their wedding planning made promises he couldn't keep and now it cost them thousands of dollars and now he's in jail. >> he's going to be spending a few days here in county jail. it's taken years for justice to be served, but now a wedding planner is spending time in jail for steals thousands of dollars from couples. amber lee is live in san francisco after speaking to one of the victims. >> reporter: the san francisco man set up shop here in china

town, one couple tells us the wedding planner made a lot of promises but kept none. on august 27th, 2006, joe biancolana marred tina phan. but what the video didn't show you is the stress the couple went the months before. the family hired this man whom they heard of from word of mouth. they paid, he disappeared. >> we had to scramble and find our own food, our own wedding cake. it was tough. it was really a drag. >> there are no licensing requirements for wedding planners. >> reporter: assistant district

attorney says he stole from couples from 2009. >> we did catch up with him. here's going to be spending quality time in county jail here in san francisco. >> this is prewedding. >> reporter: bianca lana says he only learned today that quan is finally behind bars. >> when something comes through like that and there's some justice, it renews your faith. you know that yeah, yeah something can work out. i'm glad, i'm very happy about it -- reknews. >> reporter: bianca lana says they did not let the theft affect their love.

>> nice to hear joe biancalana say that his faith has been restored with that conviction with quan headed to jail. san francisco police honored the legacy of one of their own this evening. officer james gulp was killed on the line of duty. a memorial took place where officer gulp was shot and fatally wounded. more than 100 officers responded and it lasted 25 minutes. the gunman was heavily arm and was wearing body armour. but he was eventually killed by a s.w.a.t. team. following that gun battle a federal law was passed, barring violent felons from possessing body armour. today chief suhr paid tribute

to officer gulf. the law was named after officer gulf and an officer from alabama who was also killed. a blind man was hit and killed by a car this evening. the accident happened around 6:15 in the berkeley city line. police have only confirmed that a person was killed at that location. and that this incident is not a hit-and-run but we spoke with a man who knew the victim and he say it is victim was blind and walked with a white cane. >> he is blind and he always held a stick for the blind. an official stick. >> reporter: the witness also told us another woman saw the accident and claims that the driver was going too fast. he said the victim was heading to the mosque to pray and leaves behind a wife and children. the california highway patrol is launching a campaign now to crack down on so called

aggressive driving. >> the chp tells us aggressive driving plays a role in the deaths of dozens of people nationwide. jana katsuyama joins us and says aggressive driving can be hard to spot. >> reporter: speeding and dui have very clearly defined numbers but aggressive driving some may say is left up to interpretation. that's why we road along with the chp to learn where they draw the line. drivers say they see a lot on bay area roads. >> like when you see people getting upset or a lot of like cutting off that happens. or the speeding up or slamming on the brake. >> reporter: like road rage. always jumping in front of you, angry. >> reporter: it's what the chp calls aggressive driving and they're waging a campaign with extra officers on the road to crack down on those drivers. >> reporter: people tend to get aggressive the more complicated

the driving is or conditions. >> reporter: he road along on interstate 880 during rush hour with officer daniel hill. >> the most we're going to see is speed and tailgating. >> reporter: he says while the word aggressive may be subjective, officers on patrol look for behaviors that are unsafe. >> aggressive drivers will typically follow other vehicles too close. they'll unsafely lane change, for example they will cut into a space where there's not enough room for them to be. >> reporter: the crack down is important. in 2011 aggressive driving contributed to more than 1,100 people killed and more than 1,600 people injured. >> it represents a lot of our collision factors. it ranks up there with dui. >> reporter: the chp's campaign will continue for one year. so keep that in mind when you head out on the road. the chps campaign will continue as we said for one year.

again that was jana reporting. happening now, a live picture of interstate 880 in oakland where a massive traffic jam has just started clearing up in the southbound lanes near downtown. after one of the worse back ups in recent memory. you're looking at the problem here. it all started about 2:00 this afternoon when the top of a truck that was too high clipped an overpass at the 23rd avenue exit and rolled over. news chopper 2 was over head earlier. two southbound lanes had to be shut down while crews checked the overpass for damage and replaced a guardrail at one point, the traffic was backed up all the way to the bay bridge. near by streets were also jammed after people got off the freeway to try to get around the problem and making matters even worse, there was a warriors game tonight. so far there is no estimate about when those two lanes on southbound 880 at 23rd will reopen. it looks like the race for mayor in san jose may be headed

to a recount. sam licardo already claimed victory and his opponent conceded the problem is the it director for the registrar's office quit the day before the election. the registrar contacted a secretary of state's office and was told if they wanted to recount they could. a decision is expected soon. right now liccardo leads cortese by about 500 votes. if there were a recount it would happen before december 2nd. and the chp is going to review their policy after officers accepted tickets. the chp has a gift ordinance that keeps officers from accepting gifts of more than $50. the staff has since reimbursed the 49ers for the cost of those

tickets. the storm that blew through northern california earlier today brought much needed rain to our area. >> bill martin added up the rainfall and bill is here now, how much did we get? >> reporter: the big story is not so much the rain totals but the commute this morning. the rain fell right on the morning commute. accumulations were light but as we've talked about it takes nothing to really slow things down. so here are some of the totals. you will see, these are minuscule for what you would expect in a wintertime storm. .3 that's .3 of an inch in san francisco. usually you get .5. and you have under an inch of rain. let's see what we get with the percentage of average. 34% in santa rosa, 57% in san francisco. and 66 in san jose. doesn't mean a lot right now because one big storm brings everything to about 100% of

average. but we do need a lot of rain around here. we have some to talk about. shows up in our seven day forecast. we'll see you back here i'll detail all that. >> bill, thank you. the rain and wind brought down a number of trees in san francisco today. keeping clean up crews busy for much of the day. as ktvu's david stevenson reports, one of those fallen trees injured a construction worker. >> with a much needed rain came consequences. four large trees downed in san francisco this morning. the most serious case, a ficus estimated at more than 50 years old just across the street from san francisco general hospital. >> there was a noise, we came out and the sheriff and police department came very fast coming from the general hospital area. >> reporter: a construction worker emerging from an suv was seriously injured, knocked unconscious. his arm and leg pinned by a fallen branch. >> they had to cut part of the

branch, use some air bag, use some cribbing to stabilize the vehicle and the tree. >> reporter: crews worked through the morning to repair downed muni lines that sent sparks when the tree fell. on steiner and eddie street, crews worked to trim trees. in north beach, a sense of deja vu as trees removed a ficus that fell at joe demaggio park. hundreds of the top heavy trees were planted decades ago. they are now dangerously prone to cracking and splitting. >> and so we are aggressively looking at the best way to replace the aging ones. >> reporter: not surprisingly that will come at a cost.

new at 10:00, a south bay family is mourning the death of a man they say died far too young. he was killed on veteran's day after a wave swept him out the sea at carmel. azenith smith spoke to family and friends and joins us now. >> reporter: nguyen was an airmen for the rescue wing. his family tells me he was just awarded outstanding airmen of the year. they are grieving a life cut short by the unpredictable

dangers of mother nature. inside this milpitas home, those who died kim nguyen are taking it hard. missing him most is his son. >> not having him around is very difficult, for me not having my best friend is very difficult. >> reporter: the family held out hope all day as rescue crews frantically searched under water. his father desperate to find him. >> you want to go down there and you want to jump to the ocean. >> reporter: nguyen's body was recovered the next day. born in san jose and raised in milpitas. for the last two years, nguyen worked full time for the air base. serving as a volunteer coach for the milpitas soccer league with dreaming to play with mls.

>> i am so proud of my son. >> reporter: knew web -- nguyen had fished there before. >> if you don't respect the ocean, it just can take you by surprise. >> reporter: nguyen's family just hope that others will heed the warning. >> it sounds so silly, because everybody says but anybody can be gone any moment and you just never think it could be you. >> reporter: a go fund me page has been set up for a trust fund for his 7-year-old's son. so far that page has raised more than $11,000. his family says nguyen will be buried with other family members in los altos. julie. >> azenith, thank you. today we learned a 42-year- old man who was shot and killed was visiting his mom when he was gunned down.

alonzo mccullough visited his mother's home almost every day. the family says that when he wasn't landscaping or doing handy work he was caring for his 85-year-old mom. he cut her grass, he took her to the doctor, and he sold her empty cans. now, she is preparing to bury him. >> he was my baby brother. and i am so mad. i am so upset because whoever those cowards were they deliberately did and what was their reason. what was the reason? >> reporter: there's a $10,000 reward for anyone with information that leads to an arrest in the case. san jose police are investigating the death of an infant who's body was found inside a box in a crawl space beneath a mobile home. a manmade the discovery at the mobile home park on east capital expressway near highway 101. he told ktvu's's ann rubin he

found the box carefully packaged and wrapped up. >> when i took the tape off and see the clothes out and see the little hat, i called the managers. you know what, i think i found a dead baby in a box. >> reporter: the baby appeared to be a little girl and had been carefully wrapped up in sweaters. >> three sweaters, it's not a blanket it was sweaters under the box. one of the sweaters looked like it wrapped the baby and one on the top. >> reporter: he checked under these mobile homes from time to time and he had never seen the box before. >> nobody lives here. >> for a long time. >> yeah for a long time. >> reporter: residents at silver creek say it's been years since anyone lived here. the last tenants left suddenly leaving many of their belongings behind. >> when you look in the window there's still couches and stuff behind. >> reporter: throughout time, this place has been attracted. for now the question who left

the baby. for now she's being called baby joe. >> i feel so mad because i don't know how people could do that. i feel so sad and upset. >> reporter: how the baby got here remains a mystery. >> it is really sad. but, i also would like to know what is behind it. i mean what happened. >> reporter: the santa clara county medical examiner's office is now taking over the investigation. in san jose ann rubin, ktvu news. bail was reduced for a street performer who some people call evil elmo. he was arrested after allegedly threatening to kill a shopkeeper. he is also accused of obscene outbursts. today his attorney asked for his release to prove that sandler could abide by an order that he could stay away from fisherman's wharf. bail was reduced from $250,000

the toll plaza now. if you're talking to the person who actually owned the car and he is stunned by what happened, debra. >> reporter: his lincoln sedan is part of a cab fleet. the owner told me he had no idea it was the vehicle that took that wayward path and ended up all over the news until the license plate traced back to him. now here are new photos of the car in inpound. mangled metal and a shattered windshield after colliding with one vehicle and sideswiping another. you can see where the air bag went off, protecting morgan who police say was high on drugs when she drove going the wrong way. and made it for several hours mostly by swerving on the shoulder. the owner locked it and then went out of town with his

family. >> saturday morning around 9:30 was the last time that the person that reported the vehicle stolen last saw it parked there. and that they were told on sunday afternoon, that it was involved in a crash on the bay bridge. they called the police department and reported it stolen. >> reporter: that taxi driver who works for emory bay luxor cab told me by phone today they could not believe where it ended up and how it ended up. emory street is a quick hop to the plaza. today chp finished its investigation. felony dui in this case a controlled substance, drugs. also auto theft, driving the wrong way, and driving without a license. reporting live in oakland, debora villalon, ktvu channel

2 news. it's still mind boggling that she made it 2 miles driving the wrong direction on the bay bridge. debora, thank you. and started work to replace expansion joints on the bridge but then caltrans stopped that project and removed plates after morning traffic began slowing to a crawl. the new plan calls for the work to resume tomorrow. it will now take place at night and without those steel plates. officials warned traffic may be limited to one lane. crews are expected to work monday through saturday for the next two months. the department of homeland security has come out with a scathing review of the role of the secret service in the recent case of that intruder at the white house. a man armed with a small knife got over the fence then ran inside the white house before he was stopped. the review says alarm systems

tonight 2 investigates uncovers more concerns about children mislabeled as english learners in bay area schools and the big money at stake. we learned it's not just thousands but potentially millions of extra dollars that flow into schools that need help with english as a second language. >> reporter: ktvu first reported one parent's concerns last month. what he found was that there may be a larger problem. >> reporter: more than a dozen parents contacted us. they say their kids have also been mislabeled as english learners. each child counted as an english learner is worth $1,500 to a district and removing that label is no easy task. anthony martinez seems like a pretty sharp fifth grader but he has a hard time understanding why his school paper work says that he's an

english learner. >> reporter: i don't really get it because my first language is english i don't even speak spanish. >> i right away messaged my husband and i'm like, look at the news. they're announcing what we've been dealing with. >> reporter: the story prompted a number of concerns. parents who mention one language declaring many of them english learners. a label that some say can unfairly hold children back. >> i got pulled out of my class. when we had to learn about something it was like a test right after. they pull -ld -- pulled me out of the class to go to a different classroom. >> reporter: martinez is one of more than 8,000 english learners. statewide the numbers are on the rise. after declining for 10 years in a row, the number of english learners in california klineed

to 1.4 million last year. the same time as a new state funding formula sending more money to districts for every english learner and low income learner they had. san jose is expected to see $10 million this year. the numbers are even higher in oak in oakland and san francisco. the district reclassified about 500 students out in may. but he refused to acknowledge the district could have misidentified any students like martinez who have two english speaking parents at home. >> does that seem like an english learning student to you. >> it's not about the language.

>> reporter: with districts somehow misinterpreting the law and often failing to take a closer look at each child's situation before labeling them english learners. >> they go through their steps but they don't take into account what's best for the child. >> reporter: it's a problem this family hopes to avoid when their youngest enters school next year. >> we're going to do whatever we have to do to make sure it doesn't happen. >> reporter: we repeatedly asked to speak with the superintendent but they refused. parents who believe their kids had been incorrectly identified as english learners can file a complaint if that is they're not satisfied with the response they're getting from their school district. >> part of the problem is parents don't realize there's a place they can turn to for help. >> they have a few options, some say they hit brick walls but there may be more choices out there for them.

>> eric thank you. the gop has approved mitch mcconnell as their majority leader. his selection was expected after republicans gained control of the senate in last week's election. mcconnell will assume his role in january. on the other side of the aisle, democrats reelected senator reid of nevada. the senators on the democratic side also created a new poston their leadership team for liberal massachusetts senator elizabeth warren. democrats hope she will serve as a liaison. house democratic leader nancy pelosi is lashing out. pelosi compared her situation to mitch mcconnell. >> what was the day that any of you said to mitch mcconnell when they lost the senate three times in a row.

making progress and taking back the senate three times in a row, aren't you getting a little old mitch. shouldn't you step aside. >> reporter: under pelosi's leadership, democrats lost control of the house in 2010 and lost more seats than last week's election. pelosi is 74 years old, mcconnell is 72. it appears the u.s. governor will end up earning millions of dollars for clean air start ups. the president had touted the manufacturing plant before it closed its doors in 2011. now the energy department estimates the government will earn five to $6 million from the earned to clean program. the program loaned solindra $528 million before the company flopped resulting in more than 200 lay offs. now to wall street where

the markets edged higher today. the dow gained 40 points to close at another record high. the nasdaq added five. the price of oil is collapsing. crude oil has fallen below $75 a barrel for the first time in four years. the sharp drop in oil prices is keeping gas prices low. but analysts say the collapse does pose a financial threat to energy companies. another ebola patient is going to be coming to the u.s. the newest patient is a surgeon and is coming from sierra leone. he is not a u.s. citizen but is married to a u.s. citizen and has children. tonight we're remembering

a janitor is under arrest tonight in the south bay accused of possessing more than 100 hours of child pornography on his computer.

the silican valley internet crimes against children's task force says it knew someone was downloading child porn at this los gatos trailer park. officers searched his car and said they found the videos on his computer showing children ranging in age from toddlers up to 12 years old. >> if you're engaging in this type of behavior. if you're downloading child pornography then the silican valley task force is doing everything they can to try to stop you. >> police tell us child porn is a big problem. they say the task force arrests two to three people every week. officials with fema say they have now inspected 200 homes damaged by the south napa earthquake. inspectors are documenting damage and losses for people who are seeking disaster assistance. president obama declared a disaster in september making it possible for people to apply for federal aid.

the deadline for applications is december 29th. that 6.0 quake on august 24th was the largest in the bay area since the loma prieta quake back in 1989. a new problem tonight for that unmanned european aircraft that spent 10 years flying through space before landing on a comet this week. today scientists learned it touched off in the shadows of a cliff. which could be difficult to keep instruments charged. this is a picture of the tiny craft perched on the comet. the orbiting mother ship snapped the picture as it tracks the comet at more than 80,000-miles-an-hour. the season officially starts tomorrow but the crab fishermen can start setting up their pots tomorrow morning. crab fishermen have agreed to

sell their crab at $3 a pound you can agree to pay about double that. recreational crab fishing started november 4 and the hauls have been good so far. fishermen say they hope it can keep a string of four straight years of good fishing. >> saturday morning we'll be able to start pulling the gear and harvesting crab. some time saturday there'll be crabs here. there'll be hundreds found in the next week. >> reporter: the season is the second that puts a limit on the number of dungenous crab pots per boat. the number ranges from 75 to 500. i don't want anybody else to have to go through myself and our family has gone through. >> reporter: a highway 17 crash killed her husband. the lawsuit now being filed that accuses caltrans of knowing about a safety problem but not correcting it until it was too late. in five minutes, chief meteorologist bill martin's forecast. the weekend ahead and the next chance for significant rain. and new developments in the case of that baby gorilla

love. it's what makes a subaru, a subaru. outdated and unsafe. that's what an investigation into the death of a baby gorilla at the san francisco zoo calls the electric door that crushed her. 16-month-old cabibe died at the zoo friday night. an expert brought in by the zoo says the electric door doesn't stop when it hits an obstruction like many garage doors do. there's not a clear view of the door from the emergency stop button. the investigators are recommending the zoo scrap the door and install a new one that is safer for the animals. a woman claims caltrans was negligent and that led to her husband's death. the accident happened at a

horseshoe shaped section of the highway near laurel road. many people call this spot dead man's curve. >> reporter: despite $100 million in upgrades over the last couple of years, busy and windy highway 17 remain dangerous. many drivers simply go too fast. we drove it in the rain and saw this driver lost control. at the santa cruz county courthouse a widow's plea. >> i don't want anyone else to have to go through what myself and his, our family has gone through. >> reporter: her husband jerry killed instantly on highway 17

after his car skid into a side barrier. caltrans knew for years that the curb was especially dangerous and that the chp made a special request for a median barrier just five days before the fatal crash. >> the total cost of puting in that barrier was approximately $20,000. and caltrans was able to do that in two days. >> reporter: richard alexander says the life saving barrier was put up six days after the jerry braner crash. his family is urging caltrans improve safety but lowering the speed limit. >> there's something about 17. it's a very crowded road. people drive it aggressively. they have to be slowed down. >> definitely dangerous. if caltrans can make it happen that would be great. >> reporter: several police officers are set to testify in this civil trial. john fowler.

on. rainfall accumulations around here what do we have? half an inch at the best. that's turning near the santa cruz mountains. most of them .1 to .5. valley fog a real issue. we get the invention fog that comes off the water. when temperatures drop into the 40s or even in the 50s for that matter you start to see valley fog. dewpoints are high. dewpoint temperatures are high. they're in the mid-50s and upper 70s. tomorrow morning be ready for that. i've already got fog up in santa rosa. i have fog showing up out around the walnut creek area kind of east toward clayton. it's patchy now. when that temperature drops to meet the dewpoint boom you have fog. it's all winter long. there's not a lot of mix to make up the fog. fog and low clouds in the morning hours. you can kind of see it lingering around and then high
