dies. also, the disturbing incident that has now led to an urgent warning to parents and students in san francisco. "mornings on 2" starts now. you are looking live at an ongoing protest at uc berkeley. it started yesterday and went all through the night. students are angry over the university's plan to raise tuition. ktvu's christien kafton is there. coming up in minutes, he will have more on the students' demands an what's happening today. good morning. welcome to "mornings on 2." i'm tori campbell. >> good morning. >> good morning. i'm dave clark. let's talk about weather and traffic. did you see fog driving in? >> i did see quite a bit of fog. >> steve is talking about it. a lot of fog out there. pink skies, purple skies right over san francisco and pacifica

and maybe where you are. some of that fog is really, really tough and very thick. that's in advance of the system. maybe some light rain. it's getting closer. most of the morning commute should be all right. but the afternoon commute looks like they will have to deal with this system which will be in here around noon to 6:00. it's a kelder system. cloudy, foggy, light rain. rain picks up. it will be cooler this afternoon as the system works its way in. there's some rain trying. it doesn't look like much is happening. there's been a few reports. most of it is light. the heavier rainfall associated with the system will pick up rain rates to a moderate category. 50s on the temps. look for light rain to pick up. heavier rain later this afternoon and into this evening as our first really system coming down out of the northwest. cloudy. afternoon rain. there will be light rain before. fog is the big story. cool to mild. 50s for some. low to mid-60s for others.

sal and i have been talking about at fog and he's taking a look at it on the bridge. >> we can see it on the traffic camera. you are absolutely right. the chp has issued a warning for drivers on the richmond/san rafael bridge to be careful because of the dense fog. let's start off on the eastshore freeway. it's a 30-minute drive from the carquinez bridge to the maze. not too bad. this is more normal than it has been the last few days. let's go to the bay bridge toll plaza, it's about a 20-minute delay. we're not looking so bad. i want to tell you about the peninsula because southbound 101 and san mateo, we had a crash that lasted for a while. 101 is backed up out of the airport area all the way down into san mateo. even northbound is slow. 280 is the best bet. san jose traffic is moderately heavy. on the nimitz freeway, we have slow traffic starting near 238 heading down to fremont. back to the desk. a marathon protest that

began 12 hours ago, continues on the cal campus. dozens of demonstrators are occupying a building at uc berkeley. most of them spent the night there. christien kafton joins us live to tell us what is behind the demonstration. >> reporter: a meetingup wrapped up. some of the students organizing a plan to go over to the uc regents meeting in san francisco. you can see the activity level has started to pick up. more and more students 0 ut here right now. students getting ready to, again, attend that meeting later today. what are the students say about the hardship they believe those tuition increases will present to you? >> well, first, stop the

tuition hike. two, we want financial transparency, what is all of this needed? and the financial transparency is under law and third drop the charges of the student arrested. and also why is there a 5% nearly increase for students? it does not make sense. our education in the public sector should not be out of our own pocket. >> reporter: thank you for joining us. the first is saying these tuition increases are absolutely necessary if they will continue with president. janet napolitano addressed the issue just yesterday. >> this is the budget we believe we need and we will need moving forward so that we

get off this year to year feast or famine. >> reporter: now, again, campus police were earlier here monitoring the situation. their actions will determine what they do. students are planning to allow classes to continue here at wheeler hall later on today. now, again, that meeting is expected to take place and students are rallying. the uc regents say a yes vote would fall back in the lawmakers' hand to fund the uc system better. they say if that happens, these tuition increases will not have to go into plate -- into place. we'll continue to monitor the situation here. but for now back to you, christien kafton, ktvu channel 2 news. san francisco is preparing a bid for the 2024 summer

olympics. giants' president larry baerd is leading the committee and ann warner cribs also on the committee. critics have raised concerns about whether tax payers will be left to pick up the costs of hosting the games. the 2008 licks cost $44 million. 7:07. right now, in oakland, big rigs are backed up at the port of oakland. they are trying to pick up or drop off cargo. ktvu's tara moriarty live at the port of oakland to tell us why things have come to a halt at one of the busiest ports on the west coast. >> reporter: that's because a longshoreman died on the job yesterday. as is typical, longshoreman take 24 hours to investigate that. right now, there are a couple of stragglers. for the most part a lot are

taking off. longshoremen are in a safety standdown for the a 7-year-old who died while climb up the stairs on a ship. they say he suffered and yasma -- asthma attack. many traveled from far away and will miss wages. >> i've lost about three days worth of work. >> been in and out but you get stuck in there for seven hours. >> reporter: and now this? >> now this. >> safety standdown occurs when someone dies on the job. it means that folks gather

facts, they gather information make sure that the workplace is safe and secure for folks to return. >> reporter: that truck driver said he's lost so much money for the last three days. ports along the west coast have been coming out of a slowdown. now, the longshoremen's union says the slowdown is not due to contract talks but rather a shortage of truck drivers, containers and wheels. as we mentioned, there are still quite a few folks here -- i don't know if they are sleeping in the cabs or are waiting for somebody to come out and to confirm that the port will be shut down. it will not reopen until tomorrow morning. tara moriarty, ktvu channel 2 news. >> thank you. 7:09. well, tonight, president obama will make a televised speech to the nation which you will see here on channel 2. on his plans to tackle immigration reform with executive action.

>> everybody agrees that our system is broken. unfortunately washington has allowed the problem to fester for too long. >> now, yesterday, in this video, the president gave no specifics of his plan but said he was ready to bypass congress and roll out several reforms. the president's action would reportedly grant legal status to as many as 5 million undocumented immip grant -- immigrants, including work permits. activists applauded but republicans are criticizing the move. >> right now, we have people who are parents of citizens, minors that we expect for them for -- it's a huge victory. >> he should wait until the new congress comes in, bring in the leadership from both parties, sit down and discuss it, go back to the congress and have a bill drawn which is the proper way to do it.

7:15. one of the most acclaimed directors in american movie history has died. mike nichols was 83 years old. his work includes classic films as the graduate, karnal knowledge and who is afraid of virginia wolf. he was a writer, producer. an incredible career that spanned 60 years. he was one of 12 people to win all four u.s. major entertainment awards, an emmy, gram mip, os -- grammy, oscar and tony.

he was married to diane sawyer. we are annoy hearing from the woman who plans to marry convicted murderer, charles manson. >> people think you are crazy. >> i really don't care. >> atton burton says she does plan to take manson's name once they are married. the two obtained a marriage license earlier this month and they have 90 days from that date to get married at state prison. the 80-year-old manson is serving a life sentence for the murders of actress sharon tate and six other people in los angeles in 1969. burton claims he's innocent. >> are you in love? >> yep. why would i marry somebody if i wasn't -- >> i'm just asking. people get married for all kinds of different reasons in this country. >> well, i wouldn't. >> burton's mother is weighing in. she says she does approve of the marriage and believes that

manson loves her daughter but she will not be attending the wedding. >> guy marriage advocates are speaking out. some are angry that a convicted murderer can get married but many gay couples cannot. right now, 17 states have laws that ban same-sex marriage but many laws are in the process of being chapped in court. in a half-hour from now, santa cruz high school will open as scheduled after the threat of a mass shooting forced the school to close yesterday. school administrators are confident students can safely come back to school. the scare started after an e- mail was sent to the santa cruz high principal threatened a mass shooting on wednesday. it detailed the time, the location and the weapons that would be used. >> you can't completely get rid

corner because of this crash on the upper deck. now, even if they get this crash out of the way, you can add time to the bay bridge. it takes a long time for these things to unwind. and you should leave the house early if you can or think about using public transportation. thank you, sal. 7:26. danville police hope you will recognize a burglar caught on surveillance cameras breaking into a restaurant. it happened november 7th just after 5:00 in the morning. you see him walking outside and then smashing the glass door of the mexican restaurant. he then rummaged through a back room office in a restaurant. you can see this on another camera. if you have any information about the break-in or who the man is, you are asked to call danville police. police in palo alto hope will reck nibs the thieves caught on -- recognize the thieves caught on surveillance camera breaking into a home. one of the men went upstairs and stole a computer and jewelry. the other man ripped the

security camera off the wall but the images had already been uploaded to the homeowner's surveillance system. if you have information, call palo alto police. this morning, computer security experts are telling people with webcams, baby monitors ndz and home surveillance camera cameras to change their passwords now. britain's commissioner's office says a website based in russia is posting live footage of homes and businesses by using the default log-in credentials for thousands of cameras. many people don't bother changing the default password which is often a simple 1, 2, 3, 4. many manufacturers post default passwords online. 7:27. dozens of people evacuated from a psychiatric facility in san jose. early this morning, what firefighters believe may have sparked the fire that sent people scrambling. and we're live in san francisco noe valley where an

yesterday's front came in from the west. it was good rain from marin county up to sonoma county. after that, it wasn't too much. we picked up some. we'll pick up some later on. this will be a colder system. you can see radar continues to show, not much. trying to. but there's better activity off the coast and some of that will start to move in for the next few hours. the low will be beneficial for the sierra, finally give them some snow. 50s on the temps. 50 to 56. there's one system, the second system will come in on saturday morning. today's system will pick up rain rates as the front slides through. cloudy, thig, morning fog. cool to mild. upper 50s to some low 60s for many. here's sal with a lot of pictures. mainly san mateo bridge, i've seen. >> one of my friends said, you just the bearer of bad news. >> you. >> not you. me. at least now. i mean, there's a big crash on

the bay bridge that i have to tell you about. i have to be the bearer of bad news. that bridge commute into san francisco has just gone to awful because of a crash up on that deck. this is the second time this week that the commute here at the toll plaza looks like it's standing still coming into san francisco. there are -- this -- this is just 35, 40-minute delay getting into san francisco. we look at the eastshore freeway from the carquinez bridge to the maze. it's 33 minutes just to get to this point. and then you will be waiting another 40 minutes to get on the bridge. it's awful. you might want to think about using public transit today. it's a good idea. this evening we'll have some rain in the commute as steve mentioned. that will be another bad commute getting out of the city. you should seriously consider doing what you can to avoid being in the car today. let's take a look at the commute on the peninsula. southbound 101, see some slow traffic there heading down the peninsula from the airport to san mateo because of earlier issues. 280 is the better route.

7:33. back to the desk. happening right now, in berkeley, dozens of students and community activists are still occupying a main building of the uc -- we're live now. our camera just changed. we're live in san francisco right now. uc regents will be meeting here later on today. you can see demonstrators and protesters are already outside waiting for the regents to i a -- to arrive. the big issue, raising tuition in the uc system. this is where the regents will be coming to meet in san francisco. you can see the student protesters are already gathering. they don't want the tuitions to be raised. that vote expected today in san francisco. meantime, at uc berkeley on the campus, some of the students camped out. they took over a building through the night. slept on the floor and even

though they were on the floor, they tried to be comfortable. you can zee they had on a laptop computer, a video of logs burning on a laptop computer. a fireplace and the number of students now, it was packed last night but those numbers are dwindling at the height of the sit-in. there were 200 demonstrators in the place. we'll keep an eye on what's happening on the uc berkeley campus. you will get a live all right at 8:00. we'll keep an eye on what's happening in san francisco. 7:35. a warning for parents at a san francisco school after an attempted child abduction. ktvu's brian flores is live in san francisco to let us know how the boy is doinged and how the school is -- doing and how the school is handling the situation. >> reporter: this with unparent's worst nightmare if you have kids in elementary school or any school for that matter this is something you don't want to hear. we're live in noe valley in front of saint phillip's, the apostle school.

yesterday afternoon there was an adebted kidnapping of a boy. luckily he was able to escape too a nearby cafe but this morning there's followup, especially talking with parents this morning, getting that message a i cross. i'm here now joined with the principal. thank you for your time this morning. what's gonna be happening today in the wake of what happened yesterday? >> well, at the morning assembly, i will acknowledge that we had a situation and assure the kids at that point that everybody isock. but in the classroom -- is okay. but in the classroom, i will be meeting with the counselors, in case there's students or a group of kids that would like to vent about it or be concerned about it or be reassured. i will also be sending some instructions to all of the classrooms this morning about what they can talk about the kids. what they should talk about regarding dismissal procedures. you know, what to do if they are walking home, what to do if

their parents are delayed in picking them up and where to stand. >> reporter: this happened at 3:40 in the afternoon. this was after school happened. >> a half-hour after the older kids were dismissed at 3:15. >> reporter: and we're talking about what this boy did. i mean, i don't know if you trained him or if his parents trained him to scream and to run like that. but talk about how doing what he did possibly saved his life. >> we're very proud of our student because he did exactly what his mother and father taught him to do because in part of the interview, they were talking about how she was reassuring her son about how he did everything he was supposed to and she was glad that they practiced it. so it did come from the parents. we're very proud that he was -- i wouldn't say calm but aware enough that this was not a good situation and he followed some

steps. >> reporter: thank you for your time. >> thank you. thank you. >> reporter: again, police are still looking for the suspect described as a latino man between 5'9", 5'10" wearing a light gray or white sweatshirt. if you have any information on who this person is, please call san francisco police. we're live in noe valley, brian flores, ktvu channel 2 news. >> all right. thank you, brian. 7:38. new this morning, san jose firefighters investigating an early-morning fire. it happened here at a psychiatric facility. started about 4:15 this morning on north fifth and st. john streets. but it was quickly put out. no one was hurt. but the three dozen people who live there had to quickly leave that building. >> residents were being evacuated from the house. there was a report of a resident that had a five extinguisher that started to put the fire out. >> firefighters believe someone smoking out on the porch may have started that fire. time is 7:38.

dozens of people gathered outside of san francisco's youth guidance center last night demanding that a teenaged boy who is accused of killing another teenager be tried as an adult. >> what do we want! when do we want it! >> now! >> about 50 family members and friends of rashawn williams showed their resolve with this rally out in the rain. the 14-year-old high school freshman was stabbed to death outside of a mission district market back in september. the suspect in the case is also 14 years old. the williams' family said the punishment should fit the crime regardless of his age. >> if he's try as a juvenile, the maximum sentence will be seven years if convicted. we want to maker an exception in san francisco -- to make an exception in san francisco to try him as an adult and he would face 25 to life. >> a juvenile court judge will decide if the teenager should be tried in adult court.

next hearing in this case is set for december 3rd. 7:39. we're learning new details about an overnight shooting at florida state university that injured three students. it happened early this morning in a library on the school's campus in tallahassee. at least one of the victims is in critical condition. the gunman was killed by police after they say he refused to drop his weapon. police say hundreds of students were inside the library when the shots were fired. >> at the time stroezer library was packed with students studying for final exams. our estimates are 300, 400 students. >> officers are still investigating the circumstances of the shooting and have not said whether the gunman was a student. the campus is open today. but classes have been canceled. a few earthquakes locally overnight. there was a 2.7 a mile from condition cord at 3:46 this morning. there were also two quakes

centered in the monterey area. the usgs says a magnitude 3.8 earthquake struck near san juan batista around 150:21 last night -- 10:21 last night. it was followed by a 4.2 earthquake five minutes later in the same spot. all of the quakes were melt -- both of these quakes, rather, were felt in the south bay, including san jose, morgan hill, gilroy and even santa cruz. but there were no reports of serious damage. it is 7:41. it's the interview bill cosby did not want to ever see the light of day. coming up in the next hour of "mornings on 2," what the comedian said when a reporter flat out asked him about sexual assault allegations. also a class-action lawsuit targeting a giant of the cosmetics of the industry. the claim of discrimination against certain customers. you could think about using an alternate route to the bay bridge. that would be the bridge. it will be heavier there but it

the cosmetic company sephora is accused of racism. four women have filed a class- action lawsuit claiming their accounts were blocked because of their names. pam cook is in the studio with more on the suit and the website crash that sparked the controversy. >> the lawsuit filed claims the company discriminates against asian-american customers. it all started november 6th

when a huge sale caused the website to crash. the company says it was caused by a glitch connected to bulk shoppers. they say the bulk shoppers buy bulk items and resell them for a profit. the lawsuit claims only customers with asian names or e- mail addresses from chinese domains were blocked from the site. the suit says thousands of shoppers may have been affected by this discriminatory action. so far, no comment from sephora and no comments from the parent company which is also listed as a defendant in this lawsuit. dave? >> thank you. three berkeley police officers showing their artistic skills as they help needy families for this holiday season. it's their photography that took center stage during this fund-raiser called art and the badge which will help buy

rainer. that will give maybe a couple of inches of rain much needed to the north especially santa rosa. they are only 34% of normal for the season. 49 for san francisco. that will pick up. snap is 52. they've only had 1.14. there's areas around san jose that have had more than that. you can see the system is getting closer. the rain is on the way here. but it should start to move in around 9:00 for some. noon for others. this has the low dropping us over us. that helps. even some colder air which is not what we've had. we've had mild systems coming in. this will bring snow to the sierra. snow level lowered. 50s on the temps. this system comes in today, tonight and takes us into a break on friday and then the next system on saturday. so all told, it looks like we'll get three out of the pattern before it starts to build in. high pressure on sunday/monday. tonight will be system number 2. .25 to an inch and maybe more on the third system by saturday. not bad rain totals projected

this happened last night around 7:30 in san bernardino county. the police are still out there investigating but say this was not caused by natural gas. this area now declared a crime scene. police are investigating whether this was a drug lab. a bomb's listed in critical condition after suffering severe burns in a fire at her home in pleasant hill. the fire reported late yesterday afternoon on cleveland road near gregory lane. emergency crews found the injured woman inside the home. she was rushed to john muir medical center in walnut creek. later was taken to uc davis medical center. it's still not clear how the fire started. 7:55. the secret service arrested a man at the white house who had a rifle and ammunition in his car. the 40-year-old man from iowa approached secret service officers yesterday at a white house checkpoint. he reportedly told the officers that someone in iowa told him that he should go to the white house. police then searched his car and found a rifle with more

than 40 rounds of ammunition inside. the man was arrested and charged with possession of an you an edge -- of an unregistered firearm. a proposal in utah to bring back the firing squad is moving forward. the law would allow a firing squad to carry out an execution only if lethal injection is not available which is currently the case. european drugmakers are refusing to sell the three-drug combination used to execute inmates out of opposition to the death penalty. states across the country have been using different lethal drugs which has sometimes led to botched executions and challenges in court. utah's bill to reinstate the firing squad now heads to the full state legislature for consideration. 7:56. a woman whose body was found hon a rural stretch of highway 29 in napa county sunday morning has been identified. a 7-year-old maria cruz behar

a cal campus. dozens of demonstrators have been occupying a building at uc berkeley. as we just saw at the top of the hour, they are starting to take some more action and christien kafton joins us live now to tell us what's going on. >> reporter: yeah, we've had a lot of developments here in the last hour. let's give you a live look. there is an ongoing meeting and a series of votes. one of the votes they just took was to lock or restrict access to wheeler hall. you can see there is a sign posted on this door. there is also a lock down here lower so this door is out of service. there will be no classes conducted or no education going on here at the wheeler hall. they had a little bit later on allow students to come in and have access through some of the side doors. for now, they want this area here where you see all of the students gathering right now as an open place for education. we can tell you that the major issue is the proposed tuition

increases. students are opposed to the proposed 5% tuition increase, each year for the next five years. a student protest began at 7:00 p.m. hundreds slept in the hallways. students say the hike -- proposed tuition hike would hit them ard. >> we want the regents to vote no on their proposed tuition hike. >> we want full finance am transparency of the uc budget as required by the law. we would like the u cu. re-- uc regents to trop charges against a student who was arrested yesterday on charges of insighting a riot. >> reporter: they say the move is necessary, the board. they say unless the state puts more money into the system, the tuition increases will be a necessity. >> this is the budget we believe we need. and we will need moving forward

tara moriarty joining us live at the port of oakland to tell us why port operations have come to a halt. tara? >> reporter: yeah, most of those trucks have now gone actually. some of them stuck around until 7:30 just to see if the port would open. no such luck and earlier a security guard went around knocking and breaking news. >> we're closed today, bro. we're gonna be closed until tomorrow morning at 6:00 a.m. >> okay. >> reporter: longshoremen are in a safety standdown for 57- year-old thomas hoover who died died while climbing stairs on a ship. they say he possibly could have suffered an asthma attack or a heart attack. an autopsy will determine that. many truck drivers were upset they were losing a day's worth of wages because of the closure but most were understanding. >> well, it's like another death in the family. people are gonna do what they have to do. oh, well. i will just go home and call it

police say a young boy was almost kidnapped yesterday. ktvu's brian flores is out there. coming up in minute, brian will tell us all of the right things that young boy did that kept him from being kidnapped. stay tuned. good morning. thank you for joining us. thursday, november 20th. i'm dave clark. let's talk your weather and traffic and steve, fog is a big part -- >> a lot of fog. rain starting to pick up. up in lakeport, reports there, forestville and cazadero. there's a little bug going around. if you have that, you have picked a great day to hunker down. it's gray, gloomy. rain beginning to move in especially to the north. if you are heading to the raider game, plan on taking the rain gear. it does not look that great. maybe the rain might be slowing down by then. i think it's too far into the window. it looks like the front will be moving through at that time. maybe sooner. but it looks like a rainy day.

cloudy, foggy. the rain will pick up in the next exesm hours to the north and for everyone else around the noon hour through most of the afternoon and evening. you can see some of that rain moving in. lake county, mendocino county. and then now starting to move in towards the russian river. nothing too heavy but it's picking up. there's our front. this one has a little bit more going for in the form of colder air. also a low. 50s on the temps. they've not budged all morning long. look for fog and rain to move in. it looks like a cloudy, gray, rainy day. thick, morning document. some of that might lift. when up get the rain, it will pop up. 50s on the temps. sal, i know we've had a lot of fog. any issues on the traffic. the visibility has not been great. i think the biggest issue is the rain and the wet roads. you can tell what i'm trying to say, it's been a very slow commute. east shore, 50 minutes to drive what should take about 20 minutes between the carquinez

bridge and the macarthur maze. when you get to the bay bridge toll plaza, you will see a backup of 25, 30 minutes. it's slow going because of earlier problems. it has been very slow. south bay commute is now beginning to finally get really heavy. 85, 280 and 101. we haven't had too many things going on. we had a couple of issues near 101880 and 880 itself is slow. it's improved from hayward to fremont. things are not sure. i just had a feeling things are getting worse and worse if more weather comes in. let's go back to the desk. >> there is a warning this morning for parents of a san francisco school after an attempted child abduction. brian flores joining us live in san francisco to tell us how the boy is doing and hown the school is handling that situation -- and how the school is handling the situation. >> reporter: scary situation for any parents out there. earlier in the morning, we did speak with the principal at saint fill im's apostle school. she says this morning.

-- saint phillip's apostle school. she says she will be holding an assembly to discuss this. in terms of the details, it happened around 3:40 yesterday afternoon. school officials say a 7th grade boy left the school on elizabeth drive when he sensed someone behind him. he didn't think it was a good situation. so he ran and the man behind the boy chased after him as well. officials say the boy screamed as loud as he could and ran to a place called diamond cafe which is about a block away around the corner from the school. after getting to the cafe, he called his grandmother immediately to pick him up. they both then returned to the school to report the incident to officials and police. another girl from the school also reported seeing the man chase the boy. school officials are saying the boy did exactly the right thing in that type of situation, running away as fast as as he could. also screaming getting the attention of anyone who could hear him. we did speak to nervous parents. >> terrified.

officer. they say they are partly here because of this attempted kidnapping from yesterday. it's also unclear whether this.attended the school but talking with the principal this morning, she says that he is doing okay. but obviously this was a very traumatic experience. we're live here in san francisco's noe valley, brian flores, ktvu channel 2 news. >> thank you. 8:36. new details about that terrifying overnight shooting at florida state university where three students were hurt and the gunman was killed. it happened early this morning in a library on the campus in tallahassee. at least one of the victims is in critical condition. that gunman was killed by the police when he wouldn't drop his gun. police say hun cepedz of -- hundreds of students were in the library when the shooting started. >> at the sometime dozer library was packed with students studying for final exams. our estimates right now are anywhere from 300 to 400 students. >> police are still investigating the circumstances of the shooting. they haven't said whether that

gunman was a student or not. the campus by the way is open today but classes are canceled. happening today, a large piece of artificial turf that was stolen from a church in hayward, it will be replaced this morning. the 900-square foot turf was stolen from the bayhills community church last month. we told but that this week. well, the pastor says the owner of the company that originally installed the turf saw the reports. he offered to reinstall new turf for free. sephora is accused of raisism. four women have filed a class- action lawsuit claiming their accounts were blocked because of their names. pam cook is in the studio with more on the suit and the website that crashed that caused the controversy. >> the lawsuit claims the company discriminates against asian-american customers. it all started november 6th when a huge promotional sale caused the website to crash.

the company says the crash was a technical glitch becaused by bulk shoppers. sephora complaints the shoppers buy discount items and resell them for a profit. as a result, customers could not access their accounts for hours. the laupt claims after seeing complaints on facebook, only customers with asian names or e- mail addresses from chinese domains were blocked from the site. the suitcase thousands of shoppers may have been affected by this tis crip -- discriminatory action. the suit also claims the company posted a comment on the facebook page after the crash that says we've deactivated accounts due to reselling. i just looked at sephora's facebook page. i did not see that post but i do see complaints after that crash from customers. but they seem to come from people from all over the world. tori and dave? if you use an iphone, you will notice a big change in

apple's online app store today. in the past, if an app contained a costly upgrade, it would still carry the label "free" but the word is being replaced with the term "get." the technology website is speculating that european regulators are pressuring apple to better protect children from signing up and purchasing apps without the approval of their parents. consumer groups have sued apple over this issue. the company eventually agreed to refund nep customers who unwittingly did -- any customers who unwittingly did a. scary moments for pilots at j.f.k. what they saw moments before landing and why safety experts are calling it a potential disaster. also bringing back firing squads. the state that's thinking about that and the one thing that could keep this from becoming reality. it's pretty slow out there. we've had a couple of accidents to blame. if you are trying to get to the

happening today, in fact, in less than nine hours, president obama is going to address the nation with details of his executive action on immigration. the white house released these photos of the president preparing for his prime time speech. president obama is following through with his vow to circumvent congress to protect nearly 5 million undocumented immip grants from deportation. this bold move is not only sparking spirited debates and heated reaction but possible legal action as well. to help us make sense of this move and how it will affect the law, university of san francisco political science professor corey cook joins us now by phone. good morning, professor. >> good morning. good to be with you. >> so tell us, i know that this action would not lead to a path to citizenship. what does this mean? what is the president going to announce? >> he has not released the details. what we're hearing, he will offer a brief respite for 4

million to 5 million. we'll seal how brief it is. it will affect 4 million to 5 million people. it will allow the folks to stay in the country without fear of deportation. this will be a temporary reprieve. we'll seal how temporary it will be. as a way of delaying enforcement of deportation proceedings. >> the president and his supporters think this is legal. he said on facebook, the president said i'm gonna lay out the things that i can do with my lawful authority as president. but republicans are adamant that this is illegal and unconstitutional. who is right? >> well, i think legally the president is right. the president can set deportation priorities, that's clear. i think as long as he's off rating within parameters, he's operating within his authority. this is limited. we're talking about 11 undocumented immigrants that

face deportation. we're talking about 4 million to 5 million of them. he's working carefully to be within the law. i think the republican response will be fascinating. will they brick a lawsuit? defund federal agencies. >> you know, a lot of people are wondering with -- honestly, the shellacking that the democratting got in the election a few weeks ago, why would the president deliberately try to thusm his nose to the gop -- >> well, i think the sense is, you know, that immigration reform is effectively dead in the congress and so the president's is arguing if congress can act that he needs to -- can't act he needs to. the congress -- it puts the ball in their court to act. i think the president senses now is the time to move the ball down the field a little bit at least and require the congress to do something.

because it seems that immigration reform is simply gonna be gridlock in the congress. >> last question. already i heard thousands of immigrants are calling attorneys and immigration advocates to ask how they can qualify for protection and legal work permits but i assume it's early for that. >> it's early. it will become clear. it will become much more clear at 5:00 today. i think much more clear in the next few days to see how this will be played out. which groups will be covered by the new regulations who can apply for this deferred action. i think -- it's a little bit early for that. i think it will come quickly. this has been in the works since may of 2013. >> so if anyone thinks they are qualified, what should they do after 5:00 today? who should they contact? >> there are a lot of fantastic immigrant rights organizations in the bay area in the 50e69 bay and san francisco. i think they should start to pay attention to the organizations who have legal

8:55. new information that just came in about the overnight shooting at florida state university that left three students injured. police just identified the shooter as an attorney who graduated from the university. officers say he opened fire in the library at the campus in tallahassee. the gunman was killed by police when he refused to drop his weapon. police say hundreds of students were in the library when the shots were fired. no word on a possible motive. in utah, a proposal to bring back the firing squad for state executions is moving ahead. the law would allow a firing squad for an execution only if lethal injection is not available. that's currently the case. european drugmakers are
