protests tonight across the nation from new york city to ferguson to the bay area. now 24 hours after the controversial grand jury decision new details about the evidence in the case. good evening i'm julie haener. >> and i'm frank somerville. tonight for the first time we're hearing from the man who shot and killed michael brown. ferguson police officer darren wilson describes his deadly encounter with the 19-year-old. >> his right hand goes into his waistband. and his left hand is a fist on this side and he starts

charging me. >> coming up, documents and pictures. but first, we go to oakland. there are a lot of shops there, there are a lot of restaurants there. these protesters have been working their way up telegraph. in the last 20 minutes or so we saw them trashing windows and looting a subway. we also saw them throw some kind of incendiary device into that subway. they were also breaking windows at a car dealership and we saw them create a fire, set a fire on telegraph that was spread all the way across the street. more on that is coming up, we're told that there are as many as 350 people gathered right now in oakland. and in the past hour some of those protesters also made their way on to interstate 580 and stopped traffic there for a short time. earlier they also stopped

traffic on interstate 980. ken pritchett has spent much of the night monitoring this protest march. ken is live, tell us what you're seeing tonight. >> reporter: frank all night long these protesters have been a moving target as they made their way through oakland. it was right here at 18th and castro at around 6:30 this evening when protesters were able to make their way on to this onramp and on to this interstate. that seems to be the theme of their movement tonight as they made their way through oakland making an attempt after the other, sometimes successful to stop traffic. the night of protests started at oakland police headquarters with a small group continuing to speak out against the ferguson ruling. >> whether it's oakland, california, ferguson, missouri, or new york, new york, our kids are being killed and officers

are getting away with immunity. >> reporter: at first their numbers stood at around 100. as they made their way down telegraph their numbers grew to 350 or so. people watched from their apartment windows as the crowd moved by. the crowd moved toward interstate i90 they found an opportunity. they found a wide open onramp, no police presence and they occupied the eastbound lanes of i80. followed by the westbound lane shutting down traffic completely. within minutes the chp arrived and with that protesters left the roadway and made their way back into oakland. jr. --

>> reporter: where there was a stand off preventing protesters from taking 880. now in that last bit of video. was the onramp to 880 in the china town area of oakland. it was there where we saw an oakland police officer take a water bottle to the helmet. that was thrown across the police line from the crowd. we've also heard radio chatter tonight of multiple instances of officers being pelted with rocks, bottles and other objects. >> it is a very fluid situation. ken, thank you. back to the pictures we were talking about a moment ago. that subway restaurant on telegraph avenue, this is what happened, you see them there, breaking windows at that subway shortly after that they threw some kind of explosive device into the subway and there you see them going inside and looting that subway. all of this happening in the last 30 minutes or so. >> reporter: we're seeing vandals set fire once again tonight. there's a large bonfire near

38th and telegraph within the past hour you see it there. a line of flames there stretch across the street all within the past hour. we've been watching and monitoring the situation in oakland all night. it seems to have been escalating within the past hour as pockets of demonstrators are on the move across the city. we are going to continue to watch this and as soon as we get more information and new pictures we will bring them to you. now to ferguson missouri, there is a beefed up police presence of law enforcement officers and national guard troops following last night's violence. while there are reports of damage it's not like last night. garrett taney joins us. >> reporter: it doesn't take much for things not to do as bad as last night when more than 20 buildings were completely burned down and businesses throughout the entire street for a mile in

ferguson were broken into and looted. tonight it still is tense just at the ferguson police station right now there's an ongoing stand off between about 100 protesters and groups of police there at the station as well as the national guard which has moved in with a much heavier police presence. they are now guarding buildings especially the ferguson police department and they're working their way into the crowd trying to throw rocks, bottles at police. those protesters broke into smashed city hall as well as a police vehicle there in front. smoke grenades went inside. they evident hi tried to flip that vehicle over before police moved in.

there have been arrests. we're told that tear gas and smoke canisters have been deployed. while things are better it's not the type of clean officers were hoping for. throughout the night that's what we saw until about 9:00 that's when things turned south, julie. >> garrett, thank you so much. now to the release of the interview seen by the grand jury. >> we're also hearing in the officer himself. heather holmes is here now with the encounter that started as a shoplifting call and ended in a shooting. >> reporter: wilson who has been staying out of sight appeared today to talk about that august night. he described the altercation and patrol car why he feared for his life. his decision to pull his weapon and why he has a quote, clean conscious.

now darren wilson is telling his story to the world. >> i didn't know if i would be able to withstand another hit like that. >> reporter: wilson recalled his run in with michael brown. he said i tried to use my right arm and use my left hand to have some type of control and not be tracked in my car anymore. when i grabbed him all i can describe is a 5-year-old holding on to hulk hogan. the prosecutor asked, holding on to what? he said hulk hogan. that's how small i felt and how tall he was. the 6'4", 290-pound brown was described as overpowering. he says quote, he grabbed my gun. he says you're too much of an expletive to shoot me.

i could feel his finger trying to get into the trigger guard and i remember invisioning a bullet going into my leg. i thought that was the next step. >> that's when i pulled the trigger for the first time. >> what happened? >> it didn't go off. the trigger was jammed by his hand inside the firearm. so i tried again. i thought this has to work or i'm going to be dead. he's going to get this gun away from me and something is going to happen, i'm going to be dead. >> reporter: brown then runs away from the vehicle. wilson chases after him. brown stopped, turns and began charging at him again. >> can i shoot this guy. legally can i. and the question i answered myself, i have to if i don't, he will kill me if he gets to me. >> reporter: wilson says there's no way brown had his hands up before he was killed. and he said he would not have done anything differently. >> the reason i have a clean conscious is because i know i

did my job right. >> reporter: wilson says that the shooting had nothing to do with race, that he would have reacted the same if he was white. the grand jury transcripts more than 400 pages long. that testimony seemed to convince the grand jury that he committed no crime. >> and all of that over in nine seconds. the attorney for michael brown's family is now down playing a you tube video showing brown's stepfather and furious reaction last night to the grand jury decision not to indict officer wilson. lewis had repeatedly shouts at the crowd and seems to incite or encourage others to lash out. today the attorney blamed the outfit on the raw emotion of the moment. president obama said today the anger being expressed across the country is rooted in realities that continue to exist in the u.s. >> they have deep roots in many

communities of color, who have a sense that our laws are not being informed uniformly or fairly. >> reporter: in a speech in chicago he said there is no excuse for criminal acts such as burning buildings or destroying property. he says those who break the law should be prosecuted. he early morninged demonstrators the find productive ways of responding. a march in san francisco this evening was peaceful and also noisy. the crowd chanted jail killer cops. about 300 people made their way around the mission district to 16th, then to the mission police station and then back to the b.a.r.t. station. organizers said they aren't just angry about the michael brown case. they are also angry about all people of color who they say are being killed by police who are not being held accountable. and stay with us for continuing coverage. news chopper 2 over head right now at 55th and telegraph as

that's the power of local connections. that's bank of america. now to breaking news, two b.a.r.t. stations are closed right now. one in the east bay and one in san francisco. the embarcadero station closed about 20 minutes ago. there was a person under a train. we don't know the condition of the individual. trains are not stopping at the embarcadero station and obviously that is leading to delays. the downtown berkeley b.a.r.t. station is also closed after a person was found dead under a train there. that happened at about 6:30 this evening. b.a.r.t. trains are not stopping at the station so that the body could be removed. right now there's no

identification in either incident. now to new information about a deadly shooting tonight along a hiking trail in the oakland hills. a female hiker reported hearing gunshots in the huckelberry botanical reserve. >> reporter: police were here about five hours before they left and the trail where the man's body was found begins at the back of this parking lot along skyline boulevard. the thing that's so unusual is he was found so far into the trail it was quite a hike. i called the coroner's office but they say tonight so farther -- so far they are not releasing the identity. >> reporter: police are searching for anything that might give them a clue who killed a man in the botanical trails. a woman heard the shots and

called 911. >> i heard multiple gunshots and shortly thereafter came upon a white male in his appears to be in his 50s deceased on the trail. >> reporter: police put yellow tape around a sedan and searched the vehicle that was parked along the preserves lot. they called in a truck to tow the car away. invest -- investigators say the man was about .25 of a mile from the trail. >> he was suffering from two gunshot wounds. >> reporter: police called police canines but they found no suspects. but they did find some items. >> we found shell casings. >> reporter: police say this is a quiet park they have not had any problems in the past with any crime in this spot. they say there were no witnesses, they have found no vehicles. live in oakland, jana

katsuyama, back to you. >> thank you. san francisco police say it appears three men beat a homeless man to death as he slept early yesterday morning. it happened on sutter street near montgomery in the financial district. a police spokesman said there was no sign of a robbery and no apparent motive for the attack which is being described as vicious. authorities are hoping surveillance video from cameras around the area will help identify the suspects. two investigates uncovered the stunning cost of cleaning up debris and other hazards on california highways. last week we told you how the state spent $61 million to clean up all that debris. that story generated a lot of response and led eric ration -- eric rasmussen who says this story goes way beyond money. >> i was on my way to work. i listen to the same radio station every morning.

demonstrators the brought traffic to a standstill. this came after a march that started at about three clock this afternoon in the north western part of the city that eventually ended up downtown. in new york city, a large group of protesters marched through manhattan. police shut down an entrance to the lincoln tunnel after the group attempted to enter it. some protesters held a period of sigh negligence. the several protests took place in the nation's capital the largest was tonight. the marchers snarled the evening commute blocking buses and talks but there were no reports of violence or arrests. cleaning up the damage from last night's protest in oakland and the new damage tonight. the frustration being felt among business owners and how many people ended up being arrested. coming up new rules for

safety inspectors today shut down a preschool in fremont after two toddlers were hurt when a cabinet fell on them during nap time. officials red tagged the enlight school. the accident happened last night. a little boy suffered minor injuries. a little girl was taken to the hospital where she is expected to recover. >> you think you're leaving your child where they will be

taken care of. >> reporter: the cabinet was not properly secured to keep it from falling. they also found other violations. and fire sprinklers that were not properly maintained. the school won't be able to reopen until it fixes the problems. school staff declined to talk to us about the situation. santa clara county is offering a get out of jail free card of sorts. starting monday, someone with a nonviolent misdemeanor or traffic violation will be able to go into any police station to fill out the paper work to pay their fines. we're told more than 2,800 people have taken advantage of it throughout the last seven years. the fda announced sweeping new rules that require calorie counts on menus throughout the country. the display of calories from

more developing news now. protesters in oakland still on the move. they are now near 46th and market. they've been marching through residential areas. they've been marching near children's hospital. there are also a number of on and off ramps on highway 24th. earlier tonight they did try to shut down two freeways and were successful at one point. this is going on live right now in downtown oakland. near downtown oakland at 45th and market street. we will continue to follow
