as you drive down the peninsula. i also want to mention that in the south bay as we move town down here, 101, 85 and 280 are slow. but they are not as bad as they have been. still very slow on 280 especially. let's go back to the desk. >> thank you, sal. new developments in the story we first brought you at 6:30 this morning about police activity in the berkeley area. we just spoke with berkeley police who tell us they were serving a warrant in the neighborhood of california and har monday street early this morning. it was in connection with a homicide last week in the parking lot of a market near the berkeley marina. several people reported hearing loud noises. one person also reported hearing flash bang grenades. police have not confirmed that. police say they do not have a suspect in custody but were just getting evidence. a security gaurg is recovering after being shot

near a starbucks. alex savidge joining us live now to tell us what the guard did that led to a dangerous gun battle. good morning, alex. >> reporter: and dave, good morning to you. this was a dangerous shootout that played out in the middle of the afternoon right near this starbucks store. innocent bystanders everywhere, as you can imagine. a starbucks security guard -- excuse me, a security guard working near the store got involved in a heated dispute happening near the bus stop. the guard was shot. 911 calls reported gunfire at around 2:00 near the starbucks show and a shopping center on a street near west 18th. police say this all started when the security guard spotted an armed man pointing a gun at two other people near the shopping center. the guard pummed his gun and -- purged his gun and exchanged fire. during the shootout, the security guard was hit once in the arm but mees expected to fully recover. the man who was shot, the man

who shot the guard was found near the scene and taken into custody. one woman who lives close by said this shooting certainly makes her nervous. >> innocent bystanders, people coming home from work, trying to get some coffee. i know it's hard to talk it out. but come on, guns on buses, trying to kill people, it's not cool. it's getting more unsettling by the way. >> reporter: this was the second shooting near the same starbucks store just this week. on sunday, a woman was shot and wounded near the store although she is expected to be okay. police still piecing together the details of yesterday's shooting. it's unclear at this point what the initial dispute was all about that led to this gun battle but again, one person taken into custody and that security officer still recovering. we're live in antioch, alex savidge, ktvu channel 2 news. >> thank you. 7:35. one person is being treated for serious injuries this morning after being hit by a car in san

francisco's north beach district. the crash happened at columbus and green streets just before 9:30 last night. police say the driver stayed at the scene. the victim was rushed to san francisco general hospital. the cause of the crash is still under investigation. a grief-tricken mother in livermore -- grief-stricken mother in livermore hopes someone can identify the truck driver in an accident that claimed her son's life. gina brown and her 20-year-old son cody were returning home last month after visiting sick relatives in las vegas. they were driving on interstate 5 near patterson when a tractor- trailer in the opposite direction broke an axle. a metal wheel rim ended up ricocheting through the canvas roof of brown's convertible. >> bam! i mean, loud. and i sat up thinking, you know, cody was gonna be awake. and i said, what was that? and i look over and -- his face

was gone. >> the truck driver never stopped. the chp has so far been unable to identify the driver. it's possible the truck driver didn't even know what happened. 7:36. south bay congressman mike honda, still has a lead in the hotly-contested congressional race against ro khanna. mike honda is leading 52% to 48% and has a 3900-vote lead. the 17th congressional district covers parts of alameda and santa clara counties. but there are still tens of thousands of mail-in ballots in both counties that still have to be counted. now, honda has not declared victory but his spokesman said it looks like the congressman will be elected to an eighth term. the challenger, would ro channa has not changed because

so many ballots still need to be counted. mail-in bal potts could determine the race between david chu and campos. chu has a 3,000-vote lead. whoever wins will take the place of outgoing assemblyman tom amiano. governor brown is talking about his next four years following his re-election. he says he's proud that he's been able to work with both democrats and republicans in sacramento. >> squabbling in sacramento is not inspiring. so to the extent that i can bring republicans and democrats along, i think that would be -- that will help build public confidence. >> the governor says the rest of the country could learn from california. he congratulated democrats and republicans here for working together to pass propositions 1 and 2. those propositions pave the way for new water storage and saving money for the state's rainy-day fund. if you feel that retailers keep on pressing the holiday

7:44. an east bay man was arrested for killing his girlfriend on a trip to meet her family in austin, texas. prosecutors say 53-year-old joseph karr stashed his girlfriend, kelly turner, early saturday morning. turner flew all over the country as a flight attendant for southwest airlines. but was based out of oakland international airport and lived in alameda. family and friends say they are shocked by the tragedy.

>> trying to piece together, like was there something that i saw in him that i should have noticed more so that this could have been prevented. >> karr worked as an artist and welder for the studio bohemian black smith in emeryville and was known to post pictures of knives and swords on his facebook page. this is video from his website. he's being held on $2 million bail. a cal graduate who has been detained in east asia for two months hopes to meet tomorrow with u.s. state department officials in an effort to get free. 41-year-old stacy addison worked as a veterinarian for ten years. she quit her job to tour the world last year. well, she was arrested in the country of east temor when she shared a cab with a man who went up to pick up illegal drugs. she said she spent her birthday this week inside of a filthy jail. while she's getting support from family and friends, her

mother says this ordeal is a nightmare. parents at an east bay high school are speaking out about a sexered course. some parents at the high school in la fayette supported the program pat a meeting last night. others said an organization with ties to abortion should not be involved with a school -- curriculum. >> if you want to opt out, don't have them attend. but don't try to change it for the other 5,000 students in the district because of your beliefs. >> it's totally unnecessary. they have school nurses that can do the job. >> school officials say planned parent hood has consulted on the program for the past decade. officials say parents can choose to opt out of the course and that only one student has chosen to do so this school year. expect to see more road repair work in san francisco in the coming weeks. crews will be resurfacing

picture of the bay bridge toll plaza. that is backed up pretty big backup there. i also want to mention the traffic is slow on the nimitz freeway which is -- 238 seems to be the starting point. northbound, it's slow southbound from 238 going down to fremont, northbound from 2378 in pockets all the way -- 238 in pockets all the way down in oakland. let's go to steve. we have a couple of reports, observers said there's no fog in daly city. but another observer said it is foggy there. i believe both of them. there are pockets of it. kind of retreats off the coast. there's a little bit in san francisco. yesterday had a pretty good offshore breeze. the coast was up, up. watsonville, 84 degrees. santa cruz, 78. half moon bay was 77. i remember yesterday. i -- they went from about 48 to about 68 between 4:00 a.m. and 9:00 a.m. and that was the sign of that

easterly breeze kicking in. monterey, 76 and officially in san francisco, 75. i think i saw 68 oaks beach and 67 at point reyes lighthouse. pretty mild for this time of year. 57, 72 the forecast high today. those are both above average for this time of year in san francisco. 52, 66 is what they should be. reporting, 45, 1919. the record low in 83 in 1991, the record high. another ho-hum system just falling apart. just a weak little system dragging across a few high clouds. it did increase the low cloud deck. that's why the coast will be cooler today. you can see that below the high cloud deck. the reason i'm showing you the national picture, next week all signs point towards a very cold and dynamic system setting up in the northern plains and great lakes with its impact going almost down to northern florida and will head to the northeast which in turn means if something is going that deep, there must be a high- pressure ridge over us.

president obama wants congress to spend more than $6 billion in emergency money to fight ebola in west africa and here in the u.s. that request includes 4.5 billion for new clinics and also to help develop drugs and vaccines to battle ebola in west africa. money would be used to establish 50 ebola centers in the u.s. and improve the monitoring of passengers at u.s. airports. 1.5billion would be set aside in the contingency fund. house speaker john boehner says he's reviewing the president's request. a bay area biotech company trying to raise money for a new ebola vaccine. researchers at vaxart say they are working on a vaccine that comes in a pill form and it would not have to be refrigerated. >> we have no needles, which really removes an important piece of the puzzle, handling needles, needle injuries. those kind of things.

because there's not much left to it. it did give an increase to the coastal fog. some of it seems to move around. 50s on the temperatures. 60 at sfo. 57 half moon bay. even though they do have a little component of a northwest breeze, yesterday it was mainly offshore. 55 orinda, 50s for many. san ramon, 51. alamo, 49. we're recovering pretty fast. south at sfo, east at hayward, a little northwest at half moon bay. i mean there's not much of a breeze. it's a variable. the system will move out. it will get out of the picture here quick. we'll have mostly sunny skies. i will mention a few high clouds and patchy fog but another nice day with the temperatures in the 70s for many. a little cooler, though, over by the beaches today. sal, i haven't heard too much so far, the usual bunching up. but anything changing? >> we have a couple of trouble spots, we've had traffic that's just a little better than yesterday. it's getting heavy. right now we're looking at 280. for example, 280, not too bad

right now as you drive up to highway 17. yesterday, it was much worse but the traffic is going to be busy. i want to focus on a problem in san francisco in the marina district. this problem with a crash, lombard and van ness. should be causing some slow traffic on both lombard and van ness. fortunately, it's not causing as big of a traffic jam as we thought. but it's a good area for you to avoid on lombard and van ness. also move to the east bay, oakland. a lot of slow traffic on 580 from san leandro and also on 880 heading up north. when you get to the bay bridge toll plaza, it is backed under for about a 30-minute drive into san francisco. it's 8:02. back to the desk. we have new details about two late night shootings in san francisco that injured a toteal of six people. in the first incident, someone opened fire at alabama and 23rd streets at 10:15 last night. four people were wounded, including an innocent bystander. and we just learned police have

arrested three people in connection with that shooting. the other shooting happened at 11:00 p.m. at 15th and atoma street. the investigation forced the closure of southbound 101. that's where you see all of the traffic here. that was between cesar chavez onramp and the 280 split. two people were standing in front of a building when two gunmen approached and started shooting. the victims were taken to the hospital and are reported to be in stable condition. there's also a report that stray bullets went into a nearby home but no one was injured. two suspects have been arrested in this case. 8:03. turning now to tower election coverage -- to our election coverage. simly convalley is the high- tech center of the world. but santa clara had low-tech problems when it comes to posting results from the election. ktvu's jag janine de la vega -- janine de la vega, joining us nows. the county came in last on the

reporting. >> reporter: the registrar told me that the county has not upgraded their system since 2003. they don't have counting machines at the precincts and that would have sped things up. now, the precinct ballots must be driven to the registrar's office, opened, the tabs need to be pulled off and and -- counted and scans. only tiny moma county had a worse reporting. santa clara county didn't finish counting until 4:00 a.m. the registrar says there's a limited number of ballot counting systems on the market that are certified by the state. and they are waiting for better technology to buy some before investing in them. >> with the amount of technology that we have in santa clara county it's a little bit surprising that we

have to hand-deliver everything rather than automation. >> reporter: in san francisco, there were also technical issues that caused delayed results from being posted online. there was a 75-minute gap between the first and second updates on election night. the city's election chief tells the chronicle high traffic from mobile devices caused problems from an offsiter isver and here there are still tens of thousands of absentee ballots that need to be counted which could make a difference in a close race like the one for the san jose mayor. reporting live in san jose, janine de la vega, ktvu channel 2 news. >> thank you. and speaking of that race, city councilman sam liccardo has declared victory in the very close race for mayor in san jose but his opponent, supervisor, dave cortese, refuses to concede due to the large number of mail-in ballots that still need to be counted. and the official outcome of the hard-fought election to lead the largest city might not be

known until this weekend. >> there's always a chance that, you know, those last few thousand ballots could all go in the other direction. i would say it's still a little too early to say for certain but it is looking very likely that our next mayor will be sam liccardo. >> liccardo maintains a slight lead with just over 51% of the vote. cortese has 49%. about one-third of the tens of thousands of mail-in ballots still have to be counted. 8:06. in oakland, libby schaaf said she will make public safety her top priority as oakland's new mayor. number of mail-in bal on thes. they have thousands of ballots that must be counted by hand os. happening today, u.s. officials are talking about raising the tuitions at each college. ktvu's tara moriarty joining us live on the berkeley campus now to tell us how much more students and their parents may expect to pay. good morning, tara. >> reporter: well, good morning. right now in-state due with at uc berkeley is about 11,000 a year. if this hike goes through, it would spike to $12,000 a year starting next year and then in the year 2019 it would go up to $15,000 a year. this morning, university of california president janet napolitano is expected to ask the university's governing board to increase tuition by 5% each year for the next five years. but napolitano says that the tuition hikes may not be necessary if the university receives more state funding than expected. we asked students here for

seismologists are monitoring earthquakes in nevada. a magnitude 4.5 earthquake rocked an area in the sheldon national wildlife refuge, about 40 miles southeast of lakeview, oregon. it hit after 12:30 this this morning. it's been followed by several aftershocks. scientists say the swarm started in mid-july but has

been much more amountive in the past few days. there have been dozens of quakes including a 4.6 quake on tuesday night. experts say the swarm of earthquakes does increase the likelihood that a larger earthquake could hit in the region and is reminder of the importance of being prepared. >> wow, tori. 8:13. well, a woman seen in a shocking surveillance video being kidnapped on a philadelphia street, she's been found alive. carlesha freeland gaither was found last night outside of baltimore maryland. the alleged kidnapper, delvin barnes, he's in jail. now, police tracked him down using license plate information from that surveillance video. miss gaither has minor injuries but otherwise she's okay and her family is happy to hear the good news. >> i knew my daughter was coming home. not a doubt in my mind she wasn't coming home. >> i got the phone call and they said i got your sister. she's okay.

i said mom! >> miss gaither disappeared sunday night. you've seen this video. police say she doesn't know barnes. he's described by investigators as a very dangerous predator who faces charges in another case. back here at home, believe it or not, marin county has made a weather channel list of the worst places in the nation to own a house. the weather channel ranked marin 17th of its list of the riskiest places to own a house. that puts it just below forest county mississippi which was hit hard by hurricane katrina. the weather channel cited marin county's risk of an earthquake, floopedz and wildfires when they put together the risk. four other california counties also made the list. sisky cue, kern, santa barbara. officials say these cameras collect images from five former

lookout towers. they take four pictures every 20 seconds. that system is the first-of-its- kind in northern california. it was paid for by a $200,000 grant by pg&e. it will be used to monitor lightning strikes and also downed pg&e lines. a 890 -- a 90-year-old man and two pastors were arrested in fort lauderdale for feeding the homeless. police say the men violated a new local ordinance which bans the distribution of food to homeless people in public places. arnold be aot said he's been -- an abbottabad said she's been -- arnold abbott said she's been feeding the homeless for years. >> as i served the fourth person, they said put down that plate right away. >> in 1999, abbott sued the city from banning him for feeding homeless people on the beach and won.

now he faces up to 60 days in jail and a $500 fine. i was just reading a little bit. he's a world war ii veteran, civil rights activist. he started several programs, including -- he started a culinary school where they train some of the homeless they serve to get jobs in local kitchens. he's not just feeting them but trying to help them turn around their lives. >> and people all over the internet are talking about it. >> exactly. >> we'll see what happens. 8:17. sal is saying if you are driving in san francisco stay away from van ness and the marina district? >> that's right. because lombard at van ness, there was a serious crash where a woman was hit by a golden gate transit bus. i just got off the phone with police and they told me that. this is an area that's very busy. van ness and lombard is highway 101. a lot of people use that. they've taken the injured person to the hospital. they are still doing an

investigate. just got an accident in marin county on panoramic county in stinson beach. it's a motorcycle accident. the authorities, fire department and police are on the way. let's move along and take a look at the bay bridge toll plaza. westbound. you can see traffic is moving along very nicely. no major problems as you come through. the traffic is moving along -- it's nice for this time of the morning on the bridge. it's backed up for a 25-minute delay at the toll plaza. northbound 101, you can see it's slow and there have been no crashes. when i say it's better, i'm not saying it's good. i'm just saying it's better than yesterday. 8:18. i always have to qualify that because i see traffic and i think that's good but it's not really good. >> it's gooder. >> gooder. exactly. thank you. southeast concord. east at oakland airport. south at novato. but jen. ly less than 5, 10 miles han hour. water temps are still holding in the 60s for most. beaubd buoy -- bodega bay buoy, 59. it's a warm pattern. no rain forecast for the middle of the month. one forecast model is leaning around the 14th or 15th. i think is went 2 inches in santa rosa to .02. high clouds today, minor cooling. mainly coast and bay. that's a dry pattern. maybe all the way into the middle of the month. remain optimistic. things might change. until then, there will be an unseasonably cold system dropping into the great lakes. i mean, amazingly cold. this is the rainfall projection. even up to eureka. there might be a little bit of rain up there. that's through saturday at 6:00. that's the best we can do. high clouds, patchy fog. coast and bay. but not a lot. it looks like it was there around 7:00 and 8:00. now it's disappearing.

his last bill. but then, he had second thoughts. >> before i do that, i call pg&e. >> he thinks there's a security breach somewhere since this is the first time he's paid his pg&e online. pg&e says it would never shut off power without several written warnings and if you get a similar threatening call, hang up and report it to pg&e. pg&e executive who was fired in the recent e-mail scandal, he left pg&e with a package of perks valued at more than $3 million. the bay area news group reports that thomas btooerol, the former vice president, received a hefty severance package. he was fired for improper e- mail contacts with key figures on the public utilities commission, the state agency that regulates pg&e. people who get their water

from the east bay municipal utility district could get hit with a rate hike. the utility says there's a 36% chance drought conditions will continue next year. that could trigger the need to get water from the sacramento river. the utility says that move would automatically require a 14% rate increase. some customers say they are already cutting water usage and the biggest water users should be the ones paying rate hikes. >> i live in a cooperative housing situation. it's 57 people distributed across three houses. we work really hard to conserve water and energy, it's part of the reason we're all working together. >> east bay m.u.d. says it's working out exactly how this will penalize people who use too much water. 8:26. new developments in a berkeley homicide investigation. what the police are doing in connection with a deadly shooting that happened near the

mind. up might want to put off the trip if you can. back to the desk. we have new developments about a story at 6:30 about police activity going on in the berkeley area. berkeley police say they served a warrant at california and harmon street. it was in connection with a homicide last week in the parking lot of sea breeze market near the berkeley marina. now, a 21-year-old man from stockton was shot and killed. police say they don't have a suspect in custody yet. they are collecting evidence as the investigation goes on. also, we're hearing this morning from a security guard in antioch, a man who was shot and wounded in a gun battling on the outside of a starbucks. alex savidge is live in antioch with what happened. >> reporter: an incredible story. just got off the phone a few minutes ago with this long-time security guard. he's doing well.

he told me he had no choice but to open fire yesterday here outside of this starbucks store to protect all of the innocent people in and around this shopping center. the guard fired at a man who he says was shooting from the street toward the store. here's a photo of 41-year-old lindsey gordon senior. he said he was hit bite a bullet that went through his arm and lodged in his back. he's now home recovering. this dangerous shootout happened about 2:00 in the afternoon near the starbucks store on a street near west 18th. gordon said he initially kicked two people off the property. those two people went off on the street and got into a dispute with a third man, that third man pulled a gun and began firing. that's when gordon said he fired once, then ducked down for cover. the gunman ran off and was later captured. gordon said he is grateful no one was seriously hurt. >> it could have about an hope lot worse -- a hope lot worse. no one at the shopping center

was injured. other than that, i feel fine. i have always prepared myself that this might happen. >> reporter: police did arrest the man who shot gordon a short distance away from the scene yesterday. he's not yet been identified. i asked gordon this morning if he thought his actions were heroic. this security guard has been doing this for 20 years. he said this is all part of the job. it's something that's in the back of his mind when he leaves the house every morning. it's something that he has to expect could happen. he's glad he went home to his family and is okay. i asked him when is he gonna go back to work, he told me probably monday. live this morning in antioch, alex savidge, ktvu channel 2 news. >> okay. thank you. 8:35. one person is being treated for serious injuries this morning after being hit by a car in san francisco's north beach district. actually, i believe sal just told us that this person has passed. the crash hatched at columbus

and -- happened at columbus and green streets. police say the driver stayed at the scene and the victim was rushed to hospital. the cause of the crash is still under investigation. a grief-stricken mother in livermore hopes someone can identify the truck driver in an accident that complained her son's life -- claimed her son's life. he gina brown and her son cody were returning home from las vegas last month. they were driving on interstate 5 near patterson when a tractor- trailer in the opposite direction broke an axle. a metal wheel rim ended up ricocheting through the canvas roof of brown's convertible. >> bam! i mean, loud. i -- i sat up thinking, you know, cody was gonna be awake and i said, what was that? and i look over and -- and his face was gone. >> the truck driver never

stopped. the chp has so far been unable to identify the driver. it's possible the driver didn't even know what happened. 8:36. south bay congressman mike honda still has a lead in the hotly-contested congress am race against ro khanna. here's the latest vote count, miken honda, the incumbent, leading 52% to 48% and he has a 3900-vote lead. the 17th congressional district covers parts of alameda and santa clara counties. but there's still tens of thousands of mail-in ballots in both counties that have to be counted. now, honda has not yet declared victory but his spokesman said it looks like the congressman will be elected to an eighth term. the challenger, fellow democrat ro khanna has not conceded. his spokesman said the election may change because so many ballots still have to be counted. mail-in ballots may determine

the race between chu and campos. chu has a 3,000-vote lead. whoever wins will replace outgoing assemblyman tom amiano. well, governor brown is talking about his next four years in office. he says he's proud he's been able to work with democrats and republicans in sacramento. >> squabbling in sacramento is not inspiring. to the extent that that i can bring republicans and democrats along, i think that would be -- that will help build public confidence. >> the governor says the rest of the nation could learn from california. he congratulated democrats and republicans here for working together to pass propositions 1 and 2. those propositions paved the way for new water storage. 8:38. if you think the holiday shopping season seems to start earlier every year. well, you are pretty much right. brian flores is live in walnut

the overnight investigation shut down part of highway 101. university of california president janet napolitano is expected to ask the governing board to raise the tuition at the university's ten campuses. tuitions could go up by 5% every year for the next five years. that means an in-state student could pay more than $12,000 in tuition next fall and more than $15,000 by the fall of 2019. and silicon valley, known for high technology is now known for a slow election return. janine de la vega joining us live now in san jose to tell us why santa clara county was last among metropolitan areas in california and getting back the returns from tuesday's elections. janine? >> reporter: dave, there are still thousands of absentee ballots that still need to be counted here at the registrar's office. now, the ones that were turned in at the precincts weren't counted very fast.

the county registrar's office recognizes that it does have a slow process. it's because the county doesn't have a system in place where votes can be counted at the precincts. the registrar of voters says the county was slow reporting because of a low-tech problem. the precinct ballot must be driven to the registrar's office open and then the tabs need to be pulled off and they need to be counted and scanned through the automatic mated machines. only tiny mono county had a worse showing than santa clara when it came to having posted results in the state. the earliest ballot counts from the bay area were completed between 10:45 p.m. and 12:30 a.m. but santa clara didn't finish counting until 4:00 a.m. the registrar's office has not updated their system in the 2003. >> pretty sad especially because i thought santa clara was pretty efficient with a lot of those things. i thought they were one of the best which is weird to think that they took so long.

>> reporter: in san francisco, there were also technical issues that caused delayed results from being posted online. there was a 75-minute gap between the first and second updates. the election chief says high traffic from mobile devices caused problems from an off- sitar isver. the registrar said there's a limited number of strms on the market that are certified for the state and are bet waiting for better technology to come out before actually investing. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> all right. thank you. 8:47. we're following developing news. the fbi just announced in the last 45 minutes that it has arrested a san francisco man for attempting to resurrect an underground drug operation. that announcement came in a tweet it says, operator of silk road, 2.0 blake bent wall hasted by fbi agents yesterday in san francisco, california.

the fib also later tweeted that -- fbi later tweeted that his site allowed thousands of drug dealers to illegally buy and sem drugs anonymously over the net -- and sell drugs anonymously over the internet. authorities say ross ulbrich ran the site from his hayes valley apartment. he was arrested an the site was -- and the ips site -- and the site was shut down last year. we'll continue toful to developing story and have more details for you on the news at noon. 8:48. as we go to sal, i just want to clarify. we did a story earlier about a person hit by a car last night in the north beach district of san francisco. that person has injured but sadly there was another person hit this morning in the city and that has person has died. sal joins us now with more on the traffic implications on that. sal? >> that's right, tori and dave.

this was at lombard and van ness in the marina district. police say a 50-year-old jogger was hit and killed by a golden gate transit bus at 6:15. we have a map of the area. it's a good area to avoid. lombard and van ness, a very busy intersection blocks away from gallilao high school. this jogger was hit taken to san francisco general hospital and died there of her injuries. police are still investigating and the driver is said to be shaken up. and is one of the most senior drivers, according to the agency, golden gate transit. let's take a look at the bay bridge toll plaza. this has been moderate. i do want to mention that westbound 24, there's a crash right near broadway. this -- in fact, i can put it up on the map for you. 24 is just a mess. so is highway 13 because of a crash, 24 right near broadway. this is making a big midwest of the lake commute through the
