it is cold outside, and getting colder. the next 48 hours should bring the bay area some of the lowest temperatures so far this season. good evening, i'm gasia mikaelian in for julie haener. >> we have team coverage tonight. ktvu's maureen naylor live where people are preparing for near freezing temperatures. first, to our meteorologist, rosemary orozco with what we can expect. >> yes, this system on its way in. i've been watching it move closer to the bay area, as we

move into the evening hours. a very chilly start. but numbers within a few degrees of where we were yesterday at this hour. we are still waiting for the arrival of this storm. over northern california there, you can see just a little bit of moisture associated with this system. not expecting a lot of rain out of this, perhaps a few traces when all is said and done, but this is moving now a little closer to the bay area. in around chico and sliding to the south. over the course of the evening hours and into tomorrow morning, this system is going to slide over the bay area, maybe bringing a sprinkle. it's going to have two major impacts. the first will be the wind. a wind advisory is in place. for the rest of us it starts by noon time. it's going to last the entire day of tuesday. half the day on wednesday. wind gusts up to 45 miles per hour in and around the bay area. 60 for some of our hills. i'll detail this, behind the wind, some of those coldest

temperatures we're talking about. i'll detail those on new year's eve. maureen, the cold weather has already gotten people's attention. >> reporter: here in morgan hill, it's supposed to drop to 35 degrees tonight, as rosemary mentioned even cooler nights ahead. in the bay area, winter themed themed decorations are usually more festive than reality. >> it's cold during the day. >> reporter: at grins vines, and automobilia cafe -- >> it helps my hands stay warm for one thing. >> reporter: this couple on a first day, broke the ice with warm drinks. >> it's not quite unpleasantly cold yet. >> just trying to stay warm. i'm a spoiled california girl, and 35 is too cold. >> reporter: outside, this married couple of 58 years has

a plan for the colder weather ahead. >> we stay in. hunker down. >> throw on an extra blanket for sure, and cover up the plants. >> reporter: these are frost sensitive. >> reporter: in san jose, at central wholesale nursery. >> over there is where the citrus. >> reporter: dozens of citrus ferns and other plants will spend the night in this greenhouse. suggested to keep them watered or covered to avoid frost damage like this. >> it settles in the lowest parts of the yard. >> reporter: santa clara county is taking precautions to keep the homeless population safe. starting tonight, and through sunday, the pa cardo reception center will remain open 24 hours for homeless seeking relief from the cold. >> that means we will take people at all hours, instead of just a set time in the

afternoon. and the clients who have beds for the night will be able to stay throughout the day to stay warm. >> they come with a handle. >> reporter: at mill cotton's sporting goods store, gloves with built in hand warmers are some of the hot items when the cold weather moves in. >> insulative layers. gloves, hand warmers. >> i run. so i still run when it's cold, and i do prefer it. if i'm prepared. sometimes your feet, your toes get a little numb, but then they usually warm up. >> reporter: also extending hours allowing the homeless to stay until 8:00 a.m., until 6:00, to keep them out of the cold a little longer. >> like jessica in your story, i'm a spoiled california girl. 35 is too cold for me.

thanks moreen. >> reporter: someone stole a rare bottlele of wine on christmas day. the chef tweeted these particular bottles will raise red flags if they surface in public. napa valley's screaming eagle is one of the most sought after wines in the world. bottles sell for $3,500 to $6,500 a bottle. the other wines stolen were french burgundies that have set records at auction. the french laundry sells them for $3,000, to $8,000 a boltle. for days now, the question has been why. why would the 49ers part ways with head coach jim harbaugh? today, the team owner explained. he says he got tired of the repeated arrests, and off-field misconduct that plagued the team over the past few seasons. the front office addressed the

coaching change. >> they did stress they don't blame harbaugh specifically for those things. once the wheels of change were set in motion, it came quickly. reports say harbaugh to michigan is a done deal. this morning, harbaugh's former players were cleaning out their lockers just a few hours after being officially told their coach would not be back. 49ers ceo, jed york, and general manager trent balance -- balki said it was a joint effort. there were hints why they parted ways in one of the most successful coaches in 49ers history. >> there were things i didn't necessarily like. year one, year two, year three, that you don't speak more loudly on because you win. the san francisco 49ers win with class. we haven't won, and i don't think we've conducted ourselves with the level of class that i

expect with our organization. we've had off the field issues. that's going to happen in sports. the level that it happened here is not acceptable. >> reporter: now the question becomes, who's next? the 49ers could stay in house. defensive coordinator vick fangio has been mentioned as a candidate. so has the defensive line coach. high profile names from mike holmgren, to jon gruden come up in seemingly all coaching conversations. and the 49ers have asked for permission to interview todd bowls from arizona, and dan quinn from seattle. whatever the decision, it won't happen right away. jim harbaugh's decision wasn't an official firing. but three other coaches have been let go on this day. the bears fired marc trestman, and the falcons parted way with

mike smith. the ravens haven't hired or fired anyone. they have a situation where they're going to try to decide in the next few days if tony sparano stays. he held a press conference, where he spoke as if the team's coach. >> do you think that jack dell rio could be one of the candidates for the raiders? >> i have not heard that name right now. i know jack dell rio was a local guy from hayward. that's certainly someone that potentially would be in the mix. i think there was talk at one point of the raiders making an 11th hour attempt to get jim harbaugh. also talk of the bears potentially doing that. we're going to just have to wait and see with them. they've neither hired, nor fired anyone. it was a bittersweet send off for many 49er fans. some tell us, they're looking forward to a change. many say they think the 49ers made a mistake by letting harbaugh go. >> you got into the championship game three years in a row, and this is one year

from indonesia to singapore. the pilot's last request was to divert around bad weather. if the pilot tried to climb in the storm that could have led to reduced stability, and possibly a fatal stall. >> until we find the aircraft, we know what went wrong, we'll look into it and see what we inside to improve. >> authorities say they think the plane is on the bottom of the java sea. and indonesia said it needs help with sonar gear to help map the sea floor. a california law is set to take effect in the new year that aims to reform the process for putting an initiative on the state ballot. ktvu's jana katsuyama is live to explain the law, and why some say it will hurt grassroots effort, more than it will help them. >> reporter: frank, this new law has two angles. one is to increase the transparency of ballot initiatives. the second, which some people

disagree with, would allow the legislature to have more involvement in the process. possibly reducing the number of initiatives. will lynn says he was angry when he learned he could not face the priest who sexually abused him as a child in a court of law. >> i felt hurt. >> reporter: his case had passed the statute of limitations. now he wants to change the law. >> we want to bring a ballot measure to repeal the criminal, and civil statute of limitations on sex crimes against children. >> reporter: that ballot initiative process will change in the new year. >> there will be better information for voters. >> reporter: helen, hutchson of the league of women voters was one of the 60 that worked to pass a ballot initiative reform bill. it also requires that any proposed initiative undergo a 30 day public review, where citizens comment. and it requires a legislative hearing once an initiative has

collected 25% of needed signatures. initiatives will also be posted online on the secretary of state's website, with information about who is funding the effort. >> the way it works currently is that it's only after a measure is qualified for the ballot, that they have the legislative hearings. so the legislative hearings tended to be in late july, and into august. by then, the legislature, it's too late for them to really do anything. >> the fact of the matter is, all this is doing is convoluting the process. >> lynch says the new law will hinder, not help people, by giving opponents a chance to do rail initiative before it secured a spot on the ballot. >> it disempowers the people bringing the initiative. it's just totally unacceptable. >> reporter: lynch says he's so upset by this new law, he might work to garner support to overturn it. ironically, through a ballot initiative. >> jana katsuyama.

a deadly hit-and-run incident will lead to an arrest. investigators say they believe this white pickup truck struck and killed 63-year-old jose lenez. investigators also found pieces from the suspect vehicle there at the scene. they say the debris points to a white 2007 toyota tundra, like the one we're showing you here. there are new developments in a scandal at cal fire, where 16 firefighters are on paid leave tonight. the investigation started officials looked into claims of a sex tape involving this former battalion chief, orville fleming. he is charged with the stabbing death of his girlfriend, sara douglas in sacramento. during that investigation, fleming's estranged wife claimed that she saw a video of douglas having sex with fleming and other firefighters on a

fire engine. today, investigators said the sex tape claim is unfounded, but they uncovered other unrelated policy violations. that's what led to putting 16 firefighters on leave. most of them work at a training academy in amador county. >> we wanted them to make sure they weren't disresulting those new recruits starting next week. so we wanted to bring in new instructors, and those with allegations, put them on time off. >> a full report is expected to come out in the next few weeks. a new push today to crackdown on repeat drunk drivers. a california state senator is sponsoring a bill that would require drivers convicted of dui to install an ignition interlock device. ktvu's melanie woodrow said that bill is long overdue. >> our son matt was 22. we were hit by a drunk driver and matt was killed

ininstantly. >> my daughter's name was ginger walker. she was 22 years old when she was killed. >> reporter: in both cases. the drunk drivers were repeat offenders. >> he was on a suspended license, and he was suspended five times prior to killing matt. >> reporter: i know the man who was sentenced in connection with my daughter's death was driving on a suspended license. >> in california, i think we've been very lax. >> reporter: senator jerry hill wants to change that. he's sponsoring legislation that would require ignition interlock devices for all drivers convicted of driving under the influence. even first time offenders. the device connects to the ignition, and requires a breath sample before the engine starts. if it detects a blood alcohol level above a pre-set limit, the car's engine will not start. according to mother's against drunk driving, as many as 75% of convicted drunk drivers continue to drive without a license. >> it's one of those things that we need to change. this legislation will start that change. >> reporter: in august, 2 investigates went on a ride

along with south san francisco police as investigators conducted surveillance on dui repeat offenders. lieutenant wall stopped and arrested a man under the influence, driving on a suspended license. without an ignition interlock device. lieutenant wall says repeat dui offenders in california are involved in 24% of fatal dui crashes and 63% of injury dui crashes. in california, a four county pilot program is underway, installing the interlock devices on convicted vehicles. this bill would expand the program. >> i want to prevent this pain from happening to another mother, another family. >> according to the bill, the number of offenses would dictate how long the device would be in place. for first time offenders, 6 months, all the way up to 3

years. ktvu, channel 2 news. a very cold, mostly dry system is working in california tonight. you can see just a few specks of white and green over northern california. this is a still shot of the satellite and radar. this going to sweeping across the bay area in the overnight hours. by tomorrow morning, it's already moving south. behind it, the bigger concern is going to be the winds as well as the colder temperatures. as it moves through in the overnight hours, we could see the possibility of a few sprinkles. but we have very little moisture to work with on this system. again, it's going to be the wind tomorrow that really gets us. let me take you through the next day or so, and we'll check out the behavior of the winds. tonight, fairly light. but as we get going tomorrow morning, the wind advisory begins to kick in over parts of the north bay. by the noon hour, all of us are under a wind advisory. the entire bay area. we're talking wind gusts from 40 to 45 miles per hour for our bay area communities. our hills could actually see those winds to 60 miles per

hour. so here we are at the lunchtime, from 20 to 30 to 40 mile-per-hour winds. then as we get into the evening hours, the winds continue. i think between tuesday afternoon, and tuesday night, will be when we see those strongest winds. they are going to continue for the 1st half of wednesday, which is new year's eve. as we get going tomorrow morning, temperatures will be on the chilly side. upper 30s, to low 40s in the forecast. 42 in oakland, 37 in napa. 41 in san mateo. for the afternoon, temperatures in the upper 40s, to low 50s. it's going to be very blustery out there with the winds continuing to howl across the bay area. once the winds die down, temperatures are going to fall even farther. i think it's going to happen in time for new year's eve. a look at the extend the forecast and those numbers coming up. we'll see you then. ahead tonight, a big pot bust in the bay area. then at 10:30, uncorking the new year with champagne, food, and fireworks. the preparations that are underway right now. >> up first, a change of heart, after members of a high school basketball team were told they couldn't pay.

two high school basketball teams from mendocino are at the center of freedom of speech. they were told they can't play in a tournament, after they wore t-shirts that say, i can't breathe. >> reporter: controversy sparked two weeks ago, when the mendocino boys and girls basketball teams wore t-shirts that say i can't breathe. it prompted fort bragg high school to uninvite mendocino to their tournament. the girl's team stood their ground, protesting this morning on the steps of fort bragg high at the start of the tournament. >> they said they were going to throw us out if we wore the shirt. it ended up being me and a

bunch of my teammates walked up with our shirts, totally normal. asked if we could pay. we got a stamp, we walked right in. >> reporter: the principal said the players were uninvited because the shirts could prompt a safety issue they weren't equipped to deal with. school officials changed their mind. >> these are kids who we should be teaching them the power of the 1st amendment, and the power of political speech rather than restricting it. >> reporter: players and spectators will be allowed to wear t-shirts reading i can't breathe. these teenagers say they just wanted to raise awareness about police brutality. >> to feel like we were heard and we made our point. >> it was just about freedom of speech. we wanted to raise awareness for this cause we really believe in. >> reporter: the protests have been called off.

even though the girl's team is allowed to wear those t-shirts, it's likely they won't play in the tournament, because another team has already taken their spot. reporting in fort bragg, ktvu, channel 2 news. >> the fort bragg unified school district responded to its decision. it released a statement saying under the circumstances, we believe that focusing on maintaining a safe environment for players and visitors, rather than on attire will harmonize our objective. police say a man was parked in the 5400 block of grizzly peak boulevard about 11:30 last night when two people robbed him at gunpoint. even though the victim cooperated, they shot him in the leg. in contra costa county, a welfare check turned into a big marijuana bust at a bay point home. deputies say the person living

menu. every shelf is stocked. >> the thing usually isn't full, but right now, it's full for us. extra different styles of beef. >> reporter: for $90 a person, a special four course meal, featuring dishes not normally on the menu. the restaurant is completely booked. new year's eve means catering to larger groups at a more hectic pace. >> you have different diners. you have different expectations, i guess. it's not the same thing you would normally do on any given night. >> reporter: at the hotel batali on the waterfront, there will be a party here for 800 people. extra champagne needed. 40 cases instead of the normal 3 to 5 cases a week. >> new year's eve is just an over the top party. >> reporter: the hotel offs a fine view of the fireworks show. there are some rooms still available at $400 a night.

>> we have poppers. >> reporter: san francisco party says it stocked up on new years supplies right after halloween. helium tanks at the ready to blow up 10,000 balloons on order. >> tomorrow will be crazy. new year's eve, everybody comes in because everybody in san francisco always waits until the last minute. >> reporter: businesses tell me people are willing to spend on new year's eve, because it signals a new beginning. >> it's going to be a fun night, amber, thank you. more details, san francisco hosts the biggest new year's eve fireworks display. at midnight, the fireworks will be launched from barges near the bay, near pier 14. more than 200,000 people are expected to be in the area along the embarcadero. police are reminding people alcohol isn't involved. they're also advising everyone to take public transportation if you can. muni will be offering free rides on all routes from 8:00 p.m. new year's eve, until 5:00 a.m. on new year's day. vta is offering the same free

service and schedule. caltran rides are free after 8:00 p.m., with extended service south to the peninsula after midnight. b.a.r.t. isn't offering special fares, but there will be extended service until 3:00 a.m. on new year's day, although trains won't be stopping at all stations. b.a.r.t. today ended a wi-fi service it offered on a trail basis. the wi-fi service had been provided by a firm called wi-fi rail incorporated. the san francisco chronicle says wi-fi rail might file a lawsuit against b.a.r.t. saying they illegally ended its contract. mobile phone service is not affected by the decision. in san francisco, it turns out a large sinkhole may be related to the subway project. the hole opened up at 40th street in jesse over the weekend. it will now inspect the entire central subway dig to determine if there is a connection, and

to make sure the project is safe and stable. utility crews spent the day independenting gas lines. it could take up to two weeks to complete. opponent's on san francisco's ban on single use bags say they have put that matter before voters in 2016. california is the first state to enact a statewide ban. it's set to effect affect july 1. the plastic bag ban would be put on hold until after the election. supporters say a ban on plastic bags helps the environment. those opposed say the ban will lead to a loss of jobs. christmas has passed, and warriors star steph curry is still in a giving mood. how his participation made a big impression on some of his youngest fans. >> reporter: the kids walked in with a sense of awe. >> he just goes crazy when he's
