a traffic backup for miles after a deadly crash close as major thoroughfare on the south bay. we're working to find out when the road will reopen. several days after halloween, investigators are confirming one little girl in the east bay received more than candy in her trick or treat bag. >> it looked like rock candy. i said this can't be what i think it is. >> the girl's father is speaking out about the disturbing discovery of meth in his daughter's dag as the girl sends out her own message to other children. it is election day. already several bay area counties are facing some

glitches. good afternoon. i'm tori campbell. major traffic backups after a deadly crash in the south bay. it happened in a very busy area on hillsdale avenue in san jose. that's where we find ktvu's janine de la vega. janine, is the road back open yet? >> reporter: in the last two minutes, tori, they just opened up two lanes of hillsdale avenue. you can see two lanes are still closed. the turn lane coming from almaden expressway on himsdale and you can see there is the toe truck with the car involved in the accident. still sitting on the bed there. now, i just want to give you a sense of where we are. this is right near auto row on capitol expressway, just as it turns into hillsdale. this accident happened at 7:45. a car coming from almaden

expressway, suddenly hit the side railing and overturned. witnesses saw the male driver crawl out of the car badly injured. paramedics rushed to the scene but the man did not survive. no other vehicles were hit. but many witnessed the accident and were shaken up by what they saw. >> another witness showed me where the person was and came over there and started praying for him and praying for him to just keep breathing and we're here and we were there and kept our hands on him and talked to him. >> it's early in the investigation. we're talking to witnesses and trying to determine how fast the vehicle was traveling. we have been told it looked like the vehicle was traveling at a high rate of speed. the vehicle did flip over. we do not foe if alcohol or drugs were a factor but certainly that will be part of the investigation. >> reporter: the accident did tie up traffic on cap expressway causing a big backup. the victim appeared to be

between 20 and 30 years old. his identity is pending until they notify his family. this is the 38th traffic fatality in the city of san jose so far this year. just taking a look at the accident behind me, the tow truck is still there with the car involved in the accident. the two lanes are still closed but traffic is just starting to flow pretty good in the two lanes they opened back up. the rest of the lanes look like they should be opening up momentarily after the crews finish cleaning up the remainder of the debris. janine de la vega, ktvu channel 2 news. a man was killed in union city at alvarado niles road and almaden boulevard after 5:00 a.m. the victim was rushed to the hospital where he was pronounced dead. the driver remained at the scene and cooperated with police. it's still not clear how the accident hanked. >> hanked.

>> -- dash happened. >> this does not appear to have occurred inside the crosswalk. as far as, you know, how it occurred, that's what we're trying to figure out. >> traffic was detoured to one side of the road during the investigation this morning. the alameda county coroner has not yet released the identity of the victim. >> there is new information this noontime about the body found on the b.a.r.t. tracks yesterday in concord. the contra costa county coroner's office office has identified the victim as a 48- year-old in orange county. the coroner says he was struck by a train because he suffered severe trauma. b.a.r.t. officials have not said how or why he got on the tracks between the concord and north concord station. today you decide. it's election day. but here in california election officials expect to see a near record low voter turnout. and out of those who are casting ballots, election officials say fewer people are

actually going to polling places because more voters are casting their ballots by mail. but for those who did head to the polls, there were already a few glitches in several bay area counties. ktvu's sal castanedo joins us live from the newsroom with some of the problems voters experienced early on this election day. good afternoon, sal. >> good afternoon, tori. some voters may have been set back right off the bat as technical failured caused people to do -- failures caused people to do to the old- fashioned website. this morning, the website crashed. a tweet told people the site was down. the problem was traced to a vendor who told county officials it was having servers. they say it will not affect vote counting but people who want to know where to vote have been calling in. in san mateo, county there were issues with the machines there and some had to use paper ballots. that problem has been resolved.

voters we talk to said the act of voting itself requires effort. >> it's a challenge. you know, people have to read and start to discern. my personal belief, i want to kind of curb some of the government activities and bring it down to a financial responsibility that we all take on ourselves. >> contra costa county isn't the own rip site that crashed. shasta and ventura county had problems as did websites in texas and colorado. for the most part, the election is proceeding without any major issues. at least one man who voted wanted to remind others why it's so important. >> whether you think it makes a difference or not, you have to participate. if your voice is not heard, what are you doing? >> we just checked with the website. i just tried to log on. it couldn't. people have been calling there. now, contra costa official says this website failure will not

affect vote counting. we want to reiterate that. it won't affect any of the vote counting or any of the voting but if you want to find out where your polling place is, you can just call contra costa county registrar of voters. live in the newsroom, sal castanedo, ktvu channel 2 news. >> thank you, sal. here is a quick overview of some of the biggest local races throughout the bay area. in oakland, voters have to choose between 15 candidates for mayor and to make things more complicated, oakland uses rank choice voting. that means people mark their first, second, and third choices for mayor. if no candidate gets more than 50% of the vote on the first count, then the ballots are reprocessed, considering the second choices and third until someone gets more than 50%. the mayor al race in san jose is expected to be tight between county supervisor and former city councilman dave cortese and sam liccardo. both have a long history of public service but differing

stances. cortez is supported by the police officers association and firefighters union. it is down to the wire for incumbent congressman mike honda and his challenger ro khanna . the race has been highly contentious. they are both democrats with impressive endorsements and plenty of campaign financing. the gap in the polls has narrowed tremendously putting them both within reach of a win. voters in berkeley and san francisco will decide whether to impose taxes on sodas and other sweetened drinks. if approved measure d would add a penny per ounce tax on sugary drinks. a simple majority is needed to pass. the money would go to the general fund. measure e would impose a 2-cent

per ounce tax. that measure needs two-thirds approval because the main roized would pay for physical and edge case problems. san francisco voters are deciding on the housing crisis measures. proposition k calls for building or fiing up at least -- fies up at least -- fiing up at -- fixing up 30,000 houses. proposition g could focus on properties bought and resold in less than five years. it's intended to deter investors who flip or buy buildings to resell at a profit while evicting tenants in the process. and stay tuned to ktvu on air, online and on social media for complete election coverage today. we'll bring you live results as the polls close this evening as well as final numbers tomorrow morning starting at 4:30 on the ktvu morning news. a young trick or treater in hercules winds up with more than just candy in her

a second memorial for a sheriff's deputy killed in a shooting spree in sacramento. fellow law enforcement officers along with family and friends are mourning the death of michael davis junior. they gathered at the same church in roseville as they did yesterday for danny oliver. both officers were killed during a six-hour rampage on october 24th that took place through placer and sacramento county. controversy is brewing in la fayette over sex education. a local group is upset about a partnership between a high school and planned parenthood to teach sex ed classes. some parents say the school district did not tell them in advance about the lesson and now they want another group to take over. the principal says notices were sent to parents ten days before

the program started. we are hearing from a young trick or treater in hercules who found something strange mixed in with her halloween candy t was a bag of meth. alex savidge has more on the police investigation and the message this girl and her father have for our families. >> reporter: this 8-year-old girl who dressed as a police officer for halloween somehow wound up with illegal drugs in her bag of candy after a night of trick or treating in the prom ma naud neighborhood. her parents found this small bag of meth. >> it looked like rock candy. i'm like this can't be what i think it is. >> reporter: the girl's father called police and testing proved it was, in fact, .10 of crystal meth. passed out to a third grader to offers this explanation. >> because there's a lot of people in the world, and they

can hurt children like that. >> reporter: gibson believes this was done on purpose possibly because his daughter was dressed as an officer. >> i'm like was that a subliminal message sent? >> reporter: police think it was likely an accident. either way, gibson is grateful he checked her candy. >> the worst-case scenario, she got the candy and thought it was rock can dip and put it in her mouth. >> reporter: gibson says his daughter collected candy from at least 20 different houses that night and hercules police say that will make it difficult to figure out exactly where these drugs came from. but investigators are checking this small bag for fingerprints hoping to make an arrest and this young trick or treater is warning other kids to be careful on halloween. >> not to just eat your candy first. after you're done trick or treating go home and check your candy. >> reporter: after his daughter

wound up with more treats, he shade she won't be going door to door next halloween. alex savidge, ktvu channel 2 news. the city of concord is now seeking an arrest warrant for a landlord accused of ignoring a growing bedbug problem. the city claims the owner of an apartment building on california street has refused to exterminate the bedbugs despite several recent violation notices and fines. the landlord face as possible sentence of six months in county jail, $1,000 fine or both. so far there has been no response from the property owner. firefighters in pleasanton are trying to figure out what caused several homes under construction to go up in flames. the fire broke out around 2:00 this morning near valley and bernal avenues. two homes were destroyed. two others were damaged. firefighters say it was a challenge to put the fire out. >> there was extremely large amount of fire. if you look into this, you see

it's obviously under construction. the fire hydrants in the construction zone don't have water in them. >> no one was hurt. now investigators are trying to figure out how the fire started. and a newark family is looking for another place to stay after a fire destroyed their home. it started around 8:00 at the house on margarite drive. the chief says there's extensive damage to the house and it's uninhabitable. no one was hurt in the fire. the cause is under investigation. an investigation is underway in san jose after several employees of the double tree hotel got sick. hazmat crews reese sponded to the hotel at 7:00 last night afrt six employees complained of -- after six employees complained of nausea. bests were evacuate -- guests were evacuated. the workers were treated at the scene. no one else reported feeling ill. in antioch, investigators say a hash-making operation led to a fire at anapartment

complex on sycamore drive. the fire broke out on the balcony of a second floor unit. investigators said it was discovered by accumulation of butane being used to extract hash oil from marijuana. no one was hurt. last week a hash oil lab led to a huge explosion and fire at a complex in walnut creek. two people were seriously injured in that accident. a minor warmup is in store for your afternoon today. giving you a live look outdoors where we have beautiful sky. you can see mid and high level clouds. filtered sunshine. in any case, numbers will be coming up a few degrees over what we had yesterday. for most, it already feels quite nice. take a look at the satellite. you can see the clouds that are moving in coming in from the north. if i back it up, i will show you where the clouds are coming from. the ridge of high pressure continuing to strengthen and build in our direction.

stocks, mixed in afternoon trading on wall street led by a drop in energy stocks. oil slumped to multiyear lows after saudi arabia discounted supplies to the u.s. price of oil below $77 a barrel. that's giving a boost to airlines because the cost of fuel is their single largest

operating cost. the dow is up 24. the nasdaq down 13 and s&p down 5. sears and kmart are the latest retailers to announce thanksgiving shopping hours. this year, kmart is scheduled to open for 42 hours straight beginning at 6:00 a.m. on thanksgiving day. that's one hour longer than last year. sears stores are set to open their doors at 6:00 in the evening. other retailers like costco, barnes & noble, t.j. maxx and sam's club plan to close on thanksgiving so their employees can celebrate with their families. there are two high tech companies interested in moving into the sears company on broadway. the names are not being revealed. both companies plan to put new stores and offices in the old building which could bring up to 2,000 jobs to the downtown area. sears moved to the broadway building in 1996 after more
