jail sentence. anyone convicted has to register as a sex offender. and that is for life. noelle walker, ktvu channel 2 news. a horpying discovery underneath -- horrifying discovery under neath a home. a body of an infant wrapped up inside a box. ktvu's ann rubin spoke to the man who found the body. >> reporter: he says she not sure how long the box had been there but he doesn't remember seeing it before. authorities are trying to figure out who this little girl was and how she died. >> reporter: authorities call her baby jane doe. she was found here in the crawl space beneath a mobile home. >> i feel so mad. i don't know how the people can do that. >> reporter: he does maintenance at the mobile home park made the discovery.

it was a small box tied with pink ripen -- ribbon. >> i told the manager i think i found a dead baby. >> when i take it out of the box i can smell it was something dead in there. when i see the head i am -- i am -- i think -- i am not sure. >> reporter: he called his manager who called 911. san jose homicide detectives responded to the scene but say there were no obvious signs of foul play. the question remains how long the baby was the. >> it is really sad. but i also would like to know what is behind it. what happened. >> it is a tragic loss. i can't believe people would do that to an infant that small.

>> reporter: the baby appeared to have been quite young and authorities are now passing the investigation on to the medical examiner office. >> can't imagine what it must be like to discover something like that. ann rubin, thank you. bail was lowered today for a street performer known as evil elmo. adam sandler went before a judge today in san francisco. he is accused of having obscene. >> the prosecutor objected to the bail reduction saying he is a flight risk. he live as transient lifestyle. criminals could be clever. case in point, security at san mineta international airport found cocaine. they searched through belongings and found a bag of raw meat. they found three vacuumed sealed packs of cocaine hidden inside the raw meat. the passenger was arrested. big rig accident that snarled traffic in san jose is now clore for the evening commute. police say the truck was heading southbound on 101 when it blew a tire. the rig toppled and blocked traffic. there is no word on the

many of the cities' aging trees to go. >> reporter: crews worked to restore power lines to muni buses in san francisco. a ficus tree toppled this morning in the after math of the rain. a construction worker was injured. knocked unconscious and pinned down by a branch. >> the trees out there break all the time. so -- and those branches can be a couple thousand pounds. >> three other downed trees damaged cars. the destruction highlighted worries about the aging ficus trees planted decades ago and now towering over worried people. >> one day this tree might fall down. >> reporter: he says the city doesn't have enough people to manage the trees. >> took us 5 years to get this tree trimmed. it got to the point where you could get on the roof.

>> these trees were pruned a couple months ago. >> reporter: the city's department of public works is working on a plan to replace hundreds of the trees. >> it is huge. each tree removal can go from 500 to $1,500. >> reporter: another live look at the damage. for your information the construction worker was taken to san francisco general hospital. portions of the avenue were shut down for up to 5 hours as they cleared away the damaged tree. >> all of this comes as the city is trying to shift more responsibility for maintenance oo proper owners. -- to property owners. . >> reporter: they won't shift responsibility for trees that are damaged or in danger of falling down but it aims to stream line the process to

new at 6:00 p.m. a teenager is telling a frightening story. ktvu's mike mibach is live with more. >> reporter: in the middle there, a 16-year-old girl on this day home from school because of what happened after school. >> he because big, choking me. >> reporter: wednesday, 2:45 p.m. she just walked out of the high school, when a man threw his arm around her neck. >> choking me. i couldn't yell. i could barely breathe. he told me to shut up and he tried to stick his hand down my

pants and i kicked him. >> she was hysterical. she was pushing on the doors. >> reporter: seconds later she put a call into the police department, within 10 minutes there was an officer outside the house, knocking on the door. >> took the report. said they were going to search the area. >> reporter: she did not have a cell phone gave the officer this description of the attacker. mid-30s, mustache, black hoody, blue genes and black basketball shoes. police did not return our calls calls and the school district warned parents about the incident. they say they are coming forward now with the story in hopes it will catch the man responsible and to prevent other girls from being attacked. >> i would think other people should be aware. my grandma tells me, i just think -- i don't know, i think

it could never happen to me. >> reporter: strong but still shaken. she is now back home surrounded by those she loves. mike mibach, ktvu channel 2 news. a family is searching for answers after someone shot and killed a man outside his mother's oakland home. the victim worked as a handy man and was on his way to care for his mother. >> he comes here. cuts her grass. takes her to the doctor. sells hers can. i am going to find out who you are and make sure justice is served. >> he was the youngest of 11 children. his sister tells us every day he would travel from hayward to east oakland to care for his 85- year-old mother. after 4:00 p.m. yesterday afternoon he was gunned down outside his mother's home. his death marks the 73 homicide this year. police are not releasing information on possible suspects and the motive for the

killing is under investigation. crime stoppers is offering $10,000 reward for information leading to an arrest in the case. in concord police say the man who was shot and killed by officers last night may have had a gun. this afternoon they identified the man as 26 years old of bay point, a convicted felon on probation. sheriff's deputies spotted a man driving a stolen car on highway 4 before 9:00 p.m. last noth. they followed him to the mall in -- night, they followed him to the mall where the driver ditched the car, ran to the shopping center. police say the man carjacked a driver and tried to get away but police officers boxed him in. when the man rammed his vehicle into a police car one officer opened fire. employees and customers took cover. >> kind of just -- shocking. just kind of slow motion going

through it. >> police say they found a weapon near the car that he abandon. a woman who lost her husband in a crash on highway 17 is accusing caltrans of negligence. he was killed in 2012 when his car slid through a break in the barrier in wet weather. it happened at a spot people call dead man's curve. a jury trial began today in a lawsuit filed by his widow. she claims caltrans knew for years the curve was dangerous and the chp requested a barrier 9 days before the incident. >> i don't want anybody else to go through what myself and his -- our family gone through. >> her attorney says a new barrier went up six days after the crash at a cost of $20,000. they are also urging caltrans
