a new push to ease traffic by adding a third lane to the richmond san rafael bridge, and now there's legislation to fast track that change. good evening, everyone, i'm frank somerville. >> and i'll julie haener. aiming to speed up plans to add a third lane of traffic on the san rafael bridge. jana katsuyama is live at the toll plaza in richmond to show us why an extra lane could provide ease during the commute hours. >> reporter: this plan would open up a third lane on the

eastbound side, and add a bike path to the upper deck. in the evening rush hour through san rafael, no one was rushing. cars were backed up in long lines. commuters say they face a daily bottle neck to the richmond/san rafael bridge. >> i used to work there. in the evening, when you're coming back, there is very huge traffic there. it takes about 40 minutes or so. >> reporter: officials say the backup sometimes stretches as far as 7 miles back to mill valley. so the metropolitan commission is considering a plan to condition vert the current 12- foot shoulder on the lower eastbound deck into a third lane of traffic. state assemblyman mark laveen presented a bill tuesday that would allow the ntc to work on the project at the same time it conducts the environmental review. >> my bill speeds up the process by having both of these studies happen parallel. happening at the same time. shaving off as much as 18

months from the planning process. >> reporter: they estimate the project could cost 50 to $60 million, and would be funded from tolls. the plan includes a complete traffic study on the impact increased traffic would have on the richmond side. >> under the proposal, the lane would be open during peak commute times, then closed during other hours. >> reporter: many drivers seem to like the idea. >> i do see it that it gets backed up quite frequently during rush hour. >> reporter: the bridge originally had three lanes. but after the paloma earthquake, the third lanes were converted to shoulders. some commuters say they prefer it to stay that way. >> yeah, that is for the emergency stuff. >> reporter: i asked and the ntc spokesman tells me they would have not have to raise tolls in order to pay for this

project. they do plan to have public hearings. if everything goes smoothly, they say they could have that third lane open in two years. >> jana katsuyama, thanks jana. layoffs are coming to silicon valley. ebay says it's cutting 2400 jobs. amber lee is live at the san jose campus, where employees only learned about the layoffs this afternoon. frank, i approached many employees here on the ebay campus. they tell me they're waiting for answers about their future. as night falls, the ebay sign appears bright. >> a little difficult to process at times. >> reporter: ebay says the job cuts will come in the 1st quarter. it's unclear how many jobs will be lost in the bay area, or exactly who will be laid off. >> they haven't really said

much about it. >> are you guys upset? >> no one has said who's effected yesterday. >> reporter: the ebay ceo said eliminating jobs is never easy, but it's necessary. >> that means ebay is looking into what comes next. >> reporter: a professor of finance at santa clara university. >> ebay had already announced plans to spin off its pay pal division this year. now it plans to do the same for the enterprise unit. >> they're going to be smaller, more focused. they may be more profitable. >> a lot of people i'd say are nervous, terrified. just by what are they going to do in their next career? >> reporter: jamie says she's a technical recruiter. a head hunter, brought in to help employees make their transition to their next job. >> we try to reassure them, and try our best to help them find

something else. >> reporter: many employees tell me they are nervous about what their future holds. >> amber lee in san jose tonight outside the ebay campus. thank you. more details now. investors seem to approve of ebay changes. shares went up 3.5% in after hours trading closing, at $55.24 per share. u.s. justice -- law enforcement officials say fbi investigators found no evidence to support federal civil rights charges against darren wilson. he left the ferguson police force last year. offenses say the fbi interviewed more than 200 people, and analyzed evidence from the august 9 shooting. to pursue charges, the justice department would need to prove officer wilson intended to

violate michael brown's rights. richard perez was heavily intoxicated when he grabbed at wallace's gun last september. the d.a. office in contra costa county concluded that officer jenson acted in self-defense. tonight, san francisco police are investigating why an officer apparently tried to dump a disabled man out of his wheelchair. here is cell phone video of the incident sunday afternoon in visitacion valley. police say the officers were on a regular patrol when they noticed people in a heated argument. as the police were talking to them, you see the man in the wheelchair roll across the street. on the video, you can hear the officer then yelling at the man for rolling over his foot. at this point, no action has been taken in connection with the incident. the possibility of a tuition hike at the university of california is the hot topic at a two day regents meeting in san francisco. the prospect of a tuition hike

has pitted governor brown against uc president janet napolitano. napolitano says the increase is needed. governor brown says instead, uc needs to reduce spending including administrative pay. >> we're using students as pawns in this game. putting a gun to their head. threatening them and their families with the tuition increase. unless sacramento acts, and substantially increases its general fund contribution. >> in an unusual move, the governor asked to form a committee so he could analyze finances before setting state funding levels. the regents are expected to vote on that tomorrow. the husband and family of brittany maynard took their heartbreaking story to the supreme court today. they took her to oregon so they could end her life under the

state's death with dignity law. >> all my dreams came true. >> reporter: it is the story of brittany maynard, and her choice to end her life instead of suffering the agony of terminal brain cancer. it brought the issue of doctor assisted suicide back to the capitol seven years after its defeat. >> please help me carry out my daughter's legacy. >> reporter: it was her mother, debby ziegler who thanked officers and made an emotional appeal for what is called the end of life option bill. >> contact your senators. contact your assembly members. stand up, and make your voice heard. even if it shakes like mine. >> reporter: brittany maynard and her family moved to oregon, where doctor assisted suicide has been legal since 1967. her husband, dan diaz also spoke today. >> she recognized to stay here in california would mean that she potentially would face a

horrific death. >> reporter: on one side are gut wrenching stories. on the other, those that say that assisted suicide is simply a mistake. >> if the bill passes, somele people's lives will be lost without their consent through mistakes and abuse. >> reporter: golden stands with a large wise of oppositions from doctors that will fight this effort yet again. this time, they face well publicized advocates. >> she reached for my hand. and she said momma, given the hand of life that we were dealt, this is as good as it gets momma. and it was. >> reporter: this bill mirrors oregon's law in many ways including requiring two

physicians to diagnose a terminal illness, before a patient can get a life ending subscription. in sacramento, ken pritchett, ktvu, channel 2 news. new at 10:00, people feeling the loss of the progressive bay guardian newspaper can immerse themselves in nostalgia in one last commemorative edition. the paper was shut down last october after 40 years of publication in the city. he and his colleagues wanted to have the last word. >> we produced an issue that not only talks about our history, it talks about the circumstances of our demise. it was totally crowd funded by the guardian community. for work on preserving the bay

new at 10:00, a pot club operator, vowing to fight city hall and stay in business after the city council voted that the dispensary needs to close because it's a nuisance. it is located on san pablo just about a block from university avenue in an area that the city contends is not zoned for medical marijuana. ktvu is at the club one day after the city council voted to shut it down. >> reporter: they just closed their doors about 15 minutes ago, but this is 40 acres. the owner says it's a medical marijuana collective. the city says it doesn't have the proper permits. now the owner is vowing to fight. there are no signs outside, but there is a steady stream of people visiting 40 acres. and in a packed city council meeting tuesday night, deputy city manager, laura mckinney was booed down when detailing

complaints against the pot club. >> excessive trash and littering, and dispensative customers engaging in illegal drug sales and drug use. >> reporter: the city argued that the pot club disturbed the community, and violated the rules about where dispensaries can operate. >> because the property is located in a commercial zoning district it's prohibited. >> >> reporter: owner christopher smith says the club has been operating out of his home since 2009. before the rule was written about where pot clubs could be operated. >> i should still be girlfriended in. >> reporter: some say the club is noisy, and brings a dangerous element to the area. >> i'm going to leave my serious side once again. there are several neighbors in fact i convene many, that did not come tonight in fear of their safety, as well as their

family's. >> reporter: smith says they're getting the blame for a troubled neighborhood. >> to say the word nuisance is really unfounded. it's untrue. >> it's medical marijuana, you guys. all of this scrutiny came because of color. >> reporter: smith is pursuing legal action to keep his doors open. >> we have to keep up the fight. we have to keep up the fight, not even anymore, just because of medical marijuana and the safe access to patients, but almost for our own dignity. >> reporter: in the end, city council voted 7-2 to shut down 40 acres. at this point, no word on a timeline. >> even with the vote, the debate may not be over just yet. new developments tonight in the race for barbara boxer's senate seat. he tweeted this message and picture today.

he wrote thrilled to support attorney general kamala harris for senate. look forward to working together on behalf of the next generation of californians. republicans in the house abruptly dropped an abortion bill, due to objections from gop women and others. they wanted to pass a bill to eliminate virtually all late term abortions and they wanted it done by tomorrow. several women refused to go along, partly because the measure provided exemptions only for victims of rape and incest who had reported that rape to authorities. president obama took his state of the union message on the road today, traveling to a couple of republican states. the president kicked off his trip in idaho. his first visit there since taking off. heather holmes is here now. she tells us, the white house says it is deliberately targeting conservatives. >> take on the new republican controlled congress by going to

some frightening moments in san mateo today, as two pit bulls ran through a neighborhood attacking a man today. when officers arrived, they saw the dogs then attacked a landscaper, and ran toward two women with young children. police distracted the dogs, which triggered an attack on the patrol car. officers responded by hitting the dogs with that car. one died, the other was captured. these are photos of the landscaper's leaf blower, and the patrol car door. police say a woman was also bitten in the leg before officers arrived. the number of sick and dying birds along san francisco bay is rising faster than volunteers can scoop those birds from the water. >> so far, more than 500 birds have been affected by a mysterious gray substance. the state fish and wild life

department still doesn't know what that substance is, but they have now ruled out one possible cause. >> reporter: there are miles of coastline to cover with too few people and too little time to do it. >> he was out on the island. >> today, the live birds found are outnumbered. >> that goo is just pulling their feathers, separating them apart. >> reporter: by the dead ones. >> i'm here for the live ones. >> reporter: the california department of fish and wildlife reports more than 500 birds affected by the mystery contamination. today, the state fish and wildlife lab ruled out polyisobutelane, a synthetic rubber. >> we can rule that out.

a bay area chp officer accused of stealing nude pictures from the phones of women he pulled over. tonight, one woman stopped by sean harrington speaks only to 2 investigates. >> does it make you mad? >> i think more than anything, it makes me afraid. >> that woman's experience is raising new questions tonight about how then officer harrington handled a crash and deadly fire that was just up the road from where the woman was pulled over. ktvu's eric rasmussen first reported on this controversy last october. he's here tonight with with this new information that he's uncovered. >> reporter: frank, the tip came as a bombshell to us.

we knew sean harrington was facing felony charges for stealing photos off of women's phones. then we discovered harrington was one of the officers who chose not to check out a car fire where a man eventually died. the chp said he was busy with a dui stop, and now for the first time, we're hearing from the woman he pulled over. >> we were pretty much alone on the freeway. lights came up behind us. >> reporter: 12:30 a.m., on interstate 60 in alamo. this woman says she didn't know why she was getting pulled over by the chp. >> he was very apologetic that evening. you know, he obviously wanted to know where we were coming from, and where where we were going. >> and if she had been drinking. >> i had three or four glasses of wine with dinner. >> reporter: stopped on the way home, the breathalyzer showed she was just over the legal limit. this woman, who asked not to be identified, says the night took a strange turn when another car pulled up to them along stone

valley road. >> the gentleman had his window down, he was honking, he was yelling. >> reporter: the man in that car, dr. ron wyatt told ktvu he was trying to get the officers to check out a car that had crashed and caught fire just down the road. >> i said sir we've got a car down the road that's on fire. he said we'll get to it when we're done here. >> reporter: records identify one of the officers as sean harrington. at the time, allegations of stealing women's photos had not yet come into light. while harrington called the fire into dispatch, he and his partner did not go to check it out themselves. the doctor's 911 calls turned frantic. >> they're burning to death, man. >> reporter: two investigates found it took seven minutes for anyone to respond to the accident. the driver, 60-year-old michael sevenau died. the woman says they were right here when they got the plea for help running down the road.

running a stopwatch, we found it would have taken about 36 seconds to get here to the scene of the crash and fire. >> reporter: instead, this woman says harrington's questions turned to her cell phone. >> he asked my husband if he could use one of our cell phones to call someone to pick us up. so we decided to call my mom. my mom called back a few minutes later. officer harrington was the one who answered. he had my phone for about an hour, an hour and a half. >> i don't think that's true at all. i think that's categorically false. >> reporter: harrington's lawyer told us his client never looked through this woman's phone, and prosecutors found no evidence he took any of her photos. yet, according to court records, investigators found harrington had stolen nude photos from the phone of another woman also pulled over for dui just two days earlier. text messages reveal, he shared them with at least one other

officer. >> he said no, i made a mistake, it was terrible, i acknowledge it, and he's paid a price for it. >> rain says they won't fight the charges in court. >> i imagine you have a lot of pictures on your phone. >> yes, a few thousand at least. >> did it give you pause that he at least could have looked through those? >> yes. just, you know it's a private thing and like, it's frightening, you know. you've seen the best from the people who serve the public, you know, and i still do. i still place so much trust in police officers and firefighters, and first responders. but when you come across a situation like this, it's just like kind of rattles you a bit. >> reporter: she says harrington's unusual behavior with her continued the next day. >> i heard a knock at the front door, and we weren't expecting anyone. so i go to answer it, and it was officer harrington in his street clothes and his personal

car with my purse. he apologized. he said he found my purse in his patrol car. >> reporter: was it appropriate for officer harrington to go back to this woman's house in street clothes? >> i will tell you this, it probably wasn't the preferred way that police officers are taught to deal with the situation. >> reporter: she says it was the woman's husband who left the purse behind in the patrol car, and he was simply doing a favor in returning it. yet, it was this crash, so close to a fire station, and police officers down the street that continues to haunt her. >> do whatever you need to do, put me in your car, take me with you, please make this a priority, go investigate. >> so in that moment, they have to make a decision, what's going to be the most appropriate resources we can get out there for a car fire. >> reporter: last september, the highway patrol defended their response. a spokesperson said firefighters were already on the way when the officers were contacted. but the chp declined a second interview to talk about officer

harrington's involvement, or whether his behavior would cause the chp to look at the case any differently. rain says officer harrington stands by his decision that night. >> i suspect had they made the decision to jump in their patrol car, and let this woman and her husband to get in their car and drive away, they would have been criticized for that. the problem is, in a situation like that, there's no perfect decision. >> reporter: it revealed he was drunk, but also died from 2nd and 3rd degree burns, meaning the crash itself didn't kill him. it leaves this woman wondering whether he could have been pulled out alive. >> heartbreaking. >> reporter: now the woman we spoke to says there was unexplained data usage on her phone during the time harrington had access to it. harrington's attorney insists the woman's husband was using it that night before it was

we're following some break news at this hour, in oakland, police are investigating three separate shootings with at least five victims. all of the shootings happened just after 9:00 tonight. one was at 105th in san

leandro. the second was at 88th avenue and b street. the third was on 60th avenue. police say none of the wounded are critical, and it's too soon to know if there's any connection between the five shooting victims. an apellet court is set to hear arguments tomorrow that a restaurant served foie gras during the ban on the product. the animal legal defense fund says napa restaurant la toke sold the delicacy before that ban was overturned. animal rights activists object to the force feeding of ducks and geese, which fattens their livers to produce foie gras. folks packed a french bistro in the castro district tonight. the chef says the event is good for customers, and restaurant owners. >> the local business, local

it will feel strange here by the bay area weekend. that will be the developing weather headline. 60s and 70s. mostly sunny skies this weekend. temperatures a good 10 to 15 degrees above average. the winds do pick up in the hills. this is almost a fall like weather pattern, which would boost the fire danger out there. kind of a dynamic weather pattern, especially for saturday. as far as the buoys, you might be attempted to head into the beach for friday with the warmer temperatures. right now, the wave heights are not extreme. but that will be changing, beginning friday. high surf advisory begins friday, with the waves at 15 feet. that high surf will continue right on through the weekend. here is a bigger perspective once again. the fog in the central valley. a big batch of clouds for tomorrow. primarily for the morning hours. skies becoming partly cloudy for the afternoon. high pressure returns, strong high pressure. with that, we're going to warm things up for friday.

i guess just to prove you never know what you're going to get out of the sharks. expectations as low as they've been in about ten years. they beat up the defending stanley cup champs. very physical from the start. they let them know they were going to be in a game, did the sharks against the champs. the sharks light it first. logan couturier winds up with his 17th goal of the year. makes it past john is than quick be, and a 1-0 lead. they need more than that. 1-1 in the 2nd. shot on goal, right place, right time. his 9th of the year. 2-1, and a 4-2 final. they go into the all-star break 25 wins, 17 losses, and 6
