clara, lose altos. seeing heavy rain. the afternoon commute is getting hammered in the south bay as well and park avenue in san jose, the rain picking up. heavy rain. and then back out a little bit. you see what the pattern looks like. rain. winds are light. the rain continues for the next hour or so. when i come back we will talk about this rain and more rain behind it. >> thank you. the 49ers released san francisco 49ers defensive tackle ray mcdonald. the decision comes after police unveiled they were looking to in a claim he sexual assaulted a woman. on labor day weekend he was arrested on suspicion of domestic violence but never charged. ktvu's ann rubin begins our coverage with this quick move by 9ers management. >> the 49ers say his termination has nothing to do with innocence or guilt but

rather with character and accountability. he just keeps making bad decisions. >> reporter: ray mcdonald is the subject of a sexual assault investigation. while he hasn't been charged the 49ers decided to terminate him. >> over time ray has demonstrated a pattern of poor decision making that has led to multiple distractions for the organization and this football team that can no longer be tolerated. >> reporter: ray mcdonald had just been cleared following a police investigation. this latest allegation does not involve her. authorities are speaking to her and possible witnesses but have yet to interview ray mcdonald. they were looking for surveillance video and other evidence at his home. >> that is is part of why we

obtained a search warrant. they felt there may be information that may be usual the investigation. -- crucial to the investigation. . >> reporter: the 49ers found out about the allegations, the gm called ray mcdonald to fire him an hour later. >> this isn't about guilt or innocence. we believe in due process. >> reporter: this was just the last straw. and fans support the decision to let him go. >> with stuff going on in the nfl, that is the action you have to take. >> keep the drama away. we don't need that. >> the termination is effected immediately. no word on how long it will take police to wrap up their investigation. >> thank you. mark ibanez is here now with more on this. seems like what else could go wrong for the 49ers. >> yeah. i have been a 49er fan as a kid growing up, covering them, without a doubt this is the

worse and most embarrassing season the organization has suffered. every time you think what else can go wrong, it does and ray mcdonald being just quickly released and, yes, interesting we are not hearing about due process this time around. a pattern of poor behavior led to the decision that was made. and they feel this decision comes out of the nfl conduct policy so they are not waiting around for allegations to be confirmed or not. here is some of the reaction from the teammates tonight at 49ers headquarters when they heard the news ray mcdonald was indeed reloosed. >> it is -- reloosed. >> it is tough -- released. it is tough. he is a good friend. no one ever thought bad of him. always good person to everyone around here. hopefully it is just a

misunderstanding. >> we had the meeting with the whole staff a couple weeks ago and jed made it clear on how he feels about everything and that is -- you got to go with what the owner says. it is his team. everyone knows what is right and wrong. >> organization, it is a franchise, you want to have a high standard and we do around here. you have to abide by that. >> great to see him commenting about that. they have a standard they have not reached. obviously this year and in the past, really. but the 49ers swift movement today in releasing ray mcdonald. >> i have to ask here, the 49ers have been eliminated from the playoffs. if they were still in playoff contention do you think they would have made the same decision about ray mcdonald? >> that is a question we will never know but my opinion is

that they learned a lesson, it was a pr disaster when they let due process play out with ray mcdonald even though charges were not filed, i think they would have released him no matter what. they had to have learned a lesson. you have to say with all due respect that things changed in the league, the nfl addressed. they have a policy and this falls within the guidelines to release him. >> focus now to coach jim harbaugh. word came out michigan made him a contract offer. any thoughts? >> reporter: a couple things. first of all, that offer has not been confirmed. there is another report from michigan that says he has absolutely not been offered by question. university of michigan. i will stand by what i said a week and a half ago, i think no

showing tonight, now they say they will not so the controversial movie. the interview is a comedy about a north korean leader kim jong un. and other chains across the country pulled the plug on the movie. this follows terrorist threats by hackers on movie theaters that plan to run it. >> we have been in touch with the fbi, with sony, their security people, and we have been down this road before with other films. >> reporter: late today a u.s. official said the government believes north korea is responsible for the cyberahack against sony pictures -- intoer attack against sony pictures -- for the cyber attack in the sony pictures hack.

ended up right here at city hall but all of the protest are taking a toll on the city of oakland and it is time that others step up and help pay the costs of the protests. >> reporter: these students cameitute have their -- came out to have their voices heard. . >> black lives matters. >> reporter: the message is the same as other protests but this teammate it was led by -- this time was led by high school students. these students say it is for a purpose. they learned from history and feel it is their time be a part of the movement. . >> reporter: the acts of violence by some protesters is making it hard for people to hear their message. >> we are sick of people taking advantage of an important and legitimate political movement to just send a message of destruction and that has no place in this movement. >> that chaos and destruction is costing oakland $100,000 a day. just to pay officers for over time and with more protests scheduled the mayor says it is time others share the task of defending the city. >> it is about our nation and so other resources should come in and help oakland, california bear this cost. >> reporter: she says most officers want to grow back to -- go back to their normal jobs. as of right now the protests

cost $1.3 million for the first few weeks. paul chambers, ktvu channel 2 news. people in one san francisco neighborhood are on edge after four vehicles were set on fire early this morning. the fires happened in a span of two hours. the first one, 4:15 a.m. this morning. the last after 6:00 a.m. and they happen all within -- they were all within blocks of each other. ktvu's david stevenson is live with more. >> reporter: the fires come after a string of car fires in san francisco's castro district. last week and last month. this morning's victims today were shocked and in one case grateful. >> reporter: he says he is one of the lucky ones. >> pounding on my door, your truck is on fire. >> reporter: his truck was one of four vehicles set on fire this morning in the

neighborhood. they stuffed lit paper through the window. the string of fires began before 4:12 a.m. where a black jeep was destroyed. >> my building manager called me and said my car was torched. >> reporter: a car suffered damage, and another destroy said. he can't understand why his car was targeted. >> disturbing. i hope they catch the people who did it. >> reporter: investigators checked buildings with surveillance cameras. they saw three car fires last month and another on december 8. >> looks like there might be a serial car arsonist on the loose. >> the fire department told me it is unclear whether last

after months of speculation we learned the san francisco flower mart will stay put but in a different location.

the developer and the flower mart announced details this morning. it is being rebuilt and turned into a office complex but they agreed to build an underground warehouse and that is where the new flower mart will go and all the venders and tenants will be offered a extension at their current rate. there will be office space above the retail shops. >> we have -- we are moving forward with plans on remaining here on this site. we will reinvest back into the flower business, in the future and we will maintain this flower business here in san francisco. >> not everyone is happy about the deal. former san francisco supervisor is leading an effort to get a measure on the ballot that would keep the flour mart in its current form. new at 5:00 p.m. a as well special dinner partacy -- special dinner party

in oakland for dozens of homeland people. ktvu's rob roth is joining us from the party that is being thrown by woman who just wants to help. rob? >> reporter: right. this party is just about to get started. we are inside the church in downtown oakland where 100 homeless people are spending a few hours off the street and will be treated to a dinner and the inspiration and the food is coming from one woman who just wanted to do something to make a difference. >> six, seven. >> reporter: she a engineer by day but this evening she is putting on a holiday dinner party. the guests are 150 people who live on the streets and in shelters. >> they don't get to enjoy holiday parties. i get invited to six, seven a year and they don't get to. >> reporter: volunteers helped in the kitchen but this is a

billionaire is making a big donation for stanford for research into allergies. he pledged $24 million for a research center that will carry his name. he was the first president of facebook and he suffers from severe allergies. he has been hospitalized 14 times in the last four years. between 30 and 40% of people around the world have one or more allergies. the obama administration announced a deal restab diplomatic relations with cuba. it follow as year of secret talks and it led to the release of a american contractor who spent 5 years in a cuban prison. >> it was crucial knowing i was not forgotten. >> reporter: freedom after 5

5:00 p.m. there was very close call for a man who says he accidentally broke into a home this morning. authorities say the case involves mistaken identity, a drunk neighbor and an armed homeowner who feared for his life. ktvu's john sasaki sorts out the story. >> reporter: a million dollars view that attracts people. >> my parents lived here for 18 years. >> this morning his parents had a serious scare. >> they started pound thong door. -- pounding on the door. my mom immediately called 911. >> reporter: within seconds someone they didn't know broke through the door. >> the guy got in. my dad yelled get out. you know, i have a weapon. guy came in. went into the family room. my dad fired a shot. and after my dad fired the shot, police broke in the front

door. they were already in route from my mom calling and they arrested him on the spot. >> reporter: investigators say he wasn't trying to steal anything. he was intoxicated and was at the wrong house all together. >> he said he left a friend's house after drinking and mistook the house for his home. >> the incident left his parents shaken. >> my mom loves sitting down here. no curtains because they have this view and now she is like i don't want to sit down here. >> reporter: he was treated and released at the hospital and immediately arrested. the homeowner is not being charged. he shot with a snake shot, which is small bbs.

san francisco firefighters lit a christmas tree on fire today to show how fast it will go up in flames. this tree was fully engulfed in less than 10 seconds. the demonstration was done in front of a hospital which has a large burn units. doctors and firefighters say there are things you can do to prevent a tree from catching fire. and suffering deadly burns. >> keep the tree hydrated. saw off the bottom of the tree and before putting it up, make sure the bin has adequate water. check it daily. same with the heights. don't leave the lights -- lights. don't leave the heights on over night and keep the -- lights on over night and keep it away from the fire chase and buy a new extension cord if yours is old or frayed. . >> president obama announced the u.s. is moving towards normizing relations with cuba.

more rain is falling. wasn't that long ago we would have built a newscast around it. biggest drought we have seen since 1977. and at least in recorded history, now we have had rain, 250% of rainfall average so we are getting used to it and benefiting from it. i like it is not creating flooding. we will get a break tomorrow as the next system comes in. we have great drainage sets up. not los angeles. they get a big rain and they are done. we have drainage systems set up for this. mountains, guerneville. we still flood but we are set up for heavy rain. tomorrow's forecast, scattered showers for the morning commute at best. fog will be a player. see what i am looking at?
