>> and i am julie haener. >> based on customer complaints and a suspicious money trail uncovered by ktvu's melanie woodrow they filed a lawsui against that business and the owner. and here now are details on the investigation and what this means for customer whose say they have -- who -- customers who say they have been ripped off. >> he has two goals by filing the lawsuit it get tax customers their money back and to make sure there are no victims. >> it is your money. get it faster. >> reporter: inside money mart and check cashing businesses. >> i think what they were doing was looking for people who needed the money so they wouldn't ask too many questions. >> when they noticed their refunds were missing hundreds, thousands of dollars, they

contacted 2 investigates. san francisco city attorney filed a lawsuit, it outlines what customers told 2 investigates. fees without knowledge or consent. a difference they didn't notice immediately because they did not allow them to review their returns before filing. >> i asked for copies and she refused. >> there are a host of unlawful practices. >> employees deposited refunds into an account it controlled and then deducted fees and issued smaller checks to customers. sometimes no refund check at all. >> irs told me they deposited the money. >> this went on up and down the state. >> a man customers were directed to contact with

complaints but never saw. he says he set up shop in low low income neighborhoods. >> reporter: how many victims did he target? >> i think it is fair to say it was widespread. >> the lawsuit seeks refunds for all california incident tax customers along with penalties and to shalt down nent tax for good. >> it -- shut down incident tax for good. >> reporter: i spoke to incident tax owner by phone this afternoon, he had no comment about the customer complaints or the lawsuit. >> tax season is around the corner was that a factor? >> reporter: absolutely. they intend to prosecute quickly to prevent him from taking advantage of customers in 2015. >> thank you. 2 investigates looked into

tracking the next system. >> we have this system. it is impacting the commute. morning commute and now the afternoon commute. it doesn't take much. you saw it out there. it is slow. it will continue that way for the next hour or so. we are still seeing scattered showers slowing traffic. especially in fremont area. shows now starting to get into it. walnut creek and san ramon. scattered showers. antioch as well. so that is the weather story. it is not a ton of rain but it is enough it is hitting the commutes and slowing things up. when i come back we will talk about system 2 number tomorrow. dial that in. there is a third system as well. >> lot of water. makes it dangerous on the roadways. >> i think people think they could go faster than they can because it is not raining that hard. thank you. angry students converge at a uc campus in san francisco as the uc regents consider increasing the cost of college at uc schools for the next 5 years. university of california regents poised to raise tuition after a noisy protest today and a preliminary vote in support of that hike. ktvu's john fowler was at the meeting today and john is in san francisco with key details about who will and who won't be effected by this. >> reporter: that is an important part of this story for students and families. when the uc regents showed up they were met with noisy protests. >> reporter: angry demonstrated said the 5% per year tuition hike is unbearable, even though the students do get financial aid. >> i make above the cut offline for financial aid so i will be

struggling and bearing the burden. >> reporter: officials say financial aid and scholarship -- after three years of no increases they said they have no choice. >> we don't have time to kick the can down the road. we have to make a decision today. >> reporter: it would raise $100 million that the legislator failed to provide. >> shame on us for being in this position today that got this bus load of students from all over the state to have to come here and listen to us point pingers at each other -- fingers at each other. shame on us. >> reporter: the 7-2 vote recommends the board adopt the tuition hike. students blame the problems on excessive salaries. the only no votes the governor

and the student regents. >> i think you need to understand what effect this has on students. >> reporter: they are expected to approve this hike tomorrow. but several of them argued the budget process is broken and has to be fixed. so higher education is no longer vulnerable to economic and political cycles. >> looks like it is a done deal. thank you very much. steady economic growth will cushion california when tax increases expire. that is according to a report out today. it projects trends through 2019, the first year after the prop 30 tax hikes expire. when it ends the state will not experience a sudden fiscal cliff. man is under arrest after a carjacked a vehicle in san

francisco and drove it to oakland. he was carjacked at gun point this morning. that car was then tracked to an apartment complex in oakland. police arrived that complex later in the day and arrested the suspect. and san francisco police later picked him up. police haven't released the suspect's name or said what charges he faces. police are looking for a 12- year-old girl who has been missing for a week. she went to school on november 10 but didn't come home. officials say she never made it to class. people reported seeing her in san francisco and oakland. she is 5'4" and weighs 100 scent pounds. she may be wearing black pants, a cut off shirt and high heels. threat made against a school was so alarming the principal had no choice but to cancel classes today. ktvu's mike mibach with the details of the e-mail and the

ripple effect it had. >> reporter: parked in the front, rolling by the back, officers eyes all on santa cruz high. >> i got a text that said don't go to school. there is a threat. >> reporter: an e-mail sent tuesday night to the principal who happened to be checking her mail. >> it mentioned a specific time, place and action. but did not indicate any specific person or persons. >> it was intended to be a message of mass casualty. >> get that information to us. >> he said the e-mail was concised, focused and threatened -- concise and focused. officials canceled class calling it a cautionary move. at 6:00 a.m. students and parents were

alerted about the threat. students agree with the decision to close the school. >> i think we are afraid. >> reporter: police say the fbi is working with their detectives trying to identify who wrote the e-mail. officials have not yet determined if it will reopen come tomorrow. in santa cruz, mike mibach, ktvu channel 2 news. a boy chased by a stranger while leaving school today. >> we are talking with police and the principal about the attempted kidnapping. >> and a labor dispute at west coast ports is having consequences, the benefit that is felt in the bay area. female announcer: the mattress price wars

judge heard testimony on whether a 14-year-old boy accused of killing a classmate should be tried as an adult. >> the 14-year-old was stand and killed outside a store in the mission district two months ago. he had an academic capitol hill and played -- scholarship and played football. they handed in hundreds of signatures to try him in adult court. >> he is tried as juvenile it will be maximum 7 years. >> today the family presented a victim impact statement which the judge will use in making the decision. a san francisco school is warning parents about a possible kidnapping attempt. it happened at 3:40 p.m. this afternoon on elizabeth street. the principal tells os7th grade

boy -- us a 7th grade boy was leaving school and a man chased him. the boy ran to a cafe for safety. >> he ran, he screamed and headed for the nearest business and he reported it. >> usually a good school. people coming to help someone. really shocking. >> a student said a white minivan may have been involved. the school says this is very unusual and concerning. and it is sending out a memo to parents about what happened. san jose police are looking for a gunman who was long gone prior to an over night stand off. police received a report before 10:00 p.m. last night of an armed man hold up in a house with 7 children inside. police surrounded the house over night and tried to make contact. then s.w.a.t. officers used grenades to clear the home this morning. but when they entered there was

no suspect inside. >> our officers cleared the residents. they removed 7 children from 1- 13 and two adults. the suggest that we were nilsy looking for was not located in -- initially looking for was not located in the residents. >> it is not clear how much communications officers had with the people inside before entering the home. no one was hurt. police in santa clara and sunnyvale are warning about street robberies. suspects have been targeted of people of indian decent wearing gold jewelry. in some cases the suspects pointed guns at the victims but no one has been seriously hurt.

police are warning people to conceal their jewelry while out and about. new at 6:00 p.m. a boost for bay area business is emerging from a major slow down at ports. business in ports is booming. but the news is getting mixed reaction from people who depend on the shipments going in and out of the ports. ktvu's eric rasmussen explains what that means for consumers. >> reporter: in ports at the port of oakland jumped 9% last month. ports in southern california are so congested some ships are coming here instead. -- shippers are coming here instead. the truckers weren't exactly celebrating. >> reporter: business is hardy speeding along. truckers say picking up and dropping off slowed taking 4 --

loads is taking 4-5 times longer. a labor dispute led to slow downs. even shut downs at shipping terminals but the congestion is worse at ports in los angeles and long beach and that could be opening a window of opportunity in oakland. >> we are getting hundreds of thousands of loads coming our way that has originally -- was originally targeted in long beach, los angeles area. >> reporter: imports were up 9% in october. that is good news for one of the bay area's biggest economic engines. one company is offering to drive cars from southern california to the bay area for free just to ship out of oakland instead of los angeles. >> i think there is a great opportunity but everybody has to see it and work towards a resolution. >> until a labor stand off is solved he says his trucking

well, always some kind of drama with the 49ers. instead of looking forward to their game, you have to look back at what happened last week. san francisco linebacker ahmad brooks apologizing to his coach and teammates. couple weeks ago he was the big hero to help the 9ers wrap up -- 9ers wrap up the saints and then the following week he pulled himself out of the line up because he didn't want to rotate in with appalachian aldon smith -- with aldon smith. >> reaction during the game and i reacted out of my character. and i did not quit on the team. i did not take myself out of
