a billowing cloud and shooting flames erupt tonight at the chevron refinery in richmond. an alarming sight that could be seen for miles around. but chevron is telling us there was actually no cause for alarm. good evening everyone i'm frank somerville. >> and i'm julie haener. a serious looking situation that raised concerns in the community but chevron says no worries. the oil giant says the flair resulted from normal operationals -- operations and had no impact on surrounding neighborhoods. chevron released this statement, flairing is part of refinery operations. we get the developing news from

jana katsuyama live at the chevron plant just off of interstate 580 near the richmond san rafael ridge. this all started around 7:00 tonight. must have been quite alarming for anyone near by. >> absolutely. now let me tell you right now it's dark and it's hard to see. but there is still some steam that is coming out of that unit. of course that's 2012 chevron fire is still very fresh in people's mind. so there was some concern when they saw this flair that lasted nearly an hour. chevron said it was a normal flair. the flames could be seem s if miles. >> it means there's something not working as normalled. >> reporter: a spokesperson said that a flair is a way to

release some of the -- -- chevron released this statement. it said in part we had a process unit that needed to be depressurized. the flair is a safety system that allows us to safely shut down a unit. chevron said the black cloud was steam and can take the appearance of smoke. chevron says they are monitoring the air quality. >> we were making sure there were no chemicals that were reaching the fence line. >> and what did you find? >> we didn't find anything. >> we contacted this chevron spokesperson that said no one was injured inside the plant and no alarms went out to alert to chemical releases. >> chevron themselves will do the investigation and they'll get back to us. >> reporter: that county official tells me that they do plan to ask for a 72 hour report from chevron details

exactly what prompted them to cause this flair tonight. >> that flair tonight pretty impressive in the night sky. jana thank you. right after the flairing started, twitter and instagram absolutely lit up with pictures and we have a couple we want to show you tonight. this picture shows you just how big that flair up was. that's the campenili on the cal campus in the foreground. now we have a picture showing it a little bit closer. you get a sense here of why so many people initially were worried that this was a huge fire but again it turned out to be nothing more than a flair up. scott cogawa sent us this picture it says watching the flames from el cerrito city hall, hopefully everyone is safe. and as it turns out, everybody was safe. you get a sense of just how big this flair up was and how you could see it for miles around the bay area. and those images tonight of the chevron refinery are bringing back memories of the last major fire there.

it happened in august 2012, contra costa health services ordered a shelter in place and b.a.r.t. even shut down service in the area. more than 10,000 people sought treatment at area hospitals. last year the company pleaded no contest to six charges in connection with that fire and agreed to pay $2 million in fines and restitution. now to the south bay where protesters are calling on the san jose police department to fire one of their own. white is on leave for posting comments on twitter about anti police protests. protesters were met by the chief of police tonight. azenith smith. >> reporter: this protest started two blocks away at the sacramento government center and it ended here. protesters not really marched over officer white but also over local cases where there's alleged police misconduct.

close to 100 protesters gathered in front of the santa clara county government building with a message. protesting for justice they say after smith posted comments online. a cry for public safety, the 19- year-old shot and killed by a san jose police officer in august after a power drill was mistaken by a gun. >> i hear black lives matter, i

hear officer white all lives matter. our daughter's life mattered. >> as the district attorney i'm very disturbed by the tweets of those particular officers. whether those tweets and remarks are criminal or not that's something we'll look at in the office. >> reporter: jeff rosen met with protesters calling officer white's remarks not appropriate. >> reporter: as they marched to san jose police headquarters a similar sentiment shared with larry esquivel. >> believe me this is very troubling for us as an organization. it is not, it is not what we stand for. and i can guarantee you we are looking at this as we have been proactively and aggressively to bring justice. >> reporter: and in the end, the protesters called their meetings with the d.a. and the police chief a necessary first step and they're now more hopeful for

change. frank. >> azenith in san jose tonight, azenith thank you. a discovery of a rope hanging in a tree has started making its rounds on social media. police are looking whether there was any criminal intent behind the display. we spoke to several people today who say it's uncalled for. >> it's certainly one we don't condone. >> reporter: the woman who posted the photo says she believe it is display is likely a reaction to the black lives matter movement and the i can't breathe protest. she said if you're still telling yourself that race based discrimination and violence is no longer an issue in this country, you are lying to yourself.

public defenders across the bay area stood up for their defendants today. they walked outside courthouses in martinez, vallejo, san francisco and oakland. they're calling for investigations of police involved shootings to be done by outside agencies they also want the cases to be heard in a preliminary hearing which is public as opposed to going in front of the grand jury which does it work in secret. and they're calling for officers to start wearing body cameras. these are live pictures from downtown san francisco as another storm system moves through the bay area. mark ibanez is here with when it will be moving through the area. >> we've been talking about storm clouds. a bit of a break out there. you can see on storm tracker 2, all the clouds, the main rainmaker is to the north. basically this afternoon and into the evening hours.

u.s. government. about how to respond to it. the options under consideration could include new sanctions against north korea. a federal lawsuit was filed today accusing sonoma county sheriff about using excessive force after they tased a man. sheriff deputies said roth was resisting and had to be subdued. but his attorney calls it a beating. the lawsuit is seeking unspecified damages against five deputies and the sonoma county sheriff. roth eventually plead guilty to a lesser charge. the swift and decisive action came as allegations of a sexual assault surfaced. and as ktvu's ann rubin reports the 49ers didn't waste any time

investigators now say a massive fire that shut down part of los angeles last week was an act of arson. the december 8 fire destroyed a seven story apartment fire under construction. no one was hurt but the fire caused 20 to $30 million in damage. investigators are also looking for two potential witnesses, no arrests have been made. an update now to a story we brought you as breaking news at this time last night. police have identified the driver accused of running a red light and plowing into a group of pedestrians in redondo beach killing three women. police arrested margo bromstein. investigators say the victims had just left a church christmas concert and were in a crosswalk when they were hit. the associate pastor said a 36- year-old mother and a grandmother ages 81 and 87 were killed.

new research is suggesting that the west napa fault line that was responsible for that 6.0 earthquake last august is actually capable of producing an even stronger earthquake. ken pritchett is in napa after talking to a uc davis researcher about these findings. ken. >> reporter: that quake resulted in damage that is still being repaired. it also resulted in extensive scientific study of the fault which researchers now say is longer and potentially more damaging than once thought. with christmas music in an ice skating rink, a horse drawn carriage ride and decorations everywhere, downtown napa seems normal for this time of year. many businesses closed have reopened. the cracks are census for the many needed repairs.

requests challenging but they never stopped looking. >> however i made them five months to make that change. >> reporter: when two investigates asked to see berkeley unified policy on how they handle cases like these the district failed to provide one. a spokesperson says, i encourage you to find a district that actually has a policy. >> it's really critical to have one your policy and two the system to ensure that it is actually a functioning policy. >> reporter: other local districts we called provided written policies. san jose unified assigns a counselor to work with the family and work on the request. san francisco asks for written documents like a retraining order. two days before this report was said to air, berkeley unified sent us a copy which states that children may be given

amber lee joins us now. she's live in belmont where the community and her family came together. >> reporter: we're inside the ice rink, tonight the community came here to give the little girl and her family a gift. this is the first for the 5- year-old. jade morgan has never been to an ice skating rink. she recently turned five but has gone through challenges that most people will never experience. three heart surgeries for a congenital heart defect. >> can you tell us how you're feeling. >> i'm just feeling good. >> reporter: feeling good despite recovering from her third and hopefully final surgery in october.

the father ryan morgan describes the preschooler as the child that was born smiling. >> i can ice skate. >> reporter: jade tells us she doesn't know how to skate but appears excited about everything going on around her. each surgery costs $4.5 million. while the insurance paid for most of the surgeries, it doesn't pay for anything else. it's been a challenge for the family. tonight the rink was reserved for a special event to raise fund for jade's family. >> it takes you off guard because you're not used to this support and love. everyone if it's all around you. it's all in your face. it's really humbling, it's a really nice thing. >> reporter: a family friend organized this event. >> it hit really close to home and i felt i wanted to do this. >> reporter: penny star is an
