a contingency plan is being put into place at the tesoro plant and at eight other u.s. refineries. oil workers begin the biggest strike since 1980. good evening everyone i'm heather holmes. >> and i'm ken wayne. a strike is on at oil refineries the first in 39 years and it's affecting a major facility here in the bay area. debora villalon is live outside the tesoro plant where tonight some workers are being sent home. >> reporter: some workers but not all. because shutting down this refinery is not a turnkey process. it takes days.

right now this is the only bay area refinery with a work stoppage but that could easily spread. >> there's rumors that we were going on a strike. >> reporter: the rumors came true as night shift workers were showing up for their night shift and turned around. >> i just got to the gate and they said go home. >> reporter: wishing he knew before he drove to work. now that tesoro is one of nine sites on strike after talks with steel workers and the oil companies broke down. >> the union was willing to continue walking until after

midnight. >> reporter: picket lines were already up in houston and milwaukee. workers say it's about more than money. working conditions, understaffing and fatigue. tesoro's shutdown is very complex. >> they'll take longer to shut down. >> i already pay enough for gas. i don't want to pay more. >> reporter: consumers here strike and figure somehow it's bound to hurt them. >> gas prices. gas prices going up. bad for me. >> reporter: the tesoro refinery will continue to work as a terminal but not producing. right now it's operating after about half power while it undergoes refired safety upgrades. the workers now find themselves in limbo. >> well i want to get in there

and get that money. we come a long way so we want to finish it off and go home. >> reporter: labor history shows these two sides tend to bud heads and go down to the deadline. this time, the protest signs will in fact, become picket signs, that is said to happen this thursday evening once this shutdown is complete. ken, we did reach out to tesoro management they said they will not have any comment on this situation until tomorrow. >> there's more tesoro. there's other big refineries in the bay area. what is going on there? >> reporter: we do have shell and of course chevron. and this strike could be called at both facilities as well. but they have indicated if that happens, they will use replacements and managements to keep the refineries open. and you know that's going to raise some real red flags with safety watchdogs. >> debora villalon, live in

coming up how much prices soared in phoenix. one former new england patriot was not able to watch the super bowl. aaron hernandez is being held in confinement in his murder trial. because hernandez is being housed in a special detention unit he cannot watch television, have a radio or even have a newspaper. investigators are looking for information about a fiery crash that killed three people in san jose. ktvu's noelle walker talks to the chp about possible factors and the help officials need from the public. >> highway 101 in san jose, is one of the busiest freeways in the state. even on a weekend with traffic

moving at weekend speed -- >> it's never quiet. >> not even at this time. >> even at 10:00 in the morning there's a chance alcohol could be a factor, speed could be a factor, falling asleep could be a factor as well. >> reporter: investigators are trying to figure out why a driver crashed on 101 south near story road. >> hit this tree, uprooted this tree. >> reporter: tire marks show the final path. the car hit with such force, it uprooted a tree and killed a family of five. >> did they fall asleep? was it alcohol related? all these things we don't know right now. >> reporter: what the chp does know most crashes are preventable. >> we can certainly, i do our part by watching our speed. not drinking and driving. trying to drive as carefully as

possible. hopefully this does not happen again. >> reporter: the medical examiner still has to identify the victim. the chp says two men and a woman died in the crash. if you're in the area around 2:00 this morning, the chp wants to hear from you. in san jose, noelle walker, ktvu channel 2 news. a fight led to the death of a man. neighbors said they could hear breaking glass. when police arrived they found a 24-year-old with life threatening injuries. when the paramedics arrived they pronounced the man dead. the chp coroner's office is investigating the death. 19-year-old brock turner faces five felony counts.

he's accused of raping and unconscious and intoxicated woman near the campus. three students came upon the attack and stopped him. turner who has voluntarily dropped out of the school is free on $150,000 bail. president obama is scheduled to outline his $4 trillion federal budget plan tomorrow. the white house says the plan includes ideas that are practical not partisan. and will benefit middle class working families. the budget for the 2016 fiscal year calls for a $38 million increase for the pentagon. the newly elected republican congress is expected to resist that plan. and it's being called the ultimate twin's experiment. what nasa hopes to learn by sending identical twins to the international space station while keeping the other right

tonight we learned about how three hikers were rescued after falling 600 feet on mount hood in oregon. a man broke his leg, a woman broke both of her ankles. a rescue team happened to be training near by. when rescuers arrived they were still in danger as they helped the victims, 20 other climbers used a human wall using their backpacks to protect them from falling ice chunks the size of bowling bags. >> that easily could have saved the life of the rescuers. >> reporter: the group also helped a third victim that fell into a volcanic hole. japan mourned today. the reportedly heading of a japanese journalist at the

san francisco. >> the logistics of transferring the patients seems daunting. cristina rendon reports that the transfer went fine. >> reporter: they're only two weeks old. >> for us our historic event was 15 days ago when these two beautiful little girls came into life. >> reporter: the two prenatal girls are in the icu unit. which is why their mother says moving them from one hospital to another was nervewracking. >> we did have trepidation transferring our kids. but it was really done really professionally. >> reporter: after months of planning, hospital staff started moving patients from the campus to mission bay early sunday morning. ambulances departed and arrived about every four minutes making the 4-mile journey like clock work. all transporting precious cargo. >> all of the children were

of their belongings. the fire damaged at least 32 units. we were there today when one person carried out their personal items. people are also reaching out to the dozens of people displaced in a deadly fire in the mission district last week. one person died. several others were hospitalized about 50 people were left without homes including 11 children. a near by bar called dot's clock held a fundraiser for the victim's last night and google promised to match dollar for dollar. unique homes with hot tubs, fire pits and pools all of it creates a unique opportunity to cash in on football's biggest game. and the bay area is next in line to soak up super bowl mania. >> and in a city where almost anything goes, these people decided to protest something that cannot go any more.

showers out toward the north coast out toward humble county. a few showers in that part of the state. as we expand the view to the pacific here. you can see we have a lot of development out toward hawaii. that's the river that typically brings significant rainfall to a part of the west coast. that's going to be the key trying to fine and fine tune where it could be. that could include the bay area. remember december 24th that was the last organized rainfall. tracking two storms this week. first one set to move in thursday. possibly thursday and into friday. now also producing gusty winds as well. heaviest rain as i mentioned will be focused up in the north bay. no rain drops to worry about tomorrow. partly cloudy skies and temperatures will be in the 40s out there. just get ready for the rain. a few days from now. santa rosa 40 degrees for a forecast low. san jose in the mid-40s. here again is that pattern developing without the continuous moisture out toward hawaii. for tomorrow, partly sunny for your monday. it'll be a mild pattern out

there once again. here's what happens later in the week. there's that chance of rain on thursday. especially by thursday night rain and wind. another storm move spwaos -- moves in for the upcoming weekend. over the next seven days significant rainfall developing. we could have amounts approaching 10-inches over the next seven days. the other extreme will be down toward monterey bay around .3 of an inch to an inch. so we're going to be in between this. the north bay could be amounts approaching five, six, 7-inches of rain over the next seven days. these numbers will be changing quite a bit as we approach the event. we'll be watching those numbers that could be going up dramatically. up toward the sonoma county and mendecino. san jose 59. santa cruz 72 degrees. half-moon bay 65. with the warm air in place all
