was shot and killed on august 9 by officer darren wilson. the shooting has ignited racial tensions and the debate over police tactics. and tonight a grand jury decided whether charges should be filed against the officer. good evening everyone. hello. i am frank somerville. >> and i am julie haener. >> we have live team coverage tonight. ktvu channel 2 news crews are in san francisco and oakland. and we are monitoring the situation in ferguson. >> here is what we know right now. the grand jury reached a decision and the governor called in the national guard protect facilitys including fire houses, police stations and -- facilities including fire houses, police stations and schools will be closed tomorrow. michael brown's family asked protesters to observe 4-1/2

minutes of silence after the grand jury's decision is announced. that 4-1/2 minutes is to symbolize the 4-1/2 hours that michael brown's body lied on the streets after he was killed. >> people have been gathering all day. hours ago missouri governor called for calm. they say free speech rights will be protected but not that expense of public safety. >> we all may experience inconvenience during the coming days. depending on the circumstances we may allow demonstrators to slow down traffic but we will not allow them to hurt anyone or damage anyone's property. >> we are all focused obmaking sure -- on making sure the resources are at hand to protect lives, protect property and protect free speech. >> the governor said several churches will provide shelter and medical care.

>> again here the grand jury can decide a couple of different things. they could decide no charges should be filed at all. they could charge officer darren wilson with murder. or they could charge him at the lesser end with second degree involuntary manslaughter. the picture on the right side of the screen is where the decision expected to be announced at any moment now. the bigger picture there, the protesters gathering on the streets there in ferguson, missouri. we have seen in the past hour or so those crowds have built up with a lot of people. everyone, everyone is calling for calm, including michael brown's parents, michael brown's father ushued a statement last week -- issued a statement last week saying hurting others or destroying property is not the answer no matter what the grand jury decides. >> we are waiting for the

decision. the grand jury decision to be announced in ferguson, missouri. it is now just after 8:00 p.m. in missouri. just after 6:00 p.m. here. we are looking live at downtown oakland where protests, demonstrators planned demonstrations on both sides of the bay, in san francisco and oakland. you can see it looks like police cars to the right there. some people out on the streets gathering in anticipation of this grand jury decision. in the shooting death of michael brown that occurred three months ago. at issue whether the officer darren wilson will face charges in the shooting death of 18- year-old michael brown. >> from oakland, to san francisco. there are also questions about what may happen in san francisco once the grand jury's decision is released. ktvu's david stevenson is in the city tonight. what is the feeling there? >> reporter: there are a dozens organizers and 10 or so people

who stopped by. they are counting down a the grand jury announcement and making sure the neighborhood is aware of what is ahead tonight. >> reporter: making their way home tonight that b.a.r.t. station. organizers say it was important to turn out even though some said they do not expect an indictment in the case. >> i would -- if i would bet the ranch i would bet the grand jury is not going to indict because he is a policeman. and because the whole thing has been a sparse. >> it is an injustice. the fact he lost his life. it took so long to bring about justice. we rarely see cases cases -- [ indiscernible ] >> reporter: after the grand jury announcement demonstrators

will march down had street to the -- down the street to the b.a.r.t. station. we have seen little police presence. police expect rallies in san francisco to be peaceful but they are prepared if things get out of hand. demonstrationers expect tonight's -- demonstrators expect tonight's protest to prepain peaceful. >> -- repain peaceful. we are -- remain peaceful. >> we are waiting and watching. in the meantime cristina rendon is live in oakland with the situation there. >> reporter: yeah. you know, this protest is not scheduled to start for another hour. what we have seen, it has grown to 200 people here at 14th and broadway in downtown oakland. people just keep arriving as protesters are chanting

different phrases. as we said this protest hasn't started but this is what is unfolding on the streets of downtown oakland. all the protesters plan to keep this very peaceful tonight. they do not want this to turn violent. everyone here is hoping things stay peaceful. especially the police. we had talked to them earlier. what you don't see are the police officers that rin the background. they are beefing up that are in the background. they are beefing up security. everything has been peaceful and they are just expressing their right to talk on the streets in the public. we don't know what the decision is going to be but we can hear from the protesters that if darren wilson is not indicted they will be very unhappy despite michael brown's family calling for very peaceful protests. again, we are waiting to hear what the decision will be but

already a very loud crowd gathered in downtown oakland in anticipation of the grand jury decision. >> have they said what they plan to do with the protests and is 14th and broadway still open right now? [ indiscernible ] >> let's go up to news chopper 2. this is the intersection there of 14th and broadway. by city hall and frank ogawa plaza. looks like traffic is being effected but that is broadway and it is still moving in both directions. we don't know what the protesters have planned for this evening but we have seen there is some concern about business owners in downtown oakland. in the past as the eve goes on in -- evening goes on in some cases some groups caused destruction. that is what everyone hopes does not happen tonight but

some businessesorded up their -- businesses boarded up their winds -- windows. >> once again we are waiting, watching for the announcement. as soon as it comes down we will bring that to you. there are other stories making news, we want to get that to you as we wait for the word in missouri. it happened again. another security breach at san mineta international airport. he can't figure out why this keeps happening. ktvu's azenith smith spoke with the mayor today. what is he saying about this? >> reporter: the mayor tells me that the airport, the tsa, they are looking to see if the security measures are sufficient enough following yesterday's breach. as of right now, they say they are. >> reporter: san jose mayor says he was surprised to hear of another security breach at

mineta international airport. it is alarming for some people, it is the third security breach at this airport this year. police arrested a 39-year-old after employees spotted him on the tarmac. they caught him but not before he stole a truck and tried to bolt to the other side of the airport. >> i am concerned. i don't know why people are choosing our airport to do all these activities. >> reporter: this latest breach comes after two other cases. in august a woman boarded a flight to los angeles international airport and in april a 15-year-old hopped the fence and survived a flight to hawaii in a wheel well. he was detected right away. no one is saying what new measures have been put in place. while the mayor and city counsel aren't calling for tighter restrictions, a congressman is calling for a

continuing coverage on our breaking news out of ferguson, missouri. live pictures here of all of the protesters out on it street. everyone waiting to find outlet what the grand jury in the -- out what the grand jury in the shooting death of michael brown has decided. michael brown shot and killed by a police officer in ferguson. the grand jury has several

different choices. they could decide no charges, they could decide second degree manslaughter, which would call for four years or charge him up to murder. they could recommend murder charges. 12 jourser -- excuse me, 9 were white, three of them were black. their decision expected -- was expected at 6:00 p.m. they are running behind. it could come down at any moment. >> the announcement will be made in clayton, missouri. barricade are around the building. 20 missouri state troopers were seen ademblack with rifles, baton -- assembling with rifles, batons. again, live pictures of a large crowd in ferguson, missouri.

also, protesters gathering here in the bay area as well as other parts of the country. los angeles, and new york. we have our crews stationed in san francisco and oakland. we want to show you a live picture from downtown oakland. the crowd here has gathered at 14th and broadway in downtown oakland. there are protesters who are getting misinformation here in the bay area. protesters have been hearing there has not been an indictment. the announcement has not been made yet in missouri. we are awaiting that word from missouri. you can see the protesters gathering right now in oakland at 14th and broadway. we are getting a 2 minute warning the announcement could be coming in 2 minutes. >> again, this is a key intersection in downtown oakland. this is the scene of -- every time there is a protest this is where they begin. let's go now to missouri and

the grand jury announcement. >> i have a statement and then we will answer questions when we are finished with that. the first and foremost, i would like it extend my sympathies to the family of michael brown. i said in the past i know that regardless of the circumstances here they lost a loved one to violence. and i know the pain that accompanies such a loss knows no bounds. michael brown was shot and killed by darren wilson. within minutes accounts of the incident began appearing on social media. accounts filled with speculation and little if any accurate information. almost immediately neighbors began gathering and anger began because of the descriptions descriptions of what happened and the tensions. the st. louis county police conducted an investigation that

crime scene. at times under trying circumstances. interrupted by gunfire. along with the agents of the federal bureau of investigation at the direction of everett efudex at the direction of attorney general eric holder. the investigation and review of this tragic death might not be full and fair, i decided immediately that all of the physical evidence gathered, all people claiming to have witnessed any part or all of the shooting and any and all other material would be presented to the grand jury. the grand jury selected by a judge in may of this year long before the shooting occurred. i would like to expand upon the cooperation between the local and the federal authorities. when attorney general eric holder announced the federal

investigation days after the shooting he pledged federal investigators would be working with local authorities as closely as possible at every step of the way and would follow the facts. our separate investigations followed the trail of facts with no preconceived notion of where it would take us. our goal was that our investigation would be thorough and complete to give the grand jury, the department of justice and the public all available evidence to make an informed decision. all evidence obtained by federal authorities was immediately shared with st. louis county investigators. like wise all evidence gathered by st. louis county police was immediately shared with the federal investigators. additional the department of justice conducted its own examine of all the physical evidence and performed its own autopsy. another autopsy was performed at the request of the brown family and all of this

information was also shared. just as importantly all testimony before the st. louis county grand jury was immediately provided to the department of justice. so although the investigations are separate, both the local and the federal government have all of the same information and evidence. our investigation and presentation of the evidence to the grand jury in st. louis county has been completed. the most significant challenge encountered in the investigation has been the 24 hour news cycle and its appetite for something, for anything to talk about. following closely behind with the rumors on social media. i recognize, of course, the lack of accurate detail surrounding the shooting frustrates the media and the public and helps breeds suspicion. yet the closely guarded details, especially about the physical evidence give law enforcement a yard stick for

measuring the truthfulness of witnesses. many witnesses to the shooting of michael brown made statements inconsistent with other statements they made and also conflicting with the physical evidence. some were completely refuted by the physical evidence. before the results of the private autopsy were released witnesses on social media during interviews with the media and even during questions by law enforcement claim they saw darren wilson stand over michael brown and fire many rounds into his back. others claim darren wilson shot michael brown in the back as michael brown was running away. however once the autopsy findings were released showing michael brown had not sustained any wound the back of his body, no additional witnesses made such a claim. and several witnesses adjusted their stories. some even admitted they did not witness the event but repeated

what they heard in the neighborhood or assumed happened. almost all initial witness interviews, including those of darren wilson were recorded. the statements and the testimony of most witnesses were presented to the grand jury before the autopsy results were released. by the media. and before several media outlets published, the jurors were therefore prior to the time that information going public and what followed in the news cycle the jurors were able to have already assessed the credibility of the witnesses, including those witnesses who statement and testimony remained consistent and were consistent with the evidence in the case. my two assistance began presenting to the grand jury on

august 20. the jurors gave us a schedule of when they could meet. all 12 jurors were protect for every session and all 12 heard every word of testimony and examined every titem of evidence. -- item of evidence. the grand jury worked tirelessly to examine all of the testimony of the witnesses and all of the physical evidence. they were extremely engaged in the process, asking questions of witnesses, requesting specific winds, requesting specific information -- witnesses, requesting specific information. they met on 25 separate days. heard more than 70 hours of testimony from 60 witnesses. and reviewed hours and hours of recordings of media and law enforcement interviews by many of the witness whose testified. they heard from three medical

examiners and experts on blood, dna, fire arms and drug analysis. they examined hundreds of photographs. they examined physical evidence. they were instructed on the law and presented with 5 indictments. their burden was to determine based on the evidence if probable cause exists to believe a crime was committed and darren wilson committed that crime. there is no question darren wilson caused the death of michael brown by shooting him but the inquiry does not end there. the law authorizes a officer to use deadly force in certain situations and allows all people to use deadly force to defend themselves in certain situations. so the grand jury determined whether darren wilson was

thegressor or whether -- the aggressor or whether or not darren wilson was authorized to use deadly force in the situation or if he acted in self-defense. i detail this for two reasons. first, so that everyone will know that as promised by me and attorney general eric holder there was a full investigation and presentation of all evidence. and second, as a caution to those in and out of the media who will pounce on a single sentence or witness and decide what should have happened based on the tiny bit of information, the duty of the grand jury is to separate fact from fiction. after a full and impartial and critical examination, they accepted and completed this responsibility. it is important to note here

and say again that they are the only people, the only people who have heard and examined every witness and every piece of evidence. they discussed and debated the evidence among themselves before arriving at their collective decision. after their review of the evidence the grand jury deliberated over two days. making their final decision. they determined that no probable cause exist to file any charge against officer wilson and returned a no true bill on each of the 5 indictments. the physical and scientific evidence examined by the grand jury combined with the witness statements supported by that physical evidence tells the accurate and tragic story of what happened. a very general synapsis of the evidence presented to the grand jury follows. please note as i have promised the evidence presented to the grand jury with some exceptions and the testimony of the

witnesses called to the grand jury will be released at the conclusion of his statement. at 11:45 a.m. on saturday the 9 9th of august furring police officer darren wilson was -- ferguson police officer darren wilson was dispatched for an emergency. at 11:53 a.m. while still at the call he heard a radio broadcast for a stealing in progress. the broadcast included a description of the suspect. a black male, white t-shirt, who took cigars. other officers were dispatched to the store. officer wilson remained with the mother till ems arrived to transport them to the hospitalled. he left the complex in his ferguson police vehicle and drove west on canfield.

an additional description of the suspect was broadcast about that time. a head hat, yellow socks and with another male. as officer wilson was attending to his emergency call michael brown and a conpanion were in a -- companion were in a store. michael brown's activity in the store was recorded. video played in august by the ferguson police department shows michael brown grabbing a hand full of sig rilloes. as michael brown left the store someone inside the store called the police. after crossing the street the two walked east in the middle of the street. as officer wilson continued west he encountered michael brown walking in the middle of

the street. he told them to move to the sidewalk. words were exchanged and they continued walking down the middle of the street. as they passed wilson observed that michael brown had cigarillos in his hand and wearing a red hat and yellow socks. wilson radioed he needed assistance. the officer backed his vehicle at an angle blocking their path and blocking the flow of traffic. several cars approached from east and west but were unable to pass. an altercation took place at the car with the officer inside the vehicle and michael brown add the driver's window. during the altercation two shots were fired by officer wilson while still inside the vehicle. michael brown ran east on canfield and officer darren wilson gave chase. near the corner of canfield and copper creek michael brown

stopped and turned towards darren wilson, officer wilson stopped. michael brown moved towards darren wilson several more shots were fired by the officer and michael brown was fatally wounded. within seconds of the final shot the assist car arrived. 90 seconds passed between darren wilson's first contact with michael brown and his compainian the arrival of the assist car. many witnesses were interviewed. several others chose not to talk to the media but contacted law enforcement directly. witnesses were interviewed by local and federal law enforcement. sometimes together, sometimes separately. but all statements were provided to the other parties. all previous statements of wings who testified before the grand jury -- witnesses who testified before the grand jury

were presented to the grand jury. the statements of all witnesses, civilian, law enforcement and experts were challenged, of course, by other law enforcement, by the prosecutors prosecutors and by the grand jury. the method for -- of challenging a statement is to compare it to the previous statements of the witness for consistency and compare it with the physical evidence. physical evidence does not change because of public pressure or personal agenda. physical evidence does not look away as events unfold. nor does it block out or add to memory. physical evidence is constant and as such is a solid foundation on which cases are built. when statements change witnesses were confronted with the inconsistency and conflicts between statements and the physical evidence. some witnesses admitted they didn't see the shooting. or only saw part of the
