>> and i am frank somerville. >> ktvu's ann rubin is at levi stadium with more on why the team decided to release ray mcdonald. >> reporter: the 49ers found out about the allegations about 10:45 a.m. this morning. the gm called to fire ray mcdonald an hour later. he said this was the last straw. for neighbors it seemed like deja vu. police and media converged in front of ray mcdonald's house. >> i know nothing about the man other than the fact he plays for the 49ers and -- and he is behaving badly. >> reporter: weeks after police wrapped up an vection a new allegation -- investigation, a new algage. a woman -- allegation, a woman is accusing him of sexual assault. >> felt like there may be information that may be crucial the investigation -- crucial to the investigation. . >> reporter: they haven't interviewed him yet but the

49ers say they aren't waiting to determine innocence or guilt. >> over time ray has demonstrated a pattern of poor decision making that has led to multiple distractions for the organization and this football team that can no longer be tolerated. >> players respect the decision made. >> this is a organization, a franchise, you want to have a high standard and we do around here. we have to abide by that. >> you know, go with what the owner says. it is his team. everyone knows what is right and wrong.

>> fans agree. the controversies were getting in the way of the game. >> keep the drama away. we don't need that. >> reporter: police say this is an active investigation. over the coming days they will gather medical records, looking for surveillance video and interviewing any possible witnesses to the incident. >> ann rubin, thank you. >> rayray mcdonald's mother spoke to ktvu channel 2 news calling the allegations devastating. [ indiscernible ] >> my son lost his job over some accusations that were just accusations. >> ktvu's azenith smith spoke to her and she will have more tonight on the 10:00 p.m. news. drunk man had a very close call after he broke into home this morning. that close call was with an armed homeowner who said he feared for his life. it happened around 4:30 a.m. this morning. the intruder has been identified as 24-year-old. he used a planter rack to break through a door.

police say he wasn't trying to steal anything, instead he was highly intoxicated and may have thought he was at his ex- girlfriend's house which was nearby. the homeowner shot him after he entered the house. >> the guy got in. my dad yelled get out. i have a weapon. guy came in. went into the room, that is when my dad fired. >> he was treated at the hospital and arrested. police say he has been charged with trespassing, prowling, vandalism and public intoxication. arson investigators are searching for whoever set car fires in san francisco -- witnesses say the flames rose as high as 15 feet into the air. ktvu's david stevenson is live with what firefighters are asking neighbors to do and the one message someone has for the arsonist. >> reporter: neighbors woke up the owners to alert them about

the fires. in all but one of the cases it was too late to save the vehicles. >> four vehicle ins two hour's time. >> very upset that they would do something like this. >> reporter: two jeeps were destroyed for a car and truck damaged early this morning. >> everything is under investigation right now. >> at this point it does not seem like anyone was targeted. >> reporter: his truck suffered minor damage. his neighbors put the fire out. >> i am happy with the result. i feel sorry for the other people. >> reporter: investigators are asking neighbors to check their surveillance videos for suspicious activity. they saw three arsons last months and one last week. it is unclear whether they are connected to this morning's. >> setting cars on fire is a sick person.

>> the fact it is a string of them is disturbing. i hope they catch them. >> reporter: he had a simple message for whoever did the damage. >> please stop. >> reporter: the manager of a cafe said investigators came by to check the surveillance video. the surveillance video didn't show anything of use. >> simple message. please stop. thank you. sheriff's deputy pleaded not guilty ocharges he -- to charges he smuggled cell phones to a gang member in jail. he was arrested in november along with two correctional officers. accused of bringing drugs into the jail and all are accused of accepting cash for the drugs. all three are on paid administrative leave. his attorney maintains he is being targeted by the sheriff

and district attorney. they have called that accusation nonsense. more rain damage today around the bay area. take a look at this. a massive tree came crashing down on to a apartment complex. it damaged the building there along with a parked car. one man was inside when it happened but luckily he got out safely and wasn't hurt. a neighbor saw it all happen. >> i saw it coming down. i was like oh, my god. oh, my god. what is going on? what is going on. oh, my god. oh, my god. oh, my god. >> i don't know how the roof hasn't collapsed. >> a crane had to lift the tree off the roof. neighbors tell ktvu channel 2 news the "like" is helping -- the red cross is helping the family that lives inside. the man who owns the

property that owns martin beach is fighting to keep the beach closed. they are seeking a new trial in the case. on december 1 a judge ordered the gate be opened or obtain a permit to keep it closed. >> look, this is private property. as we said earlier, the judge said this was private. no public access. no reason why a individual should have to seek the permission of the government, a permit in order a decide whether to open his own property or not. >> the commission has threatened to fine the owner if the gate is not opened soon. tonight 2 investigates takes a look at what is driving up hospital bills in the bay area and why getting a answer about the price of a procedure is not easy. ktvu's eric rasmussen spent weeks going through state records of charges from hundreds of hospitals throughout california and he is

here now with what he found. >> reporter: the prices are all over the map. we looked at 10 procedures, knee surgery at one hospital, $55,000 or a few thousand at another. and hospitals say the prices rereviewed are not what patients pay. we decided to take another look at hospital billing when her family received a $16,000 bill for a visit to the emergency room and a cat scan, even after insurance they owed $5,000 and it was only after the bill came in the mail they discovered the same procedure might have cost less somewhere else. >> reporter: [ inaudible question ] >> it would be nice. i think in every industry -- every other industry besides the healthcare industry you know the costs before hand.

you go into the restaurant a store, the cost is on the shelves. >> reporter: what would it take for consumers to know how much they would pay? >> if you have insurance you talk to your insurance company. >> reporter: hospitals say the real cost comes down to what is negotiated by your insurance company. with that said we were able to break down the uninsured prices that hospitals are required to report to the state. we found bay area helmets among the most expensive. we will have that tonight at 10:00 p.m. and what you can do if you think you are being over charged. >> thank you. covered california enrolled more people in one month than it did last year in two months. they signed up 144,000 people during the first month of open enrollment. last year 109,000 signed up. they have extended the deadline to enroll to december 21 and

offering more help to get people signed up. >> people have questions they want to know how to do this, so this year we have store fronts. we plan to have 200 of those. we have over 300 store fronts. >> the state has set a goal of insuring 1.7 million people including existing customers through covered california. thousands of bags of groceries were handed out today in san francisco. the church gives away 5,000 bags of food to needy families and this year was no different. the line started forming hours before the church opened at 7:30 a.m. this morning and then volunteers started passing out the food. and the reverend praised the volunteers who handed out the groceries. >> they have a spiritual aspect, all of us do. we want to be more human.

students who attend oakland unified schools walked out of across the protest. today's protest was a peaceful but one but leaders say weeks of demonstrations are getting expensive. it is costing $100,000 a day just in police over time. the mayor elected said it is time for others to help pay for the task of defending the city. >> it is about our nation and so other resources should come in andope oakland -- and help oakland, california bear the

cost. >> along with student demonstrators she expressed frustration to those who caused damage and problems around oakland. mayor ed lee today announced a 5.5 million dollars donation from skieser to city programs that -- kaiser to city programs that target healthcare. a program links people in the most troubled communities to medical care, health insurance and health intervention. another will be spent by the public health department to teach communities about healthy eating and active living. >> about what we do every day to keep healthy. this is as important as building hospitals. building communities in a healthy way. >> and community clinics, and a youth wellness program and a primary care program.
