the victims witnessed. >> we are a year away from super bowl here in the bay area. organizers are already underway. we'll tell you about the star- studded super bowl ad that will air during this year's game coming up on "mornings on 2." 7:00. we're live at stanford where students on campus are stunned this morning to learn a member of the swim team has been arrested for rape. ktvu's janine de la vega is there. coming up in minutes, she will tell us how two other students actually caught the suspect for police. good morning. welcome to "mornings on 2." it's wednesday, january 28th. i'm tori campbell. >> i'm dave clark. >> let's talk about your weather and traffic.

>> could -- we could sure use some rain. in san francisco, unless there is a .01 of drizzle, it will be the driest. that's for sure. the question is will they get any measurable precip? right now it's zero. it's been declining. five straight years and falling off the table since 2012. last year was the driest ever. it will be sunny. high clouds, tropical clouds. another low may impact us friday or sauent.

more on that. 60s on the temps. sal, are we still okay? >> we're doing okay at the macarthur maze. you will see that traffic is doing okay. this sa relatively good morning. you will be waiting your usual amount. northbound 280 getting up to highway 17. the traffic is a little bit slow as you drive through. i want to mention that 680 southbound from concord to walnut creek is getting slow.

a former stanford swimmer is facing sexual assault charges. the 19-year-old withdrew from school yesterday and is now banned from the campus. janine de la vega is live at stanford where students tell us there is a sense of shock and also some relief. good morning, janine. >> reporter: good morning, tori. we're here in front of the avery aquatic center. the student accused, he was a member of the swim team just several minutes ago, we did see what appeared to be the men's varsity swimming team in the pool practicing. they came in from another entrance this morning. so far we've run into master swimmers allowed to use the pool for exercise. many of them told us they are both surprised and saddened to hear the news. authorities say the late-night attack happened on january 18th on lomita court near student apartments and fraternity houses. 19-year-old freshman brock turner is accused of raping a woman he met at a party as she lay intoxicated unconscious on the ground.

two students on bikes saw the assault and chased after turner who ran. he was tackled and held until police arrived. he was arrested on five felony counts. >> the fact that he's a star at sleet should not prevent him from facing the same consequences the rest of us would. he should be more responsible for his actions. >> reporter: stanford has come under fire for the hiring of campus sexual assault and student held protests last spring. officials have put sexual assault programs in place for incoming freshman. a university spokeswoman says they are taking the allegations against brock very seriously and are conducting their own investigation. he is out on $150,000 bail. he has withdrawn from the school and is no longer allowed on campus. back to you. >> all right. thank you, janine. 7:04. a woman's recovering this morning after being pulled out

of san francisco bay late last night. firefighters rescued the woman from the waters off pier 39. she had been walking on the sea wall around 11:00 p.m. when she fell into the water. they took her to the hospital but she was not seriously hurt. well, the obama administration is getting criticism from all sides for new proposals on offshore drilling. the. the plan released yesterday would allow drilling in an area of the atlantic ocean from virginia to georgia for the first time. democrats are cal of the atlantic drilling they say an oil spill do devastate shorelines. the president also designated nearly 10 million water ways as offlimits in order to protect wildlife. but the governor of alaska says that will cause economic hardship for alaskans. oil industry analysts warn drivers should prepare for a

bounceback in gas prices. aaa reports the national average was up 1/10 of a dreent to 2.04. but bay area gas prices continue to slip. today's average around most of the bay area is 2.46, down a penny overnight. but gas is 17 cents higher in san francisco which always has some of the highest prices in the country. economists warn we should expect prices to inch up soon as refineries begin to switch over to the most expensive summer blend of gas. >> you knew it was gonna happen. >> 7:06. a year from now, the super bowl will be played right here in the bay area. organizers are already busy. they are making a big fund- raising push to help local charities. alex savidge live in san francisco now to tell us about bay area celebrities alex who were part of the campaign. good morning. >> reporter: dave, good morning to you. lowell organizers have pledged to make -- local organizers have pledged to make super bowl l the most giving big game and

in an effort to raise money, the host committee is planning to air a 60-second spot during this year's super bowl this upcoming weekend. it will feature a long list of local celebrities. >> arnold schwarzenegger, danny glover, rob schneider. >> reporter: here is a preview of that super bowl ad highly produced. it was posted on youtube. the pot is being produced by -- spot is being produced by the super bowl committee. the spot will promote the 50 fund. that's the host committee's philanthropic arm which will be raising money for charities leading up to the big game at levi stadium in santa clara in 2016. en. >> we'll take you an an epic journey, you will never forget.

>> reporter: you can see there, even the preview of this ad is like a hollywood production complete with explosions. organizers are pledging to donate 25% of all. money they raised for the super bowl. so that will meet at least $10 million directed towards local charities. it's expensive to buy a 60- second spot during the super bowl this year. it costs about $9 million, dave, but luckily the host committee will be airing their ad for local charities. they will be airing it for free. this is donated air time they are using here. >> fascinating. >> alex savidge live from san francisco. talk to you later. speaking of super bowl ads, go daddy is pulling its super bowl commercial following backlash from animal rights groups. boy, he's adorable. after running into his owner's arms, going through all of this

rain and weather and all sorts of bad things, he finally learns that she has sold him thanks to a website she created on godaddy.com. animal rights group say the commercial is heartless. last night go daddy decided to pull the ad said it was meant to be fun new but missed the mark. it will still use the ad but it's not clear what will fill the spot. yahoo's! stock is up after marissa mayer announced the company will spin off shares in alibaba. yahoo! still shows 20% of that company and that share is worth $40 billion. the way the spinoff is set up, yahoo! will not owe future taxes which do have cost yahoo! billions of dollars. nancy pelosi has successfully talked president

obama into dropping a controversial plan to tax college savings. the president in last week's state of the union address proposed to end a tax-free college savings account known as 529. while it is an account use by 12 million american families, the president argued it was favoring the wealthy. republicans at first criticized the president. but it wasn't until congresswoman pelosi pressed him for a trip overseas over et weekend that president obama changed his mind. >> then he took it to a whole new level when he said, we're gonna tax those people who have responsibly saved those kids and grandkids can go to college, i want to give free college to everybody. >> critics say this tax amounted a tax hike on those who made less than $250,000 a year. something the president repeatedly had pledged not to do. 7:10.

well, police still looking for the men who orchestrated a gold heist at the wells fargo museum. in 20 minutes, what was not stolen that was even more valuable. >> i apologize to officers everywhere, especially to the two women involved. >> a former chp officer shares no contest of sharerying and -- sharing and copying photos of women he pulled over. we're looking at a commute where traffic is still doing pretty well in many areas. even though it's a typical morning commute and we have normal slowdowns. this is a look at the richmond bridge. westbound traffic is a little slow approach ec-- approaching the toll plaza. looks like a mostly sunny day. can't get any rain. maybe next couple of days, i doubt it. we'll take a look at what looks to be a very ominous record.

there are reports that jordan is ready to trade an imprisoned iraqi woman for a pilot being held by the islamic state terror group. this comes after a video released by isis yesterday showed the japanese hostage holding a photo of what is believed to be the pilot. in the video, goto says he and the jordanian pilot have only 24 thundershowers to live unless jordan releases the iraqi woman who was in prison after a failed suicide attempt. in japan, goto's mother made another emotional plea to the prime minister to save her son saying he has only a little time left. an affiliate of the islamic state terror group is claiming responsibility for the attack on a luxury hotel in libya that killed ten people. two attackers were killed

following a standoff at the seaside hotel which is used by diplomats and businessman. an american working for a security firm is among the dead. a top democrat on the house intelligence panel is introducing a panel to authorize president obama's war against the islamic state group. adam schiff's bill would authorize the use of force against salt lake state forces in iraq and syria for three years. but it would prohibit the use of ground forces in a combat mission. schiff wants to spark debate in congress and lawmakers should not wait to see if the white house will send over its own proposal. 7:15. family members and friends, they are remembering the life of a young san jose woman killed on monday in what police are calling a street race. there's now a memorial for the 24-year-old, dare karen, pablo

-- karen pablo. miss pablo was jogging by when the cars were racing. her family said she was the star of the family. >> she's a really good person. she didn't deserve this. she just went out for a jog like every other day. >> drivers of those cars have been identified as gabriel esparaz and manuel avalos they've been booked on charges of vehicular manslaughter and reckless driving. a former chp officer will not serve jail time for stealing nude photos of the cell phone women he pulled over. yesterday, he pleaded no contest to two felony charges of theft and copying computer data that was part of a plea deal. he was facing as much as six months in jail. but the judge let him walk out of court on probation. with a promise he will go to

violence prevention training. harrington spoke publicly for the first time. >> this has cost me my career and embarrassment. >> when ktvu asked prosecutors ask the judge cut him a break waus he was a former police officer, they insisted he received a tougher sentence for abusing his computer and violating the public trust. mormon church leaders in utah are offering support to gays and lesbians but with some limitations. church leaders held a rare news conference in salt lake. they say they support nondiscrimination laws to protect people being denied jobs and housing because of their sexual orientation but called for the same laws to protect the lives of people because of their beliefs oppose

homosexuality. >> latter-day saints position who objects to performing abortions or artificial insege nation should not be forced to do so, especially when others are ready available to perform the function. >> some in the lgbf community say they welcome the church's move as a symbolic step forward in an effort to find a balance between gay rights and religious freedom but they say they cannot support any policy that would allow the denial of treatment in the name of religion. 7:18. let's get you to where you need to go this morning. you taking care of our friends on highway 24. >> that's right. we're looking a it, dave. and traffic is moving along relatively well. we have a little bit of slowing near the b.a.r.t. station. you will see it slow again as you drive through the tunnel. there are no major problems on interstate 680 as you drive

north and south. i do want to mention the traffic has been slow a little bit northbound on 680 as you drive to concord because of some late running roadwork. southbound 680 is about normal through the area. if you are driving on the bay bridge approach, that's about a 25 to 30 minute delay and i see -- i see cars moving through normally as the metering lights will let you. it's a normal-looking commute. it doesn't mean it won't be slow. on the peninsula, 101, approaching 92, some slow traffic there. now the rest of the peninsula looks okay. south bay, northbound 85, slow from 87 into cupertino. 280 and 101 are getting much slower on the way into sunnyvale and cupertino. 7:19. let's go to steve in the weather center. we do have mostly dlears. there are high clouds -- we do have mostly clear skies. there are high clouds to the east bay. but overall, mostly sunny. even though we're down 15, 20 degrees on some of the slows.

we had the tropical cloud, southeast breeze. that gave us lows in the 60s. mostly sunny, mild to warm. rainfall, we've been talking about this for two and a half, three weeks almost now. it looks almost as -- unless te get drizzle, they being san francisco we're going to finish this 2015 january with steer row pre -- zero precip. last january was the triest ever. 2013, .49. we've had declining for five years below normal. it's been falling off a cliff. we should have 4.50. last time we had that was 2010. let'sing let's look on the -- let's look on the bright side. it can't get worse. 40s for some of the temps. half moon bay, 55. san jose, brentwood says 49.

passenger pittsburg is in there. bodega bay at 57. 58 for monterey. these are not changed that much since june another low is going to form. it will probably follow the same path like the last one. could be some rain. southern california and also up into the sierra for the weekend if you are heading up there. but it's a dry forecast just keep an eye on another low. if it doesn't rain by saturday and i don't think it will, then san francisco will set the record. but you can see the track of that stays in southern california, the desert, down to las vegas. a little bit of rain making it up towards tahoe on the weekend. dry pattern continues, there will be a week system brushing us on monday. it doesn't look like it will make it for any rain and the

hoping to find the rightful owner of rare vintage coins. they first posted this on the department's pinterest page. they appear to be from the early 1900s. police say they found them in a stolen car when they arrested a man for burglary back in november. they say the suspect has ties to san francisco but they are not sure if that's where the coins were stolen. police say if you recognize or know something about the coins, you should give them a call. that big winter storm that left the east coast, knocked out power, left a ton of snow. new england was hit the hardest. three feet of snow in some areas. thousands of homes have no power and that's an even bigger concern as the temperatures keep plunging. a strong surf caused a major sea wall to rupture in eastern massachusetts. that triggered flooding along the coast. >> my wife is a little nervous with this breach down the street.

she's actually left and gone inland to our daughter's house. and -- but i stay. i say the captain goes down with the ship. >> new york city received a lot less snow than predicted. the national weather service is apologizing. one meteorologist tweeted "you made a lot of tough decisions expecting us to get it right and we didn't." while the snow fell in boston, somebody out there was out there wearing a white furry snowman costume. whoever it was roamed the streets through the night, live tweeting about it with a twitter handle @bostonyedy. i2015. the yedi posted pictures including a warning for people to be safe out there in the snow and even tweeted about having a hard time having to hail a cab.

wild pigs ripping up guardens and lawns in san jose. the new controversial law just passed to address the problem. >> reporter: neighbors in san francisco's bayview district say a young mother of three was gunned down in front of her children right in front of her house, one of two deadly shootings last night. we'll have the latest details. good morning. we're still seeing a lot of slow traffic in many areas. let's go out and take a look at the commute on 280. you can see how slow it is getting up to highway 17. we'll tell you more about the south bay commute. mostly clear. a few high clouds. had two pictures back to back. we to have a few high clouds. it looks like a quiet and dry forecast. we'll see what's on the extended.

7:30. we're live in a san francisco neighborhood where three people were shot in two separate shootings just minutes apart. you are looking live at what looks like a small memorial that started with some candles and flowers for one of the victims. ktvu's tara moriarty has just learned this morning that one of those victims that memorial is there for a mother. coming up in minutes, tara will

tell us the heartwrenching details about what the victim's children witnessed just last night. good morning. welcome back to "mornings on 2." i'm tori campbell. >> tough story. >> yes. i'm dave clark. let's talk about weather and traffic. i ducked out side for steve. a little nippy. >> it is cooler. as much as 20 degrees for some compared to yesterday when we had all of the cloud cover. the southeast breeze was roaring. parts of san jose and the peninsula. things have calmed down. cloudy has cleared out. temperatures dropped 15, 20 degrees. high clouds north bay. a few from vallejo, santa rosa, points north and some patchy fog out there. but not a lot yet. it's mainly favoring the valley. yesterday was upper 50s low 60s. it's a lot of 40s and some as. half moon bay is 55. they are one of the warmest by far. livermore 42. i think they were 60 at this time. woodside is the biggie. they were 62 this time yesterday. now low 40s there. menlo park, also palo alto, higherrervations. 49 la honda and los altos hills.

49 foster city. a lot of cloud cover taking aim at southern california. it looks like it will stay down there. another low is going to form giving them cloud cover and rain into the weekend into arizona. if you are heading down there, it looks like rain on saturday. for us, a few high clouds. otherwise, mostly sunny a lot of cloud cover there if anything for us, it would just be high clouds. mostly sunny, morning fog. not much. a little bit. mild afternoon temps even though the lows are cooler. we'll settle in with mid-60s, maybe a few upper. sam has an update on -- sal has an update on the traffic. >> we're looking at a commute here that's right in the middle of it. this the peak of the morning commute. 80 westbound, you can see, 42- minute drive from the kawz -- from the carquinez bridge to the macarthur maze. the traffic continues to be slow. we did have word there could be a problem on 80 westbound and i'm looking for it here. westbound 80 as i drive past ashby but i don't see anything.

we'll if seeing materializes and we'll be watching it closely. let's take a look at the bay bridge toll plaza westbound that's backed up for a little bit. no major problems coming out to the toll plaza area. but it's backed up for a 30- minute delay. no obstructions but a lot of low traffic as you drive through. on the peninsula we talked about 101 being slow near 92. also talked about traffic in the east bay a little bit slow from the san mateo bridge getting across the 101 and 880 slows from 238 all the way down -- southbound 880 slows down to stevenson as you head south. 7:33. back to the desk. >> thank you. one of the victims shot to death in the bayview neighbor was killed in front of her own young children. neighbors say she was an innocent bystander when gunfire broke out near her house. tara moriarty is live at the spot where the first of two shootings happened and you've

talked to some neighbors about the victim. tara? >> reporter: yeah, we understand the victim's name was lourdes. a young mother of three young children. apparently she was gunned down in front of them right in front of her own house. you can see there's candles and flowers here for her. we're hearing new reports that there were two cars in this area last night shooting at each other. now, around 4:15, a shot spotter acttyvation alerted police that 19 spots were fired. ktvu was here when the victim's husband found out his wife had been killed. she died at the hospital. neighbors say many children had just been let out of school and saw the whole thing. >> got caught in the crossfire of other people's stupidity and not knowing what was coming for her, whatsoever. and just really sad. her friends and family were here and for them to have to see that, for her to have to go through that is just horrific.

>> reporter: less than ten minutes later, two more shooting victims turned up near the old clamhouse on bayshore boulevard before 4:30 last night. an suv pulled up in front of the restaurant. the driver a woman who was bleeding had been shot and went inside the restaurant for help. wait staff say she appeared calm and didn't offer any information as to why she was bleeding. she said the man in her car passenger seat was dead and that man died of gunshot wound at the hospital. the woman was in critical condition at last check. police have not provided any description of the two cars involved in the initial shooting. back here live you can see the candles and we understand that this is a bus stop. we've seen a lot of parents come by this morning and express their disbelief about what happened and saying they feel uncomfortable. letting their kids be at the bus stop unsupervised because of how dangerous this area has come. i'm tara moriarty, back to you. >> thank you, tara.

7:35. criminal charges have been dropped against a 14-year-old boy in san francisco who was accused in the stabbing death of another teenager. the public defender says surveillance images show the 14- year-old boy outlined in the blue did not stab ra shawn williams last september outside of a market in the mission district. the teen in red is believed to be the killer. >> it's this person with the long sleeved shifrt, the lighter shirt who makes the stabbing motion. >> now, ras it shawn williams was a standout student and football player. the d.a.'s office have not said if they know the name of the other individual. just because charges were dropped now, it does not mean that the 14-year-old is innocent or that he won't be rearrested on charges of accessory to murder. the masked thieves who smashed the suv through the glass doors of the wells fargo

museum in san francisco and stole gold nuggets, well, they left behind items that were a lot more expensive. the three armed bandits drove a to stolen suv into the museum on montgomery street early yesterday morning. they held a guard at gunpoint and made off with a couple of gold nuggets and gold ore in a display case. they would be worth about $10,000 melted down. >> i thought it was a drunk driver at first until it veered and crashed into the museum. there was glass everywhere. alarms went off. >> the thieves got away in a four-door sedan. several items that were not stolen were a lot more valuable. they included a two-foot high scale. about 15, 20 birds found in san francisco bay covered in the mysterious goo are being

release. yesterday, they prepared the birds to go back into the wild. they are being released at 10:00 this morning in sausalito. the group is still treating about 220 birds and they still don't know the source of the mysterious substance that coated the bidz killing at least 300 of them -- bird s killing at least 300 of them. brian flores is live in a neighborhood where pigs have caused a lot of damage. >> reporter: good morning, tori. the law that was temporary at one point is now permanent because of continued complaints of these wild pigs that continue to roam this neighborhood here along forsome road. the city council voted 7-3 to make it permanent.

the statute allows to shoot those looking for food. because of continued complaints of the wild pigs especially near coyote creek, the council decided to make the statute permanent. about 14 pigs have been caught and killed so far. but residents continue to see them especially at night, especially along forsome road in san jose next to coyote creek. >> it's pretty bad. they come in and tear the lawns up and they come around usually in the evening and come around, you know, a whole bunch. >> reporter: the law does not allow for any resident to get a gun to use on the pigs. the pigs musting caged at first after getting caught and only those with a permit from the state department of fish and wildlife can do it. anyone planning to shoot the pig must notify the san jose police department before doing

so. the wild pigs are not native to california and they do consider them an environmental nuisance. and margey mathews one of the delete who voted against the measures said she was concerned about gunshots being heard in the neighborhoods. you are taking a look now. we're in front of an apartment complex and you can see this temporary fencing along this apartment complex. residents say this was put up months ago to keep the wild pigs out. it's not doing much of a jog because the kids continue to go through. as you go through the road as we were driving in here this morning, you saw a lot of this temporary effecting along the roadway. opponents say that they hope to find a better way than trapping and shooting the pigs. this passed last night. >> i know the pigs can cause a lot of damage. it's happened to some of my friends and neighbors. workers with contra costa health services, they will be out counting the homeless population in the county.

the survey requires -- are required if they want funding. there's a new program called zero 2016. it's part of a national effort to end homeless among veterans and chronic homelessness by the end of the next year. during the last count, two years ago, 3,800 people were identified as homeless in contra costa counties. football fans have been pouring into phoenix over the last few days for super bowl xlix. mike mibach is also there to get a feel for the excitement and how the game to give us a glimpse of next year's super bowl that will be right here in the bay area. >> reporter: the valley of the sun, so calm, so quiet. >> i hate the seahawks. >> reporter: until just about now. >> seahawks. >> reporter: nervous a little bit? >> no. we got it. >> reporter: come on. >> no, i'm not. >> reporter: plenty of confidence swirling in the desert as arizona prepares to host super bowl 49. >> it's 5 degrees in colorado springs. >> reporter: fans of the seahawks and patriots flying in

>> i gotta repotion my phone. >> you are -- reposition my phone. >> you are multitasking. >> the b.a.r.t. dispatcher was in a really good mood. all of the trains are on time. when things aren't going well, sometimes they seem tense. they had 60 trains on the system. i want to mention there there is a crash at the macarthur maze, northbound 880 on the ramp to westbound 80. it's hard to see. we saw the fire engines going through. it's roughly like right around here in this area which is kind of hidden by the actual macarthur maze. it's reported by chp as a motorcyclist down, northbound 880 near the connector ramp to westbound 80 if you are approaching the bay bridge, you want to use a better route, you might want to think about 580 instead. there was an earlier accident in the tunnel. it seemed minor but it slowed things down. earlier when i was looking at this backup, i saw a lot more

district. we'll keep an eye on the hearings. it turns out the operator of that drone that crashed into the white house, well, he had been drinking at the time and he is a defense department employee. he had some drinks and decided to test out his friend's drone. when it crashed, he was worried the drone had entered the white house grounds but decided to go to bed. when it was on the news the next morning, he realized what had happen and called to confess. prosecutors are looking to file charges. michelle obama is facing some criticism for what she wore during a brief visit to saudi arabia yesterday. the first lady wore no headscarf which is usually required for women in that country. now, some say mrs. obama violated protocol. but her predecessor laura bush and hillary clinton did not wear any headscarves and she

let's take a look at what we have now, the traffic is going to be a little bit slow on the 880. we had that earlier crash near tennyson, it was cleared but traffic has been slow from 238 all the way to milpitas dumbarton bridge also not doing so well. san mateo bridge is moderate. but you can see all of the red correspond to stop-and-go traffic. there is a lot of it. 680 southbound. we had issues there. most of the accidents have cloon cleared quickly -- have been cleared rather quickly. let's go to some riv pictures. i want to show you the bay bridge westbound. the best way to approach the bay bridge is 580. northbound 880, they are clearing a motorcycle accident from the 80 junction near the maze. also looking a the commute in san francisco. northbound 101 moderately heavy approaching the split. back to the desk. students at stan fmpd university are telling us there's both shock and some relief on campus. a member of the school's highly-

ranked swim team voluntary left school after he was arrested on charges of sexual assault. janine de la vega is live at the school's swim facility. good morning, janine. >> reporter: good morning. we're here at the avery aquatic center. it appears that the swim team just finished up their practice. we haven't been able to speak to any of them about their former teammate being accused of rape. he's drop the out of school and is not permitted on campus. 19-year-old brock turner has been arrested for rape. officials say the assault took place near student apartments and fraternity houses. authorities say turner raped a woman he met at a party as she lay intoxicated unconscious on the ground. we're told two stanford students bikes saw the assault and chased after turner who ran. he was tackled and held until campus police arrived. the woman is not a stanford student. she was taken to the hospital for evaluation. >> the stanford female student is at risk for these assaults,

pulled over. yesterday, shawn harrington pleaded no contest to two felony charges of theft and copying of computer data as part of a plea deal. he was facing as much as six months in jail but the judge let him walk out of court on probation with the promise he will attend violence prevention training. he spoke publicly for the first time with his wife by his side. >> this has cost me my career, a career that i loved and was good at and a career that mid my family and friends proud of me. my actions have caused embarrassment. >> when ktvu asked prosecutors if the judge cut him a break because he's a former police officer, they insisted he actually received a stiffer sentence for abusing his position of power an also violating public trust. 8:06. family members and friends are remembering a young san jose woman killed in what police are calling a street race on monday. there's now a memorial for her.

welcome back. 8:14. the federal trade commission approved a deal for the equity company that owns the albertson's supermarket chain to buy safeway which is based here in the bay area. $9billion will be paid for safeway which is based in pleasanton. the two supermarket chains agreed to sell 168 stores in eight states. without the sales, the merger would have reduced competition. now it's believed that no stores will be closed here in the bay area and we're also told safeway will keep its name. 8:15. house democratic leader nancy pelosi has successfully talked president obama into dropping a controversial plan to tax college savings. in last week's state of the union adirection the president proposed to end a tax-free college account known as as 529. while it's used by 12 million american families, the president argued it favored the wealthy.

slow. also looking at the commute on the westbound bay bridge, we had a little bit of a problem on northbound 880 at -- at the 80 ramp with motorcycle accident cleared. we also had an earlier accident inside the tunnel. it wasn't may major but it slowed -- it wasn't major but it slowed traffic. things seem to be recovering a little bit. on the nimitz freeway southbound backed from now before 238, a couple of earlier accidents are to blame and westbound 92 at the toll plaza there is a report of an accident there. it looks like a couple of vehicles off to the side. there have been a lot of fender- benders out there slowing traffic and it's very heavy. 8:18. let's go to a beautiful forecast. hello, steve. well, thank you, sal. it is a beautiful forecast for june -- i mean january. we could use some rain. we don't see it. everything is pointing toward the driest january ever. last year was the driest at .06 except for high cloud up there. most of those seem to be up

been killed in the crossfire. she died at the hot. >> i brought some candles to light for her. it was really sad that kids have to be without their mother now through the stupidity of people not shooting. we don't know what the reason was, whatever. it was -- midday. kids are getting out of school. it -- it was a lot. it's a lot. >> reporter: less than ten minutes later, two more shooting victims turned up at the old clamhouse restaurant on bayshore boulevard. one of them a room who had been shot. the woman appeared calm and didn't offer an explain aches as to why she was bleed -- explain aches as to -- explanation as to why she was bleeding. the woman was listed in critical condition at last check. police have not provided a description of the two cars. a lot of folks say they are quite rattled.

the city has made a law permanent. brian flores joins us live to explain why the city decided to make the law permanent. >> reporter: the pigs are still out here. we haven't seen any this morning. bull residents assure us that they are. the law for trapping and shooting that was set to expire. but the city council voted 7-3, as you mentioned to make this law ermt. the statute allahs for licensed trappers to catch and trap wild boars that have torn up business and neighborhood lawns looking for food. because of the amount of complaints of the wild pigs from residents and business owners near coyote creek, the council decided to make the statute permanent. frills says they caught about 14 pigs and killed them so far.

but residents continue to see them, especially at night and along forsome road right next to the creek. >> i can see they do a lot of damage on thoecket house -- on those houses. maybe the city can do something about it. >> i don't see anybody threatening -- before they tried to put the bigger cages you. the pig was smart. didn't go inside. >> reporter: pretty smart pig. the law does not allow for any resident to get a gun to use on the pigs. the pigs must be caged first after getting caught. only people with a permit from the state's department of fish and wildlife can do the shooting. anyone who does the shooting must notify the san jose police department beforehand. the wild pigs are not native to california and do consider them an environmental newsance.
