>> and a lot of solid support there. here in the bay area, the police protesters will stage a die-in tonight outside oakland city hall. there have been similar demonstrations throughout the country. the protesters say their rally will be a peaceful action that the whole family can attend. demonstrators will, though, plan to march afterwards. the black lives matter die-in starts at the plaza at 7:00. the workers are preparing a giant christmas tree that was damaged during a christmas night protest. vandals tore off lights and shattered dozens of orangements. the city's plan now is to get the lights at the base of the tree working again and keep that display up through the new year. the destruction angered people visiting jack london square. >> and a christmas tree is symbolic of all that is good, so they have to go and damage it. i'm mad. >> protesters also vandalized a store and a subway restaurant.
9:08 am
the store opened late yesterday as the cleaning staff was still boarding up the bin does and removing the mess which included a couple of shattered wine bottles and 25 windows. protesters say the christmas demonstration was called the no time off march to keep police busy during the holiday. and people will be gathering in vallejo today to show their support for law enforcement around the country. >> we want the police to know that we have their backs the way they have ours. >> the rally is scheduled for 1:00 this afternoon outside the vallejo police department. organizers say they plan to rally because of all of the negative press they say police have been receiving lately. christmas is over but it is the season now for all of those gift returns. according to the national retail federation, nearly 40% of consumers are going to take back at least one of those holiday gifts. experts say 23% of all returns will take place between now and the new year.
9:09 am
an estimated $60 billion worth of goods will go back to the stores, but they say people will also be spending some money. >> we do have a lot of people that are looking to spend their gift cards that they got for christmas, so that is a big thing a lot of people may be buying stuff with the cash they were given. >> and many stores say the last few days of the year are pretty critical to their bottom line. the holidays may be winding down, but the bork isn't over for delivery drivers. ups says it expects to handle four million holiday return packages by the end of the first full week in january. the company has declared monday, january 6 ups national returns day. ups says it expects people will send more than 8 00,000 unwanted gifts back to stores and sellers that day alone. well, you can return a lot of things, but you can't return gift carding, or can you? this year wal-mart is launching a program that is going to let you exchange your unwanted gift cards. ktvu reporter joining us from outside a wal-mart. the details on a new program
9:10 am
being offered at that store. are you seeing anyone else who might want to give it a try? >> well, we haven't had a whole lot of luck since then. >> reporter: we have been here since 6:00 this morning. that's when the store opened. we have seen a fair amount of people going in and out of the store, another not a huge post- holiday shopping rush that you'd expect. most of the people you have talked to this morning weren't familiar with this new gift card exchange program. we're going to tell you about it and it can certainly apply to a lot of folks. it is estimated that 80% of shopper this is year bought at least one gift card to give as a holiday present. i was on the receiving end of gift cards, and in my case i like these stores. i plan on using these, but that may not be the case for everyone. so if you got a gift card this holiday to a store you don't like, you don't plan to shop there, wal-mart would like you to trade that gift card in. they are doing a gift card exchange program. it is a pilot program that they just start ford the holiday where you can trade a gift card in from 200 different stores and restaurants for a wal-mart.
9:11 am
gift card. it is a pilot program. again, the store is just doing it for the holidays. but depending upon how it goes, they could continue to offer it all year round. but there is a catch. wal-mart will only give you up to 97% of that card's value. so, for example, if you have an amazon gift card that you want to bring in to wal-mart, you only get 95% of the value of it in wal-mart gift card. staples, only 90%. and with a gap card, you only get 85% of the card's value if you trade it in at wal-mart. so it varies from store to store. >> it is not equal exchange, but, i mean, it is still better than not using it at all. most times people just take their old gift cards and toss them or they can't use them. >> now, wal-mart isn't the only place you can exchange your gift card. this is not a brand-new idea. of course, there are a number of online sites where you can swap them and actually wal-mart
9:12 am
is partnering with one of those sites to do this program and the ceo from the site says wal- mart gift cards are the most sought after gift cards in the country so that may be why wal- mart see this is as a huge sunt opportunity for them. >> it looks like at least one option for you. thank you. we appreciate that report. new year's eve is fast approaching and with the flowing of drinks comes the need to get home safely. some of the services being offered around the bay area. and a new bill to help prevent drunk driving all year long. the device that could soon be a requirement for all cars. a wintry chill in the air this morning, and those cool temperatures are going to remain for your bay area weekend. i'll detail the numbers for you and in the extended forecast whether or not we'll see any rain before the end of the year coming up.

law enforcement across the bay area reminding drivers to obey the rules of the rule. san mateo police are one of the agencies conducting a check point tonight from 7:00 p.m. to 2:00 in the morning. officer also be looking for impaired drivers and people who get behind the wheel without a proper lens. the police say research shows that well publicized check points and i. patrols can
9:16 am
reduce the number of crashes by up to 20%. and this coming monday, the state senator from the peninsula, jerry hill, will announce he is introducing a bill that requires all drivers convicted of driving under the influence to install an ignition interlock device in their vehicle. 24 states currently require these devices for first-time convicted dui dryers. california has a four-county pilot program which includes alameda and is about counties. supporters of anti-drunk driving campaigns prefer the ignition air locks over a driving ban which they say is often ignored. well, with the holiday season, we're talking about all of these check points and the drinks are flowing and now the chp is keeping a close eye on the roads and the people behind the wheel. joining me now is the officer from the chp. good morning. >> good morning. >> thank you for coming in. so it is an all hands on deck season? >> it is definitely. we have a maximum enforcement period which means we have all available officers out on the road. >> is let's talk about the
9:17 am
drunk driving issue for the holidays. when you're out there, when you pull over someone who is driving, drunk, do they seem to say i didn't realize i was drunk? they didn't care? >> it is sort of a mixed bag across the holidays. we see a lot of first-time offenders as well as repeat offenders. >> i want to talk about this wet lab. tell me what it is. >> and in our academy we have the cadet whose are going to become officers. we actually have people come in, drink alcohol and do the field sobriety tests so the officers as they get ready to go out on the road, they have a real world experience for what they will look for. >> does it surprise them that how little they have to drink to get to this point that you shouldn't be behind the wheel? >> a lot of people don't realize how quickly they pass the legal limit. >> it obviously depends on kind of body weight and tolerance and things like that, but do you give an average of what you
9:18 am
should kind of stick with if you want to make sure you're still safe? >> there are a the of factors. if you're going to have more than one drink, you need a designated sober driver. >> there are the people who still will say i'm fine. i'm fine. and the other deterrent if it is not go to be safety or responsibility nare the financial costs of it is expensive to get a regular ticket a dui is going to cost you a lot of money. >> a dui is going to cost you a lot of money. it costs over $12,000 for a dui and a lot of it comes from increased insurance premiums. >> we have all of these kind of broken out. you have a booking fee. you have the fine, right, and then attorney fees, $2,500. that is the insurance fee, that is $7,400 on there? >> exactly. >> your insurance companies don't like that. what -- i mean, are people trying to get out of this when you pull them over? is it pretty obvious? >> we see a lot of issues.
9:19 am
we have a lot of the pleading. i didn't know i was drunk. the problem is if we stop you and we arrest you for being under the influence, it means you were a danger to others on the roadway. it is something we want to keep people off of the roads and, remember, designate a sober driver. we have way too many fatalities. i'm happy to say we have had no fatal collisions in the bay area over our maximum enforcement period, which is great. we have had quite a few dui arrests, but no fatal collisions. >> that is fantastic. we're going to end in 25 minutes or so and come back because we have these. explain these so people understand what we're going to be backing -- looking at. >> we use these as a teaching tool so they can try the dui test on the side of the road without having to worry about being arrested for dui. so this is going to give you an opportunity to try out those without having to worry about being arrested. >> that is a good thing. >> so we're going to try these. we're also going to talk about this because people have all

sorts of crazy ideas on how they're going to beat the field sobriety tests. we'll check back with you at 9:45. for now back to mike. >> thank you very much. bart will be running its train as little longer for new year's eve. train also run every 20 minutes after midnight on new year's day. bart service will operate on its sunday holiday schedule on new year's day. the first train also be set to take off at 8:00 a.m. meanwhile, aaa will be offering a tipsy tow program on the new year's holiday for drunk drivers. starting on new year's eve at 6:00 in the evening and continuing to 6:00 a.m. january 1. anyone can call aaa for a free tow home up to 10 miles. just call aaa help and tell operator i need a tipsy tow and the truck will be on its way. >> that is always a good service. you get people to know and take advantage of it. >> take advantage of it. don't get behind the wheel on new year's eve when you're
