key note address in san francisco. he considered running for the presidency but then decided against. he also declined a chance to be on the u.s. supreme court. his death came an hour after his oldest son began his second term also as governor of new york. back in the bay area, wild mushrooms are wapping -- popping up around the bay area. ktvu's john fowler joins us now with a reminder for people and people who have pets. john? >> reporter: that's right. if you look around your yard tonight you may find what amounts to poison for pets. >> reporter: anywhere moist in the bay area is becoming a mushroom garden from lawns to open spaces. for dogs especially. mushrooms can be deadly. >> he is always sniffing at

everything. chewing on stuff. keep him away from the mushrooms. >> reporter: every years dog die from mushroom poisoning. even kinds that are harm lose to humans. veterinarians say they could be brutal to pets. . >> become so weak. liver failure. and kidney failure. >> reporter: symptoms can take up to three days to develop. he says puppies are most at risk. mushrooms can take fishy, at least four varieties killed pets, including cats. treatment must be prompt. >> induce vomiting and give

and tomorrow, the bay area has declared tomorrow as a spare the air day. the cold temperatures and light winds are creating conditions for poor air quality. that means no wood burning unless it is your only source of heat. temperatures are expected to drop again tonight around the bay area. our meteorologist mark tamayo is here now. >> day two of freese warnings and frost advisories -- freeze warnings and frost advisories across the bay area. you can see the numbers showing up, santa rosa, the low of 27 degrees. livermore 32. san francisco 41 degrees. and san jose 30s. every tomorrow off to a cold start. over night frost expected once again. lows in the 20s and 30s. the freeze warning for the north bay and for the inland valleys of the east bay. look at napa, already down to 42 degrees at this 6:00 p.m.

needed to stop the incidents of young african american men dying at the hands of police officers. >> going to have to come up with a way to hold officers accountable for their actions. and to focus on retraining officers before they make decisions to shoot and kill when it is not necessary. >> the theme of the memorial echoed that of recent protests that all lives matter. >> the community must walk forth in asking for that change to occur. and how do we do that? voting, education. >> reporter: oscar grant was killed new year's day by johannes mehserle six years ago today. the shooting was captured on cell phone video and sparked debate about the use of police force, particularly against young african americans. that debate boiled over in the

wake of police killings of two unarmed black men in missouri and new york. >> oscar was like the center point of what we see happening today across the country. because of that each year the vigil gets bigger, which is a sad note. >> reporter: many african american men say what happened to oscar grant and others forced them to be more cautious in dealing with police officers. >> make sure to keep my hands up, always make sure i am not doing anything to give them any reason to stop me and cause harm to me. >> reporter: oscar grant's family will continue to hold the tributes every new year's day to remember what happened to him and -- new year's day to remember what happened to him. rob roth, ktvu channel 2 news. an investigation is underway in san jose following a shooting outside a bar that left two people wounded. it happened at 12:30 a.m.

in the parking lot of the lounge. when officers arrived they found two men suffering from gun shot wounds. they were rushed to the hospital in critical condition. investigators say it appears an argument trickled outside. investigators collected evidence and talked to witnesses. [ indiscernible ] >> doesn't surprise me. >> investigators are hoping surveillance video will offer more clues as to what happened. no arrests have been made. a 23-year-old man is behind bars after he fired a gun at officers this morning when officers responded to a report of shots fired on first lane in san francisco. police say a man identify identified at ivan dejesus gomez opened fire. police arrested him a short

time later. man faces dui and vehicular manslaughter charges after a crash in oakland about 3:30 a.m. this morning on the onramp to eastbound 530. a woman who was in the car was pronounced dead at the scene. the driver was arrested and booked into jail. gas prices continue a fall along with the price of crude oil and experts don't see that changing soon. however ktvu's tom vacar tells us gas prices in california could go up more than 30 cents a gallon. >> reporter: gas prices collapsed in the last few months. according to aaa everyone saved almost 44 bucks last year over the previous year's gas purchases. that is $115 a households and

14 billion more for the rest of the u.s. economy. gas plunged from last year's april high of $3.70 to yesterday's $2.26. perhaps within days the state is likely to impose a pollution tax on oil companies that they will pass on to consumers at 10 cents more a gallon. >> another tax. do we have a choice? really, they will impose it whether we like it or not. >> reporter: and then the federal gas tax, 18 cents on gas and 24 cents on diesel. that money is used to build and repair roads but it hasn't been raised since 1997. inflation ate 40% of its value while road building and maintenance costs sored. just to have the same purchasing power uncle sam would have to impose 8 cents. it would have to be raised more

than that to make up for years of deferred maintenance. >> if it will improve our roads, definitely. so many pot holes out there and lane closures and we can't use the roads to the full extent. >> i was a truck driver for 9 years. you go to all these different places and pay tolls and taxes and they don't do anything about the roads. >> i don't see a reason to raise the taxes. >> reporter: the state carbon tax could come at any moment, any raise in the federal taxes would have to go through congress and that could take a while. tom vacar, ktvu channel 2 news. a 71-year-old man has gone missing on a road trip to southern california. police say he left his home yesterday morning to visit his brother in palm desert near palm springs. he called his brother at 8:30

p.m. last night after reaching palm desert. he said he was lost and then the phone went dead. he hasn't been seen or heard from since despite a land and air search by the sheriff's department. authorities say he is at risk because he is suspected of having dementia. >> reporter: if you haven't got a flu shot you might want to think again. it reached epidemic levels in the united states and killed a dozen children. the report on the rise in cases and what you can do to protect yourself. >> reporter: this year's flu season is a nasty one. the cd "y" reporting -- cd "y" -- centers for disease control and prevention reported widespread cases in 36 states. every state will likely have flu cases within the next few weeks. 15 children died this season

and more deaths are likely. officials say that is why they are treating it as a bigger public health threat than the ebola virus. >> for many people it is a cause of hospitalization and deaths. >> the rise is so dramatic hospitals are having a hard time keeping up with all the patients. >> i have never seen the level we have now. i don't recall having 10 or more at any given time within the flu. >> reporter: one reason it is so bad, this year's vaccine is not as effective. but despite that, experts still recommend everyone six months and older get the flu shot, saying it is not too late. >> even when the vaccine is not a perfect match it still gives protection. >> a lot of people when they come in with the flu they say i

wish i got the flu shot. >> reporter: those most at risk from the flu are children younger than 5 and adults 65 and older. in new york, fox news. a bay area highway patrol officer killed in the line of duty was honored today with a float in the tournament of roses parade. the california transplant donor network's float was the never ending story, a reference to the gift of life. among the portraits made of throughers was one of the 37- year-old officer. he was shot and killed in 2012. he would be proud that he was able to save someone's life. coming up, the new year means new laws. what you need to know to stay on the right side of the law and how it driver's licenses for illegal immigrant are effected. >> you think so?

her heroism to fight along side with her. she was my little wonder girl. >> reporter: in order to fight along side her her mother has been forced to close her bridle shop. this caught the attention of a photographer involved in the bat kid who after battling leukemia helped save san francisco. >> we have to come together and continue the fight. >> reporter: she organized a fundraiser in hopes of raising money and awareness of wild hood leukemia -- childhood leukemia. she lost a friend to wild hood leukemia -- childhood leukemia. >> i know the struggle. she is brave. >> reporter: they are hopeful there will be strength in numbers and others will stand by them in their fight. >> i think so.
