statewide. >> you brought up symbolically this race is important. do you feel like a lot of

voters -- even though the superintendent may not have that much power because most decisions are run by the state board of education. do you feel like the voters want somebody different, somebody to be in charge of education? >> we like to -- the top issue for voters across the spectrum is education. they sort of pick and choose among candidates but education is the priority of voters across the state but this issue -- this race is particular, because of the two candidates, the questions are tenure and charter schools. this is important in terms of the administration of schools but it's very important to the future of the democratic party and i think voters have an opportunity to voice their perspective around teacher tenure, around testing and so forth. >> way tonight move onto proposition 45 and 46 talking about who would have the final

say of healthcare increases and drug testing of doctors. this has a lot to do with money, right? >> a lot to with money. >> it has a lot to do with money. 45 would regulate individual an small group insurance. it would allow the commissioner to regulate rates for insurance providers. that's about 16% of californians get their healthcare from that category of insurers. prop 46 was primarily frankly about whether doctors are reyeared to consult the statewide database about prescription drugs but as the measure unfolded, it also included the sweetening requiring drug testing of doctors and raised the malpractice bat. about $150,000 is being spent on the no side. money can't force a proposition to pass but they can defeat

golden road about 7:00 at night. a woman said she was walking from downtown, a man followed her, then grabbed her. the second incident open cured about an hour later when two women were walking on case avenue near pleasanton middle school. he grabbed one of the women as they walked past, then he ran away. police are describing the suspect as a light-skinned african-american man, weighing about 240 pounds, about 5'6", to 5'10" with a shave or bald head. san francisco could expand the program to stop drivers from blocking intersections. parking control officers are already testing a don't block the box program in several intersections in the city. the city's transportation agency says that cut the number of gridlocked intersections by 82% when drivers saw other people getting tickets. now city leaders are he proking the plan be made permanent starting in december. a warning for parents in

hercules after more than candy was found in a child's trick or treat bag. alex savidge is live in hercules to explain what you should look out for. good morning, alex. >> reporter: good morning to you. this was an 8-year-old girl who found meth mixed into her candy bag. according to police, it was put there while she was trick or treating here in the promenade neighborhood in hercules on halloween night. it's unclear ifs it accidental -- if it was accidental or intentional. her father went through her candy and found a small ziploc baggy full the white powder. he called police. the testing showed it was methamphetamine. it was about .10 of a gram. this area where the girl is trick or treating is not large. it's made up of fewer than ten streets. police are trying to pinpoint exactly where the drugs may have come from. this morning, officers say this startling discovery should serve as a reminder to other parents you should always check

sodas and other sweetened drinks. if approved, berkeley's measure d would add a penny per ounce tax on sugary drinks. a majority vote is needed to pass it. that money would go to the city's general fund. in san francisco, measure e would impose a 2-cent per ounce tax. that needs two-thirds apro profl. the money would pay for nutrition and physical ed programs. water and diet drinks would not be ta -- would not be taxed. in san francisco, proposition j would raise the current minimum wage of 10.74 an hour to $15 an hour, making it the highest in the country. the increase would be phased in over the next four years. in oakland, measure ff would raise that city's minimum wage to 12.25 an hour, starting next march. the labor activists in both cities say the workers would benefit from the pay hike.

it's a race for control of the senate and the power on capitol hill. pam cook is in the studio with more. >> the senate is under the control of the democrats currently by a margin of 55-45. that means the republicans have to pick up six seats to reclaim control of the upper chamber for the first time in nearly ten years. now, a total of 36 states are up for re-election today in the u.s. senate. of those races, democrats are expected to safely win 11. the states shown in blue. the republicans are expected to easily take mon tan non, south dakota and west virginia, where political analysts say the democrats have nominated weak candidates. the gop expected to win a total

of 15 states, those in red. now, that leaves the state's in green. those are the ten seats that could go either way at this point including colorado, alaska, georgia. republicans said to be vulnerable in kansas and kentucky. now, this could be a year when every vote counts. campaign volunteers from both parties have been out knocking on doors manning the phone banks to get out the vote. many political observers say control of the senate could be determined by which party has more voters go to the polls and they say the party in the white house is often at a tis advantage in midterm elections. >> every time a white house is in power for six years, that six years always costs the white house seats. >> now, some analysts say we might actually end up with a 50- 50 split between the democrats and the republicans. a deadlock in that case would go to the democrats because vice president joe biden is

welcome back. a controversy brewing in la fayette over sex education. a local group is upset about a high school and planned parenthood to teach sex ed classes. some parents are upset. they say the school district didn't tell them in advance of it. they want another group to take over the subject. but the principal said notices were sent out ten days before the program started. san francisco is being sued by a law. the law says only people who live in san francisco can offer short-term rentals of their home. but home away says most of its listings are for the second homes of people who don't live in the city year around.

it's cool. it was. any rain stays to the north for now. mostly sunny, slight bump up in the temperatures. afternoon temperatures, 60s and 70s. tomorrow we'll get a bigger jump on the temperatures. here's sal with an update on your traffic. i know it got slow but everything else okay. things are very slow. we do also have some breaking news in san jose. unfortunately, it's a fatal accident that just occurred a few moments ago. san jose police is getting it. this is almaden expressway at hillsdale and police are investigating. they sent out a tweet. we're also checking with him and it is a bad area, the almaden expressway and hillsdale, very busy. as i pull back and look at the rest of the commute, almost every freeway has a lot of slow traffic, 280 and 101 and 85 have been affected. some more than others by earlier collisions. 101 is backed up from blossom hill road all the way up to san

jose. this deadly car crash near hillsdale avenue and almaden expressway is the latest thing for the south bay which is not doing well as all. let's take a look at the commute here at the bay bridge, westbound bay bridge toll plaza is backed you for a 30-minute delay. but getting there on 580 is slow. it's very slow from the 24 interchange. i want to mention that 880 is getting slow passing the coliseum. this is more of a typical backup that happens every day. northbound 880. it gets better right after you pass fruitvale area and then it gets better for the -- by the time you reach downtown oakland. at 8:32. back to the desk. >> thank you. it is election day and you decide. we want to take you back to ktvu's janine de la vega. you are out there covering the mayor's race in san jose and you were able to talk to both candidates this morning. they are making that final push to get the vote out. good morning. >> yes, they sure are. they know that this is going to be a tight race. both are telling me the same

thing that they are being cautiously optimistic. we're here at one of the polling places where one of the candidates actually just cast his ballot. with one candidate voters are using to have the city follow the same course that's been upon the last eight years. the other candidate represents a change in views and policy. let's go to video that we took of candidate dave cortese over at his campaign workweeks last -- headquarters last night. the latest polls show he has the lead. he's supported by the police officers association and firefighters union. that may be key in this case, considering one of the top concerns of people here is public safety. law enforcement views cortese as one who is willing to compromise and may prevent police officers from leaving the department for other agencies that offer better pay and benefits. >> the last five police chiefs for the city of san jose dating

back 20 years have endorsed our campaign. it's because they believe i'm best equipped to rebuild this police department, to restore the lost officers. there have been 400 that have left over the last five years. >> reporter: his opponent, sam liccardo was busy at his home headquarters vying for votes. he has the support of several former san jose mayors and the majority of the councilmembers. he's been viewed as the candidate who will follow chuck reed, someone who champions fiscal responsibility and planning for growth. liccardo has favored pension reform. he maintains that public safety is a huge priority for for him. >> we distributed my book to 25,000 residents. people are getting on board. i think we'll prevail. voters want us to spend smarter. they don'tent us to spend more -- they don't want us to spend

more. >> reporter: both liccardo and cortese have already cast their ballots in their own polls placing. they are gonna spend the day in between their day jobs still campaigning and walking the precincts. they say every vote counts. they know that this is gonna be a very tight race. reporting live from san jose, janine de la vega, ktvu channel 2 news. all right. very interesting. thank you. not everything is going smoothly this morning for the election. ktvu has just learned in the last hour that some polling places across the bay area are experiencing some glitches. tara moriarty joins us live in daly city to explain someone situation there. good morning, tara. >> reporter: we're here at city hall which is also one of the polling places here for folks in daly city. we know that they were having

some issues with the electronic voting booths. that problem was fixed about 15 minutes ago. but we are told it's a county wide problem. we're seeing the same issues at the polling station off lake merced boulevard. people are having to resort to fill in the bubbles by hand. it doesn't seem to be causing too much of a backup. this is a very low voter turnout, this election. part of the reason, governor brown has spent virtually no time or money on his campaign because he is expected to win heavily. that translates to little motivation to vote for most californians. >> i think it's, you know, your responsibility whether you think it makes a difference or not. you have to participate and if your voice isn't heard, what are you doing? >> it's my first time voting. just following the lead that my parents set. like my dad said he thinks it's important for my age.

>> reporter: experts say what you are seeing is spot voting. voters will turn out in sesh certain air -- in certain areas. the closest race is expected to be the one for state superintendent of public instruction, turluckson. 8:37. well, governor jerry brown is running for re-election today but he has not campaigned much for himself. instead he is focused on promoting two state propositions. proposition 1 would authorize the state to sell 7.5 billion in bonds for improving the state's water quality, the supply and the infrastructure. governor brown says prop 1 is needed to improve the water system and also improve long- term planning for drought years. critics say prop 1 is too expensive. they argue this it does little to relieve the drought and it

harrington didn't answer any questions as he rushed out of the courthouse. he allowed his lawyer to do the talking. >> his apologies extend certainly to the women who were victimized by this inappropriate behavior. i want to make this clear, his apoll zwris extend to all of the members of law enforcement whose reputations are potentially tarnished. >> he resigned last week. if convicted, he faces three years in prison. the city of concord is now seeking an arrest warrant for a landlord accused of ignoring a growing bedbug problem. the city claims the owner of an apartment building on california street has refused to exterminate the bedbugs despite several recent violation notices it and fines. the landlord now faces a possible sentence of six months in county jail, a $1,000 fine, or both. so far no response from the property owner.

francisco. thank you for joining us. let's talk about the oakland mayor's race. first of all, let's talk about what rank choice voting is? >> it allows voters to rank order their top three preferences. it effective lynn has a run joch occur in a single election. the way the voters -- votes are tallied, the lowest vote better is eliminated. so in the oakland race there's 15 dits, the 15th vote better gets eliminated and then it goes to the second choices and they will retally the votes. and then the lowest candidate is eliminated. >> when you are a voter in oakland, talk about the importance of ranking those three? >> you need to rank all three. there is a lot of talk about how you might game the system. the best strategy is very simple which is rank isssin veer preferences one, two, three. in races where there are multiple candidates, more than you have choices, oakland, for example, 15 candidates on the

ballot, if you don't list the two, your ballot will be tallied in the election but if it goes down to the final two candidates, if you haven't listed one of the final two, your ballot will be discontinued. for voters it's a little bit complicated. they want to rank their sincere presences, at sat time they want to make sure they are casting the preference of the front-runners. >> rank all three. >> and include those that you think might be in the final two. >> we were talking about how fascinating the oakland mayor's race is. what is so fascinating about it? >> well, obviously, the city is booming. there are a lot of consequences to the boom. conversations about the high cost of living, the growing economic in equality, public safety. there are a lot of issues before the voters in this election. you have 15 sort of from all walks of life. six or seven major serious candidates. jean quan seeking re-election and is being challenged by one

of her closest allies, question rebecca kaplan and she's being challenged by her successor in her district. so a front-runner was her successor. what you have is candidates challenging her from the left, right and right on her base. so it will be interesting to see. there is a lot of talk about her being embattled. at the same time, we know voters will prefer her with her second and 30 choice of candidates, they don't know. it will be interesting. >> you a big fan of this voting? >> it works very well in some, is and less well in others. i'm sort of neutral? i think the systematic effects aren't always harmful as the opponents say and are not always ben fish am as the advocates say. in a race like oakland's 15 candidates, voters don't know enough about the candidates. you limit their choices to

three, i think it introduces problems. >> let's talk about the san jose's mayor's race. we saw janine de la vega moments ago talking about how close it is. what stands out for you in that race? >> this is the race to replace outgoing mayor cluck reed. it's largely about his legacy. you have dave cortese a member of the board of supervisors who is seeking to roll back some of what the mayor has done particularly around pension reform and you've got a city councilmember, liccardo, who has vowed to continue that path. he's been endorsed by the mayor. a lot of money is going in. it's sort of the union verses business. the police and fire are endorsing and spending money on behalf of the outsider candidate. business groups are spending money on sort of the -- seen as the stay the course candidate. a lot of many being sent. a lot of -- money being spent.

i'm gonna put it on the map for you. it's almaden expressway at hillsdale. hillsdale also turns into capitol expressway. they have a pretty big closure in this area. it's a good area to avoid. we had a couple of callers saying this whole area is a mess, especially on the capitol expressway but also on hillsdale avenue because of this fatal collision, deadly collision involving a car and a pedestrian. now, we have -- this is video of a problem on alvarado niles road in union city. these are live pictures of alvarado after there was a pedestrian crash here. again, these are live pictures. you can see that there are -- they are detouring traffic onto one side of the road as they complete their investigation. union city police are investigating a pedestrian accident. the pedestrian is in serious condition at the hospital and this happened right there at almaden boulevard at alvarado niles still causing traffic

problems if you are exiting there. let's take a look at the bay bridge toll plaza. the traffic here is going to be better than it was. still about a 15, 20-minute delay at the toll plaza and another 10, 15 on the actual bridge. if you are driving in san jose, we talked about the crash but i want to talk about 280. 280 is not your friend. we had ankerrer yernt accident on -- an earlier accident at de anza and those roads are taking a beating. let's go to steve in the weather center. thank you, sir. we have a lot of fog this morning. some of that looks to be lifting. some 40s and a few 30s, especially up in the lake county. had a lot of reports of 30s up there. we'll be mostly sunny. even patchy low clouds. all systems go. -- dave, is your private jet about ready to take off? >> yes. >> mine is being washed. >> a few high clouds, mainly in the north bay, but overall, a little hazy sunshine. highs today will be in the 70s. it will be even warmer tomorrow and it looks quiet and dry

san rafael building contractors are being warned about thieves stealing tools at unoccupied job sites. it happened at least eight times in recent times. police say the thieves either break in or come in through

unsecured areas of the job site. close to $30,000 worth. drills, saws and other tools have been stolen so far. >> the money part now, i'm kind of resolved with but the emotional part, you know, kind of the violation thing is lingering. >> at another job site, the thieves also raided a homeowner's wedding gifts that were stored there. there's a san rafael police detective focusing on this. san francisco voters will decide the fate of two ballot measures. proposition k calls for building or fixing up at least 30,000 housing units over the next sick years. a third of those units would be for low or moderate-income families. proposition g would impose a tax on properties that are bought and resold in less than five years. they are trying to deter flippers. those investors to buy a

building and kick out the tenants and quickly resale the buildings at a profit. world series mvp, madison bumgarner, had one wish at this year's victory parade. according to the chronicle, the san francisco police department asked if there was anything they could do for him at this year's parade. he said how about letting me ride one of those horses in the parade? but given the rained at crowd, suhr said it would be too dangerous. they didn't want to risk injuring that golden arm. so they took a photo of him on the horse instead. last night he made an appearance on late night tv. >> it's been an unbelievable ride. hopefully there's more to come. >> what could you do next? maybe cut an album?
